Alec Baldwin Tries to Avoid Blame (Again) in New Court Filing

With each successive lawsuit and media interview, the Alec Baldwin saga looks more and more like the famous standoff scene from Clint Eastwood’s “The Good, the Bad, and the Ugly.”

Baldwin has already fired the first shot, but it’s anyone’s guess who will stand victorious in the end.

The actor’s legal team filed an arbitration demand this week reiterating Baldwin’s claims of innocence and casting further blame on the movie’s armorer, Hannah Gutierrez Reed, and deceased cinematographer, Halyna Hutchins.

“An actor cannot rule that a gun is safe. That is the responsibility of other people on the set,” Baldwin said in legal papers filed Friday. He insisted that every single mistake leading up to the October 21 shooting on the set of the movie “Rust” was “performed by someone else.”

Specifically, Baldwin claims that Gutierrez Reed gave him explicit instructions not to check to make sure the gun was safe.

Baldwin says Gutierrez Reed had told him on multiple occasions that “it was her job to check the gun — not his.”

Gutierrez Reed fired back in a statement this week, telling CNN that “Mr. Baldwin knew that he could never point a firearm at crew members under any circumstances and had a duty of safety to his fellow crew members.”

“Yet he did point the gun at Halyna before the fatal incident against all rules and common sense,” she added.

Gutierrez Reed further claims that Baldwin and the production team resisted firearms training and failed to call her onto the set prior to the fatal shooting. She said Baldwin “had a duty and responsibility to call Hannah in for inspection of the gun and safety instruction before any gun scene was conducted.”

“Hannah was not called into the Church before the impromptu gun scene rehearsal and she should have been,” according to the statement cited by CNN.

Baldwin also used his latest court filing to cast additional blame on Hutchins.

“[Hutchins] directed Baldwin to hold the gun higher, to a point where it was directed toward her,” it says. “She was looking carefully at the monitor and then at Baldwin, and then back again, as she gave these instructions. In giving and following these instructions, Hutchins and Baldwin shared a core, vital belief: that the gun was ‘cold’ and contained no live rounds.”

Baldwin asked Hutchins if she wanted him to pull back the hammer, and she said yes, the filing says.

“Baldwin then pulled back the hammer, but not far enough to actually cock the gun,” it says. “When Baldwin let go of the hammer, the gun went off.”

Only when Baldwin was shown a photograph of the projectile did he realize he had fired a “live bullet.”

“Baldwin recognized the object as a live bullet, and he finally began to comprehend what had transpired on the set of ‘Rust’ that day,” the filing says. “He was shocked.”

It’s unclear whether Baldwin will face criminal charges for killing Hutchins, but he is the subject of several civil suits, including one leveled by Hutchins’ husband.

    The bottom line is that YOU are responsible for what comes out of the end of the barrel. Baldwin is just trying to sleaze his way out of a tragedy caused from his own arrogance.

    My favorite scene of Baldwin is near the end of “Mercury Rising”, as he is taking his karmic plunge off the top of the high-rise onto the pavement below. That scene describes Baldwin perfectly.

    Baldwin should be brought up on manslaughter charges at minimal. He has handled firearms in other movies, it’s not his first time. He cannot claim responsibility, maybe stupidity but that is no defense! I don’t care what he claims, when you have a firearm in your hand you are responsible.

    Alex’s ego made him unable to follow instructions, get training, or now even admit his carelessness.

    I have worked in the Film, TV, and Performance Arts for years, and many standard safety procedures were broken on this location film set! And, the arrogance Alec has shown both leading up to the accident and a death, and afterwards is typical of actors whose ego is bigger than their brain!

It is absolutely the persons responsibility to CHECK the firearm, not ANYONE elses. He is totally responsible, and should immediately be prosecuted for manslaughter! If it were ANYONE else, it would have already happened!! Someone, somewhere is dropping the ball!

    Aleck wants us to think that himself signed enough papers relieving him of ANY blame, fault, and liability; this could backfire, of course.     His admission that the gun ‘did not cock when he pulled the hammer back’ supports by belief he had the trigger held back while pulling the hammer back. There would be no ‘cocking’ as the sear mechanism was disabled due to the trigger being held back. I have no respect for this person. I didn’t call him man because he refused to take responsibility for his actions

    Baldwin was the executive director and in charge on that set. He hired a person as the armorer that obviously was under qualified and had no business being there. As we all know a lackadaisical attitude towards gun safety is opening the door for Murphy to set in and wreak havoc, as unfortunately happened here.

    He should have known how to verify that gun was unloaded before putting a finger anywhere near the hammer or trigger. It’s very easy to point fingers elsewhere to sidestep responsibility but ultimately HE is to blame and the only person responsibly to taking that lovely lady’s life.

    Will this be swept under the proverbial rug and this a-hole get off scot-free? Probably. Money talks and bull-shit walks as they say. I just hope he see’s the terror on the face of that young lady every night he lays his head down.

    Baldwin not being familiar with how a single action revolver works is his fault for not taking the required training from the armorer. My guess is he was going to pull a prank by firing a blank at people not expecting it and get a good laugh at their reaction. He says he didn’t cock it and pull the trigger. He most likely had the trigger already pulled and pulled the hammer back and of course it releases the hammer into the primer and discharges the round. Thats how you can fan six shots without cocking every time. He may have even loaded the gun to pull the prank and wouldn’t know a live round (which shouldn’t have been on the set to start with) from a blank round.

    The Pietta he used was checked out by expert gunsmiths and found in perfect working order. It was likely a true Colt SAA replica that can only fire without trigger pulled if it’s dropped with hammer on loaded chamber. That’s why you should carry with only 5 loaded. If it had the modernized innards with a hammer block it can’t even fire if dropped. Bottom line Baldwin did pull the trigger of a gun that was pointed toward people, and he is just as responsible as anybody else who is that oblivious to the most basic of all gun safety rules.

      Then he is defacto guilty of having the trigger pulled back, or the half-cock notch would have caught the hammer fall and held it away from the primer. He is not only a jerk, but a liar as well. This should be a slam dunk for the criminal charges as well as the civil lawsuits. We’ll see….

    Tragic accident that could have been prevented If the protocol in place had been followed. Simple guidelines are always easy to ignore when in a rush to get things done the easy way. Dumb and dumber situation. I don’t know if Alec Baldwin owns any firearms or not but it should have been everyone job handling the firearm to ensure that it was safe. Something’s shouldn’t be reled on.

    At the end of the day 1 person is dead another was wounded! Facts of the case 1 Baldwin was handling the gun that killed said person. Baldwin failed to have the armor check weapon prior to handling it. Baldwin himself also failed to check the weapon to verify it was loaded with blank round or unloaded. Baldwin was the movies producer. Baldwin failed as said producer to hire an appropriately trained armorer/company to handle weapons on set. Therefore at a minimum Baldwin is guilty of reckless endangerment and civilly responsible for the death and injured. Baldwin is rich and connected so unlike any of us he probably won’t be charged and that is the real crime !

Anyone who handles guns would never tell someone to not check the gun to insure it’s safe. He sounds so much like a typical leftist by trying to place blame on everyone but himself. It sounds so much like Joke Biden, Obozo Obama, Killary Clinton and so many other democrats. Blame everyone but yourself. This whole thing is on Balwin and if anyone is held to account it should be him. It’s almost as if he planned this whole thing and is trying to remove suspicion from himself. 25 to life is reasonable?

    Yeah, that is just not how gun safety works. There may be people whose job description it is to make sure the gun is cold, but when the gun is in your hand, whatever happens – trigger pull, hammer drop, even a breaking spring causing a mechanical failure and the gun fires – the buck stops with you. You can argue the death was an accident. You can argue that it was manslaughter and not murder. But you cannot argue that you had no guilt in this tragedy and the criminal failure was only the fault of others.
