Mother Fatally Shoots Five-Time Felon: 'He shouldn’t have brought his a** into my house'

A Marietta, Georgia, woman last week shot and killed a man she says came into her house and threatened her and her children with a gun.

“It was either him or me and I wasn’t going, my kids weren’t going to get hurt and they weren’t going to see me get hurt,” Shaquita Green told Channel 2 Action News.

The incident, which Green initially described to police as a home invasion, took place on August 3 around 2:20 a.m. Investigators later discovered that Green allowed Javarian Mitchell inside her home, who subsequently allowed Keandre Funches to enter as well. Green says she knew Mitchell but did not know Funches.

Both men were looking for another person police have not identified but that Green told Channel 2 was her husband. Police believe Mitchell and Funches were pursuing gang-related activity, but they have not disclosed details, according to the Atlanta Journal-Constitution.

“At some point, Funches threatened the residents with his own hand gun,” said Marietta police Officer Chuck McPhilamy.

Green retreated to the back of her house where she was able to get a handgun of her own. She shot and killed Funches and Mitchell fled, though he was later apprehended.

“I thank God it played out the way it did,” Green said. “I hate that someone had to lose their life, but he shouldn’t have come and brought his ass in my house, excuse my language.”

Jasmine Garry, who has lived across the street from the scene of the shooting for about 20 years, told Channel 2 that the event was “shocking” and that it has made her consider purchasing a firearm of her own.

“It’s very alarming because in this neighborhood, nothing really happens,” Garry said. “We’re all family here because most people here have lived on the street their entire lives, so it’s really shocking, to say the least.”

Officer McPhilamy told the Journal-Constitution that Mitchell was “committing a felony when someone was killed,” and as such can be charged with murder himself. He is also facing charges of aggravated assault with a firearm, false imprisonment, and third degree cruelty to children.

According to a report from the Atlanta Journal-Constitution, Funches was a five-time convicted felon who had only recently been released from prison. His extensive criminal history included gang activity and domestic violence. In one incident on Jan. 16, 2015, he attempted to shoot a police officer, but his gun malfunctioned.

Green told Channel 2 that Funches came to her home looking for her husband, but that neither she nor her husband are acquainted with Funches. McPhilamy confirmed that neither spouse has ties to the alleged gang activity.

Green will not face charges in the shooting.

    I’m proud to say I live in Marietta, this heroine’s town! She did a magnificent job of taking another slug off our streets. Night night to the filth who chose to mess with the wrong lady. Imagine the same thing happening in New Dork, Assachussets or Kalifornia, where she would have been made into the villain for daring to defend herself. But here in Georgia, we are allowed to defend ourselves from such vermin, thereby doling out rightful justice that the criminal “justice” system refuses to. The fact that this animal was on the streets in the first place is a sickening reminder of how the system is skewed toward these beasts, leaving us at their mercy … sometimes 😉

    I commend her for taking the required action to protect her family. Let’s just hope some States Attorney takes a step back, puts him/her self in this woman’s shoes, and consider what THEY would have done if their family was faced with a POS there to harm her and her children.

    Here we have a prime example of many things.
    1. Another failure of our government run so called justice system where a violent 5 time felon was released to commit yet another crime and that same system wants to limit law abiding citizens assess to firearms!
    2. If this woman was white I can guarantee, she would be brought up on some kind of charges and civil suit. She already being in the system doesn’t have anything to lose so the criminal justice system won’t touch her!
    3. This is not Mrs. Greens first involvement with home invaders and a invader was shot!
    4. The police have confiscated the firearm per procedure and both her and her husband were interviewed.
    5. There is a lot of information not here to make any real judgement on, per us readers. One thing for sure, she, weather a criminal or not has the right to defend herself and hers and her children are safe but traumatized because of this event!

    Mrs. Green, I salute you! It’s a shame you had to do this–it’s wrong that a 5 time felon benefited from an extremely lax court/penal system.

    But you rose to the occasion and defended your family. None of the side issues are nearly as important.

    To those of you who keep thinking she is guilty by association; would you feel better if she had been murdered along with her kids at 2 am by these armed psychopaths? You obviously feel she was in the wrong. I dont care if she herself was Adolf Hitler or the leader of the KKK. If someone threatens you and your kids with a gun, then you have every right to use deadly force. Stop with the racial profiling bullcrap. Hood people dont have the right to self defense or what? Even if the victim was the 5 time felon, they should have the right to self defense. You sound like scared cowards. If you own guns you shouldn’t be so damn silly and afraid. Judging the poor woman who had to kill a man in front of her kids on some strange night. If it was you or someone you know, then how would you feel?

    Great job, you did what you have the right to do, that is own a gun regardless if some seem to think you may or maynot have owned it legally. I my book you like all have the right to own a gun without infringement. Next you did what the good Lord would have you do, you defended you and yours. If enough of these thugs were to get killed daily by what they think are easy prey, then this would if published properly put a big dent into home evasions and the thought the little guy is easy prey.     Good outcome = one less scumbag on the streets, permanently. Better outcome would have been if the guy has never been let out in the first place. NOBODY who has 5 felony convictions should EVER be let out in public again, especially if they are for violent crimes or if the felon has a history of violence on top of the felony convictions.

    Was the gun she used legally purchased and owned? Many people are going to want to know that answer as well.
    If it is husband’s gun, and he is a felon as well…then there are other issues.
    Always more than one side to a story…just sayin’…

      I’m sure the police ran an NCIC check on the gun to make sure it was a “clean” weapon. The story doesn’t mention the husband being a felon or other person prohibited under McClure-Vollmer from owning a firearm. If he was, well still, congratulations to Shaquita Green for recognizing not just her right, but her affirmative duty to protect herself and her children from armed violence. When a known gang member has his gun out and is threatening you and your children, it’s no longer “may I shoot this person?” It’s “I must>/i> kill any armed intruder (even if initially invited) threatening me or others.”
      Good shoot, Ms Green. I hope responsible shooters in the community take you under their wing, help you get gun safety training and gear, and if the gun
      was legally problematic, help you get a gun you may legally and safely possess. Good shoot, Ms. Green, and thank you for reducing the street criminal population by one.

    Way to go! She did the absolute right thing in putting that animal down. Progressive thinking says that habitual criminals can be rehabilitated. BS, you can’t REhabilitate that which was never habilitated in the first place. Mad dogs must be put down, not patted on the head and left to kill. Prison isn’t enough for habitual criminals. A cheap bullet to the brain is all they deserve. Call it humane. Call it justice.

        Indeed! You can be scared by an agressive threatening prosecutor. You probably have some financial means and something to lose. You’d be a fresh-faced novelty in the court room– not the slovenly, depraved regulars that pack the hearing rooms every day/week/month/year… Everybody from the judge to the bailiff would spring into action/ top of their game when your case was heard. “Look at the clean white toy we get to play with today!”

    Too bad most of you didn’t read the original report before commenting on this article. The report says she originally called the police and reported someone broke into her home, then forced her and her children into the back of the house where she was able to get a gun and shoot the intruder. Now her story is that she let someone else into home and that person let the armed felon in. This guy was a 5 time felon who tried to shoot at cops, there is no way he would have let her get to a gun and then shoot and kill him. This story should have never been shared by Guns America. This really takes away from the credibility you guys have worked hard for over the years.

          One of Obama’s last acts as a lame duck president was to pardon several hundred drug and gang-related felons in Federal prison for illegally owning guns. He really hasn’t explained the reason for this, given that he’s exceeded his authority to punish gun dealers and owners with clean criminal records.

          This isn’t a racial issue. It’s an issue of an outlaw president using his pen and his phone to put dangerous criminals of the kind who menaced Ms. Green and her kids with guns. They were able to do this despite being felons because of leniency in the court system. I’d be interested in knowing if the man killed threatening a mother and her children was among those Obama pardoned.

    Aimed a gun at a police officer in 2015 and he recently got out of jail? That is way wrong. He should be rotting in jail still, and why he was released is a slam against the system, but in this case there was a happy ending to his story.

Every time these dirtbags commit a crime the tax payers foot ALL of the bills – police, legal fees/attorney, judge, bail, prison, healthcare, etc. A normally law abiding citizen is NOT a threat to society and will not be a repeat offender, so when they make a mistake they get the book thrown at them for petty crimes. Repeat offenders keep the dollars coming! That is also why they want to diarm law abiding citizens, so they have no means to eradicate these scum!

Not only did this idiot force himself into her life by breaking into her house uninvited and threatened her and her kids, but the inconsiderate jerk forced upon her an action that she has to remember the rest of her life.
