70,000 New York Permit Holders Are Now Felons for Failing to Register Handguns

On Thursday of this week, more than 70,000 New York pistol permit holders woke up as felons.  Law-breakers.

What was their crime?  They didn’t register their handguns with the state.  Now, why on God’s green earth would they have to do that?

Emperor Gov. Andrew Cuomo rammed through the NY Secure Ammunition and Firearms Enforcement Act in 2013.  This insidious law requires pistol permit holders to register their handguns and recertify their licenses every five years.  Failure to do so is a Class E felony.

The objective was clear.  Build a massive central database of every handgun owner in New York.  Not only who they are and where they live, but what handguns they have in their possession.  Hmmm.  Why would a government want to know which citizens are armed?  I’ll leave you to answer that.

“We’ll have for the first time a statewide handgun database that will allow the state, allow local officials to check periodically,” Cuomo said while pitching the SAFE Act, adding, “You don’t want criminals and people who are mentally ill to have guns.”

Just to be clear, the trooper in the video above says that criminal possession of a firearm is “a misdemeanor,” not a felony.  Well, according to this screenshot from the SAFE Act, it is a Class E Felony.  Goes to show you that even law enforcement is confused about what is what. I also like how he said there’s a “good chance” if you missed the deadline that your permit will be revoked. Contradicts the messaging that you won’t be penalized for late registration.  Right.  You’ll just lose your permit altogether.

Right, because violent criminals and murderous madmen register their firearms.  And to catch these evildoers, all police are going to have to do is consult this handy-dandy database.  Crime fighting at its finest.

For over 370,000 New Yorkers, all of whom were issued a permit before the rollout of the SAFE Act, the deadline to recertify was Jan. 31, 2018.  This past Wednesday.  Estimates suggest that only 300,000 followed through with the mandate.  Meaning, approximately 70,000 or more did not.

To calm the nerves of worried gun owners, state police have said they will not prosecute those who “unknowingly” missed the deadline.

“The state police are not going to penalize those people who fail to recertify unknowingly by the deadline,” said Beau Duffy, Director of Public Information for New York State Police.

“What we’re going to do is continue to accept recertifications past the deadline,” he added. “We want to make sure everyone is aware and has the opportunity to recertify so we can have the best records possible.”

Okay, so the state police aren’t going to punish people for “unknowingly” missing the deadline — at least for now.  But what about the county judges and officers in charge of issuing permits?  Don’t forget, New York is a May-Issue state.  Permits are issued at the discretion of county judges – not state police.  How will these county officials respond to those who missed the deadline?  Will they start pulling permits?

“It’s in the law but I don’t want to speculate how they’re going to move forward on it,” Duffy said. “It would be up to each office to make that decision.”

Let’s unpack that.  Duffy has no idea how your local county official is going to respond.  That judge may revoke your permit.  He may not.  Glad we cleared that up.

To state the obvious.  This is a disaster.  The whole thing.  And I didn’t even say how much it’s costing taxpayers.  You ready for this?  $28 million, according to NPR.  Wow!  Talk about a giant waste of money.

My favorite aspect of this whole SNAFU is this answer on the Q&A page of SafeAct.NY.Gov.  The question reads: Will permit holders’ guns be confiscated if they can’t prove they recertified?

The Answer: 

To be clear, the State Police will not be confiscating weapons from those permit holders who fail to recertify by January 31st. This provision was never intended to be a “Gotcha” for pistol permit holders. It was included in the law that was passed by the legislature and signed by the Governor in order to update the accuracy of both state and local records. To that end, the State Police will continue to accept recertifications throughout 2018 while we continue to update the database.

What a lie!  This whole system is a “gotcha” scheme.  As Cuomo said, it’s for police to “check periodically…” What are they checking for if not to confiscate guns from those who shouldn’t have them?

Watch what happens down the road.  Two or three years from now.  State police will be checking the list regularly for people with expired licenses.  Why?  Because they’re felons under the law.  They are guilty of criminal possession of a firearm.  Consequently, their guns will have to be seized.

    What may not be clear is that an unlicensed handgun is an “illegal weapon” as defined in the NYS Criminal law definition. Look it up. In the same law, possession of five illegal weapons is a class C felony, possession of ten or more is a class B felony. Look it up, this has always been on the books (meaning prior to the UnSafeAct). Those who now have no permit and possess 10 handguns ARE CLASS C FELONS now. Also remember, the Counties have been required to send the permit information to the NYS Permit Bureau for years. The ability to easily update that must have been a nightmare as there is no uniformity between counties though it is a NYS Carry Permit. Now here is the real rub, NYS has started suspending drivers licenses for things like; expired auto inspections, failure to pay state income tax (guilty till YOU prove innocent there) and other CUOMO revenue generation items. What this “re-certification” does is to tie your guns to your NYS Driver’s License (or non-drivers ID). The Counties never required that. I suspect 70,000 people will be without a drivers license real soon if they don;t knuckle under to King Andy. BTW, it’s only 69,999….. I know of one that is no longer in possession and has long since lost the permit. He can’t go down to the clerk’s office and update due to medical condition. At some point I will present the death certificate to the county and clean it up. Hopefully the national cross state right to carry passes.

    Just a another blatant and egregious violation of the rights of law abiding citizens. The state of New York has no legal authority to violate the federally recognized right of the people to keep and bear arms. How many other rights do you have to ask permission to engage in such as freedom of speech or the freedom to travel. This is no more egregious than it would be for them to say you have to get a permit to walk down the street you live on. It’s no more egregious than it would be if they said you have to get a permit to say something out loud.

      The problem people should see is that every county in N.Y. already has a database with all of the pistol license holders pistol information. It would have cost less for the civil servants to transfer the necessary info to the State Police.

      Seems to me that some government shenanigans could come into play pretty easily. I see that I have been getting phone calls lately that I should not be getting. Coincidence? Maybe.

      They must be “permitted” to keep a handgun in their own home.

    There is one scenario not covered in the story: those gun owners who sold or gave away their pistiols and are no longer in possession. I am just waiting for the police to kick down their door and search their premises only to find no violation of the law. Lawsuit, lawsuit. Is the failure not to recertify probable cause in light of the weapon is no longer in their possession? Really big lawsuit. Big, big. Supreme court ruling lawsuit – and this is where the whole law is thrown out as unconstitutional. That’s right kids, failure to register your constitutionally guaranteed right to possess, keep, and bear arms becomes probable cause for an unreasonable search of your person and premises. 2nd and 4th amendment, with claims in other amendments such as 8th when bail is applied to a person who was exercising a constitutionally guaranteed right.

    Funny how my fellow New Yorkers forget that the Republican led Senate voted to let this happen. In fact the Republican that voted for the SAFE Act is now the leader of the NYS Senate. What makes NYS so great is that its like a bunch of states in one. LI, NYC and the largest park east of the Mississippi. I live just north of the city and pay a lot in taxes, but I also enjoy better schools and services. If I call a cop, I get a Accredited officer in less than 5 minutes. I boat and ski and nothing is better than NY. Now as for certification, I sent mine in in early December via certified mail. I called them last week and they did not have it updated. This is clearly not acceptable. Take care guys and I cannot stand Cuomo, but his co conspirators are Republicans. Vote them out too.

    Is being mentally ill a criminal act now? Who is going to make determinations of mental illness? Will due process be involved in that action to see if you are fit to own a weapon? What if you are deemed mentally ill? Will the state then come and confiscate your weapon in lieu of any criminality? Also, you don’t want criminals to have guns. Thanks Gov. Cuomo, we don’t.     This is exactly why Florida is currently having problems. Although most full-time residents have no issues with current gun laws, more and more Snow Birds (northerners, mostly from MA, NJ, NY, MD and IL) are moving to Florida to retire. And as they do, they bring their anti-gun agendas with them and feel threatened by law-abiding Floridians who are permitted to carry concealed weapons and buy as many weapons as they want. They are urging lawmakers in Tallahassee to pass more restrictive gun control measures (magazine capacity restrictions and banning AR-15 rifles) in the guise of preventing crime and from events such as the shootings in Orlando from happening again. They should stay up north and leave us Floridians and our gun laws alone.

    Just so we are all on the same page: You have to have a carry permit to possess or purchase a handgun in New York, whether or not you carry concealed (no open carry). There has been registration for decades as part of the permit process. Some or all of the county clerks (who administer the permit system) already have their records computerized. Therefore, the government already knows who you are and what handguns you own. When the “SAFE” act was enacted, there was registration of so-called assault weapons. My understanding is that the compliance with this was low. However, there was no record of who owned what long guns (except perhaps the 4473 forms at the dealers). So there is not much that can be done about unregistered AR-15s and the like. In the case of handgun permit recertification, there seems to be much to lose and little to gain by resisting.

    As a person who has camped with my family in upstate NY and visited with many NY natives, folks here need to realize that rural NY is just a normal as rural IL or CA, but they are overpowered voting wise by NYC and the other metroplexes where the majority of those with their handout live. Those folks might as well not even show up to cast a ballot. When you review county by county voting, you see a lot of red, as you do when looking at CA and IL. I have found them for the most part to be just as Southern as any Southerner when it comes to patriotism, the Almighty, and the Second Amendment. It may be time to look at large cities like NYC as an entity into itself, treat it like a state, give it one one H of R rep and one Senator, so those other folks have a voice. Don’t they do that with DC?

      I’d guess the folks in the big cities would prefer things as they are so they can ‘control’ more (of all things political). While the founding fathers may not have envisioned the urbanization getting to where it is now; John Adams said “Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.” Some can twist “shall not be infringed” in the second amendment to mean what ever they want when the framers clearly said the constitution was to be taken exactly as written to avoid and misinterpretation. As judges have repeated ignored that, the latitude to misconstrue the constitution has widened to where we are now, and the unfathomably potion(s) people like Cuomo espouse.

      Not sure you are being cynical or serious, but I’ll bite.
      Not required, and state has a preemption law. You do however need to be concerned with transporting or carrying in MD and DC. As a non-resident of either jurisdiction, you will be arrested if stopped and a firearm is found, either through admission, warrant/warrantless search, or the stop gets escalated to a felony stop. FOPA doesn’t seem to help in these jurisdictions even if you are doing everything FOPA says to be protected

    I lived in NYS many years ago and got sick of the taxes and all the hassle and moved to the Southwest. All handguns had to be registered with the local county. A local NY left wing newspaper under the sunshine law got the list of all handgun owners in the county and published the names of the people, their address and a interactive map of where they lived. There was a big outcry but the damage was done. NY is headed down the road to the ultimate seizure of all firearms. What’s funny is that Albany is so corrupt that people have accepted it.

      The people can change it; vote them out. I know easier said than done, but when the state or locality has a majority liberal demographic it’s hard for the minority to have a say. New York is becoming a liberal dystopia, if not already. It just a matter of time before they completely destroy it and they will.         Exactly. I live in upstate NY. Having traveled for a decade working I realized most of the country only thinks there’s a city and the rest of the state is uninhabited or something lol. NY is the exact example everyone should know and use to show why popular vote is HORRIBLE. If the nation ever switches to it America is done. Having traveled a bit I believe a major problem is NY and CA sand possible a few more states live in bubbles. I mean they own the news and the movies and almost all music/art culture. They think the entire country is just like them not realizing they are the actual minority of states. Hell I know how most must feel when the lines of Cuomo tell you how bad of a person you are with no idea (or care to know) what’s it your heart. After all, he did address most of upstate NY when he said “The Republican party candidates are running against the SAFE Act – it was voted for by moderate Republicans who run the Senate! Their problem is not me and the Democrats; their problem is themselves. Who are they? Are they these extreme conservatives who are right-to-life, pro-assault-weapon, anti-gay? Is that who they are? Because if that’s who they are and they’re the extreme conservatives, they have no place in the state of New York, because that’s not who New Yorkers are.”… I love this state but it’s run by idiots. Used to think it was worth fighting for, but realized it was a lost cause. Time to fall back to make a stand elsewhere not behind enemy lines here in freedom Nazi occupied NY. All the idiots who run these states are migrating like locusts and need to be offset with some similar called and thinking to the states they’re invading.

THESE STATES HAVE DONE SHOWED THEIR DISRESPECT FOR THE LAW SO WHY UP HOLD IT NOW. You can not pick and choose. Un Americans first. WE do not reward breaking the law with citizenship and then want to put our citizens in jail for the same thing.

    The 70,000 number is wrong! There are 1.25 million pistol permit holders in NY and right around 30% re-certified so that leaves 850,000 that became felons overnight. Talk about throwing the middle finger at King Cuomo.

    This is exactly what the German government did after WW1 to comply with Allied gun restrictions for its citizens. Later the database was used to by Nazis to disarm their political opponents. It made rounding up Jews easier for extermination after they came to power. Read Stephen P. Holbrook’s “Gun Control in the Third Reich.” Why would anyone want to live in a society where only the criminals and authorities have the guns?

    Check it out – read the law – YUP they can confiscate ALL YOUR FIREARMS!!! they sent out 377,000 + letters , far short of all the permit holders in NY. and they wrote in the NYSP page they dont have to give you a letter, ignorance is no excuse for not registering – letter or not. Another source says NY has 1.2 to 1.5 million permit holders who HAVE TO do it.. I hope all of them sue ( class action suit) NY for taking ALL other firearms not just pistols.

    The State Trooper is funny, he said all the other states require some sort of registration, what, no they don’t, only you pinko commie bastard states require registration of ones firearms. I would not ever register any of my firearms that is just asking for them someday to be confiscated if the wrong people get into office in this country and we already have the wrong people in too many places, NY, NJ, MD, and CA. And I am sure there are others. My current home state is at risk but for now the current gov’t is following the state and federal constitution for the most part.

      Incorrect.
      CA for one (I’m sure there are others) require that all possessed firearms be registered with the CA DOJ if you are a resident of CA. I found that out when I got my CCW and couldn’t add the one pistol I had for over 20 years (bought it while I was in the military) to my CCW list of carried weapons. Since I had served for a period of time in NY, I did have a pistol (CCW) permit for NY with that pistol.
      What’s BS is that weapons are registered with the FED when you initially purchase it. Why does every state need to spend millions of dollars to keep their own records, and why do citizens have to be burdened with registering, registering again, and reregistering the same weapon over and over just because they move to a new state?
      Message to Government – Tax less, regulate less, address the real issues.

        The same reason you have to renew your driver’s license. How does a card being expired not allow you to buy beer? Did your age change? It’s always about taking more money from the lower classes to keep them in their same classes. It’s why public schools teach dead beat parent’s kids to be workers and never business owners. Public schools won’t even teach you how to properly operate in your community; as an example, in a court of law. Slavery never ended it is just called economics.

      There are 3 or 4 states and maybe same number of major metros that require registration, sally enough. Registration is control and control is power over the people. It easier to take law-abiding citizens’s firearms than to disarm criminals. Laws have zero affect on criminals, but far reaching and long-lasting effect on law-abiding citizens.

Such as those of us who love our Second Amendment Rights, we as Americans also have the right not to be adjudged guilty without first being tried and found guilty in a court of law! These so-called 70,000 New York State citizens are not “felons” but are purportedly in violation of a statute which has felony punishment provisions. Your title should have read something like “70,000 NYC Gun Owners Face Felony Charges!”

    I’d like to see our President intensify the efforts to permit universal carry; reciprocity. As for these Democrats, there appears to be a day coming that I believe is tantamount to a “show-down”. People (Patriots) in America are guaranteed the right to possess and carry firearms. No democrat is going to remove that right, at least not without very significant sequelae.

        You obviously lack the understanding of that issue. It is precisely Because there are so many conflicting state carry laws that we need a national right to carry law. For example, I was planning a trip to MT from my state of FL. The route AAA mapped for me as the shortest took me briefly through IL. All the states along that route has reciprocity with FL, except IL. I would have to re-route my trip just to avoid traveling 60 miles across part of IL.

He was draining the oil directly on the ground!! When I confronted him, he said: “Dis is how we do eet in My country.” I told him he better not do that here, and to go back to where he came from.       Robert, that was my 1st thought, but human nature being what it is, I’ll bet that they make examples out of a fwe dozen and most of the rest will fold. Nothing like the threat of losing one’s freedom or home, or whatever, to bring them into compliance. Already part of The Gov’s plan. Maybe a couple convenient shootings, “See, this guy didn’t renew.” I maintain a 3 state buffer between me and any one of those socialist utopias.
