California governor approves confiscatory gun bill

California Gov. Jerry brown approved a bill Tuesday that would give family members the power to seize the firearms of a relative they deem to be a danger to himself/herself or others.

Under AB1014, known as the “gun violence restraining order” bill, family members would be allowed to petition for a judge’s order instructing law enforcement to confiscate the firearms of the at-risk or allegedly dangerous relative.

Should the order be granted and the firearms confiscated, a hearing must be held within 14 days to give the gun owner a chance to demonstrate that he or she is not a threat.

During the proceedings, the judge will evaluate the person’s mental well-being and suitability to possess firearms, and ultimately decide whether to return the guns or authorize the state to hold onto them.

Under current California law, authorities can confiscate firearms from any prohibited person, e.g. felon, domestic abuser, mental defective (adjudicated), minor, but need to obtain a judge’s order before confiscating firearms from those who have no criminal record or documented mental illness.

In addition to AB1014, Gov. Brown signed another bill that requires law enforcement to develop policies to ensure that officers reference gun-purchaser databases when they are responding to routine welfare checks. Knowing whether the individual has a firearm will help them to decide whether it is in the public interest to obtain a judge’s order to seize the weapon.

The passing of the bills was greeted as victory for gun-control organizations.

“It’s hard to know how much it will be used or how much it will prevent,” said Amanda Wilcox, an member of the Brady Campaign to Prevent Gun Violence. “It only takes avoiding one loss for this to be worth it.”

But for gun-rights groups the bills open the door for abuse, and further infringement on one’s Second Amendment rights.

“Our concern is not so much what they intended to do; our concern is with the method they put in place to address people with mental or emotional issues,” Sam Paredes, executive director of Gun Owners of California, told The Associated Press. “We think this just misses the mark and may create a situation where law-abiding gun owners are put in jeopardy.”

The impetus behind the measures were the Isla Vista spree killings back in May, when a mentally disturbed 22-year-old fatally stabbed or shot six people and wounded 13 others.

    If you live in CA, or NY., It’s as if you don’t even exist anymore!
    Not until your DUES run out anyway. Then you hear from them EVERY day!
    Every shooter I know belonged to the NRA for over 50 years. Not anymore!
    We all just donate more money to our State gun supporters, like the NYSPA, New York state pistol association. At least they TRY to stop this kind of crap!
    Hey, they ARE PAID to do their JOBS, just like the rest of us. Dare we forget the Millions of dollars that Wayne LaPierre was paid as some kind of “deferred payment” a short time ago.
    These people are not like Chuck Heston, doing it out of the goodness of his heart. They are paid VERY well to do it.
    I used to believe what they said. But for each BS law that was passed in NY, there was two less appearances by the NRA!
    California, my advice to You is to start you own pro gun voice that the NRA left behind. Have Them deal with your Politicians, maybe they can get some Action out of them for you. The NRA won’t!

    Funny how lightly those registering false charges are let off after this is found out. This is even worse then perjury being criminally False Charges.

    If after the “hearing” within 14days the proclaimed perp is innocent- then ALL those that made the claim are to be examined by the judge separately and if malice is discovered to harm by false accusation then they shall be criminally charged. At least to be charged with Perjury.

    Any vindictive spouse, relative or neighbor can put an innocent
    person’s life into turmoil and this will happen if not also called into question.
    Severe repercussion should apply within this law to warn those who would ~!

    So much for innocent until proven guilty, and what about the judge making the evaluation of whether the person is stable enough for gun ownership. Does a law degree automatically carry a psychologists license with it now? Creeps, and control freaks, maybe they should be evaluating JB’s mental stability while they are playing doctor.

      This is going to be such a abused law. The police confiscated my guns once because a “friend” told them I was a danger to myself. With no proof, only a phone call, they came inside my house and searched and took my firearms with no proof of me being a danger to anyone or myself! I had to prove I was mentally fit to own and operate MY OWN firearms! I thought they were supposed to prove I was unfit! I was guilty with no proof!
      I was told by a police officer friend that they were actually waiting for me to just give up the whole thing so they could destroy my firearms. That was about 20 years ago.
      I did get them back after almost a year and missing turkey and deer seasons to boot!!

    It take very little intelligence to see the HOLE in this bill and idea. Now every time there is a domestic dispute, a divorce, a business disagreement between partners, one or both of them will call in a complaint about the QUESTIONABLE actions of the other person in the conflict.
    Where do these legislators come from. Why don’t they have enough intelligence to see the UNINTENDED CONSEQUENCES?

    Everyone seems to forget that he killed the first 3 people with a knive. So should they take away the knives also? Butter knifes included? What about baseball bats and golf clubs? Were do you draw the line. A car is a 2 ton deadly weapon and has been used as such in France not long ago. It is the People with the mental Heath problems that are dangerous not the objects they use to harm people.

    Don’t believe the naysayers, those who say this can’t pass, it can. Just check out how I-594 just passed in Washington State. I can no longer safely pass my rifle over a fence to a hunting partner without breaking this ridiculous law. Apparently Bloomberg and Gates money still talks louder than common sense. I think we should start taking cars away from people we think might have an accident or use it for a getaway.

      Why do they call it “common sense”? In today’s America, the notion of “common sense” is an oxymoron (for the liberals out there, that means that there are too many morons using up too much oxygen…). Bloomberg got rich mining the Ponzi Scheme that is Wall St. That gives him all the information he needs to rightfully conclude that any scheme, no matter how fascist and objectionable it may be objectively, can be packaged in such a way as to make it appeal to the low information voters who dominate the electorate. As the stock traders say, “put some lipstick on the pig” and sell it. Californians love their pigs with make-up and nobody should be surprised that “Gov. Moonbeam” is back in office and screwing up as usual.

    Altho’ I was born in California and spent my first 7 years there (and several more, post-college), I no longer recognize the place. It’s a crap hole. Wilshire Blvd in LA was once an upscale neighborhood. Now it’s a gang-ridden barrio all the way up to the Paley Museum and beyond and two blocks outside downtown LA will put you in gangland at the risk of your life, even in broad daylight. Downtown San Fran is a squatters’ camp full of beggars and bums and petty criminals. The Central Valley is indistinguishable from Chiapas and English isn’t even spoken south of La Jolla anymore. Which is fine – if that’s what California’s voters want, well, let ’em have it (but let’s not fund their deficit with Fed’l dollars). My objection is that the morons who created this situation are now fleeing to MY state, Oregon, and… and repeating the exact same mistakes they made in California. If they didn’t like the mess they made of it, why export it? Yet that is precisely what they are doing. Not only are these Californians “low information” voters, they apparently have an absolutely flat learning curve. I really could cure 90% of Oregon’s ills by the simple expedient of blocking the Siskiyou Pass (the major access route from California to the Pac. NW) and turning back every Californian coming north (which is pretty much what former Or. Governor Tom McCall did for 8 years, which is the only reason we’re not completely screwed up already).

    BUT, here’s what I don’t understand. The crime which supposedly justified this enactment saw the perp kill almost as many people with a car and just as many with a knife as with a gun. Why are those not being targeted? I mean, really, if taking knives away from everyone will save just one life, isn’t it worth it? If taking cars away from everyone will save just one life, isn’t it worth it? Seriously. That kind of “just one saved” rationale can be applied to every human activity, so where does it stop? Let’s be consistent and ban it all. Ladders kill lots of people. So do bathrooms and stoves and stairs. More kids under 5 drown in buckets than are killed by guns. Is nobody concerned about bucket misuse? How many “just one” people could we save by outlawing those things? BUT, if you really think that way, at least have the decency to live with the mess you made. Stay out of my state.

    It makes no differance if this is a true or false statement. That this legislation may more likly be ill considered and concived, politically motivated, adgenda directed, while undermining the 2nd A and placed into effect by a subversive and extreme state government which see’s itself as better than and above the United States Constution, its Bill of Rights and the majority of the nation of which it professes to be a part, may be more to the point.

    The IDEA and CONCEPT of this law may have some merit and is of possible value as a part of a more comprehensive system to address the real issues and problems instead of making it just another ineffectual political bandaid that serves no one but the politicians who pushed it into law.
    However, given the current political climate in the US, certenly in Califorina, and the massive division in our nation and culture it only serves to further separate us as a United people.
    The first rules in all things Political . . . . Follow the Money! And Where are the Most Votes?
    These are the driving forces behind half baked and ineffectual laws such as this.
    Change where the Money and the Votes come from and the laws and how there made will change! Go figure. . .

    California has some of the strictest gun control laws. One of the many rules is the registration of guns. All of Rodgers guns were registered according to the police. So it begs the question, why didn’t the police check the registration listing before going in for the welfare check a month before the tragedy? What is the point of registering guns if the police do not make a quick check. Why didn’t the police ask Rodgers if they could enter his apartment? Rodgers’ cool demeanor may have changed enough to arouse their suspicion. We do know Rodgers was concerned about the police visit and discovery of guns/ammo in his bedroom. The police failed the welfare check. The welfare included Rodgers and the public.

    The point I’m trying to make is that laws like the ones in California do not stop gun violence.

    If this law was instituted in Colorado, there damage would have been less….. Despite the PR/Marketing of a certain organization, if you have a mentally disturbed individual at home or in your family it is your “DUTY’ to not allow them to hurt others…basic civilization premise.

    By Amanda’s “logic” they could save many more lives by trying to outlaw automobiles. Wonder what she’d say if her car was made illegal. I doubt it would be polite.

    Her idea that it would save one life makes it worth it, what about the lives of people who defend themselves from robbery or other crimes by having and using a gun? Use of a gun saves far more save lives than criminals using them costs.

    7. He’s crushing our economy & our ability to manufacture.
    8. He’s wasting our cash and shipping it like a pipeline to China.
    9. He’s stopping us from using our natural resources.
    10 He made this next generation the dumbest with the smartest phones.
    11. He gave our enemies our technology and stopped us from producing more.
    No more NASA, give the Russians the space station and land our drones for china to recover.

    Isn’t that enough of what an enemy could only hope to accomplish?

    I’m a disabled combat veteran. I have some insight as to total government control of our guns. Lets just look at history for now
    1 Germany
    2, Russia.
    3. Mexico
    4. China
    5. Cuba
    6. Vietnam
    All dictatorships start with taking away the guns. Obama has tried it numerous times. Remember “when seconds count… the Police are only minutes away”. Now the Police are more like MILITARY than they are like cops.

    Who commits the majority of gun related crimes in the US ? Per capita its Black Americans, and street gangs. I remember when during Katrina a little old lady was staying in her house, well supplied and capable of staying in her house. She even had an old pistol for protection. The police came, they argued she needed to go to the stadium for safety,,,, that was a joke. She had a GUN, they threw her to the ground and took her gun away, and jailed her. WHY ?
    The street gangs were roaming the town stealing and shooting at First Responders…why didn’t they didn’t get arrested ? Why are street gangs free to roam at will, while hard working tax paying Americans are targeted by the government ? Remember when the Liberal Leaders called the Tea Party more dangerous than the terrorists ? That tells you volumes about what is going on “behind the curtain”.
    We are facing the dawn of a new America. Will she remain the most “exceptional country” in history ?       Could not agree with you more. Too many in our United States are naïve or ignorant about what is happening right under their noses. I suspect a great deal of the Black uprising right now is being agitated and stoked up by Terrorist already into our Country or they are some homegrown terrorist trying to tear our Nation apart. No one can tell me theat the Racial divide in our Country has not gotten worse over the past several decades and it was going on before Obama but has escalated during his Presidency. He has proven his own Racism in the Michael Brown garbage: He chose to be a Black male first and a President second. Your are absolutely right on the Countries that take away your guns.     I don’t have one psychiatrist in my family; yet if I lived in the people’s republic of california I could have one of them make a clinical diagnosis on wheather I can own firearms? I’m expected to believe that the fact that I will get a court hearing (In California!) to make me feel better? As is a judge is going to side with me…in that state? What about the cost involved to defend myself? What about having a medical physician making the determination. What about the 5th Amendment?! What about me being innocent until proven guilty and making the courts prove my guilt?! I’m supposed to see this as fair because I get the “opportunity” to prove I’m innocent? It really is like California is another country. I’d rather eat glass than live there. This is going to be abused, as sure as I’m writing this!

        Those are some of the States I am looking into moving to. I am just tired of the Super High Crime Rate in Louisiana. I was born and raised here and only moved back after my Mother died and after I had her funeral here. But, I have found out the hard way that the Crime Rate is out sight because the City I live in is reasonably small but it has the highest CR in the USA (straight out of the mouth of a DEA Agent). I had been looking forward to enjoying some fishing and hunting again here but there is just to much crime. The City Manager’s here just keep refusing to Prosecute and Jail Criminals and turns them loose on the public to commit their crimes again and again and again. No more. Just want to leave here.

          Might I recommend West Virginia. I got my CC Permit 7 days after I took the class. The hunting is great and the people friendly. I moved here in 2008 and have been satisfied the whole time. Winter can be a little cold but we also have some good winter activities.

    It breaks my heart to see families devastated by gun violence perpetrated my obviously mental ill individuals. It’s time we, as a community, have serious discussions about treatment AND confinement of those suffering from mental illness. This kind of senseless violence did not occur as often prior to the “mainstreaming” practice of the1970’s and many types of weapons (including assault weapons) were available prior to that time. At that time many mentally unstable individuals (some violent) were put on the street to do as they wished. At that time I lived near a mental institution that was closed. Some of these folks were terrified at being “out”.

    Since then, the result has been devastating for both the patient and the public. Our prisons are full of bi-polar and schizophrenic individuals. Some of which are basically nice people that did not get the right kind of help with their illness. I would much rather see these folks in a highly secure mental hospital instead of a prison. I think their families would agree. Please don’t forget that even the perps have family members that constantly question if there was something they could have done to prevent these horrific acts. I sometimes think that this was a deliberate conspiracy to increase gun control. If so, there are some politicians that should have never been voted into office.

    One final thing. My father was a U. S. Marine that fought in the Pacific theater in WWII. He is the one that taught me about the correct use of fire arms. While he never discussed the killing of other human beings; having earned 5 bronze stars is proof enough of his doing so.

    He taught me that gun ownership for self defense is a not just a constitutional right it is a God given right. While he owned several guns, while at home (in America) and in peacetime he would be perfectly happy to have never used them on someone who was stupid (or sick) enough to break into his home or threaten his family. He passe away 4 years ago perfectly happy.

    I feel the same way and own a few guns myself and, like my father will be happy to have passed them on to my offspring never having used them on another human being. That being said, I would not hesitate to protect my family if threatened.

      A lot to respond to. Most of what you say I genuinely agree with you. My problem is largely with the People in Management of our City’s and who draws the line where. I had a sister that took something she knew to be wrong and tried to use it against me just to get her Power of Attorney back, which I had to take away from her for my Mother’s sake: I had to do it twice before she got the message. She lied to police, to Sheriff’s Deputies because she had friends in that office; she lied to Dept. of Children and Family Services, to Doctor’s, to Nurses, and to any official she could just to try and get ;me in trouble. She already had put my Parents home in a Reverse Mortgage just because she wanted to insure that my Parents could never let me inherit property. I have never known any other human being as malevolent as my own sister. Both of my sisters just wanted to slap my Mother in a Nursing Home right after my Father died in Jan. 2002. I told them they were not going to do that. They did not want to take care of her; they just wanted her someplace where they could occasionally visit without the burden of being a caregiver. They had been very good Parents and neither one of them deserved this from them. I became the primary caregiver and went through a ton of difficulties because of both of them but I endured. I managed the care of my Mother for 9 1/3 years mostly all by myself; sometimes I had an individual helping me some as a Resprite worker but it was never for very long. There is nothing your mind cannot think of that I did not take care of. Yet, both sisters tried to make the police and everyone else think I was crazy or abusive or whatever. None of it was true. I hope you see where this is going. What do think would have happened to this very good and loving Mother had my sister had such laws as CA is trying to get into Law? She did her best to get me arrested. I was fortunate that at least some neighbors told the investigator’s with the Dept. of Children and Family Services that my sister was not being honest, that I very much gave my Mother excellent care and attention. I am sure some of the doctor’s also said positive things on my behalf. Had she had a law on her side to have me committed, she would have used it: There is a lot of room for abuse of such laws as where CA is headed. These people opening the doors to 2A Rights Abuse are out of their minds. There are already a lot of laws being misused and abused. My Mother died May 6, 2011 and I still miss her.

    Wa gun is a total waste do you have any idea how many ppl will amd do privat pages id feel bad for the guardsman that tried to break the constitution would be handled as that woulx be thse start. of a revolution i wont register my fatherwould vebe behind my back taking up my position to guard the door witha door breach which on impact incinerates the front half of the first two the. The rest of it you empty 17 magnum SST sabot slugs then whoever had my position would sight in and hit. Every vehicle in the gas tank plus count RDS at 30 they’re goonn attempt to move on 30/well thaylt sucks considering I have 42 rd mags I have a 9 and same m&p 40 shield and my rifle with several thousand rounds my friend has ak And a SKS I have radios that span 30 min and many folks would do the same even if they were trained on how to stop them and how to break a aqud up. Also if you know basic chemistry you’d get globes on stands. And shove 2-3 chlorine tabs cork it and slowly poly heat holy shit now you have chlorine/mustard gas sorry but I kiss no ones ass

Nothing even remotely like this is even proposed. Grow up and use legislative support of the NRA and other pro 2nd Amendment organizations to fight your battle to protect your gun rights.

    it’s sad that guy’s kid was killed during that shooting. i can only imagine the pain that father feels. however, he seems like he is pushing for something to be done, simply for the sake of doing something, rather than actually thinking about the repercussions of his agenda. this opens up CA citizens to some serious 2A rights abuse. let’s hope these morons wake up one day.

    Take thier guns they can just go buy an antique firearm made before 1899 no paperwork required. Now they have a gun. They can keep a gun hidden in a safe deposit box in the bank the just go and retrieve it.I rrealize that libetal politicians are among the top 1% of the stupidest people in America but even lame brains like them should know this isn’t going to work.
