NY Senate Dems Introduce 9 ‘Smart’ Gun Control Bills

For the second time in the span of about two weeks, New York state lawmakers have embarrassed me. Yes, as a New Yorker (I live in Western NY, not the Big Apple), it pains me to report that Senate Dems introduced nine new gun control bills. What Senate Democratic Leader Andrea Stewart-Cousins referred to as “smart” gun safety legislation (see video).

Let me be the first to say that there is nothing intelligent about the bills these feckless politicans proposed. In typical New York fashion, these bills chill the 2A rights of law-abiding citizens while doing nothing — nothing at all — to combat violent criminals.

The List

Here’s a list of what was put forth.  Note, the descriptons are not mine but copy from the Dems.

  • Prohibit Bump Stocks and Mods That Increase Rate of Fire: This bill, S.6902, introduced by Senator Brad Hoylman, will make it a Class D Felony to possess a bump stock or similar device. Bump stocks were utilized in the Las Vegas shooting, which dramatically increased the rate of fire and contributed to the high number of casualites.
  • Establish Extreme Risk Protection Orders: This bill, S.7133, introduced by Senator Brian Kavanagh, will allow courts to issue an order that would seize or prohibit the sale of guns to individuals who are likely to act in ways that would result in serious harm to themselves or others.
  • Prohibit Possession of a Firearm by Anyone Who Commits a Hate Crime: This bill, S.7072, introduced by Senator Brian Kavanagh, will add hate crimes to the list of offenses that disqualify offenders from possessing a firearm.
  • Effective Background Checks: This bill, S.5808-A, introduced by Senate Democratic Deputy Leader Michael Gianaris, will establish a ten day waiting period, extending the current three day period, to conduct background checks for individuals attempting to purchase a firearm. This legislation will also require licensed firearm dealers to report the criminal purchase of a weapon and will require background checks for any employees authorized to possess or transfer firearms.
  • Prohibit Undetectable Firearms: This bill, S.5829, introduced by Senator Kevin Parker, will prohibit firearms, rifles, or shotguns that cannot be detected by x-ray, magnetometer or metal detector and make their sale, transport, possession or manufacture a Class D Felony.
  • Create a Firearm Violence Research Institute: This bill, S.4363, introduced by Senator Roxanne Persaud, will create an institute to study the causes and conditions that lead to gun violence and develop methods of prevention.
  • Allow Victims Of Negligent Manufacturers To Seek Compensation: This bill, S.5922, introduced by Senator Jamaal Bailey, will overturn the legal holding that prevents victims and their families from seeking compensation from gun manufacturers found to negligently market firearms to irresponsible buyers.
  • Enact the “Children’s Weapon Accident Prevention Act”: This bill, S.3355, introduced by Senator Liz Krueger, will make it a crime to fail to securely store a weapon to prevent injury and death due to use or handling unintended by the person authorized to possess the weapon.
  • Close the Out Of State Resident Mental Health Record Loophole: This bill, S.7605, introduced by Senator Brian Kavanagh, will close a loophole in state law and allow the state to check the mental health records of an out of state resident when that person applies for a state gun permit.

“We must continue to take bold steps to reduce gun violence throughout New York State by passing sensible gun safety legislation,” Senate Democratic Leader Andrea Stewart-Cousins said.

“It is our responsibility to protect our communities. Enacting this common sense legislation will help save lives by keeping guns out of the hands of dangerous individuals and banning tools to make legal guns more dangerous,” she added.

Typical dog and pony show.  Where a bunch of do-nothing weasels get up on stage to recite the same old B.S. about “protecting communities” and “saving lives” and “sensible” laws and “common sense” and yadda, yadda, yadda.  I’ve heard it so many times before that it’s nauseating.  It really is.

That said, my favorite bill of the bunch is the call to waste taxpayer dollars on a Firearm Violence Research Institute.  WTF?  Like we really need a state-funded agency to tell us who is responsible for the vast majority of gun murders?  I can answer that right now. Violent gangsters and drug dealers (I’m not even being glib, a number of cities have done research on this only to find that a very small percentage of violent offenders were responsible for most of gun violence in their cities. Solution: stop them and you reduce gun violence).  Boom!  There ya go Senate Dems.  I just solved the mystery for you.  Feel free to cut me a check for whatever you were going to drop on that inane thinktank.

    Better yet , let’s just give them all they want. Ban anything that has “gun” in the title: paint, chalk, staple, glue, hair dryer guns etc…. So now we are all safe! Hell, with this new ” bill or law”, we won’t need law enforcement! No more “bad guys with guns”, so no need for “good guys with guns”. Tax dollars saved!! We probably won’t even need politicians ….Now what will they do ?
    If these elected individuals want this for NYC liberal minded democrats, fine, just leave the rest of us law abiding 2A citizens alone.

    I too, as the author live in New York. Luckily, I’m no where near NYC and we have a decent good judge. It just blows my mind that these over paid politicians waste their time and my tax dollars dreaming up more laws to regulate and make me “safer”. I just don’t get it.
    On a second note, other than this web site and a few others, was there a mention of the Utah Good Samaritan that helped out the police officer in need. I suppose there is no such thing as “a good guy with a gun”. Common sense, looks like that can only be found in Webster’s Dictionary. God help us please!

    Hey! Dumbass demonrats… you already have a law that prevents out of state residents from even applying for a permit! Maybe you should read the laws you already have like NY Penal Law 400 which by-the-way, also violates two of your own state’s Civil Rights Laws! http://ypdcrime.com/civil_rights/article4.htm#r40c Article 4 Section 40-C: Discrimination.1. All persons within the jurisdiction of this state shall be entitled to the equal protection of the laws of this state or any subdivision thereof. and, http://ypdcrime.com/civil_rights/article2.htm Article 2 Section 4: Right to keep and bear arms. A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms cannot be infringed. Notice how in the NYS Civil Rights Laws is states CANNOT be infringed. Hmmm… Seems like infringement to me! If you are one of the United States of America you NEED to abide by the Constitution! (period) Or, be hung for treason!

    Yeah, banning bump stocks is really going to do a lot, since we are limited to 10 round magazines anyway. Anyone with more than a 10 round magazine (unless you are a police or peace officer) is already committing a crime… Very stupid law

    A new gun could be in the making that works like a bump-stock internally and is activated by a gun part where the gun operator has his finger off of the trigger. If understood correctly, a automatic gun must have a trigger continuously pressed to be called automatic or a machine gun, correct?

      Realistically yes, but that is not how the statute is framed. An automatic or machine gun is one which allows more than one round to be fired with each press of the trigger. Whether your finger is on the trigger or not is not in the statutory language. So for example, if you could pull and release the trigger but the gun continues to fire or fires one or more additional rounds (which has happened in some malfunctions), you are holding a machine gun.

Man has been killing man since the dawn of time using everything from rocks to nuclear weapons. Eliminating guns will not change the course of human nature, it would not create some utopia where all disputes would get ‘hugged out’. Wake up folks, stop electing these idiots who really only care about getting your vote, not your personal well being or safety.

      Nah, this is the “Let’s copycat the laws in California” gun control act. Bloomie is pushing the variously named “:gun violence restraining order” law, but many of the other proposals have been around for years before him. For example, an “undetectable firearm” law was passed when Glocks first hit the market, and some idiots believed that because they had polymer frames they were invisible. I think there was a Bond movie or something that used an all plastic gun. But what these idiots don’t seem to realize is that all ammunition on the market is metal cased and easily detectable. Laughable, this proposal. California was the first or second state to adopt GVROs some years ago. It has had a ten day waiting period for many years. Bump stocks (and binary triggers) were banned shortly after they were invented. Failing to prevent a child access to a firearm has been a crime for as long as I can remember, which means for more than a decade, with the severity of the crime dependent upon the harm inflicted by the minor. last but not least, California created and funded a gun violence research center at UC Davis last session, a center headed by anti-gun advocate Dr. Garry Wintemute. A reward, I suppose, for all the declarations he signed helping to keep guns out of California cities by upholding the “may issue” concealed carry law under the theory that “more guns = more gun crimes.”

      One of the new ones is the proposed hate crime firearms ban, which is really pushing the envelope, since a hate crime can be a nonviolent act, such as painting racially offensive words on a building or door, posting “White Lives Matter” posters on a college campus, or engaging in certain forms of speech. The other is a state law allowing actions by “victims of gun violence” against manufacturers for their “negligent marketing” of firearms to “irresponsible” people. Aside from the fact that any such law probably is pre-empted by federal law, the idea that a manufacturer will know who is buying its guns when it is not selling them to anyone but wholesalers or directly to FFLs is plain stupid. It really is a back door ban on advertising, which probably wouldn’t hurt the industry all that much if it stopped advertising since most of its advertising is gun reviews. And it is a law that is rife with the potential for abuse. Any attorney who has such a law will be required to sue the =manufacturers to avoid claims of malpractice, even thought it will be a rare case indeed that could even have a chance of succeeding on the facts. This is the same ploy being used by the Sandy Hook School parents int heir lawsuit, notwithstanding that the shooter was neither the buyer nor the owner of the gun. Who reads the ads anyway?

    The others are just plain silly and overly broad but this one is typical of all liberals. Let’s spend more taxpayer money, employ cronies who agree with our stand on an “institute” that will publish “research” which will fortify our anti-2A stance. They never stop and have become so predictable. If I lived in NY I’d be embarrassed by this bunch as well.

      No, the Constitution still rules no matter what legislators want or tend to legislate into law. There are many in this nation of ours that would just love to see the Constitution destroyed permanently. We all must stand our ground even if they want or do make some law that they think could take away our Constitutional rights. Own a gun and know how to use one or acquire some other weapon that is not classified as a gun and know how to effectively use it for your “self defense”.

        That is the way it is SUPPOSED TO WORK, however, with the liberal activist judges, we are being held hostage.
        Since we can not get our case heard by SCOTUS, then lower case law is what we are stuck with ! Lower court rulings have said that NY SAFE law is constitutional, even though it is a in your face, blatant violation of everything that the US constitution stands for !

    Cousins has no idea what she talks about except to regurgitate the anti-Constitution, anti-freedom, and anti-rights agenda shrouded in feigned altruistic concern for the peoples’ safety. Her statement is loaded with liberal code words that mean banning all gun ownership, confiscation, and disarming law-abiding citizens. There is no such thing as gun violence. There are violent crimes committed with a firearm. Guns are not inherently violent.
    Well, my understanding is the Republicans have the majority in the legislature. Bills ought to be DOA somewhere in the process.
