ATF Seizes Customer Data from Gun Company, Uses It to Confiscate Guns and Raid Home of California Firefighter
The case could have implications for 80% receiver and arm brace owners.

A fire captain in California has been charged with multiple felonies after the Bureau of Alcohol, Tobacco, Firearms, and Explosives raided his home in July of 2019 looking for a device that supposedly converts a Glock handgun into a machine gun.

During the course of the raid, agents discovered the Glock conversion devices, but they also found 19 firearms that violated California’s ban on “assault weapons,” four AR-10 lower receivers, and two AK-47 lower receivers, along with numerous illegal “high-capacity” magazines.

The ATF only knew to search the home of Capt. Derik Oakes because they obtained customer data from the company that manufactured the Glock conversion devices, JNC Manufacturing. Even though the ATF determined in 2012 that JNC’s product did not count as a “machine gun,” they reversed that decision in 2018 and launched an investigation.

Oakes and his attorneys are arguing that the search warrant—along with the evidence it uncovered—should be thrown out because the ATF did not properly inform the public about their reversal nor provide evidence proving Oakes purchased the device after the 2018 determination.

“Particularly relevant to this motion is that upon BATFE’s 180-degree change in position, i.e. the JNC kits were not machineguns according to the BATFE one day, and the next day they were, is that the BATFE utterly refused or failed to provide any notice of the kind to the public,” Oakes’ attorneys wrote in their motion to suppress unlawfully seized evidence.

The case has serious implications for gun owners in light of the ATF’s proposed rule changes on 80% receivers and arm braces. Like in Oakes’ case, the ATF could obtain customer data from 80% receiver companies, arm brace companies, or companies that used arm braces on their firearms, to harass law-abiding gun owners and look for additional violations of state and federal gun law.

The ATF claims that agents tried to reach Oakes and his attorneys prior to obtaining the search warrant in order to seize the Glock conversion kits. But Oakes claims that the agents never explained precisely what they were looking for and asked that Oakes surrender his “machinegun.”

“This misleading statement resulted in a magistrate judge unlawfully issuing a search warrant based on misrepresentations which evidence a reckless disregard for the truth and omissions by Agent Bietz,” Oakes’ lawyers write. “A warrant must be based on accurate information, not ambiguity and misrepresentations. The breach of those requirements requires suppression of the fruits of the warrant.”

Oakes’ attorneys are also pushing for a deal that would reduce their client’s charges to misdemeanors. Oakes has never been in trouble with the law, and multiple firefighters submitted testimony vouching for his high character. Oakes also argues that he did not know his rifles were illegal due to the complexity of California’s gun control regime.

“There is no allegation that Mr. Oakes posed a threat to anyone or anything, nor is there a victim or harmed party in this case,” his lawyers write in court documents. “Instead, this case derives solely from shockingly complex, draconian and arguably unconstitutional firearm statutes created by our beloved politicians in Sacramento.”

Oakes would be allowed to keep his job with a misdemeanor conviction, but he would still have to destroy all of his illegal firearms.

“Obviously, any offer would involve destruction of any kind of assault weapons, contraband, things of that nature, so they wouldn’t be returned to him,” Miles Perry, the deputy district attorney, told The Sacramento Bee.

Gun rights groups are following the case, and some believe the state will pursue a plea deal out of fear the Supreme Court will strike down California’s “assault weapon” ban.

“I think if you’re a prosecutor in California, and you’re continuing to try to imprison people for peaceful conduct for possession of assault weapons, you’d better think twice,” Brandon Combs, president of the Firearms Policy Coalition, told The Bee.

For now, Oakes plans to keep closer tabs on California’s ever-changing gun laws.

“I learned real fast from my event that the only way you’re going to actually know what is correct is to talk to legal counsel,” Oakes said. “Many people think they’re doing the right thing, and they find out in the flip of a switch: Oh, no, that’s entirely wrong.”

    West Virginia just became a 2A sanctuary state.
    We don’t pay sales tax on firearms or ammo, no fed firearm laws, passed since 1-2020 will be inforced. Anyone that helps the feds locate or arrest a citizen for a gun law passed after that date, can be imprisoned, and fined $3600. (Not limited to ). I feel that my state has my back. If I were you, I would pay much closer attention to your State governments, because if your state passes something unconstitutional, it’s supposed to be the Federal Government that corrects that for you. But if the Federal Government passes unconstitutional laws, then it is the State’s responsibility to correct it.
    And what do you do if the State and the Feds are against you?

    I may or may not have firearms. I may or may not have them registered with any government agency that charges a fee to register, including a CCW in my state that requires a fee. The 2nd Amendment is very clear. “shall not be infringed”, and I don’t give a damn about states like Californoa where the citizens are too weak to stop this unconstitutional act.     First of all why would you buy something like this that turns a pistol into a machine gun, you should know that machine guns are illegal unless you pay the $200.00 tax for a permit. Further more according to the 4th amendment The items searched for must be described accurately and only the things described in the warrant may be seized, therefore the ATF agents broke the law with an unconstitutional search and seizure of items not listed in the warrant. We the people are tired of a government that thinks itself above the law and the Constitution of The United States of America.

      Just because you own it does not make it a machine gun. You use to be able to own them but the ATF changed the rules on these. You need to modify your slide to make it work. You can still own all the parts to make an AR-15 fully automatic and not get into trouble by the ATF. You get into trouble when you modify your lower receiver by drilling the third sear hole

    I would suggest that Article I, Section IX, Clause 3 would be a defense against the hob-nail boots of the Gest – or, ATF.

    That clause reads, “No Bill of Attainder or ex post facto Law shall be passed.”

    Ex post facto means that no law shall be passed that criminalizes an act that was committed when the act was legal.

    The proper defense in law is to cite Miller v US, and the Militia statutes. Miller ruled that the purpose of the 2nd was to guarantee that Article I, § 8, Cls. 15 & 16 were enforced. The Militia statutes require an armed citizenry with weapons they themselves supply. And the folks who debated our Constitution said things like “Is not a well- regulated militia sufficient for every purpose of internal defense? And which of you, my fellow citizens, is afraid of any invasion from foreign powers that our brave militia would not be able immediately to repel?”
    What defense one might ask? The defense of all our rights could be an obvious response to anyone who is not a selfish and foolish person who believes that there would be no one desirous of destroying liberty.

    ok, this device (conversion kit) may have been legally defined as machine gun and when approached by the ATF, the information about to whom they shipped the kit may be proper for them to request…..BUT

    I want to know, when a dealer like MidwayUSA (or any other sporting arms retailer) sells legal braces at a fire sale (because they don’t want to be caught with a bunch of inventory they are stuck with)….are they going to roll over and give the names of customers who purchased braces from them to the ATF….with, or without a fight.

    has anyone (retailer or mfg) been approached by the ATF to give up the names of customers that bought bump stocks?

    I wonder why the ATF, a Federal agency, was enforcing California state laws in regards to the bogus “assault weapon” and high capacity magazine bans in the People’s Soviet Republic of California. Those are not Federal violations. It is a perfect example of the ATF’s constant infringement of The 2nd Amendment rights. The ATF is the most anti-American law enforcement agency in the Federal Government. They are almost as political as the FBI, another corrupt Federal Law Enforcement Agency.

      You’re correct. And it’s even more interesting that ATF is enforcing California’s rules on firearms (which are arguably, at least, violative of the US Constitution) . . . . while California refuses to enforce the Fed’s rules on immigration (which are absolutely constitutional — immigration is one area where the Federal Government is supposed to legislate!).

      Because they normally operate in a task force group comprised of state and local agencies as well as federal. Agents/officers don’t make laws, but they are certainly pressured to enforce them. I find it hard to believe this resident of California wasn’t aware of their very strict assault weapons and high capacity magazine laws. Maybe so, but we all know ignorance of the law doesn’t fly in court. We need to win these battles in court, not by threatening or trying to battle the agents/officers enforcing the laws.

    Wake up people it ain’t going to matter what you have, once biden’s task force starts hitting dealers they are going to get all the records (paper, computer, stone tablets) and come after all guns period. Think about this……they no longer say “assault rifle” it is now assault weapons!

    Oh, this is funny. And I can come up with some thoughts that might burden the sleep of some January 6th types.

    Not only have I had an FFL myself but I have worked for FFL dealers. The next time you are thinking about buying a firearm from a retailer, check to see if they keep their A&D (acquisition and disposition) books on computer. Every major national chain does this and a lot of smaller chains and even individual stores are starting to. I worked for one particular regional chain of stores that kept their A&D books on computer. The records for all of these stores were kept together in a single program on a computer in another state. This particular program had a button whereby a user could e-mail all the records for all the firearms that had passed through this store’s A&D books to any e-mail on the internet. Serial numbers, home addresses, even phone numbers if the FFL collects such information. The main hub for this program had a similar button, where you could e-mail all the records for all the firearms sold through all of the stores in this chain. That button was not guarded by some fundamentalist 2nd amendment purist who was likely to demand a warrant before e-mailing this information to… the DOJ? ATF? Merrick Garland? Loretta Lynch? No, it was watched over by an IT flunkie, who would likely be pretty scared by a call from the ATF demanding such information. This chain sold AR-15s, AK-47s and other MSR assault rifles. What if one of the states with Democrat governors decides they need the records the way California did? Could they get records for other states that are less likely to knock on doors- Oklahoma, Texas, Kansas? What if the ATF listens to Beto O’rourke and decides to pick up AR-15s? They could have the records from this store in a matter of minutes.

    The thought of the government taking these weapons of war off of American streets doesn’t really bother me – nobody is really coming after my Winchester 94s and Model 12s – but I do know a lot of people that could have been bothered by this database. I did tip off more than a few friends and well-dressed strangers about this button. Any store that keeps their A&D records on computer probably could turn over their records quickly. A company like Academy, Gander, Big 5, Cabela’s, EZ Pawn, Attwoods, Dick’s… they all probably could turn over thousands of names and addresses quicker than David Chipman could read them.

    Before you respond telling me I live in a basement and offer myself as a rent boy, ask yourself – how many guns have I bought in the last 5 years from a store that could have kept their A&D books on computer?

That’s what was used at the incident in Gilroy at the Garlic Festival. The media classified the weapon as an assault weapon. They said it was an AK style rifle. So shouldn’t you be scared of the feds coming to get you? I mean your not a hypocrite right?

      There is a dictionary definition of an assault weapon – any of various automatic and semiautomatic military firearms utilizing an intermediate-power cartridge, designed for individual use. That sounds like an AR-15 to me, unless you want to claim that the 5.56 NATO is less than an intermediate-power cartridge, which I might agree with.

      “Assault weapon” is defined in penal statutes of states that regulate or prohibit possession of such firearms. Yes, it is a term invented by state legislatures (and at one time the Federal Government), but that doesn’t mean that the term has no meaning. I don’t care what gun grabbers call them, but I do care what state law defines them as, because I do not want to get caught with an “unregistered assault weapon” and face serious criminal ramifications.

    Typical overzealous prosecution. None of the lowers are “illegal” because they are not “firearms,” the ATF should not be prosecuting state law crimes based on the configuration of various firearms as illegal “assault weapons” under state law, nor should it be charging possession of magazines legal under federal law, especially when there is a federal court order enjoining prosecution of offenses for large capacity magazines.

      A ar type lower at anything greater than 80% is indeed a firearm according to the atf opinion! A firearm is the receiver with the serial number! With or without any other parts attached! I suggest you know what the atf considers a firearm before informing others of what you think is the law? If you wish I can supply you with the exact definition of a firearm according to the ATF
