Man Will Not Get Back His Confiscated M1 Carbine, It’s An ‘Illegal Assault Firearm,’ Rules NJ Court

2nd Amendment – R2KBA Authors Current Events Police State S.H. Blannelberry This Week

New Jersey native Danny Burt inherited his grandfather’s M1 carbine in 2006.  Burt’s grandfathered served in WWII, so the iconic rifle meant a lot to the Cumberland County resident.

In April 2013, Burt’s entire gun collection — including the M1 carbine and 20 other firearms — was confiscated by the New Jersey State Police after a temporary restraining order was filed against him.

A month later, the restraining order was dropped.  When Burt, who had no criminal history, attempted to reclaim his firearms, the court ruled that “the M-1 carbine is an illegal weapon and is therefore improper to possess.”

“Burt claimed the rifle had considerable sentimental value to him, and that he had no knowledge as to whether the gun was operable,” the decision states.

While the court offered its sympathy, it iterated that not only was the weapon “contraband” but since it’s a second-degree felony to possess the rifle in the first place, the court granted the prosecutor’s request to force Burt to forfeit his entire gun collection as well as his firearms purchaser’s identification card.

From the court documents:

Here, of course, plaintiff had not one but two hearings in which he stipulated to a statutory basis for forfeiture, namely his possession of an illegal assault firearm, the M1 carbine, resulting in a judicial finding disqualifying him from gun ownership in New Jersey and revoking his firearms purchaser identification card. Possession of an assault firearm is a second-degree crime under N.J.S.A. 2C:39-5f.

As the prosecutor correctly asserts, “the weapon is contraband [which] can never be returned to [Burt].” Accordingly, because Burt has had a weapon seized as a result of a domestic violence complaint that has not and can never be lawfully returned to him, he is subject to the specific disability under the Gun Control Law contained in N.J.S.A. 2C:58-3c(8).

I live here ABSOLUTELY do not move to new jersey. They are completely corrupted and don’t even bother to hide it. 2008 ask how many people knew they removed the electoral college. The justice system here is completely incompetent They falsify evidence down the road completely remove all traces of it. JUDGES say guilty no evidence.
This is how the police act. One man threatened a car full of people with a hand gun. FULL ON MAN HUNT.
4 cops came to my parents house one day 4 fully automatic assault rifles INVESTIGATED the property WITHOUT A SEARCH WARRANT went in the backyard everything.
All because 1 person alleged he was here basically falsifying a complaint to harass. helicopters n all. For one man who threatened 4 people who most likely robbed him. It’s nj criminals get slaps on the wrist cause they have no money drug addicts are completely normal they rob steal assault crazy shit self harm but because they have no money to take or fine it’s completely normal. 30 days in jail let go back at it again. The girls are far worse bringing heroin into the jails not getting caught.
NEVER DATE A GIRL FROM NJ AT ALL
it’s a bag of crazy that’s going to explode in your face. The police and the people in mainly the bad areas don’t walk a beat the streets for a reason and rely on cameras cause it’s so dangerous to walk down roads. TALK ABOUT COWARDS yet the residents in the area do. Your not allowed to defend yourself against attackers at all here zero tolerance for protecting yourself and your property. They fail to properly investigate anything. Got robbed 2 times same night NOTHING REAL HAPPENED AT ALL the 2nd time either the manager and the people in the area wouldn’t say anything about it. THE PLACE IS SCUM even if you buy property typed up contract says due title YOU’LL NEVER GET THE TITLE TO THE PROPERTY cause it never belonged to them in the first place sold it on company property on the clock on the job. No title Mr anisle…
And of course he knows the local law enforcement n fire department. I never did get the title cause I was going to sue him over it. Get my money back and press charges.
Some cops are good there not the ones you gotta worry about.
FUCK NJ 2/3 Gun crime comes from out of state the 1/3 pay for it dearly.
It is a rouge state I WILL BE LEAVING IT SOON. I suggest everyone do the same. The amount of c.c. fraud every year is insane and says a lot.
Middle East crime rings every year 200 million stolen in fraud rings yes they are by the F.B.I. defined Muslims. They don’t see this coming every year nor try to stop it. Any place that hires immigrants or is runned by a foreigner will not hire Americans unless forced to. Especially gas stations. High authority is only allowed to commit crimes if you accidentally sneeze on a officer your screwed. The people are in complete fear here the disabled completely discriminated against funds or programs do exist but guess what don’t pan out at all.
No one’s heard of the A.B.L.E. program yet it’s federal law. 1 thing Obama did that was good / bad. It technically taxed the disabled when they aren’t supposed to be taxed.
It allows disabled people to get out of shit holes like this it’s bad. Police work along side criminals repeat offenders to get more arrest while more new people get addicted the snitch is rewarded every time.
NJ is hell personally it’s the next Chernobyl SOON. These morons can’t run a state nor balance and clean the budget pass it on to the next person yet have a power plant.
I see massive money laundering here at a executive level.
The town by native tounge I live in is translated the place where evil spirits gather. As of today no one’s ever seen a native here before the town took over completely it’s history makes no sense at all.
    The schools are far worse.!!!
North Korea is far safer then Nj
That is not a joke at all.

  • David Welsh April 6, 2018, 11:08 am

He should protest down at the local station until he gets his rifle back. The politicians and police who confiscated and didn’t return his weapons are the ones who need to be in jail. NJ is a defacto enemy state of American’s fgreedoms. Get out of there or if you stay, do some mass protests, Ghandi-style, until the punk thugs get the message.

  • bob September 11, 2017, 11:35 pm

So some how it’s ‘legal’ in New Jersey to violate the Second Amendment. The people in this country need to pull their heads out before it’s to late and get rid of these politicians violating their oath. Then try them.

  • Todd Jaffe August 18, 2017, 5:53 am

Once again the cowardly liberals confiscate guns so the people cannot protect themselves against criminals, both those in the street and those in suits. The states trying to limit the second amendment are exactly why the second amendment was written. This country is heading to another civil war, it is obvious. And the attempt to keep the citizens from being armed will fail, as the armed services will end up joining the citizenry when the criminality of the leaders is demonstrated. In Europe there are gun restriction and so they use cars now to kill large numbers of people. For years we have said, guns don’t kill people, people, kill people.

    • bob September 11, 2017, 11:37 pm

Not only that now the medical doctors are banning together to get kitchen knifes ban.

  • Paul July 28, 2017, 6:42 pm

He was cleared of any domestic violence issues but upon inspection of the gun collection he owned a banned weapon the M1 Carbine. In New Jersey, this is a second degree felony to own this gun. Once he admitted to and was found guilty of owning that gun, he was guily of a second degree felony and thus lost his New Jersey Firearms Identification Card. He can no longer own amy firearms in New Jersey. His collection is confiscated since he cannot own them. If he had a family member he could get the guns returned to them. My brother ran into this problem and yes the police want to keep the guns to sell and then keep the money. I was able to get the NJ county prosecutor to get his guns tranferred to me as wisely we all in the family had NJ Firearms ID cards. Police were not happy as I came into their evidence room and took back my brothers guns. Many of these were left to him by my father so I wasn’t about to let this happen. Thankfully I live in an adjacent county away from those local cops as they were not happy and I could expect future harassment. The M1 carbine does not belong on this list as the list was created by past Governor Jim Florio who was out to destroy all gun ownership in NJ.

  • Douglas White April 8, 2017, 11:48 am

THOSE POLICE NEED THOSE FIREARMS. they have collections too that need new additions.

  • Problem Solver March 24, 2017, 6:13 am

In the Declaration of Independence, we are told We, the People, have the right and the responsibility to restore sensible and responsible government. As is obvious by the subsequent actions of the writers, we are not limited to the means when the government becomes out of control. And many of us have taken what amounts to a blood oath to protect and defend the Constitution of the United States against all enemies both foreign and domestic. What are the true responsibilities associated with the meanings of these statements?

I do not know the acceptable answer to our problems and I do not know the proper method for causing the appropriate answer to be implemented. Violence will probably not work as the crooked system can not be changed to he extent necessary through violence. But, I do know that as long as crooked people are appointed as bureaucrats or elected and re-elected in a crooked system, we, the people, can expect no improvement. I also know that, as long as the federal government continually violates our rights without any legal recourse or punishment, the future will not differ positively from the present and nothing will change for the better.

How did we get here? Improper upbringing of the past generation comes to mind. So does contempt for proper values and respect for those who provided what came before. And, importation of those who do not hold the same values does play an important part as it will result in continuation and worsening of the unacceptable downward destructive spiral.

Many problems must be solved and those problems can not be addressed or solved by people whose income and position relies upon maintaining or continuing the spiral downwards. In our recent past, some politicians asked if we are better off economically today than we were previously. Is that all we have become – a society where physical commodities are more important than the moral principles associated with maintaining the rights that have been earned by those before us? Is that all we taught our children to believe? Perhaps we are guilty of this false teaching, and perhaps we are reaping the results.

Like I said, I do not know everything. One thing I do know: we can not have what we previously had if we are unwilling to demand that the federal government uphold the requirement that the federal employees, the state governments and employees, and local governments and employees AT ALL LEVELS and IN ALL BRANCHES abide by the US Constitution and recognize the validity of the complaints given in the Declaration of Independence.

If the governments and government employees at all levels will not willfully and of their own accord abide by the US Constitution and recognize the validity of the complaints within the Declaration of Independence, they are as guilty of treason as any other enemy – either foreign or domestic. And, I do not see a difference between the so-called intelligence agencies (which violate our “wiretap laws” or privacy), or the thugs who compromise or way of life by taking bribes or telling us they we can not know what is in a “Bill” without voting to pass it, or the various so-called justice department employees who invoke civil asset forfeiture, or judges who tell police that it is ok to kill, harm, or violate citizens when it is the policeman (or the judge) who has violated everything this country actually is supposed to stand for. I believe those people are guilty of treason against We, the People.

Clearly, the situation has become unacceptable. It will probably get worse and may not ever get better. Perhaps no one is wise enough to know how to fix the problems. Or, perhaps those who could solve the problems or at least move in the direction of solving the problems are in fear of their lives as they would be going directly against an unprincipled bunch of thugs who will (and probably have) killed to maintain their power and position.

I love my country. I regard the Declaration of Independence and the US Constitution as evidence of the maturing of man’s mind that required many, many years to attain the levels necessary for such documents to come into existence. I am saddened that such progression is negated by a bunch of thugs. Perhaps this is the natural expectation given that man, as a whole, is not good by inclination and false spirits abundantly roam loose. Perhaps, but I prefer to think that a Righteous and Holy Lord God in Heaven can straighten our path by raising up and empowering those among us who can and will do what is required. The necessary fixes will not occur any other way.

If the gun was issued in WW2 I gotta ask did it have full auto ability? I had a friend who’s father had one brought back from that war and it had full auto capability which we really enjoyed as teens of the 1960’s.

    • TexasAKM February 4, 2017, 8:44 pm

M1 carbines were/are semi-auto only. They were never a full-auto or select fire weapon.

      • Gordon Webb February 5, 2017, 4:24 am

The M2 carbine , a later model of the M1, was issued in late WW2 and widely used in Korea. It was full auto.

    • Larry Zink July 21, 2017, 9:41 am

M16 carbines is not full auto. The m2 has a selector switch to turn on full auto. We used both WW2 guns I’m Viet nam, another question is how did the gun get to the US. Thousands of these gun are I’m Korea that could have been sold in us to pubic and Obama stopped that. These are collector guns made me.by GM and other companies only for the war time one time the NRA sold them to public for $25.
      .

      • Larry Zink July 21, 2017, 9:43 am

        Sorry I meant M 1 carbine.

      • Steve in Detroit September 11, 2017, 8:32 am

In the late 1970’s M1 Carbines were being sold at a Woolworth’s in Warren MI for $69.99. They are only “Prohibited” in those states that are taking your 2nd Amendment Rights away. Look at “Problem Solvers” post above. It points as to what is wrong, but We have to find solution.

  • Tripwire February 3, 2017, 11:53 am

Each and every one of us has to do as we see fit in almost every thing we do, thus it’s my rule that I never go too or thru a state that has restrictive gun laws, I don’t spend my money there. I do have a problem at times if I’m buying something online that comes from such a state and I will shop around in hopes of finding somebody in a free state to do business with.
I see this like being one of 10,000 archers in an epic battle, I’m only one of 10K but when I shoot my arrow I’m acting as one man so my one man logic seems to hold water in a small way that if I didn’t launch my arrow it would not matter in the long run but if the idea spreads maybe only a few arrows get fired off. So rebel, be one of 10 K and ask your friends to boycott offending states.
I no longer watch Matt Damon’s movies, nor several other leftist hollyweird hacks. Do they care? not at all, but if every gun owner in America stops that’s a lot of lost $$..
BTW, I don’t go to starfucks anymore.
I think we should all stop buying guns made in offending states and tell the mfgr what you’re doing. If Magpul can fight the good fight so can every other gun or gun product producer.
Fight the good fight…with your wallet.

    • stymie222 February 3, 2017, 12:44 pm

      Me TOO !!

    • George Hovey February 3, 2017, 5:10 pm

In Maryland we believe that our legislature should determine who should be allowed to possess or carry certain firearms in our state, and the idea of out of state people overruling our laws makes us quite nervous. So, although we would love to have you visit, please don’t bring a controlled gun.

We understand and appreciate your principled stand.

      • TexasAKM February 4, 2017, 8:47 pm

Would you rather uncontrolled guns? The 2A doesn’t recognize state borders. It is for ALL CITIZENS of the United States.

      • mike ehrig February 24, 2017, 9:31 pm

a shame, i had hoped to visit on my next bike trip east, but i shall pass.

      • DAN BASSPLAYER March 17, 2017, 10:40 am

I will NEVER visit/travel-through fairyland or nude gurnsey or other states that infringe on my Constitutional rights. If you don’t like the Constitution and Bill of Rights (FYI-that contains the 2nd Amendment!) you could either secede or leave the country.

      • Woody Ulmer March 24, 2017, 7:17 am

All of us that live under the oppressive Maryland govt do not believe the govt can or should control who or what weapons we as citizens of the US may posses or own. Our constitutional rights are bestowed upon us by the creator, no politician, man or govt has the authority to override GOD. The 2nd is so we can defend ourselves from an overreaching, tyrannical govt. When the 2nd was written e “militia” (comprised of all free men, not govt troops) was armed with superior firearms than the govt forces had, why is it now we are not even allowed to have semi auto rifles to protect and defend ourselves? The laws we have in Maryland are unconstitutional.

      • Fred June 17, 2017, 7:19 am

Speak for yourself, slave. Free men don’t share your cowardly reasoning.

      • Willie-O September 1, 2017, 3:56 am

Well George, if you support any law (or politician) that restricts the ownership of an M-1 carbine, then my issue is with you. To be blunt, I’m sick and tired of ignorant laws being enacted that don’t accomplish a damn thing. Anyone that thinks banning a specific type of weapon or limiting the capacity of a magazine will have any impact whatsoever on crime is simply delusional. Why ? Because criminals and the mentally ill couldn’t care less what laws are passed – they will not be impacted in any way. Period. All these laws do is further restrict the rights of law abiding citizens. Anyone with even the slightest bit of common sense or intelligence can comprehend this. Even Hi-LIE-ry and Bernie said they wouldn’t come after my shotgun – correct ? I can assure you that the right shotgun, in the right hands, loaded with the right ammunition can be as lethal, deadly and destructive as any assault-rifle. I’m happy to stay right here in the great state of Tennessee and as far away from liberal land as possible.

      • bob September 12, 2017, 12:32 am

and that’s why we who live in states who still don’t infringe on the Second Amendment aren’t worried about cowardly mass shootings because even these crazed shooters know where to number large body counts without any fear of being harmed them self. It’s just ashame there are ones like you who make it easy on these criminals in government. Maybe if you could show me any stat saying any gun law has reduced violent crime or saved lives. If I lead an anti-gun organization and EVERY TIME the organization got one of it’s anti-Constitutional laws passed it saw the raise in murder rates my humanity would reverse my thinking. But if off the top of of the donation I’m pulling $900,000 a year, $5,000 a show, and heartless as Sarah Brady I could sleep at night. For the Brady Center to Prevent Gun Violence. You might want to donate to them. The only thing saving you from that 158 grain, ceramic, hollow core, comin out the end of a pistol cannon, at point blank range, is Sarah. She also wants to save the children. But Sarah is a busy woman and it takes donations. So donate today, donate big, and donate often. Remember to donate! It takes donations to keep her living as she is accustoms.

    • Harry Sr February 3, 2017, 9:01 pm

You just described my thinking to a “T”, that is exactly how I feel and how I conduct my life and my business. As far as New Jersey goes I wouldn’t go near that place again. I was there one time for my mothers funeral, (my stepfather was a native of Toms River, NJ) and they wanted to be buried there. Anyway that was the end of my visits to any part of NJ, what a depressing place. I also have a list of movies certain Hollywood liberals have played in that I will not watch, for example Danny Glovers flicks, after he embraced Hugo over in Venezuela and criticized the USA, so you are not alone I have shot a few arrows from my quiver too, Keep up the good work.

    • Rebellion March 24, 2017, 6:37 am

I couldn’t agree more, and actually find it relatively easy to avoid purchases in anti patriotic states. I departed the communist State of NJ in 2015 for Florida with my collection in tow and never looked back. Obviously, once in Florida some upgrading of the fun stuff was in order.

  • gary February 3, 2017, 11:36 am

If you keep voting them in you keep more of the same, history truly does repeat itself. All judges should have term limits along with all politicians period. No more than two terms ever in any one post. this of course would end the lobbyists getting their hooks in too deep and the poli from getting too well in position for brides etc.

  • Wake_Up_America September 9, 2016, 11:21 am

Stay away from these awful states: NJ, NY, MD, CA, MA,CT and any other “non-free” states. These idiots have gotten so out of control, it is just disgusting. When are we, the people doing to stand up and do something about this b.s. You all know that one day, probably sooner than later, they are going to ban ALL firearms period….It’s not too far away my friends.

    • Bill in Lexington, NC February 6, 2017, 7:19 pm

In order to avoid going trough Chicago on my way from NC to Minneapolis (sons & grandchildren), I skip Illinois altogether.

It adds about 300 scenic miles to the journey, but there is no way I am going to 1) go through Chicago unarmed or b) risk getting caught with a firearm in Chicago.

So I give it a wide berth.

      • Bart March 25, 2017, 5:03 pm

Good call, avoid Illinois altogether. those flippin schifferbrainers want the same politics as the kalifrnicators and east coasters, let them lose tourist dollars.

  • D. Baillie September 30, 2015, 6:44 pm

I was all upset and ready to email every official in the state of New Jerky when I started reading the article, to tell them what a bunch of a–holes they are. Unfortunately, when I got to the end of the article, my disgust for NJ was replaced by disgust for Burt. I’m sure most of you didn’t even catch the line “Burt has had a weapon seized as a result of a domestic violence complaint “.
Now I don’t know the outcome of the complaint (guilty, not guilty), but I for one believe that any bully who abuses a female, is not the kind of person I want to have guns in his posession. I still think that the NJ state officials are a bunch of a–holes.

    • Peggy June 3, 2016, 1:28 pm

@D.Baillie, just getting a domestic violence charge lodged against him isn’t a reason to ban his gun ownership. Some women to get even with a man breaking up with them file charges of domestic violence.

He had a temporary protection order placed against him. It wasn’t found to be valid by the court wasn’t renewed into a permanent one.

      • mike360000 February 3, 2017, 8:05 am

North Carolina does similar, and this is supposedly a gun friendly state.

I knew a man who got into an argument with his wife. He never physically threatened her. Next day she reports the argument as him threatening her and files a complaint.

She tells the magistrate she is afraid. The courts takes his firearms.

She drops the charges, admitting she exaggerated the complaint, but he doesn’t get his firearms back.

In the process he leaves her because of her actions.

I could tell y’all 3 or 4 stories of acquaintances I know where the girlfriends or wives filed false charges against their boyfriend or husband, and the courts fully sided with the women. Not necessarily that firearms or abuse was involed, but rather there was profit to be made.

One of the saddest cases I know a wife had affairs and children outside her marriage, she was caught red handed, and the testing proved the children weren’t his.

He lost his house and family farm, including the farm equipment to her. He was also ordered to sell his firearms. Then he had to make support payments on top of that.

He done the right thing in response though. He eventually quit working anywhere because he could never make anything for himself.

BTW, the ex wife was related to the judge, a cousin. Other judges were sympathetic to her also.

There goes the life of a farmer employee who worked hard trying to make a life. A once productive person forced into becoming a bum. Or driven to it.

Much more to that story, but it shows life belongs to the cheaters and liars, and the decent people pays for it.

        Michael –Deo Vindicabamur

        • Harry Sr February 3, 2017, 9:18 pm

That is the problem with liars and cheats, they don’t have a conscience, it’s like the muslim terrorist, they are OK when it comes to telling a lies, cheating, killing, or any other form of duplicity, including using our system to achieve their goals thereby putting the honest hard working law abiding American at a distinct disadvantage and in harms way. Hope for my children, grandchildren, and great-grandchildren it is not too late for them to salvage this mess they are inheriting.

        • Geo March 10, 2017, 5:26 pm

If something like that happened to me i’d get the hell out of Dodge tell the wife and judges to go f*** themselves and burn the place down so the wife wouldn’t get anything out of it!

          • Fred June 17, 2017, 7:24 am

Well, at least then you wouldn’t have to worry about supporting yourself, what with being in prison for arson and all…. Kinda adds to the argument that you’re too unstable to own guns….

        • DAN BASSPLAYER March 17, 2017, 10:45 am

I used to do child abuse investigations – in 100% of the cases I had assigned to me and there was a divorce in process or pending, the female made fraudulent accusations against the male. The sad thing is that local law enforcement/courts refused to deal with the unfounded accusations every time and ALWAYS awarded the majority of the custody to the female. I am certainly glad to see that there are groups and attorneys addressing this blatant discrimination now.

    • Stargzer June 24, 2016, 10:46 am

I don’t believe that all domestic violence complaints are necessarily true. Since he was never charged or convicted, it’s most likely this was a domestic dispute, not an assault, and the spouse may have over-reacted. However, abuser of not, the big problem for people who aren’t abusers is that NJ considers an historic semi-automatic weapon that was (is still on the few occasions they get any) sold by the CMP, and qualifies as a Curio and Relic Firearm under a Type 03 FFL, to be a so-called “assault weapon.” Now, maybe he had the automatic version, but the Guy’s list only says M1 Carbine, which includes the semi-auto version. Another good reason to avoid NJ altogether, even if I have to drive out of the way through PA to get to MA for a class reunion, or any part of NY. Now if only I could afford to move out of the DPRM (Democratic Peoples Republic of Maryland).

      • jake February 4, 2017, 11:34 am

If it was a selective fire M2 Carbine the control freaks would have had him in federal court where possession of a full auto weapon is 10 years mandatory.
Move far away from any place full of Democrats.

    • Mahatma Muhjesbude July 16, 2016, 7:02 pm

Burt, that’s very noble of you, to care so much about defenseless women and all, and so do I, personally, having handled enough of such incidents in my career, but i don’t think someone like you, who gets so emotionally riled when you don’t even know the detailed facts of the situation, and make such a strong subjectively arbitrary statements about who ‘should’ or who ‘you don’t want’ to have guns, is ‘not the kind of person who should have guns either!

In fact, the slippery Totalitarian slope, which this case is a screaming example of, is working on people with ‘abnormal’ emotional content potential, as you exhibit here, like they are on the above Unconstitutional domestic injunction case…which if you read the article was NOT an actual domestic violence charge or conviction. Just a restraining order. Which is pure, malicious bullshit. Threaten to hose down your bitch neighbor’s dog for shitting in your driveway and she calls the police and says you have guns and she’s afraid of you because she knows you kill things on hunting trips…

And in New York, under their bullshit Safe Act, the cops will do their own temporary restraining orders and come in and confiscate your guns!

Anybody can disarm anybody else now, fyi, without due process with a restraining order. All they have to do is pay an attorney a few hundred bucks to get one on you and the Police State people move into action, come ‘a’knocking, home invade and search and seize all your weapons, large amounts of cash, and anything else they see fit to Seize for ‘public safety’ and future crime prevention!

Hope you see the point here, my friend. And change your mind before they change it for you?

      • mike360000 February 3, 2017, 8:15 am

Mahatma, you make a couple of valid points, but overall you’re post doesn’t cut it. It can be understood that there are exceptions to everything, even when a statement appears to be all inclusive. I always state, adding, No Exceptions when I actually mean everyone. Other exceptions should be understood, even in statements referring to a whole, in general.

Stop being a white knight. Modern western women will use the law (big brother) to punish any man that doesn’t obey her will. For you to quickly jump on the (I believe he is a wife abuser because his wife says so) shows how brainwashed you are. Today abuse can be telling your wife “no”. Continue with your thinking and watch our society continually being overrun with anti-male garbage laws.

    • Rich K. February 3, 2017, 9:24 am

Women will often use a “domestic violence” complaint to get their way or get revenge for some imagined slight. Remember that in today’s era of whinyness and stupidity, “domestic violence” often includes non-verbal types of abuse and can be loosely interpreted. Courts these days are often run by either feminazis, or by castrated liberal “male” judges who have been brainwashed and browbeaten into submission by feminazis. I found out too late, for example, that my (now ex) wife only married me because she wanted children – she was jealous of her two older sisters who already had kids. Once she had the kids she wanted, she lied and claimed I had “emotionally abused her” in order to get the cops to show up and remove me from our home. It eventually came out in court that SHE, in fact, had abused ME. Sadly, the judge still had feminazi leanings and granted her custody of our kids and now I am being raped for child support because, the judge said, “the mother in most cases is generally the more nurturing parent”. Since then she has twice tried to use dirty tricks, including trumped-up child abuse accusations, to remove what custody and parenting time I still have (she was even found to be in contempt of court on one occasion); after the second such attempt at having me charged with child abuse, she was given a very stern talking-to by child protective services (among other things, when CPS interviewed my kids, each of them had a $5 bill in their hands!). My ex has been much more circumspect since then, but I have to walk on eggshells for another 9 years until my youngest graduates from high school, so that my ex doesn’t have a leg to stand on for any accusations. I trust her about as much as I would trust Kim Jong Un if he said “I’ve dismantled all my nukes”.

      Dear; D Baillie,
I do not know what Country you were born in?
Nor how knowledgeable you are on our Constitution/ Bill of Rights.
All Citizens have a presumption of innocence!
All Citizens have a Right to a trial by Jury, or can elect to have a trial by judge!
There are legal procedures the government must follow to just to get to trial these are constitutional protections, that we all are supposed to enjoy!
If Burt’s case had gone to trial, the government has to prove their case beyond a reasonable doubt, that Burt was guilty!…………
The problem is Burt’s case never got to Trial……
Because; the government lacked the evidence to prove he was guilty.
      The Government dropped the case.
Quite frankly the Courts specifically the Supreme Court Of The United States, has dropped the ball on this subject and on our Constitutional Protections, from a Tyrannical Government, In the Commonwealth of New Jersey.
The fact is Burt is innocent of all charges, Burt should be able to sue the Commonwealth of new Jersey for defaming him, he should also have his firearms returned to him.
But the bigger picture is these laws, are Unconstitutional, Look at Burt’s case he is accused, his property is seized,
charges are dropped, but the State still is saying Burt is guilty and refuses to return his property.
These Lower courts side with the government, because many of these judges are what they are Bolshevik’s.
They do not care about Justice nor Burt’s Innocence.
What they care about is politics and what will get there Fat-Ass’s Re-elected in November!

      • mike360000 February 3, 2017, 2:29 pm

    • C. Van Laarhoven February 3, 2017, 12:36 pm

You and any others need to reserve judgment of Mr. Burt. Because:
1.) Just because a complaint was filed doesn’t mean it was justified. During my divorce my ex-wife claimed she was threatened by me when I sent her a bouquet of flowers in a failed attempt to reconcile our marriage.
2.) There should be no linkage between domestic violence (not a felony) and firearm ownership. Firearms are a Constitutional Right.
Understand that women file 85% of divorces in this country and use firearm ownership against men as leverage during the divorce.

    • lurther February 3, 2017, 3:04 pm

I as any Man would not ever beat or mistreat a woman or anyone else for that mater. Having said that , I give an exception, self defense against a physical attack from anyone is a given.. The laws on domestic abuse are way to tight and people are being punished for so call abuse . We absolutely do not need a federal law on such cases.

Any New Jersey resident knows that NJ has onerous gun laws. If one possesses a “controversial” firearm in NJ, one must never let it see the light of day, unless and until he takes up residence in another state. It is also well-known that, if you have a Restraining Order against you or even an ACCUSATION of Domestic Violence, the cops will seize ALL your guns without a court order, and this applies to most ALL states, not just NJ. If it’s likely that any such thing will come your way, you must store your weapons collection ELSEWHERE than at your house, or Forfeit. It sucks, but Reality will be in your face if you do not prepare adequately.

  • Kivaari September 28, 2015, 4:10 pm

Once more NJ shows its hand. Keep in mind that Chris Christie thinks New Jersey gun laws are “about perfect”. Any one thinking of supporting Christie, is out to destroy liberty. Christie needs to pardon everyone convicted and imprisoned for these silly gun crimes. We know he wont. He had a chance a few years ago, when a new resident was arrested and convicted after he tried to register his guns. Christie let him out of prison and left his felony conviction intact. NJ is a premiere example of what is wrong in America – and American politics.

No authoritative definition of an assault weapon or assault rifle includes an M1 Carbine, not by DOD, ATF or any military in the world. An M1 carbine as manufactured is incapable of fulfilling the tasks of an assault weapon. The cartridge used itself is incapable of intended ballistic performance, it is semi-automatic instead of select fire or fully automatic. It is not capable of sustained offensive or suppressive missions for assault forces.
This is simply a matter combining willful ignorance and dishonesty in arbitrarily deciding which firearms the court will allow and which ones it won’t without justification.
In light of the total actions of the court, the firearms returned to the plaintiff I believe this decision violates the Second Amendment and should be rebutted and fought in the courts. I hope the NRA and other gun rights organizations will offer material support to this man who has been victimized by the state of New Jersey.
Lesson #1 from this abuse of individual rights – If you voluntarily live in a state that is widely known for the abuse of individual rights, don’t be surprised when yours are also.
I wouldn’t live in New Jersey for any reason, bar none.

    • guy smalley September 28, 2015, 10:04 pm

Brass I agree with you in that if this is a M1 carbine it is a semi- auto case closed not an assault rifle few were made full auto only but unlikely this is one. I believe the problem here is the Restraining order and the fact that the rifle is a “stolen gun” verified by his father. Since the Prosecutor is being hardline and has his state behind him add to it a domestic flag to the case it is an uphill case. I wouldn’t live in NJ or NY or other states that trample on gun rights. But the father like it or not kept his $48 rifle, Christ he earned it but under the law it was stolen property. At the very least the collection should be return since the RO is now resented and at the very least considering the sentimental valve at least decommission the rifle as the owner didn’t shoot it and give it back. That at the minimum .

  • december September 28, 2015, 12:38 pm

More than likely the arms were either sold already or destroyed and they just needed a way to get away with a pure profit.
Seems to be happening more and more. The governments have nothing really to compensate so they use various laws to just seize without recompense. Sorry, but in many police departments and agencies it has become something of racket.

    • guy smalley September 28, 2015, 9:28 pm

Each Police dept. or State in so cases have a policy in place that all guns after X number of years get destroyed I have seen some really fine guns gone because of this. Now with that said if that is a full auto and they sell it at auction to me that is a conflict of interest as they are profiting. In my experience as a collector they destroy the weapons.

      • Willie-O September 1, 2017, 11:16 am

You know when your state is a bad state when people move out of it in droves, or when you notice that nobody retiring is moving into your state. New Jersey makes the top 2 list on both of these. The state of New Jersey is as socialist as New York, and that other socialist over populated piece of garbage, Calif. How sad that those that swear oaths to protect their residents against this, are the first ones to abuse, and dishonor their oaths to not only God almighty, but the constitution, and the people. • guy smalley September 28, 2015, 11:42 am

As a C&R collector a couple of things are interesting here. They should have researched NJ gun laws the fact is its considered stolen by the Gov and confirmed by the father. In the case of that gun it should have “never existed” from the time it came back from the war. eventually in time it becomes traded in the C&R trade with no way of tracing it.
As far as the restraining order and going through 2 divorces you can’t just get one without documentation of police reports or some actions. Not to say some women can help it along but as gun owners we have to be aware of our actions at all time. If a RO was ever pulled on me for “no reason” I know what would be happening to my collection and I would have an attorney all over that that day. Nobody here knows the whole story and to say the order was trumped up or not is guessing

    • guy smalley September 28, 2015, 12:27 pm

It’s illegal from the stand point of “stolen” from the gov as oppose to german weapons being spoils of war. I don’t agree but NJ is strict. Now few were full auto and that would be a different story and would be subject to NJ’s crazy assault weapon laws. were as here in NC I would have had my dad put it in the will have a form four letter from my sherif pay a 200 tax and good too go

Why are we thinking of ANYONE who has ZERO experience in leading a state of country in the day to day running it’s business much less of their votes on GUN CONTROL. I like some of the candidates but some of them are either anti-2nd Amendment of lack the proper experience in Government. Come on we have had an OJT President for the last 7 years who has failed to lead or listen to the public he is supposed to serve not rule over!!! • Jim September 28, 2015, 10:06 am

I’m a little confused by the courts definition of a M1 as an assault rifle. The M1 is a semi-auto, gas operated magazine fed rifle with a garand style action, it’s a conventional styled rifle with a full stock and an 18″ barrel. Really no different in design to a Ruger Mini-14. Now unless this particular rifle was not actually an M1 but instead a select fire M2 then I don’t see the problem but I’m not completely familiar with NJ laws so I don’t know if a Ruger Mini14 is legal there.
Either way it’s complete bullshit to confiscate his entire collection and remove his 2nd amendment rights over what seems to be a misunderstanding of the laws and misclassification of the rifle.
I would run this past the BATF for a review of the classification of the rifle but if Mini14’s are legal then no reason an M1 isn’t. Also Citadel makes a .22lr rifle design as a look a like for the M1, is that rifle illegal inNJ?

  • Rick P September 28, 2015, 9:52 am

Since I live across the river from NJ I have heard some silly laws, like only Law Enforcement can carry hollow points, which brings me to the point. The NJ law makers who don’t know anything about ballistics should not be able to enact laws regarding firearms, not to mention it being an infringement on the Constitution. NJ judges should not be allowed to rule on cases they do not understand.

  • RS September 28, 2015, 9:40 am

    • SONNY October 5, 2015, 6:05 am

Good point RS. A lot of people don’t know the difference between the M-1 and M-2 Carbines! M-1, of course has no “Full auto” position or even a “selector” for that matter.

    • Danny burt October 13, 2015, 1:16 am

No it was not an m2

  • twolazy September 28, 2015, 9:02 am

I was wondering when this would happen, I had thought perhaps California would be the fist to try this ploy. You see, and if you remember Obama stated that “military weapons have no business on the streets.” I am not surprised that this court has declared an M1 carbine can be defined as one of the evil assault rifles. But then, using Obamas logic and if you know your history of military rifles, you’d know that at any point in the history of military rifles … ALL RIFLES, be they muzzle loaders, trap door, lever actions, bolt actions, semi automatic loaders or fully automatic rifles have been employed by some military, somewhere. Ergo all rifles fit that criteria of being assault rifles at some point in time. Even the lowly Ruger 10/22 could be by that definition, an assault rifle it is after all a semi-auto just like the M1 Carbine and the AR 15.

The restraining order was bogus she tried a month before that and was denied by s judge in Millville the she goes to superior court judge changes her story then goes to court and drops it because her attorney tells her it’s not going to go in her favor The police officer showed up to testify against where she lied and the police report stated that Mrs Burt said that mr Burt almost ran her Toes over and when asked Mrs Burt stated” she didn’t feel as though mr Burt intentionally tried to run her toes over

” … he has done NOTHING to change any of the PRNJ’s crazy gun laws.”

Well, he didn’t make it through the primaries. However, one can only do so much in the face of an overwhelmingly Democratic legislature. The fact that a Republican can be elected is an amazing feat there. Believe me, I know. I live in the neighboring DPRM (Democratic Peoples Republic of Maryland). I paid $103 and change for a Handgun Qualification License (HQL) for the privilege of buying a handgun and STILL have to wait 8 days before I can pick it up. As far as I can tell, even a C&R handgun is subject to DPRM state law.

Looks like things may change in the he good old Free State…

  • Jack Gates September 28, 2015, 6:41 am

Sorry guys, but this elitism isn’t smart. Telling people to move to another state is totally unproductive. It not only solves nothing, it makes you an unwitting ally of the very enemies of freedom you so detest. Why? It’s pretty simple really. If enough states’ totally draconian laws are allowed to stand, it’s only a matter of time before they come to YOUR state. Granted, it may be quite a few years down the road, and by that time they may or may not affect YOU. But they WILL affect your children and grandchildren. In other words, while you may have won the battle where you live for now, the enemy will win the war!
So, instead of writing these people off, we should try and help our fellow patriots who reside in enemy territory. You don’t think that the concealed carry victory in Illinois affects you? I absolutely guarantee that lawmakers in other states, who saw that, immediately dropped any fantasies of introducing anti carry laws in their more pro gun states. “If ILLINOIS had to pass it, then we’re screwed forever in _____ ” (fill in your red state here)
The same goes for these sanctimonious dealers who proudly state “No Sales to Commiefornia” etc. Not legally complicated ones, which no one can blame them, but ANY sale, out of “principle”. Talk about giving comfort and aid to the enemy. I’ve seen the papers and mailing from Violence Policy and other groups where they reprint these ads. They are touted as victories, “we have them on the run”, and “the gun nuts are turning on their own” etc… Anyway, hopefully you get the picture?

So, next time you’re tempted to think or say, “screw’em, let’em move to a free state like mine”, ask yourself, is that REALLY what you want them to do? Or would you rather they were able to enjoy the same freedoms you do? Where their family may also go back generations and there may be incredibly deep roots?

Let’s fight the enemy where he is strongest now, before he is emboldened and brings the fight to us…and then there is no one left to tell US to move.

    • BC September 28, 2015, 10:29 am

    • Jeff September 28, 2015, 11:45 am

Thank you for some common sense amongst those that just do not understand running from the problem is as anti 2nd Amendment as the existing laws in the aforementioned states. I’ve been inactive and uncharacteristically quiet for quite some time on the internet in general as it seems people in for the most part would rather insult each other than to unite over the issue of the 2nd Amendment. (actually on nearly every topic) But this topic and it’s comments struck that nerve.

I find it difficult to comprehend the thought process of the vast majority of so-called pro 2nd Amendment rights people. The fact is we should be taking action as a whole, all gun owners actually uniting, pressuring our/their Representatives, donating money not toward the status quo NRA (if you want to keep your membership, no qualms here) but rather a group like NAGR, or similar group that does not have other agendas and who will not negotiate away our 2nd Amendment Rights, (yes, the NRA has repeatedly caved on 2nd Amendment policy) and we would be the most powerful, influential Pro 2nd Amendment group since Patrick Henry, Alexander Hamilton, Samuel Adams, James Madison, George Mason and Noah Webster. Unfortunately, we have ten’s of thousands of people telling each other what they should do, and doing nothing themselves. It is bad enough to give horrible off-the-cuff advice, like telling people to “move out of states without favorable 2nd Amendment laws” when it is the worse thing a Pro 2nd Amendment believer can do! That would mean the powers-that-be who want these ridiculous interpetations of the 2nd Amendment will have won that battle! STAY AND FIGHT! Be active, at minimum contact your representatives, if possible attend Rallies, start or join a Pro 2nd Amendment type club, donate money to a PRO 2ND AMENDMENT action committee or lobbyist group.

We are also unfortunately one of the worse groups for having people stating others should be doing “something” about the rules, laws, etc. while the extent of their own activities consist of telling others they should be doing something… I read 50 of these types of comments a day, in reply I used to ask them what they personally have done. Naturally the majority fire back what have you done, or more often, a string of profanity… But I tell them what I have done, I write my Representatives here in WI and in Washington (during the threat of background check changes that would have done nothing to curb criminals from using guns I apparently wrote a bit too often, until two of them requested I stop). I donate about 30% of my income to Pro 2nd Amendment lobbyist and political action committees, I attended protests, including at the Minnesota Capitol steps as one of about 25 pro-2nd Amendment people amongst a sea of anti-gun nuts. I am a member of our local Rod and Gun Club, Izaak Walton League, and the U.S. Sportsmen`s Alliance, I participate in a local group who seeks hunting privileges for Youth Hunts from landowners…
Now do I believe everyone should go to my extreme? No, most cannot do as I do. But…. If those people would instead of commenting aimlessly and derogatively, and oft uselessly, would each write or call their Representatives the entire fight for the 2nd Amendment would swing the other way, and law abiding, gun owning citizens would not be the ones worried about losing their guns!
      Anyway….

      • Rick Vezzani April 6, 2018, 1:25 pm

Thanks for saying that. I too believe if everyone of us who believe in the 2nd amendment would just do one constructive thing to help defend it ,things would go our way. It doesn’t have to be a lot but everyone of us needs to do something. I f you can write a comment to posts like these you can write a short letter to your lawmakers.. I wish I could do more financially but I do write letters, emails, etc ,and belong to several strong 2nd amendment supporting groups.
This post hit a nerve as I don’t know what I’d do if someone came for my M1 carbine…I just may have to take no chances and hide it …I wish that were not the case but until we ALL do something about it ,that is reality.

Jack, best thing I’ve seen in years of reading. Think of it like a strategy to war, don’t retreat until it’s on your doorstep, stand and fight them back from ever getting there!!!

Yes it was she tried a month before that in Millville and got denied by the judge there so she changed her story for the superior court judge and the prosecutors won’t go after her for perjury but the will rake me through the Coles

Living in these rabid leftist States is its own punishment. If you become a victim of their good intentions you’ve brought it upon yourself for living there. I’m sorry but I have little sympathy.

    • Stuck in NY September 28, 2015, 8:31 am

You don’t have sympathy? Easy to say if you had the good fortune to find yourself in a free state before you had a career, career associated licenses that are specific to your state, a house, children, grandchildren, etc. You don’t have sympathy? Must be because you don’t respect other people very much.

      • rouge1 September 28, 2015, 1:50 pm

Associated license? Sounds like you were already a government slave. Professional licenses are nothing but a dog leash to control you. Hard to give that crony position in the cast system up for freedom isnt it.

        • Curly September 28, 2015, 9:58 pm

Come on rouge1! What if he is a licensed dietitian, a medical lab tech, or any other occupation that requires specific state licenses? If your chiropractor, or your relative’s speech therapist, physical therapy specialist or etc. was that person? You’ve convicted him of being on a “dog leash”, with a “crony position”. Show some respect man! you don’t know this person, but you attack him vehemently. Show some common decency and don’t insult just to shoot your gun off!

        • bojo September 28, 2015, 10:09 pm

rouge1 You don’t show any respect for the guy you’re talking about. Many technical fields require state licenses to practice their professions. You call him a “dog on a leash”. That’s just an insult, and unfair. I wish folks here would treat each other with some respect and quit tearing at each other. This forum would be more productive and informative if that were the case.

  • Randy September 28, 2015, 4:56 am

I would hedge my bet that the restraining order placed on Burt was hogwash to begin with. An angry ex thinking “I’ll show him!!” It takes no proof to obtain a restraining order. All done in spite.

What Draino said I couldn’t said it better. What is America turning into?

    • Switzerland September 28, 2015, 7:12 am

Draino was wrong to lump in NH.

    • Mick September 28, 2015, 7:22 am

A bunch of PC pansies !

    • Jeff September 28, 2015, 12:15 pm

Seriously? Tuck tail and run? That sounds about as anti-American as it gets. It is easy to flippantly remark about things when they have absolutely no bearing on the commenter. If everyone just packed up and moved when they didn’t like something instead of making a stand with like minded individuals, we wouldn’t have the UNITED STATES of AMERICA. They crazy gun laws get passed after some mentally disturbed person, often a minor and often at school, goes on a murder spree. It is a knee-jerk reaction to a problem we wont solve here today so I wont get into it further, but the passage of these laws is often pushed through under the guise of “protecting the children” which none of these laws do.
What is America turning into? Apparently a bunch of people shooting off their mouths with ill thought out plans and insults on the internet. A country who has probably the highest per capita access to the most vast source of knowledge and information ever conceived, and instead of using it for educating ourselves it is mostly used for porn, shopping, and commenting anonymously so we are rude, thoughtless, cruel and nearly anyone other than the person our family would recognize us as in person. A country whose next generation is most certainly doomed because our children are taught they are not to blame for anything So I don’t know, what do you think this country is turning into?

    • quixdraw September 29, 2015, 12:46 am

Draino’s an idiot–move from where it doesn’t snow to where it does? I spent a cool million for my house and just give it up? idiot again—It’s you whiners that give us Calfornians a hard time, we need help, not some idiots version to bail out of a problem–it’s not the American way to just move away from an obstacle, Not when we can move the obstacle!

  • DRAINO September 24, 2015, 9:41 am

Ill say it again…..GET OUT OF NJ, NY,NH,CT,MA,CA and IL!!!! Just get out!!! Why would you stay in a place that is all about restricting your rights..???…taking your cherished family heirlooms away…??? WHY??? I don’t want to hear because of a job or family or any other excuse……MOVE! If you stay there then you are consenting to all the bologna that is happening there. And as a result, if you are consenting, you have no right to complain….so shut up and take your medicine.

    • steve September 28, 2015, 4:16 am

Draino, Agreed or just own whatever you want and don’t hand it over. Marburry v. Madison makes that pretty clear. My policy, if gov goons want my guns, is to give them the ammo first, one load at a time in rapid succession.

    • John Saunders September 28, 2015, 7:03 am

      Amen!

    • Danny Burt September 28, 2015, 7:11 am

      yes where is christi

      • Kivaari September 28, 2015, 6:13 pm

Christie is not at his desk signing pardons for the victims of NJs former gun owners and current felons. Thousands have been imprisoned on bogus gun charges.

    • Switzerland September 28, 2015, 7:11 am

      NH???
Some of the best gun laws in the US. Please do some research.
Stop lumping north east states in with the likes of MA and CT.
You can open carry in NH with no license. VT and ME have Constitutional carry.
Ignorance amongst gun owners is as bad as any other group.

    • Danny Burt September 28, 2015, 7:12 am

I wish I could I have little children here

    • Danny Burt September 28, 2015, 7:13 am

I cant I have 2 little children here

    • OZ September 28, 2015, 9:13 am

You’re comment is lacking common sense. Who would just pack up and leave over intrusive unconstitutional gun laws? So you’d leave a decent paying job, pull your kids out of a good school, uproot and move to wherever the best gun laws are? I agree with you up to a certain point. If you have nothing to lose, are single no kids and can pack up and leave ,do it. But, you better have a job lined up. I had a buddy of mine do just that and he came back to New England because there weren’t any decent jobs. He is single and the most pro gun guy you’d ever want to meet. It didn’t work out for him he was so sick of our lousy state he quit his job and left. Now he regrets it. He also sold most of his guns to make ends meet.

      • KW September 28, 2015, 10:38 am

OZ: Anyone with common sense would leave a place where mere possession of a scary-looking piece of steel could be a felony.

How good can the job be, when you risk your life and freedom every day for having it?

How good can the schools be, when they are used to bring up generations of children who grow into people who would demand that freedom and property be taken away of unpopular minorities?

Get some perspective. You stand and fight where a battle can be won — places where Fascism has already won are not the places to stand.

      • DaveGinOly September 28, 2015, 4:23 pm

Hundreds of thousands of people did exactly that to get here, over the course of our history, when conditions in their own countries, for one reason or another, including infringements upon basic rights, became intolerable. Why is the thought of simply moving to another state so objectionable? Maybe our forebears were made of sterner stuff.

    • Manny Alonso September 30, 2015, 12:08 am

Right on. I grew up in Northern NJ and harbor fond memories of my years there. However, I moved away when the “assault weapon” law was passed in 1990. I then moved to Connecticut and when they too started getting wacky I finally moved to Houston. Never again!

  • Chris September 23, 2015, 9:51 pm
