Federal Lawmakers Introduce ‘Common Sense’ Magazine Ban

2nd Amendment – R2KBA Authors S.H. Blannelberry This Week

Ugh. Here we go again, another “common sense” and “reasonable” gun bill from lawmakers who know absolutely nothing about firearms.

Below, in his own words, Sen. Bob Menendez (D-NJ) lays out what’s known as “The Large Capacity Ammunition Feeding Device Act,” a bill he introduced in the Senate and Rep. Elizabeth Esty (D-5th District) introduced in the House on Thursday.

“It prohibits high-capacity magazines,” explained Menendez. “It wouldn’t take them from people who already have them but moving forward large capacity clips will be in the hands of our military and law enforcement where they belong, not on our streets or our schools and not in the hands of those who don’t need them and shouldn’t have them.”

“If you need 10, 20, 30 or 100 shots as a hunter, maybe you shouldn’t be a hunter,” said Menendez.

Toward the end of his address, Menendez said that he will continued to fight for tougher gun laws, “So that we never again have to see the suffering of another parent describing what happened to their loved one at the hands of a madman.”

Menendez speech is exactly what we’ve come to expect from anti-gunners in that it is replete with erroneous nomenclature, large capacity “clips” (I highly doubt he knows the difference between a magazine and a clip), the misguided notion that the government can decide what tools citizens need to protect themselves, the ass-backward presupposition that the Second Amendment was created to protect hunters, and the utterly insane premise that if we just ban certain guns and gun-related accessories homicidal maniacs will (a) start following law and (b) suddenly stop taking innocent lives.

I don’t really have to say much in response to Menendez or his ill-conceived bill that seeks to place a federal ban on magazines holding more than 10 rounds. Through his profound ignorance and poor grip on reality he’s pretty much said enough.

Though, I will say the Large Capacity Ammunition Feeding Device Act will ultimately die in Congress. The reason? It lacks the very thing the creators of it claim it has: common sense.

    How can DC law enforcement state that high capacity magazines were use in all those murders? How many murders were solved? Very few i bet. So how do they know what type of magazine was used?

    I live in Michigan where in a nearby location ( Dearborn, Mi) we have 500K+ Muslims. We also have a Muslim “training camp” where even the local police won’t go and inspect. The point is if these people decide to stage an uprising there are nowhere near enough law enforcement in this state to contain them, nor deal with the social chaos that would follow such an uprising. The only REAL protection that Michigan citizens have is their own firearms, and other defensive weapons. Senator Menendez, like all the other progressive elitists, seems to want the Second Amendment to say that “ordinary citizens” are only entitled to own weapons for hunting. The Second Amendment was codified by our founding fathers as a hedge against our government turning on its’ own people. Our founding fathers went through a period of severe tyranny, and a serious restriction of personal rights. Therefore, in order to prevent that eventuality from happening to future generations they allowed their citizens to carry weapons with which to defend themselves from ALL enenies foreign, and DOMESTIC. If our so called congressional representatives don’t understand that then maybe they should be removed from office until they can pass an American history test? An English comprehension test might be in order also.

    Anyone who is anti-gun needs to be forced to read the reports that Harvard and the CDC put out regarding gun control. The CDC report was commissioned by Obama.

    The gist of the report is that any country around the world that has disarmed it’s citizens has a much higher rate of violent crime. In fact, most unarmed countries have more crime overall. The slight of hand the anti-gunners use is to say un-armed countries have less gun crime. While that is true, that lack of gun crime is replaced two and three times over with other violent crimes. This pattern repeats all over the world. At the time of the report, Russia had a total handgun ban. They had approximately 77 murders for every 100,000 people. In the US, the most armed country in the world, we had 7 murders for every 100,000 people. They also documented european countries that had various levels of legal gun ownership. As legal gun ownership increased, crime decreased.

    At the end of the day, we have the 2nd Amendment which guarantees our right to firearm ownership. This right isn’t about hunting. If anyone cares to read anything the founding fathers wrote, they would see that America is based on personal freedom and responsibility. This country is great because of the people, not because of the government. The Bill of Rights specifically lists the rights that are given to us by God. They are not granted to us by a government. Therefore, owning a firearm is the only sure way to guarantee the rest of our God given rights are not infringed upon.

    Imagine how disappointed Menendez’ mother must be to have given birth to such a failure.
    I have an idea. Let’s make it illegal for anyone but uniformed police and the military to possess firearms.
    That includes under cover cops and especially private security. That would mean all the rich people would not have hired armed people protecting them at all times. Menendez would have to give up his concealed gun.
    How would the rich feel to know they are out in public with no protection? Oh, that’s right, when this law is passed, there will be no guns so they are completely safe! Let’s take the guns from the rich FIRST. Outlaw private security! Outlaw politicians from carrying concealed. Make that the first provision!

    How about a better idea, rather than punish the responsible people who possess the high capacity magazines, why not impose huge, mandatory, earth shattering terms of non-negotiated periods of mandatory prison time, for each and every individual who use a magazine with a capacity of, lets say 10 rounds, and mandate it that the charge or mandatory time merely for possessing a hi capacity mag during any crimes goes for say 10 years, no parole. The problem is the same liberal law makers were liberal criminal defense lawyers prior to going to Congress, and they bargained there clients to a lesser sentence, which takes all the teeth out of mandatory laws, or they are afraid that a certain portion of the community will be subject to these laws, because they are the ones disproportionately committing the crimes, so the ever so great Congressman doesn’t want to loose their vote. Lets put the blame where it belongs, on the criminal.

      Remember it’s not the mag’s fault it was used in a crime, it’s the criminals fault regardless if he used a six shot revolver or a five shot mag fed rifle / pistol , or a thirty to one hundred round mag or belt fed weapon

    I hope Mr. Blannelberry, author of this article will forward a copy to Senator Menendez. It probably won’t do any good but maybe the Senator at least will think about how foolish he sounds. All he is trying to do anyway is stay in the news, keep his name on top so as to get reelected. New Jersey is full of liberal Dems.

    haha I think it is funny that it is all common sense and reasonable. 1st it seems like it but in reality it is not, if u take “scary looking guns” (AR-15 ect.) out of my hands that leaves to kinds of people who have them, gangs and police, that my American friends smells like a set up for Tierney an all out assault on the constitution just like they have wanted since Nixon. 2nd even if they could prevent me from one large mags they will NEVER stop them criminals. common sense to me sounds like stop turning Americans into pussys and let us put guns in schools and any other place that is in danger of being shot up.     We will not continue to stop nor go away in defending our 2nd amendment rights against those who would infringe upon our rights .My defensive weapons (they are not assault weapons,I do not assault people) and the mags that go in them are not for hunting they are to protect my family and community against threats .I am so tired of you freedom hating politicians doing your best to destroy our Constitution and our very way of life .

    I’ve never been an AR fan, and don’t own any large cap weapons, but have no problem with others having them. One of the interesting things that I have noticed lately from watching many outdoor reality programs about Alaska, is how many of the locals have ARs with high cap mags. They use them for hunting, and for protection against large game like Bears and Moose (Moose kill more hunters than almost any other large game animal). I bet if you ask them, they would cherish their high cap mags for when they need them. If a Grizzly or Moose came out of the bush by surprise, I’d want as many rounds available as I could have. Maybe we should put Menendez in Alaska facing one of these animals with only 10 rounds. I bet he would change his mind real quick.

If the anti-gunners would put the time, energy and money into keeping firearms out of the hands of the mentally defectives that commit these atrocities it would be more effective then trampling on my constitutional rights. As for the criminals, you can pass as many laws as you want and they will still ignore them.

    The Second Amendment was never about hunting. It was instead about the right of the People to Keep and Bear Arms without said right being infringed by any government entity. By definition, the Federal Government has No Legal Right to Infringe upon the rights of the People to be armed, in any way ! Thus ALL Federal Gun Control Laws, or such attempts, are Unconstitutional, at base.

    First off, the Bill of Rights didn’t actually ‘grant’ us any rights, but instead it codified certain pre-existing, naturally occurring rights into the basis of all of our laws; the US Constitution, in order that said, naturally occurring, rights would never be taken from us.

    Secondly, the Militia Act of 1903 created the ‘Unorganized Militia’, to be comprised of all male Americans of military age and veterans up to age 60 (considered to be old age at the time). Said militia members are required to provide their own military comparable arms and munitions, in the case of being called up, by either their State’s Governor, or their County Sheriff. This Act is still in force, to this day.

    In the words of one of our Founding generation, Tench Coxe; “The power of the sword, say the minority…, is in the hands of Congress. My friends and countrymen, it is not so, for The powers of the sword are in the hands of the yeomanry of America from sixteen to sixty. The militia of these free commonwealths, entitled and accustomed to their arms, when compared with any possible army, must be tremendous and irresistible. Who are the militia? Are they not ourselves? Is it feared, then, that we shall turn our arms each man against his own bosom. Congress has no power to disarm the militia. Their swords and every terrible implement of the soldier are the birthright of Americans. The unlimited power of the sword is not in the hands of either the federal or state governments but where, I trust in God, it will always remain, in the hands of the people. The Pennsylvania Gazette, Feb. 20, 1788.

    He cites Sandyhook where because a magazine was changed 11 students managed to escape…what he FAILED to mention was that the only thing that stops a bad guy with a gun, is a good guy with a gun. And that if teachers with a CC license were allowed to bring them to school perhaps all of the killings could have been prevented, something his bill will NOT do.
    As for him saying NO ONE needs a AR15 with a large magazine, remember years ago we had stuff like the LA Riots, mobs of people looting & killing…more recently Katrina, again mobs looting & killing.
    Then go back in our own history and see Ludlow Massacre, Lattimer Massacre, Haymarket massacre, Battle of the Viaduct, Battle of Athens, and on & on.
    They even made a movie about the Battle of Athens, (WWII vets that broke into a National Guard armory just after WWII to stop corruption in their elections.)
    This guy says ONLY our cops & military need these, even as news is reporting all the police abuse in the country. And remember the police DO have assault rifles, but we’re expected to face the same criminals WITHOUT THEM, until they show up.
    Just because HE sees no need for these weapons, does NOT mean people don’t need them, we have needed them in the past, and I have no doubt that we’ll need them in the future.
    Plus he looks old enough to remember when the National Guard was called out against college kids during the Vietnam protests. Kids were shot & bayoneted, but he wants us to TRUST the Government!?!?

    Comrade, when are Socialist idiots like you going to understand that since the Socialist Democratic leaning people killed off the Mental Health system that use to exist before your cost saving measures (so you could put more into Social Welfare programs) were put into place. The NRA has proposed a common sense approach of education and gun safety but apparently you cannot read or comprehend common sense ideas when it comes to gun safety or responsibility (unless it comes from the central committee. Instead Comrade why not institute a national computer check that includes those too mentally ill to handle and/or possess a firearm as determined by a court or corporate counsel preventing these sick people from possessing a firearm. Also institute a court/corporate counsel that can re-establish their right of ownership once treated and certified by health care professionals as being responsible enough to possess them again. Those firearms taken should be safely stored and/or turned over to a responsible family member. Make reasonable and safe laws that where the real citizen is truly protected. Stop trying to turn us into another Soviet Union, one Putin in the world is more than enough!!!!

    So, this is how it happens. No different to the baby steps of a new child….crawling first, followed by baby steps next, and lastly running to the finish line. The only problem with this analogy is that in this example we’re dealing with calculated politicians and not young children….innocent and open to learning new things. Yet again we see another elevated member of the general public harboring the conceit that they and those they congregate with know more and better than the regular law abiding citizen when the decision to equip yourself with lethal means of self-defense is being considered; and you don’t even have to read the fine print yet at this moment. The problem with this latest government proposition is that the speaker of these restricting measures and those they truly represent (fellow law makers) haven’t yet come out of the first stage of development and continue to crawl their way through life instead of growing a strong and reliable back-bone on which to stand solemnly. Governing everyone with restrictive government measures fitting only to be used on less than 1% of the American population is not evidence of “serving the people’s interests” but rather widening and growing government’s liberties to control and punish the whole of society for the devious and murderous actions of few. There is no “common” sense in legislation or the actions to follow with any governmental control(s) that will seek the weakening of constitutional liberties and enhancement of governmental powers of retribution against any and all citizens on account of supposed loss of safety and security. If these elevated members of the general public won’t acknowledge the true source of deprived acts of public violence and instead seek to legislate restrictions to free peoples then the time is right for the voting public to reclaim the seat of power and show them the door. It may sound like they (government law makers) are arguing about small things at the moment but be assured that all big things had their beginnings in small packages.

And make no mistake , two rounds will be considered “high Capacity” in the eyes of the anti- gun nuts. So now one good thing is sales will be up. Bad news is price gouging will happen then. And NO they won’t let you transfer them I’d imagine . Just like the full auto ban of 1986 (?) where any class 3 manufactured after that date was for the government who controls your “rights”. And the price of older class 3 has gone thru the roof. Until those wear out , and you have no ,ore in the civilian. market. Eventually there will be no more.And that is exactly what they want. And no, Indont hunt. I’ve got no problem with those who do resposably. But this ain’t about hunting. Why do I “need” a high capacity magazine they ask ? How else would you suggest I feed my legal Class 3 firearm ??

      Buy a M1 Carbine. All the necessary parts to make it into a M2 full automatic weapon are legal to purchase. Just be shure not to assemble the parts and they will remain as collectors items as long as they are only for display. This is the only weapon with wich this is legally possible, as the wepon was, not long after it’s introduction conveerted with the adition of a selector and a fiew other parts to make the M1 into the automatic M2. The Carbines that were converted were marked on the reciever as a M2 conversion. So any conversion you make is not legal and cac’t be licenced with the ATF. You can also buy 5 15 20 and 30 round Mags. For the M1 Carbine. This is not written to tell you to make a M2, but if the baloon everj goes up and anarchy rules this just might save you and your family. God Bless America! Stay safe and LEGAL!

    The Constitution never mentioned sporting purpose, that was shoved on us in the 1968 Gun Control Act.
    Buy lots of extra mags folks, they are cheaper now than a long time. stock up on good quality, there will be a day that you are greatful that you did.

    citizenship test, a THROUGH test on the Constitution and its amendments, and a provide character witnesses to their ethics.

    The only Common Sense firearm, magazine, ammunition etc… law that makes Common Sense is: Quit trying to make any laws restricting law abiding citizens! If the powers that be, government, has possession of something that can be used to induce and enforce tyranny, then I as a citizen, if I can afford it, have the right to own that same something to prevent tyranny!

    Does this goon understand that a mental patient with a gun can carry more than one magazine for his AR15? And that changing a magazine can be done so quickly that no hero could reach and stop them in time? So no matter what the capacity of the magazine, multiple magazines make this a null point. This piece of puke is waving the bloody shirt and using victims of crime for his own advancement and self glorification. And pocketing Bloomberg dollars into the bargain. I am sure his constituents would like to see where the money went. And who he’s really working for.
    I wouldn’t care, except his brand of stupidity means my SKS only has a 5 round magazine, which is annoying and pointless. Thank God I don’t live in his electorate – those who do should vote him out.

    Dear Tyrant Menendez,
    The Bill of Rights and Second Amendment protections from government infringement of inalienable rights are not about the protection of arms for the purposes of hunting! The founders of the U.S., having defeated the tyranny of their oppressors, had something much more important than hunting in mind when they put their ink to paper.

As long as we have Mexican cartels throwing hand grenades into the local Sheriff’s office and the Mexican military violating our borders and bringing in illegal aliens and drugs, the American public will not allow for his warped version of “common sense”: That went out the window a long, long time ago.

      Since US police kill about 1,000 civilians per year, killing innocent unarmed old men, women, and BABIES, often at the wrong address, why exactly do the steroid-crazed SWAT maniacs “need” firepower to serve simple warrants? Disarm THEM!

      OK, let’s presume that I am a law-abiding home owner who experiences a break in by an armed criminal who never leaves live witnesses. I’m not worried because I have a firearm that I am well trained on. I’m pretty sure that I can protect my family from such danger.

      A confrontation takes place but the home invader is not deterred by the sight of my handgun and starts wildly shooting at me. I return fire but the adrenalin coursing through my body makes accurate shooting a joke. Hey, I have a ten shot capacity magazine, right?

      As luck would have it I see one of my bullets tear into his non-gun arm. This only seems to infuriate the criminal who keeps coming at me. My luck runs out when my magazine runs out of bullets. The bad guy has an illegal handgun with a 15 round capacity magazine. Yeah I know, who would have thought that the bad guy wouldn’t obey the new magazine capacity regulation?

      The last thing I see is the furious criminal pointing his pistol at my head and laughing. I have just enough time to recall Senator Bob Menendez (D-NJ), saying that as a hunter, I shouldn’t need a 20 round capacity magazine.
