7 Ways Biden Can Circumvent Congress to Attack 2A Rights as President

Tip of the hat to The Trace, the self-described “independent” publication financed almost exclusively by failed 2020 presidential candidate Michael Bloomberg, for doing the legwork.

This week, it laid out 7 ways President-elect Joe Biden can go at it alone on gun control, meaning ways he put the squeeze on the Second Amendment rights of law-abiding citizens without Congress.  

Gun owners should recognize now that regardless of what happens in the run-off elections in Georgia, all of what’s about to be said isn’t just likely, but imminent if Biden is sworn into office on Jan. 20, 2021.  

This is what the next four years will look like. Warning: it isn’t pretty.

Bullet points and excerpts from The Trace’s article:

1. Implementing an “all-of-government” approach to gun violence reduction

On Day One, Biden could sign an executive order creating an interagency task force on gun violence prevention. Such a task force could bring together the White House, the Department of Justice, the Department of Health and Human Services, and any federal agency that touches gun violence with the goal of coordinating the national response.

2. Reinvigorating the Bureau of Alcohol, Tobacco, Firearms, and Explosives

Biden’s platform does not stop with new, more focused leadership. He has said he will direct his attorney general to deliver within the first 100 days a set of recommendations for restructuring the ATF and related Justice Department agencies to most effectively enforce gun laws, including by increasing the frequency of inspections on ATF-licensed gun dealers.

3. An overhaul of how the ATF classifies National Firearm Act weapons

The National Firearms Act subjects certain types of weapons and accessories — machine guns, short-barreled shotguns and rifles, and silencers — to heightened regulation. The ATF determines exactly which models, components and accessories should qualifies. Under new leadership, the agency could review its previous determinations and reclassify firearms and components teetering on the line of being considered an NFA weapon.

4. Data collection and research

In order to truly understand the workings of America’s gun violence problem, you need data, but there’s not much high-quality data available. There’s currently a two-year lag on data from the Centers for Disease Control and Prevention on gun deaths, no reliable data on the number of nonfatal gunshot injuries that happen every year, and no up-to-date, reliable nationwide database of crime statistics. The Biden administration could direct agencies to more efficiently collect and publish data, and prioritize data related to gun violence.

5. Cracking down on untraceable “ghost guns”

While it might be difficult to ban or prohibit ghost guns through executive action alone, there are proposals on how the ATF could use its rulemaking authority to regulate the parts needed to assemble homemade weapons. One, from Everytown for Gun Safety, would see the ATF requiring the manufacturers of ghost gun parts to stamp them with serial numbers, and subject buyers to background checks.

6. Banning the importation of assault weapons

While banning the manufacture and sale of assault weapons would require legislative action, the executive has significant authority — and, in fact, a legal obligation — to regulate the importation of firearms from abroad under the Gun Control Act of 1968. Biden could use that authority to restrict the importation of assault weapons.

7. Enact universal background checks

There are also some modest laws that could have a chance even if the upper chamber has a Republican majority.

In 2019, an expanded background check bill sponsored by Republican Senator Pat Toomey of Pennsylvania and Democratic Senator Joe Manchin of West Virginia nearly made its way out of Congress and to the desk of President Trump, who signaled he would sign the bill. That is, until the negotiations process stalled amid Trump’s impeachment. With a Biden administration more focused on expanding background checks, the Manchin-Toomey proposal — or something similar — could be signed into law.

Okay, so the first six are actions Biden could take unilaterally.  The last is one that he would actually need Congress’ cooperation.  

Regardless though, and as mentioned, gun owners should assume that this agenda WILL be implemented if Biden takes the White House.

    The SCOTUS ruled in 2008 that EVERY INDIVIDUAL American has the right to possess and BEAR a firearm for protection, so that removes the ‘well regulated militia’ argument…and the TYPE of weapon wasn’t indicated in the ruling, so that removes the ‘musket’ argument. More Americans are killed with knives than every type of gun, combined. A bar of soap in a sock is an ‘assault weapon’, if you’re intending on assaulting someone. Joe can ‘EO-EO-EO’ all day long, and all he’s going to accomplish is calling the donkeys home.

    The Second Amendment (wink)

    In some 229 years neither law professors, academic scholars, teachers, students or congressional legislators after much debate have not been able to satisfactorily explain or demonstrate the Framers intended purpose of the Constitutions Second Amendment. For over 10 years I had taken up that challenge and this should finalize it. Other versions available in any public washroom wall.

    I will relate further by demonstration, the intent of the Framers, my understanding using the associated wording to explain. The Second Amendment states, “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”

    Merriam Webster. “Militia, a body of citizens organized for military service; a whole body of able-bodied citizens declared by law as being subject to call to military service.”

    If, as some may argue, the Second Amendment’s “militia” meaning is that every person has a right to keep and bear arms, the only way to describe ones right as a private individual is not as a “militia” but as a “person.” (The individual personality of a human being: self)

    The Article of Confederation lists eleven (11) references to
    “person/s.” The Constitution lists “person” or “persons” 49 times to explicitly describe, clarify and mandate a constitutional legal standing as to a “person” his or her constitutional duty and rights, what he or she can do or not do.

    Whereas, in the Second Amendment any reference to “person” is not to be found. Was there a reason? Which leaves the obvious question, why did the Framers use the noun “person/s” as liberally as they did throughout the Constitution 49 times and not apply this understanding to explicitly convey the same legal standard in defining an individual “persons” right to bear arms as a person?

    In the entire U.S. Constitution “militia” is mentioned 5 times. In these references there is no mention of “person” or “persons.” One reference to “people” in the Second Amendment. People, meaning not a person but persons in describing militia.

    Now comes the word “shall” mentioned in the Constitution 100 times. Merriam Webster, SHALL; ought to, must ..will have to; MUST; will be able to; used in laws; regulates or directives to express what is inevitable or seems likely to happen in the near future.

    And interestingly, the word “shall” appears in the Second Amendment. “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, and shall not be infringed.”

    “[S]hall not be infringed.” Adding another word “infringed” to clarify any misunderstanding as to the intent of the Second Amendment. Merriam Webster. Infringe. To encroach upon in a way that violates law or the rights of another; defeat, frustrate, encroach.

    The condition “Infringe” has put a stop as to what your thoughts are regarding the Second Amendment, as you cannot infringe or encroach your beliefs as to what is evident as to the subject “Militia.”

    Finally, clarifying “..the right of the people to keep and bear arms…
    Merriam Webster. People. Human beings making up a group or assembly or linked by common interest. 2. human beings, persons.

    You see, words do have meaning and consequences, take for instance, Merriam Webster: WALK.. 3a: “to pursue a course of action or way of life: conduct one self: BEHAVE, b: to be or act in association.”

    In closing, I am not against guns, everybody has them. I’m against using the Second Amendment illogically as a crutch. If it makes those feel better so be it. Just use it with a wink.

    Fortunately none of the above is allowed per the 2nd amendment. We can throw the current fed nonsense into the nearest garbage cans. If only we had a people in this country that could find a way to be better than excuse-making, drama queen weaklings. Also Article 1, Section 8 limits what powers the feds have in the states and it mentions NOTHING about gun control. Time to commence physical enforcement people.

    We have a 2nd Amendment that the framers, forefathers of OUR nation put plenty of thought into in advance of tyranny. You will hear anti-American leftists talk about “guns and hunters” trying to get We The People to take OUR eyes off of the ball and concentrate on shooting squirrels. True, we can shoot squirrels and deer and food sources, but that is not and never was the intent of OUR 2nd Amendment. The specific intent of OUR 2nd Amendment is and always has been about OUR self preservation, freedom, OUR nation. OUR 2nd Amendment was penned with hunting in mind, that part is correct but the hunting that was intended were the two legged animals known as tyrants, foreign and ESPECIALLY domestic, male AND female, no matter who they or what their positions are. OUR 2nd Amendment merely protects and affirms that God given right.

    The illegitimate Kamaliar Harris and her Trojan Horse ride into OUR white house, Banana Republic Joe Biden can say or attempt to do whatever they wish, but I’m old enough to know that We The People have a 2nd Amendment and it’s intent. Each of us will die one day, there is no way around or avoiding that so if push comes to shove when our day comes we take at least five tyrants with us and make that their day as well. Corner a dog and keep beating and jabbing it and expect to be bitten or worse. Each of us WILL die one day. Do it while on our backs cowering and being beaten? Or do it while biting a tyrant’s face and head off?

    Suggest,you all read the 2nd and the 14 amendment. Part of the 14th says the,right to free enterprise which means,the feds,DON,T have the right on how to spend your money. That includes guns,and ammo. If Obama couldn,t stop,guns and Clinton didn,t do more,than a,assault weapons ban that morphed into 992R you people,really think That idiot Biden will do something other than start a 2nd civil war,He won,than do shit.

    We need strategic lawsuits designed to get to the SCOTUS. They need to address and confirm every American’s right to keep and bear arms suitable for use in a militia (i.e. military weapons). The decisions will apply to every state, even the PRC (People’s Republic of California). It should put in place an FFL system that ensures criminals and mental patients cannot touch a firearm or a cartridge, but everyone else can easily be verified at time of sale and the record of the sale erased. Concealed Carry should be a Federal program requiring hand gun qualification and regular requalification. Gun storage should be regulated so children cannot get their hands on a loaded firearm. If you ever use a firearm to commit a crime, we toss you in prison and throw away the key. Suicide by firearm will void all life insurance, social security benefits and have a $1million fine which will wipe out any money going to heirs… require a public shooting range for every 200 sq miles… (OK now I’m getting greedy)… Essentially make the 2nd Amendment THE gun law get rid of the rest.

      Other than your suicide criteria I can agree. No one can regulate nor should they regulate the means of a death not to mention that opens a whole other can of worms and rabbit hole to get lost in. If someone chooses to take thier own life they are free to do so. As for insurance they paid for it so it should be paid. As for heirs benefitting from the death of a loved one or being fined 1 million dollars. Why should they not inherit their right, and why should they be punished for a lived one that has given up on life for a multitude of reasons?

The primary reason the second amendment was added to the constitution is to protect the people from a tyrannical federal government. By that definition all law abiding civilians should be able to own anything the federal government owns provided they can afford it.

      You know what you are right. I live out here in California where all our gun laws totally make sense.
      I mean, I doubt they will use Cal as a model. But if they do it will be fine. To list a few things; we can still buy and possess ARs. We have a huge list of like 30 handguns the gov let’s us buy. And those are really easy to purchase too. We can still get regular magazines and are allowed to own them. Ammo is really easy to get and there is no background check that declines law abiding people. We can order ammo online. It’s possible to get a ccw permit in most counties. There isn’t a ten day waiting period to pick up a gun you bought.

      So yeah don’t worry at all guys. Wink wink.

      Except there are still other’s (such as AKM’s) that ARE imported – the ban you speak of target specific countries (such as China and Russia) but excluded others – Poland , Romania etc…they still import “assault” weapons from those countries, they just have to meet a criteria and have X amount of “US” made parts installed after import.

    What has to happen is that law enforcement on every level need to realize that their first duty is to the Constitution and not to idiot law makers that opt to try and take our rights away. They are affected by the same insane laws as much as the rest of us and if they understand that, then they must be our first line of defense against anarchy. If they defy orders that oppose the Constitution, then we are one. It’s imperative that we all be on the same side.

      Good luck with that – 1) A large number of LEO’s (typically, but not always, the further up the ranks you get) don’t think “regular” people should own firearms,

      2) LEO’s tend to be exempt from any number of the insane restrictions/laws the rest of the population are expected to follow.

      3) Even when they aren’t actually “exempt” other LEO’s and prosecuting attorney’s/judges tend to look the other way when they break the law.

    There’s a lot of things they can & likely will do, just gonna go point by point here.

    1 – Yawn – more of our $$ wasted doing research and reports where the numbers don’t actually mean anything. Trump already has this – hasn’t he sent officers from various agencies to ChiRaq (and other places) to battle gun violence? What is a “national response to gun violence”. This is just “smoke & mirrors”.

    2 – They’re already “re-invigorated”. “Increasing frequency of FFL dealers inspections”? Just creating more jobs, for more bureaucrats. FFL’s are inspected for COMPLIANCE. One of the reasons I got rid of mine after a year – the paperwork was a PITA since I had to hold an FFL-I to do gunsmith work (and it was more of a hobby than something I made a living at) and it just wasn’t worth the time $$ and effort. Honestly – GUN LAWS SHOULD ENFORCED AGAINST PEOPLE THAT VIOLATE THEM. OTOH – the ATF giving that Chicago “straw buyer” a pass a few years ago (like PROBATION), wasn’t proper enforcement of criminal activity. Any FFL that isn’t FOLLOWING THE LAW – deserves to have his ticket pulled. Every FFL I know – is VERY CAREFUL TO FOLLOW THE RULES. Most who break them, do so by lack of attention to detail, and NOT CRIMINAL INTENT.

    3 – This is THE SCARIEST ONE – THE SCARIEST ONE (yeah, I repeated that). The ATF classifies by OPINION. You make a firearm (oh, say, the Q HONEY BADGER PISTOL), and you send it into ATF Technical Division, where they “render an opinion” as to what category the firearm falls into under the GCA. Problem is – OPINIONS ARE NOT WRITTEN IN STONE – and can change with the DIRECTION OF THE POLITICAL WINDS.

    I firmly believe that the Honey Badger thing was a “test balloon” – to gauge the reaction of the industry & us. This is different from the whole “bump-stock debacle”. Which I still think was WRONG – and the current Texas case may back this up. But it was demonstrative of how something can be “legal” (by OPINION) one day, then be ILLEGAL the next. I would think the FIRST THING that a Harris administration would do – would be to BAN BRACES (since they are also, legal, SOLEY BY OPINION). Not a huge deal for those of us with removable ones (keep them in a separate location from the firearm, otherwise, you will still be in possession of an SBR – even if it is not installed) – for people with integral ones, it becomes more of an issue. Then again – the “braced pistol thing”, becomes a matter of ENFORCEMENT. I have 4 firearms that would be “suddenly illegal” WHEN (not IF) they go after the braces.

    4 – Yawn – see #1. Though it would be nice to DEBUNK the bogus #’s they use – in comparison to other weapons. But they will skew the numbers to their benefit anyways – so – creation of more bureaucracy – waste more $$ – with little benefit to THE AMERICAN PEOPLE WHO PAY FOR IT.

    5 – This has probably been in the pipeline for awhile. The statistics of (so-called) “ghost guns” that have been used in gun crimes if NEGLIGIBLE. Most people LACK THE SKILLS to complete and 80% lower (that will actually WORK), and those of us that do – don’t get them because they are “untraceable” – because MOST GUNS ARE – ESPECIALLY HOMEBUILDS. ATF having the serial of my AR LOWER – doesn’t give them the ability to TRACE THE BALLISTICS OF THE BARREL if one of my builds was used in a crime. I have 80% lowers for “emergency purposes” – in case the SHTF with a commie government that has already grabbed my guns (we’ll do the “cold dead hands” thing, somewhere else). The “untraceable gun” is a MYTH – built up to look like there are MILLIONS OF GUNS THEY CAN NEVER FIND. But it’s really just the “boogeyman under the bed”. Much ado about nothing – though – when they come for the REGULAR GUNS – being able to complete an 80% build may be all we have left to work with.

    6 – This is really fugged up – and they WILL USE THIS ABILITY TO BAN IMPORTATION OF PRETTY MUCH EVERY IMPORTED FIREAM – not just rifles. OTOH – there are enough FULLY US MANUFACTURED FIREARMS (clones) of our FAVORITE GUNS (US Manufactured AK’s for example) that this, while a PITA for those of use that like certain manufacturers (I LOVE MY IWI GUNS – HAVE ONE OF EACH) – most of the “more popular platforms” could certainly “tool up” to be 100% US (and not 920R) firearms. So if you had something from “overseas” on your Christmas list – BUY IT NOW – because this (along with #3) are two of the things THEY CAN DO WTH THE STROKE OF A PEN – and ZERO oversight, 100% legal and likely will NOT SURVIVE A COURT CHALLENGE BY US TO OVERTURN.

    7 – Don’t we like HAVE UNIVERSAL BG CHECKS ALREADY? I personally, have only sold guns to PEOPLE I KNOW – that I KNOW FOR A FACT ARE NOT PROHIBITED PERSONS. People I don’t know – have held VALID CARRY PERMITS in my state – so essentially – THEY ARE ALREADY CHECKED. Where this comes into play – is the “supposed gun show loophole”. We have a big gun show down here, has been going on for decades – different location every week. Years ago (when it was much smaller in scope) ANYONE could rent a table and sell their guns. After Sandy Hook – the only people who could have a table – were LICENSED FFL DEALERS. This didn’t sop people from walking around with their own firearms to sell – usually folks that wanted to get rid of something they had, to use the $$ to buy something new.

    I am pretty sure – EVERY SINGLE PERSON HERE – would not want to (or knowingly) sell one of their guns to someone that wasn’t allowed to have it. From both a MORAL AND LEGAL PERSPECTIVE. Yet – THE LAW doesn’t permit US TO DO A BG CHECK ON A PERSONAL SALE. They do this in CO and other places already – where personal sales MUST be done at an FFL and a 4473 must be filled out – where FFL’s charge a FEE to do the transfer (versus a simple $5 BG check fee).

    I would have NO PROBLEM walking up to a BG Check Table at a gun show – and making sure that I was not putting a firearm I was trying to sell – into the hands of someone WHO WAS NOT ALLOWED TO HAVE ONE (a CRIMINAL). Close the (supposed) “gun show loophole” this way. Make the NICA system PUBLICLY ACCESSIBLE (not criminal records, but a yea/nay on a sale), and I would be MORE THAN HAPPY to use it. Then again – I don’t sell guns TO PEOPLE I DON’T KNOW (though I’m thinking of vastly trimming down my collection soon).

    8 – I’m going to add this – because it seems like NO ONE HAD CONSIDERED THE MOST HORRIBLE THING THEY CAN DO – REGISTRATION OF FIREARMS ALREADY OWNED.

    This can be done with an ATF RULE CHANGE. We already know that, even though NICA BG checks are supposed to have the record destroyed (with a non-identifying data used for “statistical purposes) – but does ANYONE ACTUALLY TRUST THE FBI TO DO THIS? ANYONE? BUELLER? The FBI has the name, bio data and weapon type of every check run through NICA since it’s adoption. Lists baby – lists. They may not know WHAT YOU HAVE – but they can run your name and see HOW MANY YOU’VE BOUGHT.

    Everyone who picks up a gun at an FFL – fills out a Form 4473. FFL’s are required to keep these for TWENTY YEARS. They are SUBJECT TO INSPECTION by the FFL (see #2), or to look for a SPECIFIC RECORD in tracing a gun. Dealers that go out of business (or lose their FFL’s) are REQUIRED to send every 4473 to the ATF when they close. If you DO NOT THINK THE ATF enters these 4473’s into a database, then you actually believe that HUNTER BIDEN HAS THE BACKGROUND TO BE ON THE BOARD OF AN ENERGY COMPANY.

    A simple rule change by EO (or even just a rule change) could require all FFL’s to send copies of their historical 4473’s to the ATF – as well as ALL FUTURE ONES. This essentially would mean AUTOMATIC REGISTRATION OF ALL LEGALLY PURCHASED FIREARMS.

    If you happen to live in a state that REQUIRES REGISTRATION – you’re already “got”. I don’t. But even IF you already sold a gun that was purchased on a 4473 – a database of owners, gives “them” a great starting point of doors to start knocking on, if this escalates to CONFISCATION.

    Pretty much EVERYONE WHO HOLDS A CARRY PERMIT – can be assumed to have AT LEAST ONE FIREARM – cross-referencing them with NICA – puts a face and inventory to the citizen.

    We have an INCREDIBLY BUMPY ROAD AHEAD OF US, THEY WILL STEAL THE TWO SEATS IN GA – COUNT ON IT. The brazen manner in which they held this election is proof enough for me. They aren’t even trying to be coy about it anymore. The threat of street violence if Trump flips this to a win, has many officials cowed – the threat to family, jobs, etc. – has many other people forfeiting their personal integrity to go along. Not EVERYONE who has turned hates Trump. They do however, like not having BLM/BlackBloc protesters in their front yards. They like knowing their kids can go to school without being bullied or worse. They like knowing they will have a job, without their employers being pressured to get rid of them for standing up for WHAT’S RIGHT.

    If they get the WH and both houses – they will RAM SO MUCH DESTRUCTIVE STUFF THROUGH BEFORE THE MID-TERMS, the DAMAGE WILL BE TOO GREAT TO BE UNDONE – even if we flip both houses in ’22. But by ’22 – they will have the election systems SO RIGGED – that it won’t even be worth the time to vote ANYWAY. Many people I’ve spoken to – aren’t going to bother voting any more, because this election has proven to them that THEIR VOTE IS MEANINGLESS.

    And while I admire folks who “voted their conscience” – there was a BIGGER PICTURE TO CONSIDER – then voting libertarian – where THOSE VOTES (on an even playing field) MADE THE DIFFERENCE IN MANY STATES. So THANKS GUYS – elections HAVE CONSEQUENCES – I hope YOU ENJOY YOURS.

    Hate Trump ALL YOU WANT – EVERYONE WHO DIDN’T VOTE FOR HIM (election fraud aside) VOTED FOR EVERYTHING THE LEFT IS GOING TO DO TO US AND THIS REPUBLIC.

      I compliment you, you obviously put a lot of thought into this posting. I absolutely agree with your last two paragraphs that if you didn’t vote for Trump, YOU have become part of the problem. It seems like too many of the postings now must be made by Dems and trolls because of the most absolute ridiculous things that are said. Whether it’s Biden or Harris , gun ownership is going to drastically change for the worse for many years to come. At this point, we should be thanking the heck for Trumps SCOTUS picks. That may be our best 2A defense for years to come.

        Thanks – I typically do try to be specific and accurate. Unlike lefties who just believe everything that’s fed to them by the MSM.

        Many of us are old enough to still have been taught critical thinking and research skills. Those of us who have been gun world long enough – are aware that Gun Control is NOT ABOUT PUBLIC SAFETY. If it was – they would be TEACHING GUN SAFETY – not trying to take guns away from law-abiding/safe-handling citizens.

        The left has ALWAYS tried to disarm the law abiding population, so they could run roughshod over the rights of them. This dates back to reconstruction – where the democrats tried to keep the black population from arming themselves. While they have flipped the script – EVERYONE NEEDS TO REMEMBER – THE REAL RACISTS ARE THE DEMOCRATS. Always have been – always will be.

        What the left plans to force on everyone, through open borders, green new deal crap, funding trillions of policies for which the only choice is to either borrow, or destroy the US dollar by currency devaluation (printing more $$, with no GDP or assets to back it up).

        We are witnessing the slow motion death of the republic. SCOTUS and the R held states will prevent constitutional amendments (like the repeal of 2A, or the elimination of the Electoral College system of choosing a president) from happening, for now, until they can cheat their way into flipping those states. Through the mass migration of liberals from places like the NE – West Coast, into places like TX, FL, GA and the rest of the red states – we are going to see them flipped in another two election cycles (if even that long).

        We will likely see a rebound of both houses in the mid-term. Not sure, even if he runs again in ’24 – that I want to see DJT try again. It’s not that HE IS DIVISIVE – but he makes TOO GOOD OF A TARGET FOR THE LEFT TO USE TO DIVIDE (no one was as race/class/nationalist divisive as BHO). We need to start NOW TO CULTIVATE A VIABLE TICKET FOR ’24. And the PARTY NEEDS TO COME TO AN AGREEMENT EARLY ON – NOT TO RUN A DOZEN PEOPLE – so the ticket can be CONSOLIDATED EARLY to present a united front against the left.

        Never in my lifetime – did I ever dream that we would be in the shape we’re in. Whether by plan or coincidence – the politicization of the WuFlu made ALL OF THIS POSSIBLE. With a Biden admin – China will take Taiwan in the next couple of years – and continue to consolidate its power in the WestPac/China Sea. With Biden and Co benefitting in millions (if not billions) as well as overt/covert support.

        WE ARE SCREWED. I hope DJT really does flip this. Cities will BURN? NOT OUR CITIES – we’ll put a stop to THAT CRAP BEFORE THE NG CAN EVEN ARRIVE. And the “blue cities”? While I pity the family I have that live there – tough titty on them.

    Once again for those in the 2nd amendment community who pretend that they are actually pro-2nd. There are 27 words in the 2nd, not just the last 14.
    Imagine the amount of disrespect you would have to have for the Founders of this nation who risked everything, some did lose it all, by clinging to the individual right theory and ignoring the first 13 words and the reasons why the Framers placed them not only in the Bill of Rights, but also the original Constitution.
    Imagine that the political genius’ who wrote the Declaration, and then the Constitution wherein all power derives from the people, left the authority of the people blank.
    Words on parchment are just that. They mean nothing if there is no means to enforce them by “We the People” for whom the documents were written.

      The first 13 words of the 2nd Amendment point out the need for a “Militia” (to protect a Free State). They also point out the necessity to “Regulate” the Militias. Our Founders were concerned that such a Militias could be used by Governments against the very people they were formed to protect. Given the historic propensity of Governments to turn against their own people, these Governments could not be trusted to “Regulate” the Militias. The last 14 words solve this problem by giving “The People the Right to Bear Arms”. In doing so, the “People” are given the capability to “Regulate” a rogue Militia. So indeed, the last 14 word were intended to stand alone. The first 13 words were included to provide the justification.

        The word “regulate” at the time of the writing of the 2A simply means “to make regular”, i.e. everyone is using the same caliber, etc. It did not mean control as it does now. A well regulated militia is one that is equally equipped and therefore easier to supply. The people are the militia and therein lies the power of the people to resist rogue or tyrannical government or invaders.

      Exactly! Why give more information to those who may not know. We all are aware there are things that any President can do with a paper and pen but to say it out loud so the left can gain clear knowledge and ideas. Now I understand this was already written by the left, but I do believe they read forums like this more often than their own people’s printouts because they want our information for lack of their own knowledge. For every edict signed by Executive Fiat, there needs to be a lawsuit straight to the Supreme Court.

      The Constitution provides 3 provisions that would not only prevent, but also retract all gun control. Those 3 provisions are not only denied, but they are also disparaged by a community that could not speak coherently on one word of the clauses.         People are already trained to bow down to “authority,” it happens every day. Go to any Wal-Mart and you will see people stopping to show their receipt to prove that they bought what is in their bags/cart, just waiting in line for their turn to be “allowed” to leave with their items.
        These fools don’t understand that once you pay for these items they are now theirs and the staff has no right to stop and check to make sure what is on their receipt matches what is in their bags/cart. They have been trained to submit to this illegal search when all they have to do when asked “Can I see your receipt?” is to continue walking out of the store and respond with a “Have a nice day” or an “I’m good” and nothing will happen to them. Security won’t stop them, police won’t be called, no one is going to chase them down but the fear of noncompliance “keeps them in line.” I have told people they don’t need to show their receipt and can just walk out but they are so fearful of going against authority none have ever followed my advice and have even said they “didn’t mind” showing their receipt.
        Our society and freedoms are in trouble as total social compliance begins small like showing receipts to leave with one’s goods and slowly increases until it can get to the point where the government controls every aspect of one’s life.

      I suspect most will surrender their arms, a few will resist, and there will be a repeat of Ruby Ridge and Waco events. Those began as ATF investigations and turned into a test of wills.
      Has America learned anything since those murders by the government over inert hand grenades, gun parts and a short barrel shotgun instigated by a federal informant. Nope.

      I also suspect Bidens Head KGB GUN GRABBER BETO will take on Stalins persona and start 3 am Swat raids on families who are on their list as having newly classified contraband such as the Feinstein list of evil guns and magazines. Kill all who resist will be the order.

        I suspect hardly ANYONE will surrender their weapons. Policing this would be a nightmare (for those PD’s that actually do try to enforce what really cannot be enforced). Probable cause, search warrants, and the database for it would be almost impossible to actually make work.

          Hopefully if it comes to a federal “gun grab,” local police will refuse to enforce it as many sheriffs did in Washington when that state passed gun restrictions which raised the age to buy and possess a semiautomatic rifle to 21 and would have required anyone under 21 currently in possession of one to turn theirs in. I believe if this happens it could turn into Republican governed states deciding to refuse to follow the mandate as it is unconstitutional to confiscate weapons from lawfully abiding citizens when the 2nd Amendment clearly gives us the “right to keep and bear arms.” If states work together to fight against any unjust laws that may be passed then there is no way to fully enforce them and they will become irrelevant and discarded.

          One of the dumbest things said about the “outcome” of the election is that “now the country can become whole again” but what those idiots on the left fail to realize is that the country is and will continue to be divided and they have their heads so far up their @$$ they can’t see it. The outcome of the election was predicted well before election day saying that President Trump would be ahead in the polls the entire time and then a bunch of ballots would come in late for Bident that would give him the necessary number to win. It’s hard not to think that is a bit suspicious that it turned out exactly as predicted especially when everyone you talk to say they voted for Trump. Maybe everyone in the states (Michigan, Wisconsin, Pennsylvania, Nevada, Arizona, Georgia, North Carolina) that were “deciders” in the election should be vetted to make sure that they are legit and this will take all speculation out of it and then maybe we might think of moving on.
