Dead Home Invader’s Family to Female Victim: ‘What’s wrong with her, she did not have to shoot him’

The family members of slain 17-year-old Trevon Johnson are outraged — outraged that a 54-year-old woman shot the teen while he was burglarizing her Miami home last Thursday night.

“I don’t care if she have her gun license or any of that. That is way beyond the law… way beyond,” said Johnson’s cousin Nautika Harris in an interview with CBS Miami. “He was not supposed to die like this. He had a future ahead of him. Trevon had goals… he was a funny guy, very big on education, loved learning.”

According to police, the homeowner saw Johnson breaking into her home on surveillance cameras she had installed after previous robberies. Concerned about the theft of her belongings, she armed herself and went to find the suspect. She spotted Johnson as he was attempting to climb out of a window.

“She observed a subject leaving the home through the rear,” said Miami-Dade police Det. Dan Ferrin.

Investigators said that there was a confrontation, the extent of which is not clear at this moment. The homeowner fired one fatal shot. Johnson was pronounced dead at the scene.

“What’s wrong with her,” asked Johnson’s sister Nisha Johnson. “She did not have to shoot him.”

“It’s no reason she should have waited until I think he walked out the yard to try to shoot him,” said Harris. “If she called the police already why would she shoot him?”

The family of Johnson insists that he did not steal anything from the home, but investigators did not confirm that claim.

“You have to look at it from every child’s point of view that was raised in the hood,” said Harris. “You have to understand… how he gonna get his money to have clothes to go to school? You have to look at it from his point-of-view.”

Meanwhile, the homeowner is cooperating with authorities. So far, no charges have been filed. The case has been sent over to the state attorney’s office for further review.

“She’s a person that is a little distraught because this is her home that someone obviously was in,” Det. Ferrin said.

Ferrin added that it’s best for the police to confront the suspect, not the victim.

“If there’s any type of situation that happens or they believe there’s a burglary at the home or any type of confrontation, dial 911. Have the police make that confrontation,” Ferrin said. “That’s what we’re here for.”

Obviously, not all the details are known. But from the looks of things, the woman was fully justified in shooting Johnson. For starters, he had no lawful right to be in her home. In fact, he was — if the reports are true, and there’s no reason to doubt them at this particular time — in the act of committing a felony!

Beyond that, it’s not clear what his intentions were. Was it just a robbery? Was he going to physical assault her? Rape her? Kill her? Plus, how is she supposed to know what his motives are when he’s standing in her home?

Florida’s self-defense laws protect homeowners who reasonably fear for their safety. Unquestionably, the homeowner could argue that she had a legitimate reason to fear injury, great bodily harm or even death with a younger, stronger male stranger in her home.

With that said, what are your thoughts on this shooting? Also, what would you say to the would-be burglar’s family who all believe that the homeowner was too quick to pull the trigger?

    Trevon’s family says she didn’t have to shoot him. He shouldn’t have broken in to the neighbors house and put himself in a position to get shot. Anyone breaks into my home is getting lead poisoning. I guarantee it.

    Wonderful to know he was big on education. His education is now complete. He was awarded a lead diploma and didn’t even have to wait two weeks for it to arrive in the mail. Also didn’t have to bother with all the pomp and excitement of walking across any stage, getting pictures… There are two cures for stupidity, and one of them assumes you survived the other.

    The article fails to mention the time of the incident…was it 8 p.m., or 3 a.m.? Not that it matters legally, but the time would probably enter into the state of mind of the homeowner. Regardless, the 17 year old burglar should have known the risk he was taking and therefore got what he deserved. For the family to be upset at the intended victim is analogous to a family being upset at General Motors for manufacturing a car that was being driven by a drunk driver who died in an accident when he ran off the road and hit a tree. At some point people have to accept the consequences of their criminal activities. The truly sad statement in the article was voiced by the pathetic cousin, Nautika Harris, who unashamedly tried to justify his felonious conduct by stating people should understand that by his being from the “hood”, there was no other way for him to get clothes…huh??? Based on that statement it is reasonable to assume that working for money was not a familiar activity for that extended family, and their sense of “entitlement”, as promoted by the Muslim community organizer, AKA Barack Hussein Obummer, led this man to believe he didn’t have to work to acquire the things he wanted. With that type of reasoning in the family’s gene pool it makes sense for him to be killed during the commission of a serious felony. And for the article to make reference to the fact that the homeowner should have waited for the police to confront the burglar, ignores the fact that the dude would have already done what he came for and be long gone by the time the law arrived. People need to understand that police don’t carry a firearm to protect you, they carry to rightfully protect themselves. This story had a happy ending…the intended victim is alive and her property secure, while one non-productive, criminal drain on society is eliminated. As to the cousin and other family members who blame the victim…”you can’t fix stupid”!!!

    I would not shoot to kill, there are many choices to be made when we own guns.
    One is shoot when you aim, it doesn’t say kill.
    I’d rather disable where ever possible and you have that decision if your mentally prepared.
    There are consequences for trespassing and standing in another man’s home, the young man knew this & his family should be asking the question what would they do if reversed and how was my child responsible that fateful evening?
    I’m sorry they lost their child; it’s not a perfect world .
    Where violence has become the norm, we have a long ways to grow up consciously.

      I seriously doubt the woman “shot to kill” but death is a very real possible result of shooting at somebody. The woman was no doubt frightened, heart pounding, hands shaking, tunnel vision, Was the house lit or dark? I really doubt if she could have killed him intentionally if she HAD meant to. I say the final result was just rotten luck. His wound however, no matter the result, was because of choices HE made.

      Now, IF he was climbing OUT the window, (something she may not have been aware of at the moment) she might have done well to have hung back and let him go. But, not having been there, not knowing the facts, I won’t even stand on that.

        OK , if she let him go im sure that would have been the last time he robbed somebody else home. He was making a living at what he was good at, STEALING!!!! There is no other way of getting money in the hood such as working. If she had not stopped him maybe he would have shown up at your house where your 15 year old daughter is sleeping and im sure he would never think of a little rape on the side. SEE WHERE THIS CAN GO!           No, that’s pointless. The decision she made ENSURED that he never was able to rob another home again or possibly put any other law-abiding homeowner’s lives in danger.

          If someone breaks into your home, they’ve forfeited their right to safety. Robbers obviously don’t care about the law, so why wouldn’t they just lie to police and say “she let me in and then shot me!”, this way that robbing piece of garbage gets exactly what they put themselves into a situation to receive and no one else can say a damn thing because there were only two people who witnessed that, the robber and the homeowner, and one of them is justifiably gone. Good riddance.

      “I would not shoot to kill?” Do you not understand the law? The law does not protect a citizen to shoot to disable. If you shoot to disable someone, you have in effect told a jury that you were not in fear for your LIFE! You will be arrested for assault with a deadly weapon, and Nautika and her lawyers will take everything you own while you serve out your sentence which will leave a felony on your record. If you are not a police officer, you do not have the lawful luxury of shooting to disable. If you decide to do so, you have signed your own life away as a free citizen. They will rip you to shreds in court. Just sayin….

    I have read through almost half of the almost 400 comments and have seen so many opinions that shake out as another redundant statement that has already been made before [many times] in the lineup. So, in an attempt to avoid that pitfall not finding the one basic question that entered MY mind at the finish of reading the above article, I will try to stir the pot with something new for a change.

    In all of this “discussion”, albeit much of it leaning one way or another, let me throw out this thought. I read that the alleged B&E perpetrator was “a 17 year old shot while he was burglarizing her home, [ie., the homeowner] The alleged burglar was:

    1. “observed” by the homeowner “breaking into her home” on a surveillance camera which she had installed after some other burglaries.

    2. She “armed herself” and went to locate the suspect.

    3. She found him “attempting to climb out of a window”.

    4. Investigators said there was a “confrontation.

    5. Homeowner fired “one fatal shot.” the alleged burglar, “Johnson was pronounced dead at the scene”.

    6. “He had no lawful right to be in her home”. In fact, he was in the act of “committing a felony” …..

    So, with these high points being stated as such, if I were the defense attorney in a court case with the homeowner as my defendant, the very first question I would ask the jury to clear up beyond any shadow of doubt would be,

    “Ladies and gentlemen of the jury, if the deceased, Trevon Johnson, was not at my client’s home for illegal purposes, and he was not involved in any illegal act of breaking and entering with intent to burglarize the building, ………… why didn’t he simply go to the front door and either knock or ring the door bell?”

    That would be a major factor, in my mind, in any final judgement passed down by any judge worth his salt sitting on the bench. If half of the alleged “facts” of the case are as the article stated, one would be suspect if they replied that entering and/or leaving a private home of a total stranger is the “thing to do in the hood”.

    ANd lastly, I will say this to Mr. Blannelberry, the author of the article for GA, “Shame on you for that opening line you presented to the readers when you have absolutely nothing here in print to prove or disprove the allegation which states:

    People who can’t understand this are just plain stupid. Many years ago I woke up at 3:00 AM by the sound of foot steps approaching my bed at a quick pace. He was only about 15 feet away. Talk about a rude awakening! Deep sleep to wide awake and heart pounding like it’s never done before in about one second. Lucky for me he turned and walked right past me, never knew I was there. All I had was a baseball bat and that’s not enough. I’ve never felt fear and adrenaline anything close to that before or since. That was when I bought my first gun and will never sleep without one again (besides, I love beautiful firearms anyway). Other people that I’ve known haven’t been as lucky, some paying a price physically and emotionally that they will never recover from.

    My mother and I had a similar situation 2 months ago where 3 guys ran up our driveway as I was speaking to a deputy on the phone, describing the suspicious knocking and luxury car these ‘Trevons’ came in. One guy with green gloves had already jumped one of or gates right before I grabbed my shotgun. I told the deputy what I was doing and he never prevented me from doing so. Had I not been there, my mother would have been surprised and probably the worse situation would have occurred since she was initially unaware of any knocking. When she heard me describing to the deputy what was happening, she couldn’t even dial the phone because her hands were shaking. The first sheriff SUV arrived about 2 or 3 minutes after the car that the ‘Trevons’ came in left quickly. That means my mother and I were the only line of defense throughout that ordeal. All it took was for the guy with green gloves to see me holding my shotgun in a defensive position. They all left a lot quicker than they came.

      There are all thousands of people who are poor who do not resort to stealing, who do not break into people’s homes. There are people who can and do help people in need.         God’s word says if a thief breaks into your home during the day let him go, if at night kill him. The obvious meaning is that if he is breaking into a home during the night, he is not afraid to kill because it’s expected that the homeowner will be home. A day thief is taking the risk of getting seen (daylight) to avoid contact with people so is not the threat to this homeowner or the next 100 homeowners, so let him go. Notice it does not mention wether you let him go with your things or not….

        I don’t think anything I own is worth your life, but I’m not giving to someone who is trying to steal. If I confront a thief and they run, I’m not shooting anyone in tha back, but if they move towards me, I will not hesitate.

A robber committing a crime has no defenseable point of view. An intruder has chosen robbery over work. There are other lawful means to get money to buy clothes, all require work.

    I stand firmly behind the “Make my day” and “Castle doctrine” laws put in place in the more enlightened states. You cannot stop an intruder with a cell phone. Your dog will be shot. Your locks are a false sense of security. The police respond to crimes in progress as quickly as they are able. I respect their work and the fact that they put themselves in harm’s way on a daily basis. But more often than not the police arrive to a crime scene well after any prevention is possible. It is your responsibility to protect yourself and your loved ones from harm with every tool at your disposal. A firearm, even if it is only used for self defense and you never intend to hunt anything, is your best bet at deterrence and might possibly be the only thing that can save your life against a determined attacker.
    Every gun owner should take advatage of any training they can obtain, and practice as often as is possible and affordable. Marksmanship, especially under stress, is a perishable skill. Without practice your skill diminishes. Since even in a self defense situation you are responsible for the end result of every round fired, ensuring that all of your rounds end up in your target is more than just important, it might prevent a tragic accident during a self defense shooting.
    Any unauthorized person in your home must be assumed to be willing to harm you as the prison sentence they face for simply being there is felony time at minimum. If they carry any weapon, I would shoot. A knife is equally, if not more, lethal as a handgun inside of 21ft. That is the standard for police when dealing with a knife weilding assailant. Never let them get that close. A baseball bat is as deadly as any gun, just at a shorter range. But take a look around your home… just how quickly could a person reach you upon entering your home? What would you do if they were armed with a gun? A knife? A bat or crowbar? The answer is, or should be, always the same… you fight for your life and to stop the intruder. The most effective method available to most people is a firearm. Self defense is a natural right of every living being on earth, including you.

    Kind of hard to say you fear for your safety when you go looking for the person who just broke in your house…
    In a home break in, especially if you call the cops, you hunker down in your room with the gun pointed at the door (if you need to get kids or something that’s different.) You don’t go around crying to clear the house, or looking for a confrontation, because you don’t know if there is more than one person, how they are armed, how dangerous they are, if they are insane or on drugs, etc. All reputable self defense schools teaches this.
    And if she did shoot him as he was leaving through the window, that is despicable and immoral. That is not self defense, if anything it is murder. You don’t kill people over money (especially if like it appears in this case, the kid may not have taken anything.)
    But as for what the cousin of the burglar said, “look at it from the point of view of a kid growing up in the hood. How’s he supposed to get cool clothes for school?” Are you fucking kidding me? Did you really just say that out loud? To a NEWS AGENCY no less, that will be broadcasting your words to possibly millions of people? Is that really how people think? That because you don’t have something you are entitled to break the law, and take it from someone else who earned and payed for it? Maybe he should have sold one of those two chains he was wearing in the picture. Or better yet, GOTTEN A JOB.

I would not sit outside and wait for the cops to come. I would confront the individual.     There’s an interview with a neighbor of his the media has quashed. A mother of one of his friends told a reporter that she would have hidden him from the law even if he killed a cop. She then said killing a cop isn’t that bad. The reporter was stunned for a few seconds and had to cut the interview.     Florida statutes Chapter 776 deals with Justifiable Use of Force. It’s pretty clear that the woman was justified. The thug was in her home in the process of committing a forcible felony (burglary). He was in her home, so she’s covered under 776.013(1). He was committing a forcible felony, so she’s covered under 776.031(2).

    What is the most disappointing is that none of the media interviewing the family felt any need to challenge the obvious insanity of their claim.

    If that is a fact home owner may have a legal problem. If he was attempting to leave,with or without her stuff, she could not have reasonable concern about her safety. Most stand your ground laws still require that the defender have reasonable concern. Seems the main difference with new laws and previous laws is that the victim now doesn’t have to make a reasonable effort to remove himself from harms way before using deadly force. With all these folks running out to arm themselves there are going to be a lot of them left wondering “what did I do wrong”. Fact that one can now easily own a weapon and has new encouragement to stand their ground doesn’t mean they can just start firing away without any thought.

    FWIW- Case law like Tennessee v. Garner has held that in property crimes- a fleeing (retreating, not visibly armed) person does not pose the threat justifying use of deadly force. There are other considerations… time of day, age of victim, victim’s perception of subject’s actions, belief suspect is or will be armed et al.
    As posted, police response is reactive- they are not likely to be there when they are most needed. Sometimes folks have to deal with ‘problems’ before the assistance can arrive. When citizens ask me if they should own a firearm for self defense, I usually ask if they know the average response time of their local agency to high priority calls and how long they can hold their breath if being strangled, or bleed if stabbed. If the answer to the second is less than the first, I suggest they have answered their own question.

    Caution to readers; know the law before you shoot! If kid was leaving, and she confronted him, that is legally considered escalation on her part. If she can prove that he went for her, or a prosecutor can’t prove he didn’t, she’s ok. As much of a scumbag as he is, an exiting or fleeing perpetrator is not a legal target, as there is no reasonable fear of death or grave bodily injury. I doubt that anything will come of it, especially considering Florida’s castle doctrine and stand your ground laws. But there I often a thin margin between a legitimate self defense shooting and murder/ manslaughter charge. I carry, I will shoot if needed, but not just because I’m pissed off or tired of being burglarized.

      Castle doctrine law(s) allow for the use of deadly force when an intruder is IN you home; the home owner DOES NOT have to retreat, regardless of the (unknown) intentions of the coming or going perpetrator. When you are a woman and you fear for your life and are not in the commission of a crime, you have every right to use deadly force (in FL & TX anyway) protect yourself AND your property.

      You (and everyone else) should read up on your state’s castle doctrine/self defense laws before you give unsolicited advice.

This felon was not raised to respect others property.Even the idiots still alive a mouthing that they have a right to take others materials because they want clothes. That is what Goodwill and the Salvation Army are for. Stop prosecuting law abiding citizens and enact a new law. If your idiot child screws up and they are 21 or less, the parents should have to pay reparations. There will be a lot fewer idiots roaming the streets because either they will stop reproducing or the kids AND their parents will be in jail together. Anyone, no matter how stupid can have a kid and then they expect ‘a village’ to raise it for them. I listen to those who said he grew up in the hood, so they think this is OK to go into someone home a burglarize, to commit a crime and commit a theft. The statements by his family show how out of touch with reality they are. Everyone has a right to defend their home. Intruders lately usually come in, assault, possibly rape, possibly murder and then rob the occupants. And it is not just that moment, but the incident lives with you forever.

      This woman had her home broken in to multiple times. Is she not supposed to react. And, just an FYI, I am not WASP. I had the Hells Angels has my next door neighbors. I never locked my doors, they were always polite and when they had a function, they would come over and ask if they could use my parking. And they policed our area. I never locked my doors.       Sarge – no offense, but it isn’t a question of knowing right from wrong — it’s caring about it. The ghetto teaches entitlement — “I gotta get mine!”. So the problem is culture. Until the ghetto culture is somehow changed, nothing changes. The parents will feel justified in feeling outraged that their son was killed during the commission of a felony.
      We don’t know the exact circumstances of this situation, but if this boy was actually in the act of trying to escape out the window, I kind of think they are justified in feeling this way. If, in fact, he had turned toward this woman, and was advancing on her, then it would be reasonable for her to pull the trigger. It’s a question of undo force or justifiable force. A person escaping a scene, and being killed in other than a homicide, is certainly an example of undo force, and many an individual has been convicted of 2nd or 3rd degree murder, or manslaughter as a result.
      I’m not excusing this boy’s actions in any way, I’m just saying any judgement depends on the facts of the case.

    I am a member of the NRA. I am a life long hunter and I also target shoot with my weapons that I carry. I live in Massachusetts, home of Smith and Wesson, about 10% of what they make is legal to own in this state. I am stuck in one of the top three most liberal states except when it comes to weapons. I know my rights, you have to if you’re going to carry. I believe the second amendment is sacred, but I see some morons that have no business owning a weapon.

    What really pisses me off are the people who have written some of the most awful things about this kid, or anybody who isn’t white like us. Yes, he’s still a kid. Neurology has proven that most human brains don’t fully develop until their mid twenties. This kid is guilty of doing wrong. This kid was also doing what most of his friends do. Nobody teaches right from wrong, you learn as you grow, you learn from what you see, you learn what you can get away with. Now a kid is dead and it’s shameful that this is his legacy. The environment this kid was raised in sucked. Who knows the circumstances, I don’t know what life is like in the hood and I don’t want to. I’ve been dirt poor yet I never would have resorted to a B&E to support my life style. I don’t ever recall my Dad telling me not to commit crimes. I was more afraid of him than the police, yet he never hit me.

    People who call us ‘crackers’ need to go no further than reading some of these responses. People are calling him a piece of shit, that he deserved to die, teach him a lesson.       So my final thoughts if we had a responsible justice 50 years ago especially considering drug dealers who I think should be killed or in a chain gang for life for first offense this kid would more than likely be a normal working productive citizen and the innocent such as the Miami lady would have never been victimize. For those of who that disagree I said it before and I will say it repeatedly the U.S incarceration rate is 6 times higher per GOP than the second worst country in the world that is England. The government get $33,000 per year per incenration per inmate based on 2006 census. The poor black/Latino communities are being used as ponds for government capitalization. It is too bad we do not riot to have strict laws for criminals such as Singaporo’s in Malaysia that has the world’s fastest and safest growing city.         Mr. Hey. I did a poor job of explaining my thoughts. Sadly in my state, the law basically says you can’t escalate unless you have no other choice. Again I am pro 2nd amendment, very conservative, and survived Ted Kennedy, Elizabeth Warren, and Barney Frank. I have the benefit of time to think of what I would do. Some lawyer may make the argument that she knew she would be broken in to again, so much so that she bought security cameras and a gun, and probably call it premeditated. I wasn’t advocating for the kid; I’m saying I hope my actions would be different if he were running away vs. coming at me. I wasn’t there. She did what she felt she needed to do. Lots of paperwork when you kill somebody even when justified. As many writers said, move out because retribution will surely follow.

The bible also speaks of gouging ones eyes out when witnessing a sinful act. If I have a hundred acres, and see someone trespassing, I have the ‘right’ to tell him to leave, and then give him the chance to do so. After he leaves and I go back up to the house to find someone rummaging through my closet, I am not going to ask him if he needs a jacket because it might get cold outside. I’m going to ask him to stand still while I call the sheriff. If he bolts, I’m not going to check my closet to see if anything is missing. I can’t sit here in the comfort of my living room, and say I would shoot him. That should never be anyone’s first thought. But all these analogies don;t fit this case. I’m a 54 year old woman, seeing a young man in my house, I’m going to be near panic. In that case, I probably would shoot. Out of fear. I know nothing of his intentions.     It is sad that this young guy lost his life. He made a bad decision in breaking into someone else’s home. He probably had insufficient guidance in his life and he probably didn’t fully comprehend the implications of entering someone else’s home. So the result was that he was shot and killed. The homeowner, despite the kind of neighborhood in which she lived, despite that she was a female (obviously), despite the fact that she had made the choice to arm herself, she must have felt threatened to the point that she took steps to mitigate the threat. She produced the firearm, she confronted the threat, she took aim and discharged the weapon. None of that was, most likely, an easy thing to do. She took steps to protect herself from an immediate threat. No one should blame the homeowner and no one should celebrate the young guy’s death.

    Do we have all the facts? We just went thru this with Trevon Martin. Now we have Trevon Johnson. First question. Is that a current picture of Johnson. In the last event, they were posting pictures of a 12 y/o kid, not the 17 y/o hood. Did Johnson force his way into the house? There were cameras according to the article, what do they show for a possible threat. Let’s not go to the double standard on “Feared for my life.” either. The cops throw it out now like the libs throw out the race card. And it’s blindly accepted by the courts. Was there a credible threat shown in the video? What is the average response time for the local police. What were Johnsons’ intentions? Nobody knows. I’m guessing at this one, but I don’t think he was going to stick around for an exit/inventory/intentions interview. The point of view from the “Hood” isn’t a valid defense. Theft is theft. The kid gambled and lost. Regardless of the outcome of the legal issues, he’s going to stay dead. So much for his love of education.

    All of the facts have not been presented. With that said, my interpretation of what was reported is that the homeowner was off site and witnessed the burglary from a video camera, then drove to the home armed. If this is true, she is guilty of murder. I am a responsible gun owner, and a second amendment advocate, but to intentionally place yourself in a situation that you could have avoided, instead of calling the police, is negligence on her part. Now, if she was home and the incident occured, then she was well within her right; driving home to confront a burglar will be very difficult to get a judge and jury to side with you on.

      Kevin- read it again very, very carefully. No where does it say she was off site. Maybe she was in the garage, or in the side yard. She saw him on video (personnel device?) and armed herself, and confronted him. He “intentionally” put himself in a situation “he” could have avoided. I am licensed, and trained. Both in the military and civilian life. If I find a person robbing or attempting to rob or threaten myself or family, they get one option. Go hands up and yell I surrender. You say you are a responsible gun owner, and a second amendment advocate. That could mean you own a hunting rifle and want to keep it. You did not say you advocate stand your ground, castle law, lawful carry etc. I think you are suspect.

I would add to that a “BurglarBomb”: It fires can of pepper spray to flush anyone out of your home: That probably would have stopped the burglary right there. Also it’s a good idea to get concealed carry insurance (CCAA or NRA). For less than a dollar a day I have a million dollar policy to pay my bail and attorney’s fees if I ever become a political football persecuted by a leftist media and legal system – as long as I’m legally carrying (this woman BTW was black so there’s no race card to pull on her, but if you’re white you can expect it).

      Unfortunately, I’ve been in two very deadly confrontation, because both times the felons were also armed, one a carjacker and the other just a thug that thought whatever someone had, it really belonged to him, and he had a gun to prove it. Thank God I was either a better shot , and/or a little more in control of my weapon. I can guarantee the people we killed had their life’s goal to kill us, so it was kill first and live, but we never went after people that weren’t threatening us and if people knew the Lord had given me a protector attitude towards children , or helpless people. If I had saw any of my bro’s going after children, I would have shot him and so would the best guys, cream of the crop of our generation, soldiers I crunched gravel with. Had to say it, the abandonment of our young, best soldiers the world has ever seen because of scum who ruled by intimidation. Still can’t believe American people acted like the French in Nam. They lost, it’ll cost to much to bring our soldiers home, so just write them off. Just like teddy Kennedy and his cronies.
      Sorry people, it still tears my heart up, seeing those young soldiers, maybe a year out of high school laying on the ground, their life over before it began.! Then our entire country washed their hands of their sons who were only doing what their dads had done, protect our way of life.

        SkyGunner. . .my neighbor is a 3 year Vietnam Vet snipper. The stories he tells and the pictures he has would make one’s hair curl. He lost many good buddies over there and is still plagued with guilt because they didn’t make it home and he did. what horrific memories for him and he has PTSD because of it. Having seen the wonderful young men on the Wounded Warriors commercials and how they have suffered from lost of limbs, nerve problems, brain trauma, etc, etc. . . .I cry for all of them and you as well. I am so very sorry you went through that and then many came home to jeering, name calling, being ignored by ignorant people, spit upon. . .I hurt for you and pray that God will heal all your wounds as much as possible. Today’s society has gotten to where you could be killed for a dollar so people have to protect themselves especially a woman. What my hope is that this will be a lesson to all as to what can happen if you choose to break into someone’s home or business. Remember, you could be the next statistic.

    This is a tough call. There are a few more things I would need answered before coming to a conclusion. Was the intruder going out a door or leaving through a window? What was the distance between the involved parties? If he was shot while crawling out a window or was halfway out the door, the homeowner might have some charges or a civil suit coming her way. Would a “reasonable person” have considered the intruder a threat ?

    This homeowner should be commended for saving taxpayers from having to fund the arrests, prosecutions, and incarcerations that this aspiring felon would have been responsible for in his bright future, as well as preventing him from breeding more of these unproductive, unappreciative miscreants.       Dan, you answered your own question. Yes, these people are that ignorant. Such “disadvantaged” people feel that they have a right to take what does not belong to them because they can’t afford to buy such things. That they don’t work to earn enough money to buy those things, is unimportant. Solution? Education is often suggested to produce adults that are constructive members of society. This suggestion has been floating around since Noah’s Ark landed.

      I suggest that communities be organized, communities consisting of people with the same mindset as the mother of that “innocent child” who was just looking for “…money so he could get clothing and go to school”. Once the new communities are built, high walls should be constructed all around with high voltage wires running along the top. Truck loads of food, and clothing should be sent to the communities to enable the “decent residents” a means for survival. This wouldn’t be all that different from the ghettos we that now have, except for the restraining walls.

      The point? Young Trevon Johnson would find it more difficult to break into the homes in other communities to find money for a lifestyle not earned. One should think of the restraining wall as a kind of crime fighting effort. It might help one to consider this as being a “gated community” of people “who are not as fortunate as you are”.

    I must say that based on what I’ve read about the incident, a minor was killed trying to escape from a burglary, nor a robbery. I’ve legally owned firearms for 30 years. I live in a state where if there were a confrontation, I will assume she would have been immune from charges. If she shot him as he was attempting to escape out a window, it would likely have resulted in some murder charge. I’m simply stating that this is the world we live in, not the one some of the readers wished we lived in.

    I love hunting, I love target shooting. One of my instructors shared some of his opinions with us, he said this was his class and if you didn’t agree with him, keep it to yourself and politely engage after class. He classically stated that if you are going to learn how to live with a firearm with the sole intent of protecting your life and property, become very good at shooting at targets within 10′ of you. If you shoot somebody anywhere reasonably beyond that distance, likely there will be murder charges because you have engaged in aggression and not protection. Yes there are exceptions, but not many. Whatever transpired before you shoot somebody is not the question, it’s what you did after that counts. Calling 911 should be paramount as your first action, if possible. I’m not going to get into the mud on response times. You may need to demonstrate that you called for help first. Shooting was a defensive action based on impending harm to you or your family, it’s also one of the few legitimate times where you can say you ‘felt’ your lives were in danger and that your ‘feelings’ actually may keep you out of jail. The thought of spending and dime on a lawyer to defend me in court because I feared for my family, makes me sick. Yes, victims are subjects of a crime. If you shoot somebody who is trying to escape, not harm, you just made them the victim and you the aggressor. Again, it’s almost as if your meeting the burglar in the action of exiting your house is a clean crime slate. What happened before doesn’t matter, you just killed somebody trying to escape from you. The only possible justification that you may win that I can think of is if they were trying to kidnap one of your kids. Your training inside of 10′ better have been damn good if you’re going that route. Stay on track with me and don’t go down the ‘what if’s’ route. This is the reality of these stories, yes I want you to protect your family and will vigorously fight for your right to safety. If somebody is in your house doing something other than trying to escape you, then do what you have to do. All I’m trying to do is to clarify that if they are halfway out the door or window, keep them in your gun sight, but sadly you simply are entering a whole new realm if you shoot them. It’s the world we live in, not the world we wished we lived in.

    If you stayed with me this far, good. True story in MA, where I live. I’ll keep it short, keep it factual, Google the rest. A wealthy business man tells police he’s going out of town for a few days. Please keep an eye on my house. He returns earlier than expected. Police notice light on in the house, enter the house, do not announce their presence. Business guy ends up shooting an officer through the door thinking he was about to be robbed. The outcome was in favor of the homeowner, fearing for his life, and doing what he thought was right. Sadly, the officer was severely injured and evidently permanently disabled. So being in fear for your safety can be a legitimate reason. Before anybody writes their opinion, read the story. There are lots of details left out by me due to space, but none that mattered to a jury in my left wing state. A plus B resulted in C.

    Lastly, I’m ashamed for the editor of this site. It’s unfortunate that they will allow their forum to be a funnel for people who have used pejorative words, blatantly racist language and quotes using misspellings of words, phonetic words and hate speech. What possible outcome other than non-Caucasian’s assuming that all white people think and talk like this? We don’t like it when whites are all thought of to be illiterate, gun loving killers, any more than all blacks like it when they are thought of as illiterate criminals stealing from others. Your forum posts email that uses ‘ monkeys’ ? Why are you perpetuating the publishing of words and language that are going to incite hatred of whole races? Yes, I am a lawful gun carrying right wing conservative. Yes, I support the freedom of speech. But the celebration of a kid who got killed is awful. He’s 17. No, he shouldn’t have gotten away with it, but I don’t think he should have been killed. If he were attacking, threatening, etc. then bad things can and will happen. None of us civilians know the full story. If he was jumping out a window to escape getting caught, then the shooter was wrong. He is a product of his environment and it is this same concept that makes us a product of ours. My parents didn’t own guns yet I do. Yet they also raised me not to choose a criminal way of life, and I don’t. I did some really dumb petty things during those teen years as did most of us. I just as easily could have been that kid except it was nighttime and I had to go out a window to avoid be caught by girlfriends dad. I wonder what would have happened if he shot me?

    I am not defending the criminal activity that happened. I am not demonizing the shooter. We all have the right to be safe in our own home. This criminal should probably not be dead. If trouble comes in to your home, know what your plan is before it happens. Would anybody who reads this rather have an intruder make off with their property, or would you rather risk your life or your families in exchange. I don’t go looking for trouble, but if it comes looking for me I have a plan. Yes, in the heat of the moment your may think you are justified, in your mind you may be justified, however when the smoke clears are you ready for what comes next? As for the people who would empty their weapon in to somebody, there’s a damn good chance that the criminal isn’t alone. Have a Plan B.

If the vitriolic comments in this thread were aired in a broader public forum, it would not only be an extreme embarrassment to to gun owners generally, it would provide powerful evidence supporting more restrictive gun laws. There is no way to justify the action of the kid that was killed, and he should have suffered legal consequences, but the shooter unquestionably committed the more heinous crime.

I am sorry this kid had to grow up in a country that the liberal party allows and nearly promotes this type of scum bag druggie culture with do what ever you want attitudes except be independent of government services such as in the case of protecting yourself. We need to acknowledge the lack of justice and education is what is killing those kids especially in black communities, the more we make fun of their background the more divided they will become from the white conservative folks and vote more disruptive scum bag liberal promoting laws/politicians in power. I could not blame myself for doing it if I was black and reading some of the comments.
    So my final thoughts if we had a responsible justice 50 years ago especially considering drug dealers who I think should be killed or in a chain gang for life for first offense this kid would more than likely be a normal working productive citizen and the innocent such as the Miami lady would have never been victimize. For those of who that disagree I said it before and I will say it repeatedly the U.S incarceration rate is 6 times higher per GOP than the second worst country in the world that is England. The government get $33,000 per year per incenration per inmate based on 2006 census. The poor black/Latino communities are being used as ponds for government capitalization. Tell that to the next black thug instead of name call. It is too bad we do not riot to have strict laws for criminals such as Singaporo’s in Malaysia that has the world’s fastest and safest growing city. They spend their money on infusture and education, not crack.

    The woman was totally justified in protecting herself against any intruder who has broken into her home. The matter of race was not the issue until his family started making accusations and saying “How he goina get his cash for buyin cloths an goin to school” “That how anybody who raised the hood do it”. My opinion: Black, white, green, yellow or poka-a-dot, the woman protected herself, killed one intruder who will not have the chance to repeat the crime. Why did she have to shoot him?     The victim made two mistakes. First shooting him OUTSIDE the home. Second calling the police. Our society has been so twisted that the criminals are now condoned, while responsible citizens are condemned. In a world where you can never tell who to trust, I trust NO ONE. She may not have charges against her YET, but it isn’t over. And even if the “law” doesn’t go after her, it is likely the pathetic family will. If he had violated my safety, security, and privacy, he would simply end up on a milk carton. No mess, no fuss, no witnesses.

      I have to disagree. First, whats wrong with calling the cops? If you watch the video she wasn’t home and “rushed” home when she got alerted from her video cams. She most likely called the cops then. Second, they said there was a confrontation in the yard. That most likely led to the shooting one would assume. This has happened several times to this poor woman, who seems to be alone in that house btw. You can only blow so much air in the balloon people.

    I started working at 11. My SS records go back to that age, so I was paying SS taxes even then. But…in the hood they just take what is rightfully theirs from the “white privelege” folks.

    At home, our doors were never locked, and my dad had a sign on the window. It said “Yes, there are guns in this home, and everyone here knows how to use them”. I think the number was somewhere near 40 guns, with 2 parents and 6 kids. And yes, we all knew how to use the guns, and knew where the loaded ones were kept. At work, the loaded pistol was right below the counter, pointed out. Guess what? We never had to use them for protection – people were not that stupid.

    Having been the victim of robbery several times but luckily nothing was taken due to someone being at home or me coming home at the right time. Still there is the cost of replacing a door jamb and door not to mention the stress caused by the incident. I work hard for the things I have and if I loose them in a fire or other natural disaster, that’s beyond my control. I have always maintained, if I catch someone in my home stealing from me, they will be lying there when the coroner arrives.

    Her life was NOT in danger, and he was LEAVING.
    She essentially killed him for protection of PERSONAL PROPERTY.
    I am from Colorado, and am an active supporter of the 2nd amendment.
    Since is this occurred in Florida, I don’t know of the exact nuances of the law.
    Either way, two lives were changed permanently from this situation…
    And we cannot overlook the fact that every situation starts with a tipping point.
    This tipping point was when the intruder ENTERED the home. It all starts with him.

    As an example…I think Colorado has their law pretty well written.
    You will ONLY be protected from prosecution if you kill someone IN YOUR HOME, AND you believe you are in imminent danger of bodily harm or death.
    In Colorado, It is on YOU to convince the police and prosecutor of your situation when you killed the intruder…that is why anyone who is put in this situation would be advised to consult a lawyer before saying a word to ANYONE…after you called 911 and reported the incident…to ensure you do not say something that the prosecutor could use to prosecute you with.

I too live in Colorado, ex-police officer, and we have the “Make My Day Law.” A woman in her home by herself, with an unknown felon having broken into her home, having had to put up cameras because of previous burglaries, having to get a gun to protect herself, was probably in fear for her life whether or not he might have been leaving or not. You don’t know what happened at the time of confrontation, what he said, what she said, maybe he threatened her. I have little doubt that she was fearing for her life at that point. If you are truly a Second Amendment supporter I don’t believe you would be so quick to have her charged. You sound more like the gun grabber mentality.

      The homeowner is cooperating with the local police, so I imagine if charges were in order, they’d be filed. But we don’t know what sort of confrontation this was, or if the perpetrator had placed the woman in credible fear of dying or receiving grievous bodily harm.

    The detective is just spouting CYA propaganda “that the police should handle these situations” to make the populous “feel” safer. His remark also reflects the disdain that many cops have for an armed citizenry even though cops are mere civilians themselves.

    On the other hand, the Sheriff of Milwaukee County told the people in his county to arm and protect themselves because his understaffed department could take more than 90 minutes to respond to a 911 call. The Sheriff’s honest statement is the correct view on how to make the populous safer and acknowledges the fact that armed citizens can help the police.

    I am an avid gun owner and i love shooting.
    HOWEVER, you do not have a right to shoot ANYONE unless they are literally trying to attack you.
    Too many idiots are buying guns thinking they will be the next hero going around playing Clint Eastwood.
    Picture this, you see someone shoot someone else, what do you do? Shoot him? How do you know he’s not an undercover? Or how do you know hes not like this lady, who “justifiably” shot someone who was retreating. Or they could have just murdered someone in cold blood. Perhaps they see you draw your weapon, and proceed to tell you that they are a responding off duty officer and calms you down until you trust him and lower your guard juuuust the slightest and then BAM he shoots you too. The thing is you DON’T KNOW, what if that kid had heard someone screaming in the house and broke in to save them? I mean it isn’t likely that that’s what he was doing, but you never know. The only time you are justified in shooting someone is when they are either shooting at you, or charging at you with malicious intent, PERIOD.

Why should you have to be beaten half to death before you can return force? If you haven’t ever been in a situation like this you obviously wouldn’t understand. I was left for dead by my attacker with my weapon still in my pocket. I got a horrible feeling and almost new it was coming and should have left my attacker lay victim to my 9mm instead of me fighting for my life with cracked ribs collapsed lung and too many stitches to count. I shouldn’t have had to fear facing prison to defend myself before I was attacked.

        Hey man I am terribly sorry to hear about what happened to you, it is that predatory mentality exhibited by those few people out there that causes the rest of us, who are otherwise mutually respectful, to lose trust in fellow man.
        And you are right, you would have been better off leaving that attacker filled with more holes than the asshole day parade.
        But even though the result was tragic, to shoot someone who is not apparently trying to attack YOU, is to make a great assumption about the situation that you can not otherwise know about. I once saw a man being viciously attacked by another man, there isn’t much of a gun problem in the area, however there is a violence problem (like anywhere, I guess).
        I came up and shoved the man and confronted him, which allowed the other man to get away. It turns out that that man had got his daughter into doing hardcore drugs, which led to him selling her as a prostitute in exchange for supplying her the drug. She ended up contracting HIV and killed herself. Her dad found out about the story, and he was the guy beating him. And although preventing the beating was the right thing to do, I had made a totally inaccurate assumption about the situation just because there was so much behind the story, that face value analysis could NEVER provide a wholesome understanding. Imagine if I had a gun, I would have shot a grieving father who was beating her daughters killer, and I would have felt like a hero, and seeing as the father would have been dead I never would have knew otherwise.
        All I’m saying is its not what you don’t know, its what you don’t know you don’t know that gets you in trouble.

I live outside Chicago, in Illinois, which happens to be the most anti-second amendment state left in the country. I am so fed up with the shooter automatically being the bad guy (or girl.) If I sat down and started self rationalizing “if I shoot this person, I am going to be sued, or I’m going to jail,” then I would probably be dead. This woman had her home broken in to, enough to install video cameras, and, in all likelihood, by this same person. As for me, and my family, I will not hesitate to engage ANYONE in my home, at night, uninvited, and with unknown intent. PERIOD.

I am a parent of 6 children and I cannot fathom the pain of losing a child regardless of fault or age, but if one of my children did this and was killed by the homeowner regardless even if my child was leaving through a window at the time of being shot by the homeowner, I would NOT fault the homeowner in anyway, period!     When I was a child my mother was on welfare. my father couldn’t give a rats arse about my siblings and me. my mother worked in sweat shops doing piece work sewing for pennies a piece. I grew up in your classic broken home and I dropped out of school in the 9th grade. I was a misguided child. i started working when i was 11 years old. when i was 22 my first son was born. i had no education and no future in sight and there i was a father. i got work where ever i could. i went back to school and got my HS diploma. at one point i had 3 jobs and worked 7 days a week. 25 years later i am still at this job and my first born son will have his own first born in July.

    the point here is everyone has a sad story to tell. no one has a monopoly on sorrow or hard times. sometimes we fall or can’t see the way but as i tell my children, yes i have 3, always be a good person in life. even more important than grades is respect.

    i have no pity for this young man and i blame his family for his demise.

Horrible violation to have someone go into your house. To be there makes it many times worse, can lead to years of nightmares about what could have happened.     Reading the article , I became ammused about the Line it’s best to let the Police confront the suspect.
    I know a single parent who resided in a major city and had to travel out of the country a lot at the time and would take their child to their parents house, for them to watch while they went to work.
    It was pretty routine until one trip that is they were in England and returned to get their child and returned home, there in a Taxi and the Garage door is wide open , The Taxi Cab Driver and the parent both call 911 and the Taxi Cab driver says I have to go back to work, so he kicks the parent and the kid out of the taxi, The Burglars are in the House, The Parent does not know what to do they are two blocks from the main drag , their our houses all over the place but this is Florida and neighbors keep to themselves in Orlando that is and the parent really doesnot know the neighbors so the parent make a decision and runs to the master bedroom and thank god know was in that room and barracades themself and their child in that room and repeatidly calls the Orlando Sheriffs Dept, with Burglars in the Kitchen , Living room , and dining room and the other bed room, You would think The Orange County Sheriffs Dept, would have sent a Level one Response , the Bastards never showed up, The parent was my sister and my neice, so it makes me wonder was this women, in similar situations in the past/ and was she like my sister found out you can not rely on the police ? That in fact you are on your own ? That is until you shoot a 17 year who was raised by Idiots to be a Scumbag ?

    He entered a home to steal money for school clothing. Sez who, his family? He was committing multiple felonies, how did the victim know what he was there for? He was a young imposing male and she is a middle-aged woman who lives in what is obviously a high crime area. Her gun is legal. OBTW, he doesn’t look like he has any problem getting clothes to me. I feel sorry those young ladies losing their brother but that’s live in the hood.

    Wow just wow!! The justification for breaking and entering is unbelievable. I know the whole story is still unfolding but maybe if the young man would have said “Hey I’m sorry, don’t shoot I’ll wait here for the police to arrive” (in 15, 20 30 minutes). But then he if he went to jail he wouldn’t be able to go to school in his new clothes bought by thievery. I’m sorry the young man is dead but he should realize, especially in Florida doing a B&E you take your chances the homeowner is armed and has full legal rights to defend.

    He was committing a B&E. I’m Hispanic my wife is Black. She carries firearms as I do. I’m pretty sure if this guy was breaking into our home my wife would have shot him too and called the police. It’s unfortunate this young man died, but he was committing a crime. I wonder if this would even be news if the victim was asian, hispanic, or white. The media keeps all this animosity going between all of us Americans. We got scum in all races, and ethnicities but we are not all bad. All whites aren’t racist, all blacks aren’t criminals, all Hispanics aren’t illegal. But according to the media all minorities are criminal and all whites are klansmen.     17 years old? Where’s he supposed to get moey for school clothes? Something wrong with getting a job? When I was 17, I was being raised by a single Mom. We didn’t have a lot of money to spend, and dammit, I wanted to get a boom box like the rich kids had! And she refused to buy me ammo for my .22 and my 12 gauge, so I had to get a job. Even with the blatantly obvious lack of education this family has, working in a grocery store doesn’t require much. He had a future? Where? Raiford Prison Facility? My hat’s off to the home owner. It’s never a good thing to have to kill, but she did what she had to. And judging by the reactions of the kids family, she may have to again.

    If he decided to hurt her, help would possibly have been too far away. We don’t have all the details, but it may have been a good shoot. I’m not blaming the police, but they can’t be everywhere all the time. To the hood rat’s family: If you (meaning the hood) would teach your kids right from wrong, maybe – just maybe – things would look up for you. Theft is a crime. Burglary is a crime. Trespassing is a crime. In my mind (sane) it’s the parents responsibility to ensure their kids have what they need for school and such. It’s not the kid’s job to steal for it. Step up and provide. Be a part of America that you can be proud of. ‘Entitlements’ are going to start drying up. What will you do then? I know it won’t be my house or stuff you’ll turn to….
