Female Bail Agent Fatally Shoots Client in Front of Her Son: ‘Mom You Just Shot Him’!

An Oklahoma woman was acquitted of first-degree murder Friday in the fatal shooting of her client.

Bail agent Chasity Dawn Carey shot and killed 38-year-old Brandon James Williams while attempting to take him into custody last August.  The incident was caught on camera.  See video below.  Viewer discretion is advised.

Carey, 42, claimed she did so in self-defense. “I was afraid he was going to shoot my son,” Carey told the Payne County jury, according to The Oklahoman. “I felt like we were going to be killed. … I’ve never been that scared before.”

“Mom, you just shot him,” says her 19-year-old son right after the shot was fired according to the video.  “I did,” she says.

Carey initially told the police that there was a struggle for the gun she used in the shooting.  Upon viewing the video, investigators arrested her because it doesn’t appear as if there was a fight for the firearm.

However, in court, Carey’s defense attorney said that the tape doesn’t tell the whole story.

“What’s not on the video is your reasonable doubt,” said attorney Jarrod Stevenson.

“The video only showed half of the shooting,” Stevenson told reporters after the verdict. “It didn’t show what Mr. Williams was doing and I think that’s what the jury really focused on.”

Prosecutors tried to focus on the fact that Carey shot Williams, an accused burglar, in the back.

“It’s never OK to shoot someone in the back. … Where’s the danger? Where was it?” First said Assistant District Attorney Kevin Etherington during the trial.

    What are the laws of OK with bail bondsmen(women)? Was this person technically jumping bail, therefore would be classified as ‘Wanted’ and subject to being shot by a bounty hunter that was sent after him? I think the OK jury just decided, one less scum bag on the street is reason enough.

    She appears to have pulled the gun to prevent letting her bail run out the door.

    They were on the third floor of an office building, so where was the deceased guy going? Three floors up is between 30 feet and 50 feet up in the air!

    What does the Business and Professions Code for the State of Oklahoma say in this situation? Is there a section or subchapter regarding when it is appropriate to shoot a client in the back? She is after all working in her chosen profession – right?

    The woman bail bonds person should lose her business license and be tried for manslaughter.

    I would hope that local law enforcement or the State DOJ take a second look at this case and the manner in which the deceased man was shot.

    Even in the southern US today in 2018, is it now acceptable to shoot someone in the back? It is not like he was chocking her and she was struggling and in fear for her life or for the life of her son. If the woman’s profession is a bail bondsperson, then she should have a whole lot of experience with individuals who really don’t want to be arrested or return to jail.

    The deceased man was out of frame of the camera so we actually have no idea what he was doing. The fact that the woman’s son was so surprised that his mom actually shot someone in the back is a rather powerful testimony as well as the son returning to stop the camera from gathering any more evidence of what occurred. Could turning the camera off be seen as tampering with evidence at the scene of a crime?

    The woman who shot the deceased man in the back is working in her chosen profession and she is aware of the risks in dealing with some kinds of personalities. Perhaps she should have had a police presence present when the man kept his appointment or else other employees present of large stature to take command of any situation.

    At the bare minimum the FBI should investigate this shooting.

    There is always the civil court option for the family of the deceased.

      I could see no reason why she shot this man. She should have had a police officer there to make the arrest. She should be charged with murder. I forgot she was part of the pack that defender that defends her. No one is above the law but is this case is appears she was. Why did the boy cover the screen, I suspect to cover up any evidence. This should be turned over to the FBI.

    This is a classic case for a taser..If she gets this rattled in situations like this, then perhaps she needs a different job..The client was obviously uncooperative, but a taser would have controlled him enough to handcuff him..How any jury could find this self defense is definitely a statement about how bad the judicial is..WOW..

    There was no way that guy was a threat! He could have cleaned her clock at the door and walked out. He was looking for a non-confrontational way out or he would have gone through her, not walked around her multiple times then exiting through the window. Even when she grappled at him he said to take her hands off him rather than belting or otherwise manhandling her. The jury were beguiled or stupid. Though you can’t see him in the frame, how could any one be a threat with their back to you trying to crawl out the window. Terrible miscarriage of justice. She should have gone to jail. Her son will have problems about this incident for a long time. Maybe a lifetime.

I have seen personally other bail bondsmen harass , humiliate and blatantly threaten people because they claimed they could do anything they wanted to regardless of legal law.     That is sickening to watch. Every and any generic citizens would have been found guilty and caged for life.
    Law enforcement should be held to a much higher standards then citizens (like a traffic ticket means jail time for a officer). There can be no trust if there is no accountability for law enforcement.

            Bail bondsmen are not law enforcement in Oklahoma. They are not certified by CLEET and have no law enforcement powers other than being able to arrest a bonded client for remittance to the local law enforcement. Anyone can become a bail bondsman who can pass the testing, pay the fees, and isn’t a prohibited person.

    There were several items that I noticed that weren’t even mentioned or discussed by anyone here who has “contributed” their “expertise” as a legal expert. I will mention these items as they occurred in the video with no judgement one way or another, simply stating fact.
    1. While talking to the woman’s son, the alleged “bad guy” removes his shoe, peels his left sock half off of his foot and begins absently picking at something on his left heel and scratching around his left toes?? Is this a nervous reaction or did he need the help of a podiatrist? Who would knowingly walk into a bonding office and proceed to remove articles of dress and pick at irritations on his foot? Very strange actions ….
    2. Directly after the alleged “bad guy” mutters “oh sh*t” , after the bonds person closed and locked the entry door, her son stands up and reaches in his right back jeans pocket for a set of handcuffs. Was this preplanned that he would be the one to cuff the guy if she deemed that she should “talk to him with cuffs on”?? (I never heard any mention of her “arresting” the guy or wanting to “arrest” him) Was he working for his mother that day and getting paid for assistance in questioning an alleged “bad guy”?
    3. The 1st time he says “Don’t touch me!”, you couldn’t see the bonds person’s full body to tell if she had laid a hand physically on his person. But the 2nd time he repeated the warning, you could see that she did not touch him at all. What do you make of that particular outburst??
    4. As the alleged “bad guy” moves away from the woman and around her desk (and off camera), he appears to throw a sheet of newsprint or some paper covering back toward her. I did not hear the sound of a window opening off camera but later on, as she was talking to the 911 operator, she distinctly tells her son “Don’t close that window!” and he replies with some incoherent reply. Was the “bad guy” attempting to gain exit through a window?? Was there a fire escape at that specific window which could be accessed for a means of escape??
    5. Finally, the bonds woman draws her semi-automatic weapon from the drawer and appears to flick the safety into the “fire” position and takes her shot. Then she does something very strange, even for someone who isn’t fully familiar with the operation of a semi-automatic handgun such as she owned ….. she racks a round into the chamber! Anyone who has the slightest basic knowledge of the operation of a semi-automatic handgun can tell you that, the only time you need to rack a round into the chamber is if you know beforehand that the chamber is empty as is the case with many who do not normally carry or store their handguns with “one in the pipe”. But, in this case, there HAD to be a round already in the chamber because she did NOT initially rack one into the chamber, she simply took the gun off safety and fired a round at the alleged “bad guy”.

    These were things I saw in that video which caused some questions to form in my mind about the occurrance of events and what was seen and what was NOT seen in the security video …….

      Oklahoma doesn’t have any “reasonable” force clause in our Self Defense Act. It does say that if you feel your life is in danger (like she claimed) that you may “defensive force that is intended or likely to cause death or great bodily harm to another..”

          There’s a bit more to the statute than that, like part of the statute mentions violence, or threats of violence, usually towards the shooter or another person, in which the defendant is in a location that they’d normally have a legal right to be in – home, car, place of work, etc.
          You can’t just walk up to a scary looking person and ventilate them – the statute won’t protect you from that.

    Based on what I saw in the Video, the Lady Murdered him by Shooting him in the Back… The shows that the man was NOT armed, whether a Knife or Gun, and he was walking away from her so he would not be cuffed. So being embarrassed in front of her Son, she grabs her gun from the desk and shoots him. Her son goes into some form of shock and can’t believe his mom shot the guy! This murder(imho) should never had happened as the man shot was a petty thief and was not aggressive at all even when she announced he was to be handcuffed and simply walked way asking why? The loss of Life here should not have happened and this is just another example WHY WOMEN can NOT do a Man’s JOB! I wonder if the DA can still go after her for Manslaughter or even Negligent Manslaughter? I feel bad for all involved but especially so for the mans family.

If you don’t have any intent on using it they why draw it or even have one in the first place?     What was he doing with his left foot? Was there something (weapon of any kind) in there or was he just fidgety? His behavior did seem really “off” to me. Like other viewers, I don’t get the full story from this video either but I definitely got the feeling he was up to no good. Now, justified use of deadly force? I didn’t see that either. This is pretty disturbing and not the best example of a gun used in self defense. Granted this was a big dude, and she’s a little woman, sitting in my armchair playing Monday morning QB, I’m not quite sold on this as a justifiable shooting. But, without being there, I can’t say. I do agree with the comments about the boy’s reaction. He was more freaked out at the fact his mom just shot the man, vs thankful that he was dead and the threat had be neutralized. I also agree that this will get dissected in civil court and likely will have a different ruling.

        From what I observed, her trigger finger was not even visible before the shot. It looks like she kept the pistol in a racked position while it was in her desk drawer. What she was attempting to do by racking it afterwords would have only dumped a live cartridge on the floor, unless she might have encountered a stovepipe. Just guessing.

        I agree we saw only what she did, we did not see him on the tape at the time of the shooting, but can you honestly say that if you are on a jury and she is accused of murder and this is the only evidence presented that you would NOT find her guilty? We don’t have all the facts, but this is what I saw: (1) a woman walk to a desk while chasing a man; (2) she calmly took possession of her gun; (3) she took a shooter’s stance and pointed the gun and with no warning and no provocation that I could see – she pulled the trigger; (4) I then saw the only witness in the room other than the defendant make an excited utterance that indicates to me the shooting was unjustified. I could care less what he was doing to his foot, I don’t care what he was charged with (she is a bondsman according to the information we are given here – that means he was accused of a crime, released on bond, and she or her company held half of the bond contract. FYI – if she surrenders him she gets her money back). I saw a tape where a woman shot a man in cold blood because he would not obey her or make her getting her money back easy. If this is the ONLY evidence, I would give her the death penalty.

    The jury was forced to make a decision between murder or nothing, and that responsibility lays on the state of Oklahoma. To convict Carey of murder would have required proving she had a “deliberate intent” to kill Williams. Payne County District Attorney Laura Thomas made a decision to file Murder 1st degree in this case based upon the evidence presented to her…in this case the judge instructed on only the same charge the State filed in the beginning. The judge could have given the jury the option of convicting Carey on a manslaughter charge instead. In fact, the jurors indicated in post-deliberation comments that they would have convicted in manslaughter in the first degree, but the state did not give them that option. After the evidence has been presented at a trial, the judge can instruct the jury on additional crimes if he or she believes the evidence supports consideration of another charge; in this case the judge instructed on only the same charge the State filed in the beginning.

        Every crime, including homocide requires intent. Now if by “intent” Trevor is referring to premeditation – then he is partly right. The level of intent is the defining difference between Murder and Manslaughter. Murder is intentional killing whereas Manslaughter is causing death through reckless disregard or neglect. Feel free to look it up on Black”s Law Dictionary. These two terms are so settled in law that while individual states may decide what is reckless disregard or neglect as opposed to intentional both meet the mens rhea requirement of the crime of homocide.

        Trevor – ever hear the term “mens rhea” – a/k/a “the guilty mind”. It is the legal standard for intent. You do not have to intend to kill person A when you point a gun at person B. You may not even intend to kill person B – your desire is to strike fear in person B. You sneeze and the gun has a hair trigger so it goes off and kills person A. Did you “intend” to kill person A? Not in the most direct and traditional use of the word. Are you guilty of murder (manslaughter) – absolutely – you intended to brandish the gun which is capable of causing death and you had carless disregard for the safety of person A and your carelessness and the intent to use the gun are sufficient to convict under the law. The test in the law is not “premeditation” that is why we have “premeditated murder” in the vocabulary and in many states (I believe OK is one of them) a conviction of “premeditated murder” means automatic life without the possibility of parole is the minimum sentence, the only option is death or prison until the convicted dies and neither the Judge nor the Jury can pick any other punishment. Another example would be “heated passion” – man comes home and finds his wife in bed with another man, inflamed with anger husband kills both lovers. Did he “intend” to kill them? YES – this is murder. Was it “premeditated”? No.

    Bail bondsmen do have more authority to arrest those who bond they hold as stipulated by the supreme court many years ago. They and bounty hunters even have given extradition rights that local law enforcement does not posses without court and hearings. In the video all I can see is a extreme over reaction to a situation. I was not there and can not comment on if there were any extenuating circumstances, like previous trouble with this man but what would’ve been wrong with pointing the gun at the man and telling him he is under arrest and let the son cuff him. Shooting the guy might not have been necessary! Many unanswered questions and lack of information to this video and trail for sure!

    from the report i saw, the woman was tried with 1st degree murder. ofcourse thats going to get thrown. if she was slapped with 2nd degree then she would be in jail. regardless, the claim was that there was a fight over the gun, the video says otherwise. people have been put in jail for less.
    the man appears to be leaving when she shot him. what happened off camera is up to debate, but i have yet to see any reports that said he went to his car to get a gun which would have justified the shooting. so to me, because she was a bondsmen, its the state protecting one of their own. sure he was a criminal, doesnt mean he was violent or even a bad person, just someone who makes bad decisions. but when a botched conviction for 1st degree, then yeah bad call on the justice department cus this was more like 2nd degree.

      Agree with Kramer. How can we expect law enforcement to get better at keeping guns from truly dangerous (e.g. mentally incompetent) when they can’t even keep them away from their own unqualified officers. This woman belongs in jail for murder, period.

    Only from what I can see I would hate to defend this woman in court. If she felt she was in the right, what’s with trying cover up the camera%? I would suspect altering the evidence. Damn lucky to get off on this case. Might get a civil suit though.

    Well you guys who say good riddance to a criminal are FUCKING IDIOTS!!!! You don’t know what his crimes are or if he was working on turning things around. People do deserve chances. He obviously showed up voluntarily and was talking with her until she was going to take him into custody. Obviously he should have complied and figured things out later but she was in no harm, he was trying to get away. He came in, sat down, shook her sons hand & was smiling. then when things changed he put his shoe back on grabbed his belongings and tried to flee out the back. Her son didn’t look alarmed or scared, until she shot him. She didn’t look alarmed or scared and wasn’t fending him off, she was looking for her pistol and shot him in the back. To all you armchair commandos that think there’s one less criminal on the street, you better hope that your never in a situation with a woman like this who is playing cop with her 19 year old son, and doesn’t shoot you because there will likely be no sympathy. You people are pathetic and ignorant of real life, the laws and what the consequences of ones actions should be.

    It doesn’t appear he was threatening great bodily harm to anyone, especially since he was shot in the back. I do not agree with the jury on this one, but I have no sympathy for the dead criminal either.

    She needed better backup than that son of hers, who did nothing to help detain the suspect. While it doesn’t look “justifiable,” he certainly didn’t cooperate with the arrest, and I can’t say I’m broken up about getting another POS off the streets.

    This was a cold blooded murder, there was no threat. Bail bonds people are bottom feeders who profit off our injustice system. Even her own son couldn’t believe what was done.

      She had time to with obvious anger but not much haste, open up her drawer and pull the gun and stand there for a second and aim and shoot. She shouldn’t have got off. The prosecution was incompetent. Given what she did, the kid is probably traumatized and will likely get killed by some other worthless bondsman after committing some comparatively minor crime.

        YOU are only seeing PART of what happened. We CANNOT see the off camera struggle with him. He was TRYING TO RUN, ESCAPE, and the intent on his part was NOT to co-operate with a sworn officer to the court (as Bail Bondsmen must be in virtually EVERY state, by the terms of their license…)
        SO, WHY sympathize with a PROVEN THUG. This guy WAS NOT AN INNOCENT…he had a STRING of offensives. NOT A PRINCE.
