All Black Rifles May Be Subject to NFA Restrictions If Bump Stock Case Fails

One of the cornerstones of Joe Biden’s assault on 2A rights is to unleash a massive confiscation and registration mandate on all modern sporting rifles.  

While on the campaign trail in 2019, Biden made no bones about his intent to disarm America.  

“Biden will also institute a program to buy back weapons of war currently on our streets,” reads the Biden-Harris Plan to End Our Gun Violence Epidemic.  

“This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act,” it continues. 

Most would assume the Biden administration would need Congress to step in to pull off such a scheme.  

However, the bump stock saga provides a unique blueprint for POTUS 46 to bypass the legislative branch altogether and execute the sell- or register- mandate.

The theory goes that if the ATF can bastardize the definition of “machinegun” to include non-mechanical plastic stocks, the agency can pull a similar stunt to give black rifles the NFA treatment.  

To understand the perverse logic on how the agency could reach such a conclusion, consider this comment from Biden’s former ATF nominee David Chipman (H/T TMGN):

“The danger posed by firearms that enable shooters to continue firing in this manner is the same reason Congress chose to include machine guns in the NFA when it was originally enacted: these weapons enable a shooter to fire many bullets very quickly. Semiautomatic firearms equipped with large-capacity magazines do not, however, fall under the NFA. The NFA refers to machine guns as those firearms that discharge more than one shot ‘without manual reloading, by a single function of the trigger.’ Firearms developed since the NFA and equipped with large capacity magazines rarely require manual reloading, but they can expel a lot of ammunition in a brief period of time. They do so by allowing a trigger to be pulled many times very easily and ensuring that there is almost always another bullet ready to go. Despite this, large-capacity magazines and semiautomatic firearms equipped with them (sometimes called “assault weapons”) are not regulated under the NFA, even though they pose incredible danger to our communities.”

Traditional definitions apparently don’t matter to Mr. Chipman.

In Chipman’s mind, modern semiautomatic rifles with standard magazines are tantamount to machine guns because they “almost always have another bullet ready to go” and the trigger can be pulled “many times very easily” and they “pose incredible danger to our communities.”

Biden and Chipman, and anyone else who wants to enact laws via bureaucratic decree, must’ve been encouraged last week when the U.S. Court of Appeals for the Sixth Circuit issued a split decision, 8-8, that affirmed by default a district court decision upholding the bump stock ban.

Gun Owners of America (GOA), the pro-gun group at the helm of the suit, now say they have to appeal it the Supreme Court if they want justice to prevail.

“GOA’s fight is far from over as our lawyers begin preparing a petition for certiorari to the High Court,” Erich Pratt, Senior Vice President of Gun Owners of America, said in a press release. 

“The fact that the Sixth Circuit was so divided that it could not even give us an answer to our question means that the Supreme Court must eventually decide whether unelected ATF bureaucrats have the power to create new federal crimes out of thin air.”

Hopefully the high court strikes down the bump stock ban for good. However, if the Supreme Court punts on this issue and opts not to hear the case, it may pave the way for the Biden administration to put modern sporting rifles on the chopping block.

    Chipman’s nomination was withdrawn 3 months ago. I also find the arguments for bumpstocks to be a little forced. While I don’t believe any gun restrictions will result in reduction of criminal firearm usage. If one recognizes the need to register automatic firearms aka machine guns, than it doesn’t require any twisted logic to see a bumpstock is pretty much the functional equivalent, the only difference being the automatic fire is the result of the weapon movement, rather than the sear not locking, while the trigger is held stationary.

    As I whistle past the graveyard – assuming that this call to emergency will not occur – I’m given yet another reason to rue the days that; some moron developed this idiotic device and morons lined up to buy them and then commenced to record themselves using them in the manner designed; as a dodge to own a clandestine-machinegun.

    I have ZERO sympathy for anyone caught up due to these but now, because of them, my ownership of firearms outside of their parameters is in jeopardy.

      The govt has had more than enough time to abolish nfa/ class 3 items, and they didn’t do it so alternatives had to be devised.

      The govt simply doesn’t want a well armed populace, because a well armed people make poor slaves. And not only do they need slaves to function, the alternative is for them to do the hard work of representing the people and not themselves.

      And who wants to work to make others wealthy? Certainly not our Govt.

      You are 100% correct Rusty. The bump stock ban was an executive order from President Donald J. Trump. It was never voted on by Congress but Trump took it upon himself to issue an executive order banning bump stocks. He betrayed gun owners and nobody said a word.

      Right on the money, Rusty. There were a number of us calling out the dangers of the precedent Trump was setting. It was obvious that the next Democrat President would take that and run with it. We have more than three years of Democrat White House ahead of us, at least. The 2A community was full of FUDDs who openly derided bump stocks and insisted their ARs and AKs were safe from this dynamic.

      And to Armed and Dangerous, you add the correct word here, this was a betrayal, as well as the model for the Executive Branch to violate the separation of powers with impunity.

        The worthless bump stocks are NOT a legitimate answer, repealing the bogus NFA is the true solution. How do people like you remain unsullied in the current political environment?

      Tens of millions of Americans own semi auto rifles. Including yourself by your own omission. How would restricting your right to own such a weapon solve anything? Seriously, do you think it is reasonable? Should all handguns be illegal? Should there be a 2nd Amendment at all?

      Personally I cherish the fact that we live in a country where owning a AR-15 is common. Free men should not fear dangerous weapons unless they are being wielded by tyrants.
