CA Legislature Approves Bill to Disarm Misdemeanor Hate Crime Offenders

The California State Legislature approved a bill this week that would disarm all hate crime offenders for a period of 10 years, including those with misdemeanor convictions.

The Disarm Hate Act, AB 785, cleared both chambers with unanimous support.  It’ll now head to the desk of Gov. Jerry Brown for his signature.

“There are too many examples in our country’s recent history, which show what a firearm can do in the hands of people who practice hate,” said Assemblymember Reginald Byron Jones-Sawyer, Sr., the author of AB 785 in a press release.

“The recent incident in Charlottesville, where heavily armed Neo-Nazis, Klansmen and white supremacists, spewing hatred and inciting violence under the guise of protecting free speech and the right to bear arms, is not what the founding fathers of this great nation were protecting when they drafted our Constitution,” continued Jones-Sawyer, Sr.

This bill mirrors a similar one introduced in New York earlier this year.  We asked Alan Gottlieb, executive vice president of the Second Amendment Foundation, his thoughts on that NY bill and he brought up a good point about its redundancy.

“If a Hate Crime is serious or violent, laws already on the books would prohibit the offender from owning a firearm,” said Alan Gottlieb in an email to GunsAmerica.

“Liberal anti-gun fanatics want to make everything they don’t agree with a hate crime. Some even want to make owning a firearm a hate crime,” Gottlieb added.

Same holds true for AB 785.  It’s creating a slippery-slope for civilian disarmament.

    Hate Crimes can be more than we can look at, Hate the Bank for to much money, hate the corner store for making money, hate my spouse at the time she was killed, hate this guy for robbing me, hate this guy because of skin color, hate the Police, when will hate crimes start or stop. Each case should be a individual case. They should also be relieved of the privilege and responsibility of owning a gun, when will they hate again, tomorrow.

      I am very glad that I did, move out of Calif. when I was 24 in 1981! I must admit that I needed a job, I found one north in Wash.

      I lived out in California during the 1960s and 70s for more than 10 years. It was a great state back then and I had planned to retire there. Fortunately, for me the Navy needed me in Orlando, Florida. Florida is everything California is not. Admittedly, California is beautiful and the weather there is wonderful and varied, but you have the worst traffic in the country, roving street gangs, homeless people defecating in doorways, open drug abuse, and a population all but disarmed by a liberal and tyrannical minority who have no regard for the Bill of Rights or U.S. Constitution.

    Under absolutely NO circumstances should an American citizen lose ANY of their Constitutional rights! I don’t care what “crime” they commit, if they serve their time, they must have their rights reinstated the moment they walk out of prison. If they are deemed so dangerous that they are still a threat, they should remain in prison. We’ve been giving our rights away for decades to these mealy mouthed children who want to hide under mother governments blanket.

    “Hate crime laws” should be abolished as unconstitutional. Not only does it treat some groups as being somehow more “worthy” of legal protection than others, thus denying equal protection under the law, it also creates Orwellian “thoughtcrimes” based on what an individual was thinking or feeling at the time the crime was committed. How long before “hate crime” laws turn into “hate SPEECH” laws and open conservatives up to prosecution just because some pathetic snowflake was offended by something that was said or written? It’s already happening in some places, where people can get in trouble for referring to a transgender by the pronoun of their correct gender, the one they were actually born with. Nobody has any “right” to not be offended, insulted, or have their pwecious widdle feewings hurted (if they did, liberal notions would be banned because many conservatives find them to be offensive), and a straight guy murdering a gay, or a white guy burning a cross on a black guy’s lawn, or a skinhead attacking a Jew, should be simply treated as any other murder or MDOP or assault. Treated HARSHLY, but equally to all other such crimes regardless of who the perpetrator or the victim is.

    The idiot who killed somebody in Charlottesville used a vehicle not a gun. So it’s cars you want to confiscate. Since saying colored person instead of African-American is probably a misdemeanor hate crime in CA, this could also solve their problems with freeway congestion. Kill two birds with one stone…oops I forgot the PETAs would have you thrown in jail for that.

    “Reggie” needs to the truth.the right to have a gun isn’t just lost for 10 years following a conviction, but following just a warrant without any conviction. This makes it too easy for a local prosecutor to disarm the populace with the help of the right judge/magistrate. One day it may be the Klan, but the next time it may be you.
