Fox News Insider reported that two federal lawmakers were under the microscope of D.C. attorney general Karl A. Racine after posing in a Twitter photo with an AR-15.

The photo of Rep. Ken Buck (R-CO) and Rep. Trey Gowdy (R-SC) caught the eye of the attorney general’s office because of the District’s draconian gun laws, which include a ban on AR-15s and other commonly owned and widely popular semiautomatic rifles.

“The matter has been referred to the Metropolitan Police Department for further investigation,” a spokesman for the attorney general told The Hill.

“It is illegal to possess an AR-15 in the District,” the spokesman added.

Rep. Buck said he is not breaking the law because the firearm is “inoperable” and he had approval from U.S. Capitol Police to display the rifle in a locked case.

“I have a very patriotic AR-15 hanging in my office. It hangs directly above my Second Amendment flag,” Buck told The Hill.

“While safety protocols call for all guns to be treated as if they are loaded, this one isn’t. Further, a close inspection of the only public photo of the rifle will show that the bolt carrier assembly is not in the rifle; it is in fact in Colorado,” he continued. “It is a beautiful, patriotic paper weight.”

Gowdy addressed the matter on “Fox and Friends” recently, also echoing the comments that the Republican lawmakers did not run afoul of the law.

“As I look at that photo, the real crime is the suit that I have on more so than the holding of an inoperable gun after you receive permission from law enforcement,” Gowdy said.

“I can’t dictate what’s gonna become news and what’s not,” he added.

What the heck is wrong with this country that two citizens are now being investigated for holding America’s best selling rifle in our nation’s capital?

Not sure what’s the big deal is here, they stated very clearly the weapon is non functioning and they also received permission to display it, but I guess that doesn’t matter, the headlines will read 2 senators holding a assault rifle with high capacity mag… omg…. some folks have nothing better to do than complain, especially when it comes to firearms, Firearms don’t kill!!! People kill and if they can’t get a gun they’ll use a knife if not a knife then a car, or bomb and the list goes on but damn it let’s get rid of all those evil weapons…

At the risk of sounding uneducated, what is a “Second Amendment flag”?

Does he mean a Gadsden flag?

  • Just1Spark April 27, 2015, 4:14 pm

I hope everyone doesnt miss the point here.

Since the ANTIgunners are against this gun display, the PROgunners reaction is to ‘defend’ the politicians actions. (you know… to spite the antigunners)

Heres the catch. These politicians arent superior to us. They arent immune to the same asinine rules they pile on to me and you average citizen every year. Infact, THEY WORK FOR ME AND YOU.
I dont give a damn if he’s the biggest pro gun guy out there. He’s throwing it in your face. Flaunting the fact that they CAN get away with what ever they want, and the people THEY WORK FOR cant.

You and I would be face down in handcuffs…….. at the very least.

So, if they want to seek favor with me, they will have to follow the letter of the stupid ass laws they create, like everyone else, or start ABOLISHING the laws.

    • Anonymous December 21, 2015, 11:35 am

I completely agree. Both Feinstein and her group as well as these men should be held to the same letter of the law and laws they apply to us. You’re so very correct Sir except for the profanity.

It isn’t fair that they not only can conceal carry themselves on the Capitol, but that they are also afforded at our cost the highest layering of protection of any Governmental Body on Earth. But for us they leave our choices at survive if you can and by the way we will arrest you if you take certain measures to defend your Families (Depending on where you live.)

Our Government is completely broken. I don’t trust a single 1 of them with making a Law.

I wish Texas would just succeed and become it’s own Republic again. At least most of our Politicians are still decent and make the same laws apply to themselves at the State level and have made it so no County or City or Town may pass Laws that supercede that of the State level any longer.

Anyone still living in the whole Tri State Area is a Victim waiting to happen whether to Criminals or Draconian Laws.

Correction to the comment above about the charging handle being missing……if you look close you can clearly see it IS installed in the upper. The trigger lock to me (along with the charging handle being installed) makes me think the BCG is simply being held open by the bolt catch.

Also….isn’t that a “hi cap” PMAG in that lower? I’m all for firearms (I think it is ALL unconstitutional….4473, NFA, GCA ’68, etc…) but they’d throw us in prison for something like this and these politicians wouldn’t care. It isn’t a left vs right issue….it’s an us vs the State (big gubmint) issue.

Now that the US Constitution has gotten a grip on commie Chicago, the D of C has escalated to the most un-American, anti Constitutional “town” in America. The District is run by a lawless, rogue administration begun & maintained by leftist Dems.

Do everyone in the country a favor & promise yourself to never ever vote for anyone with a “D” behind their name. By doing just this one thing, we will eliminate the vast majority of problems were are currently experiencing in the country right now.

    • Winston April 29, 2015, 12:05 am

Just construct the Congress like UKR with soon to be ONE political party- the Nazi fascists. Always above the laws they pass for the lower class citizens.

  • LarryH April 27, 2015, 10:56 am

Yes the BS bATF says an EMPTY lower receiver with ZERO parts, IS a Firearm – so much CRAP. They also say a shotgun MUST be longer that 28″ (rifle 26″ AND 10″) shorter than 18″ barrel shotgun with at least 10″ of stock “doesn’t work well, so has no useable purpose”! The “government” HAS become the ENEMY of YOU and the US Constitution – READ IT! The 1968 Gun Contol Act was from NZI Germany’s 1939 GCA – GEMON-rats had it converted from German into English – STUDY TRE HISTORY – DEMONS ARE EVIL! Now go SEE: http://cassandraeffect.com/the-health-care-chart-that-will-scare-you-to-death/ where: 10 year olds = 1/3 of a human! Zero – 2 years old = non human! 60 = 1/3 human, 80 – 1/20 human! Handicapped and “chronically ill” (2 overnight stays in a year, at a hospital) NO health care, only “palliative care” (DEATH CARE via http://dictionary.reference.com/browse/brompton+mixture ) REMEMBER the demon-rats EXEMPTED THEMSELVES from this!!!! FACT!
Another FACT; demon-rats, INCLUDING JFK could NOT get Security Clearances! Only a Waiver – Why? Drugs, Rape Charges, PSTD, Certified Insane, kicked out of the military, non and anti American activities (visa-via John Kerry). NOW Muslins are in charge of the White House, HS, CIA, FBI, etc. . . . WAKE UP! The “progressive” governance model for hitler, Hilary, obamination, and other DEMON-rats? Woodrow Wilson!!!!

Maybe just a double shot at Starbucks next time, not the quad.

    • Thomas A April 27, 2015, 2:03 pm

You may be drifting off topic here, and just out of curiosity, how are your security clearances coming along LarryH?

    • Winston April 29, 2015, 12:02 am

These two patriotic buffoon “conservative”clowns didn’t read the BATFE law that governs the rest of us. Through them in jail.

  • Kim April 27, 2015, 10:26 am

Throw them in jail just like common citizens ( common criminals ) and we will see some laws changed. The bolt carrier group being missing does not change anything, it is a gun as long as it has a lower receiver. Make the laws ( rediculous as they may be ) be administered to everyone the same way. I am pro 2nd but see their political positions protecting them whereas common folk would already be in jail.

    • dink winkerson April 27, 2015, 12:48 pm

Good catch. The piece that’s missing is in the upper receiver, the part that is not considered the “GUN”.

  • Ziggy April 27, 2015, 9:58 am

Maybe this is selective prosecution/persecution. My question is this: is there anything in the law that says it is OK to have an AR 15 if it is \”inoperable\” or if you have note from your mother or the capitol police?

  • Leslie N Williamson April 27, 2015, 9:17 am

If you look closely at the rifle the charging handle is missing which would lead me to believe that the bolt carrier group is not present and the weapon indeed is non-fireable.

  • Jack April 27, 2015, 8:36 am

I like the paint work. Any chance Rep. Buck can tell us the person that did the paint work?

Glad a few of our reps have a pair, and aint afraid to let them know.

  • Papa213 April 27, 2015, 8:30 am

I guess they are mad because Eric H. didn’t get to send this one with the others in
    the F and F package.

  • AR-PRO April 27, 2015, 7:45 am

At least this Gentleman responded to the allegations unlike David Gregory who ignored questions as to why he ignored police who told him not to bring an illegal hi-cap magazine into DC. Why isn’t Gregory behind bars like any regular citizen would be?

  • Clarence Klekar April 27, 2015, 7:41 am

What a bunch of hypocrites! Sen. DiFi brings an AK into Congress to sell her worn out gun control hysteria, and nary an eyebrow is raised… But if you’re a conservative posing with America’s most popular sporting rifle, then woe be unto you! If you can’t see what’s going on here folks, you’re not paying attention!

  • Chris April 27, 2015, 5:09 am

Can’t interfere with a congress critter while in the process of doing the people’s work, or something or other was what that D congress critter hid behind after slapping the capitol policeman. When he stopped her because she forgot her lapel pin and looked like a psychiatric patient. Or is it only if you are a democrat.

  • Elnonio April 27, 2015, 3:12 am

Are we talking about the same prosecutors that wouldn’t prosecute that reporter with a 30 round magazine (Gregory?)
The same prosecutor that has not prosecuted Democrats for doing the same thing?
Can you say politically motivated prosecution?

    • Boz April 27, 2015, 8:07 am

Exactly! Cherry picking who they want to prosecute and who they will leave alone.

      • Michael April 27, 2015, 9:39 am

And how is that different than any other D.A.?
Cops break the law and attack someone to “teach them a lesson” and to protect the cops, they choose to prosecute the innocent person that was a victim and then became the criminal!

      • ExNuke April 30, 2015, 4:44 pm

Of course, that is the whole function of the Department of “Just Us”.
