Oregon Lawmakers Start Petition to Repeal New Confiscation Law

A group of Oregon lawmakers launched a petition last week to repeal the state’s new confiscatory gun law.

Signed by Gov. Kate Brown back in August, the bill — known as SB 719 — gives  the government the ability to slap one with an “extreme risk protection order,” which is just a fancy way of saying “You have 24 hours to turn in your guns.”

In an article published in the Herald and News, state Rep. E. Werner Reschke explained the problems with the law.

“SB 719 calls for the forced confiscation of property (guns) by the police with no due process, no conviction of a crime and no accusation of a crime,” he wrote.  “It allows anyone, including strangers off the street, to make assessments and a case before a judge.”

How this all works is that a concerned citizen can ask a judge via the extreme risk protection order process to revoke another individual’s 2A rights.  If the judge agrees with the sworn testimony provided by the concerned citizen, that individual’s guns will be seized by police if he or she refuses to turn them in.

At a later date, the individual can apply to have his or her Second Amendment rights restored.  Though ostensibly it may be well-intentioned, this whole charade opens up a big can of worms.

“It allows judges, with no mental health credentials, to render judgment on another person’s state of mind whom they have never met or spoken to,” Reschke continued.  “Furthermore, it actually forbids judges from considering assessments of the respondent’s mental health by people who actually do have mental health credentials. The law even goes so far to allow a judge to confiscate every firearm in a household because one person in the household has a past DUI conviction.”

Reschke and his friends in the House are now collecting signatures for a petition to put SB 719 on the 2018 Ballot so Oregonians can vote to nix this unconstitutional gun grab.

WHY REPEAL SENATE BILL 719?

  • The law provides NO help whatsoever for a person who has been accused of being suicidal. In fact, an amendment that would have called for some minimal intervention was not even considered.
  • The law provides NO protection for people who are living in the household of a person who has been accused of being a danger to others.
  • The law provides NO guidance for the police who are tasked with confiscating the firearms of the person who has not been accused of or tried for a crime.
  • The law requires the accused only 24 hours to turn over firearms even though in many cases that is not possible. That 24 hour window is clearly a time of extreme danger in the event the respondent actually IS a danger to self or others.
  • The law defines NO provisions for determining how many firearms the respondent has, or how to assure they have all been seized:
  • Worst of all, Governor Kate Brown stalled signing this bill into law which greatly limited the amount of days to gather signatures, thus depriving Oregonians of their constitutional rights.

    Oregon was one of the best states to live in. It was great for 2nd ammendment rights. Now the LIBTARDS keep moving here and turning our conservative state into another California. This governor is not even suppose to be in office. We kicked out our last governor who also should have not been in office, they then put in this idiot to fill in. When election time came around, the Libtards put her in office because no one else was running in their party. The whole state is controlled now by basically one county. Thats just not right. The whole state has to follow one group of morons from one county out of 36 counties. Its so sad that just a few years ago that we had plenty of money for schools, roads, parks etc. Logging, farming, fishing and hunting paid more than the bills were. We had plenty of money to pay for this stuff. It truely was a great state. Now, Oregon has become a giant Welfare pit and everyone is moving here to get in on the feebies who gets all their money from the Feds. We are becoming a socialist state run be anti american Dems. The libs have moved in and are taking away our Oregon/American rights. Even if the good dems want to be “good” they should at least change to the Independent party…. They dont have to be Rep. but at least be American and get as far away as possible from the Progressive part of the Dem. party. They can then vote sensibly. Brown needs to go and take all her minions with her and get out of here so we can get Oregon back to the great state it once was and repeal every single thing she signed.

    The best thing to get rid of in Oregon is idiot governor Kate Brown. Obviously, she does not have the good common sense and fairness to be governor. Why do American citizens elect an idiot like Kate Brown??? People saw the real Deranged Hillary and made a much better choice.

    While the repeal of this onerous law is well intentioned, in reality good luck on obtaining enough signatures from a state population infected with such a large number of leftist ex-California anti-constitutional America-haters.

      So you know, the only liberal infestation in Oregon is in the cities. Outside of Portland, Salem, Eugene and Bend the rest of the state is conservative. So there are plenty of people to sign the petition and getting enough signatures will be easy here in Oregon.

        Problem is most people live in those cities (holes). I live in Spokane, WA. When I first moved here 40 yrs ago it was a conservative smaller city. Now it has grown and a lot of the Seattliyes have moved over for some liberal infestation. Now Spokane is liberal.

    What a boon to all aspiring Oregon Gestapo troops this law is. Thankfully, a lot of our real cops see the danger in it themselves. That aside, it not only lets police confiscate guns, but anything in the house the cops on the scene deem “dangerous”. Kitchen knives, lawn mowers, Malibu Barbie dolls, ANYTHING! And if something gets “lost” on the way to the impound locker, I’m sure they’ll “investigate” thoroughly too. Rather than create a law that allows for Due Process, they went the other way. The disease of liberalism is infecting Oregonians in the cities, which is just a polite name for CalTard refugees, who after mangling their state and seeing themselves potential victims from the very laws they condoned, now come here to ruin it for us as well.
