Democrats Introduce Bill to Bankrupt Gun Industry, Remove Legal Immunity

The gun-grabbing Democrats in Congress are at it again, this time attempting to repeal a common-sense bill that protects gun manufacturers from frivolous lawsuits.

This week, US Sens. Richard Blumenthal (D-CT), Chris Murphy (D-CT) and Rep. Adam Schiff (D-CA) introduced the “Equal Access to Justice for Victims of Gun Violence Act,” which would effectively repeal the Protection of Lawful Commerce in Arms Act (PLCAA), thus allowing shooting victims to “have their day in court” with gun manufacturers, sellers and interests groups.

“Victims of law-breaking gun makers and dealers deserve a day in court – fair rights and remedies restored by this measure,” said Sen. Blumenthal, in a press release.

“Alone among all industries, guns are protected by a near absolute wall of legal immunity that bars the courthouse doors to victims,” Blumenthal continued. “Our proposal would unlock the courthouse doors – holding gun makers and dealers accountable, and giving them a strong incentive to make safer, smarter products.”

Passed in 2005, the PLCAA simply protects the gun industry from civil liability when criminals or negligent users cause harm to themselves or others with a product. Since its passage, the PLCAA has been a primary target for anti-gunners. This new bill would strip away that protection.

“Making the gun industry immune from lawsuits effectively handed them a license to kill. Congress intentionally let gun makers and sellers off the hook for the murder and mayhem they knew would happen. And they looked the victims’ families in the eye and said ‘Tough luck. There’s nothing you can do about it’,” said Sen. Murphy.

“The gun lobby doesn’t own Congress like it used to – this legislation is essential to ending the firearms industry’s grip on Washington,” added Murphy.

It doesn’t take a genius to figure out what these gun-grabbers are trying to accomplish. They’re trying to bankrupt the industry, as Alan Gottlieb, founder of the Second Amendment Foundation, said in an email to GunsAmerica.

“No one frivolously sues a car manufacturer because a drunk driver kills someone with a car. But anti-gun groups and gun prohibitionists have sued gun manufacturers and dealers because a criminal misused their product,” said Gottlieb. “They do it try to bankrupt the industry

“Maybe we need a law to allow crime victims to sue democrats for passing laws that limit their means of self-defense,” Gottlieb quipped.

Larry Keane, senior vice president, assistant secretary and general counsel to the National Shooting Sports Foundation, was also quick to point out the underlying agenda of this legislation.

“The PLCAA only bars frivolous lawsuits that seek to blame gun manufacturers and dealers for the criminal misuse of lawfully sold, non-defective products,” explained Keane in an email to GunsAmerica. “The PLCAA exists because the Brady Center, greedy trial lawyers and big city mayors got together in the late 1990’s to circumvent Congress and impose gun control regulation through litigation through settlements or bankrupt the industry with massive judgment.”

“They are lying about the PLCAA to advance the anti-Second Amendment agenda,” Keane continued. “They want to repeal the PLCAA so they can launch a new wave of frivolous lawsuits with the same objective. The gun control zealots badly underestimated the resolve of our industry then – and now – to stand and fight for truth and justice.”

While it’s unlikely this new bill will clear a GOP-dominated Congress, it’s important to note that all three Democratic candidates for president have expressed an interest in repealing or modifying the PLCAA, that includes Bernie Sanders, who initially supported the PLCAA.

    When auto makers, airplane manufacturers, motorcycle manufacturers, rake, shovel, baseball bat makers all fall under the same laws and regulations we could watch the entire country go bankrupt. Or how about we hold the representative responsible for introducing a new law or regulation that may cause harm to anyone or anything, financially responsible for the law or regulation.? I apologize for the long rant but this is going toooooo far!!

    Great Idea! Let’s open THAT door across all retail businesses. WE can sue both auto and alcohol manufacturers for drunk driving fatalities AND tickets, ( if I couldn’t get alcohol or a car I wouldn’t have been drunk driving! ) McDonald’s, BK, KFC, Carl’s Jr., Baskin-Robbins and all other unhealthy food outlets for diabetes, heart issues, and obesity, and let’s not forget the tobacco manufacturer’s for any and all, types of cancers and other issues they cause. Let’s continue to blame EVERYONE ELSE for our poor life’s choices instead of taking responsibilities for our own actions. This way we can eliminate the need for the Republican Party, all be Democrats, and let the Gov’t make ALL our choices. Great Plan! Vote Hillary in 2016! (Unless of course, she goes to jail like she should, or you have half a brain or more and some pride, then you can dismiss this plan as Liberal tripe, like I have)

    Thats fine as long as when innocent people can sue when theyre attacked in gun free zones or budwiser for dui injurues and death or chevy when a person with a suspended license drives drunk and kills someone as long as the rules are applied to everyone equally

    Just look at what then Attorney General Blumenthal did to help his former law firm when he committed Connecticut to the lawsuits against Big Tobacco. New article from the CT Post

    One of Blumenthal’s biggest wins involved the 1998, $246 billion national settlement with tobacco companies accused of deceiving the public about the dangers of smoking. It also marked a sharp departure from his office’s traditional role of defending state agencies and offering legal advice to government.
    Blumenthal did not initiate the tobacco lawsuit, but he did join early, arguing the state should be reimbursed for Medicaid expenses related to smoking. Big tobacco, in a stunning admission, settled a few years later, giving the 46 states involved 25 years of reimbursement payments. Connecticut’s share is estimated at about $3.6 billion.
    When faced with the need to hire outside law firms for the complex lawsuit, Blumenthal picked his former law firm, Silver, Golub & Teitell of Stamford, and a second firm, Emmett & Glander of Stamford, which is connected to his former firm by marriage.

    The law firms were paid from a separate fund established by the tobacco companies. Although the amount is secret under settlement terms, it’s believed the Connecticut lawyers shared as much as $60 million.

    And Dick Blumenthal Attorney General has already shown his true colors on suits of tis type. Attorney General he submitted an amicus curiae “friend of the court brief” in Ganim v Smith & Wesson (2001) supporting suits against firearms manufacturers when the City of Bridgeport sued Smith & Wesson to hold them liable for failure to adopt self locking devices on handguns when “firearm injuries and deaths that occur in Bridgeport when children and other unauthorized and unintended users gain access to guns.” That suit alleged “defendants have for years knowingly sold guns in a manner that foreseeably leads to the guns flowing into an illegal market that, in turn, supplies guns to criminals and other unauthorized users.”

    This has nothing to do with Sandy Hook. It has been Dick Blumenthal and Chris Murphy’s agenda all along.

      I am sorry to tell you Connecticut, children are the parents responsibility. Afterall, adults, older children, common pets, forces of nature, and machinary, tools, society and their own emotions over logic can easily overpower a child at any given moment. Unlike the tobacco industry, the gun industry did not put up false advertising telling society guns are safe, instead you have gun companies like Remington establishing the 10 gun safety commandments. Maybe you should read them, and you would have an understanding of what commonsense gun safety is. Please do not use the toy guns industry and video game industry as a model for teaching kids unsafe practices. Again children are the parents responsibility. Male children practice the art of combat long before Jesus time, it is merely a primal instinct served as a counted balance of man’s nature to dominate the other man (slave labor) a shrinking middle class and higher taxes are associated.
      If you are so worried about guns flowing into an illegal market than the BATF needs to be completely overhauled with several members being prosecuted and imprisoned, just when considering Operation Fast and Furious alone.
      What about all of these criminals that are repeatedly allowed to be back is in society, not only to commit more crime but to influence the next generation of tax sucking scum that averages $33,000 per year incarnation. But hey who sues the government for allowing the scum to prey on and influence the innocent for the sake of wasteful government capitalization?? No wonder American’s incarceration rate is 6 times higher per GOP than the second worst country in world which is England. What about the FDA, pharmaceutical drug companies, and the license drug dealers who allow/give phychiatric drugs that are known to cause violent outburst to the mentally ill that have adverse reactions to over time, that are also linked to the mass shootings?? Where is the commonsense? The lobbied government is not going to be held accountable for not intentally destroying American lives/prosperity

    Too many people want to blame someone or some organization rather than take responsibility for their actions. Too many people in our country have a limited vocabulary and very limited ability to think, too many people don’t have or even know what COMMON SENSE IS. Too may people don’t want to be held responsible for their actions in every aspect of their life but they want to blame others for causing them to make the stupid decisions that they themselves made. Like having more babies and demanding more welfare, like buying, selling & getting hooked on drugs/alcohol and demanding the taxpayer pay for their rehab, TOO MANY PEOPLE WITH COLLEGE DEGREES THAT CAN’T THINK FOR THEMSELVES OR MAKE LOGICAL DECISIONS, AND THEY WANT EVERYTHING TO BE POLITICALLY CORRECT, AND THEIR VOCABULARY CONSISTS OF WORDS AND FRASES SUCH AS , GIVE IT TO ME FOR FREE, I’LL SUE YOU, I WANT MORE WELFARE, ENTITLEMTENT, YOU’RE NOT BEING POLITICALLY CORRECT TOWARDS ME.       This is something I keep wondering about. Why would the Jews, of all people, push for an unarmed, unprotected populace? The Jews are, by and large, a very intelligent people. A people who keep themselves heavily armed in Israel because they are surrounded by the enemy. We are surrounded by the enemy, too, yet only fools think removing guns from the hands of honest, law-abiding citizens will solve the problem. Our guns have never harmed a human in any way so why would anyone feel safer if we gave them up? It only makes sense to liberals, I guess. My hope is that the new brain pill they are developing will be used on the left so they will at least then have an average intelligence.

    No one is suggesting putting gun manufacturers of sellers out of business and no one is coming for “our” guns. In order to legally operate a vehicle that could “run Mom over”, you’d have to get a license after showing some sort of competency and responsibility to have that privaledge (vision, laws and consequences, insurance). Instead, with guns, that by design are intended to be dangerous (cars are not marketed by how stealthy of efficiently they can “neutralize threats”) are somehow sold, sometimes in large amounts to the same individuals, with no more than a background check, if even that.
    Tell me why a young business man walks into Sportsman’s Warehouse and immediately orders three Glock 23s in 9 mm? He’s got a party to go to and needs party favors? Maybe he owns a shooting range and needs loaners for visitors and price is no object and doesn’t wants to bother with a less expensive website order? Or, maybe this guy knows he’s going to charge the three felons that need a handgun two times that amount after he scraped the serial numbers off of them.
    Lawful gun owners and enthusiasts have to see that these legal means to an illegal end is the responsibility of the shop owner and could be, if conspicuous enough, the responsibility of the manufacturers.
    Try walking into Chevy tomorrow and ask to buy three new, identical trucks, and see if they don’t ask you what you need those for.

      One question! How out of touch in reality are you? I worked in the Auto Industry for 35 years and not once did I request why someone would purchase six Corvettes. It was none of my or my dealers business why he was buying six Corvettes. The manufacturer would certainly not question why he would purchase six Corvettes. If a felon owns a car and commits a crime through the use of the car which results in a death, the auto contributed in the commission of the crime, thus becoming part of the mechanism through association supplied by the manufacturer. So why not sue the manufacturer? That seems to be the philosophy of your reasoning. You do know that the bill the senators are trying to introduce is just the tip of the iceberg leading to future additional gun controls, essentially making the 2nd Amendment a virtually impotent amendment. It is people like you that probably have access to bodyguards or other security. However, God forbid that you require Police assistance and have to wait while being assaulted and possibly beaten to death with a baseball bat, shot with a gun, or stabbed with a knife and thinking, if I only had a gun to protect myself, I might not be in this situation. Take the guns out of the hands of the criminals. Less than 1% of gun deaths occur outside of the criminal element. Gun deaths have gone down per capita for the last 30 years or so. So in essence, guns are now safer in the hands of responsible gun owners than in the past history of the United States.

      Please read the second amendment everyone. The purpose of that amendment was to protect our citizen rights to own
      firearms to protect US FROM TYRANNICAL GOVERNMENTS. We waste BILLIONS of dollars on anti-gun legislation every year and we should be trying to put that money back into education. They have realized that we have reached a point that our poor communities are so un-educated that you can tell them anything and they believe it and guess who shows up at the polls? This guy is saying the manufacturers need to make smarter and safer products because people are to stupid to use them the right way. This is the beginning of the give us control so we can protect you from yourself government that the second amendment is there to protect us from. We need safer cars and we need to be able to sue the auto industry when someone dies from a car accident that wasn’t their fault. (Mom got run over crossing the street so I’m going to sue Chevy because I want my day in court)

    So does this mean that if this law passes soon after other Industries will also fall victim to the same types of laws? Like, If I get drunk and crash I can sue the car maker, the place or person I bought it from, the company that made the booze I drank to get drunk, the bar restaurant or store I bought it at and the town and state that the road was in that I crashed on? because the way I see it, if I get drunk and get to sue all those people, Ill go get loaded right now and jump in the truck and crash it into a bridge.. heck even if I lose my drivers License i’ll be loaded and can afford to hire a limo and driver! lol

Also, I am so sorry that My States Super Liberal, Constitution and Freedom hating sissy democrat senators, Chris “Mommas Boy” Murphy and Richard “Dick” (AKA “Needs-to-come-out-of-the-closet”) Blumenthal. Also Chris Murphy is also one of those D-bags who thinks now is the time to raise the gas tax to repair the roads… now that oil prices are down and they blew the money they had for the roads on other crap… Probably giving it away or using it for Male escorts! If it weren’t for these people we wouldn’t be facing as much of this BS as we are now. All in the name of Political career advancement! I still say I want to fight either one of these two or Both at the same time, On Pay Per View and donate the proceeds to fight for our freedoms! lol Hey they may kick my butt but Ill do it for the cause…lol

      As a fellow resident of CT, I can’t agree more. Newtown is my hometown even… it used to be rural and nice. I used to shoot in my backyard as a kid. Now, my state and hometown are an embarrassment of soccer moms who have no grasp of reality and think that slippers and yoga pants are clothing. But I digress, Newtown for those who are unaware is also the home of the NSSF, proof that people here weren’t always retarded. Many major firearms manufacturers came form here, several are still here. Do they get any respect for the freedom this country enjoys? No… these fruitcups, pandering for their own advancement, don’t care about anyone but themselves. I hate what my state and my hometown have become, but I like my job… so unfortunately I can’t really leave. But you can be damn sure I’ll be at every CCDL rally I can be, and will continue to annoy the scum bag politicians trying to destroy our rights and screw honest manufacturers. Also, I would like to say there are a few politicians here in CT that fight a good fight to protect the remaining rights we do have, everywhere from a local to state level.

    Wow a bunch of garbage. Any “law-breaking gun manufacturers or dealers” are already subjected to a number of laws, and to the best of my knowledge and belief, if someone has broken the law, he/she is NOT granted immunity under any existing law, UNLESS he/she brokered a deal with whoever was prosecuting the case under an “Alford Plea”, in which the accused doesn’t admit guilt or pleads non-guilt BUT ADMITS there is enough evidence to convict him/her of the offense(s) he/she is accused of committing. And the victims CERTAINLY can object to an Alford Plea and the JUDGE can also deny it. This is just an attempt to open up the flood gates to everyone who wants to destroy the gun industry in the USA. Can you imagine pedestrians or innocent victims of car accidents suing the automotive industry every time there is an accident or fatality with an automobile? and someone suing the manufacturers, dealers, etc. of LIQUOR whenever someone drives drunk and injures or kills someone? Or suing an aircraft manufacturer every time there is an accident or near accident on an airplane, regardless of whether there were any fatalities or not? These people are just simply FASCISTS who failing to find support among the People of the United States are looking to SHYSTERS to help them destroy the gun industry- without even realizing if they do that WHO the HELL will provide the military, law enforcement, etc. with firearms? And if they do survive, can you imagine the cost per firearm due to the cornucopia of lawsuits? Taxpayers would be BLED DRY in taxes just to furnish police, sheriffs departments and the military with firearms.

    As a resident of the state of Connecticut I feel ashamed to have the worst senators representing me and I apologize to my 2A brothers around the country. When the Sandyhook tragedy happened, these suck ups rushed over there to immerse themselves with grieving families who just had their 7 year old children killed at school. After experiencing that profound grief, how can they be trusted to make rational decisions regarding firearm ownership by taxpaying, law-abiding citizens? I could at least respect them more if these assholes lead by example and disarmed their security details – but they’re not men enough.

    The GOP should just amend the bill to make the provisions apply to all companies and all products produced. Car manufacturers and car dealers should be sued when someone gets killed in a car accident or by a drunk driver. Ditto for all motorcycle companies. Companies that manufacture knives and axes should be sued if someone gets killed with one of their products. Same for baseball bats (it would surprise you how many people get killed by baseball bats!)

    See how many Democrats would support the legislation if it applied to all companies.

    There is also the underlying fact that most congressmen and senators are lawyers by trade. I’m betting heavily that firms they are affiliated with are the ones filing these suits (if made possible after repealing plcaa) and these “public servants” will end up with a fair portion of the money.

    I’ve said this before, I’ll say it again, and I’ll KEEP saying it. If you repeal PLCAA, that means victims of drunk driving accidents get to sue auto manufacturers and distillers. Sorry, folks, but if some moron broke into your house and killed your husband, you do NOT get to sue Ruger or Smith and Wesson or Glock or whoever. If you can’t sue the police, you DAMN sure don’t get to sue the manufacturer of a firearm for no other reason than that firearm was used in the commission of a crime. Rant over…..for now…

      It’s NOT going to stop crime. They don’t care about that. Their intention is to disarm the populace. It’s much easier to take total control over a populace when they have no armament in which to use to fight back. Read about Hitler, Stalin, Mao & every other dictator that existed since the invent of firearms. The first thing they did was take away all the civilian guns.
