Win for Gun Owners in California, Governor Signs Confiscation Reform Bill

In California, a family member has the power to petition a judge to impose a “gun violence restraining order” on a relative, which, if granted, triggers law enforcement to confiscate the firearms of the supposedly dangerous individual.

While the intent of the law is ostensibly good, it certainly opens up the door for abuse.  A disgruntled spouse can easily use the law to make life extremely miserable for his/her gun-owning husband/wife.

Until Gov. Jerry Brown signed a reform bill this week that changes the law, a person caught in the crosshairs of a “gun violence restraining order” was forced to either sell off their firearm collection or turn them over to law enforcement.

Assembly Bill 950, championed by Assemblywoman Melissa A. Melendez (R-Lake Elsinore), amends the law to allow the person to transfer his/her firearms to a federally licensed firearms dealer to hold for the duration of a gun violence restraining order.  Once the matter is cleared up and the order expires or is revoked, the person will have no trouble getting back their property.

“Today, we witnessed a rare victory for gun owners across California,” said Melendez. “By allowing a trustworthy alternative for gun owners to maintain possession of their firearms, we are preventing any unjustified gun grab against those who may be unfairly targeted by bogus allegations.”

“I am honored bipartisanship prevailed and my colleagues, the Governor, and I were all able to agree on the importance of protecting the Second Amendment,” Melendez added.

Assembly Bill 950 will take effect January 1, 2016.

    So an individual, or your wife brings accusations against you, and then those accusations are proven false. Now, what legal action is brought against that person ? Nothing ! Your wife, or ex can lie their ass off, but the courts side with them. They should be jailed and you should be able to sue. Not !

      hell someone in a line at the market who has never met or knew you could file a complaint and you lose your rights. that is what socialism is made of. Kalifornexico had a law on the books that added 10 years to a conviction and sentencing of a crime involving a firearm they decided that since it greatly affected one of the progressives’ pet minorities it was deemed unenforceable since the prisons were already overwhelmingly filled with this protected minority.

    I have wondered many times why the people of California keep electing people who are obviously anti-gun and in favor of any law that is gun control that restricts gun ownership. The elected people, such as Pelosi and Feinstein, totally ignore the Second Amendment rights of the people. I have not been to California but I fell the people are either very gullible to the liberal political lies or the people are foolishly following the opinions of Pelosi, Feinstein, etc. It seems the majority of people in California live in a mental dreamland and are not in touch with reality.

      At least most Californians can spell correctly. And, for your information–we do have governor moonbeam but we didn’t create the Clinton’s or Trump–you did! I really can’t believe these naysayers who spout out about our problems but create major ones for the country, then stick their head in the sand, and say it’s not that big of a deal. How many of you mid-westerners voted for Obama? Clinton? And now we gonna get shafted by one of these two idiots? the governor of Kentucky said on national TV that if Clinton gets elected there will be civil war in two years? At least if Trump gets elected, there will be no housing shortage, crowded classrooms will be a thing of the past, 50% of the gangs will be removed from our borders, welfare, food stamps, major unemployment will slowly go to low levels–our health care will stablize and we could get out of foreign countries that snub their noses at us; I mean, why arfe we paying these people for nothing while we starve our own people?

        Perhaps you might use spell-check yourself before slagging others about it. “Clinton’s” (possessive form) should be “Clintons” (plural form), “arfe” should be “are”, and “gonna” should be “going to.”

        Your grammar and syntax leaves something to be desired as well. “And now we gonna…” fails on multiple fronts.

          The discussion is about gun laws and abuses, not spelling, grammar, etc. The most uneducated have the right to express themselves and sometimes have more sense than the highly educated. Over 50% of morons like you could not survive a week off the grid. Cal/Berkley, Harvard, Yale full of socialist dumbasses.

      The non-gun owners out-way the gun owners. Its the same in new York state. People are lead to believe the gun control will reduce crime. Lets look at the war on drugs, with all the laws drug use should be not exist. Laws are there for the honest people.

      I’ll reply to this old post, with my take from 50 years of living in the People’s republic. The answer is gerrymandering. And the peculiar way the California senate vote is rigged (and i do mean rigged). This is why corrupt old grifters like Feinstein get re-elected over and over again. The appearance on the ballot is that of a choice, when it really isn’t – Feinstein could still win back her seat in the Senate with one vote, even if it were her own.

        ben I agree with you 110%. if conservatives ever get equality in the peoples republic the first thing to do is redraw the voting districts in a squared off grid and that will end the voter registration as a basis for gerrymandering. it is not just the liberal/progressive/socialists doing this. the repubs do the same thing. a squared grid MUST be used and all gerrymandering made illegal.

    As a native of the People’s Republik of California I am tired of all the gun laws all aimed at eventual confiscation. My question is: How much will it cost us to “transfer” to an FFL and back again? It won’t be free, and some charge up to $100 per firearm. I know if this happens to me, I will be hauling my guns to my brother for safekeeping, as being a CA native, I know what dealing with CA authorities is like, and no thank you!

    It is one small victory here in Kaliifornia. Today there are at least SEVEN more anti-gun bills being voted on by the legislature in Sacramento. Two of them have been previously vetoed by Gov. Moonbeam. The other four are hijacked bills that had nothing whatsoever to do with guns when they were originally written. One of them, if passed will use taxpayer money to fund the UC’s study of gun violence, which, theoretically could be used in the future to ban ALL now legal semi-automatic weapons. The battle is far from over, komrades.

    So if there is known to be “bogus allegations”, why wasn’t a penalty for making a false allegation included? Still, startling to see any PDRC Senator do anything for the gun owners.
