President Joe Biden announced yesterday a slate of six executive gun control orders covering “ghost guns,” stabilizing braces, red flag laws, and community violence intervention programs. He also named Giffords Senior Advisor and former ATF agent David Chipman to lead the Bureau of Alcohol, Tobacco, and Firearms.
The administration stressed that these measures are only “initial actions,” and called on Congress to ban “assault weapons,” private gun sales, and standard capacity magazines.
“Today, the Biden-Harris Administration is announcing six initial actions to address the gun violence public health epidemic,” the White House announced. “President Biden is reiterating his call for Congress to pass legislation to reduce gun violence. But this Administration will not wait for Congress to act to take its own steps – fully within the Administration’s authority and the Second Amendment – to save lives.”
Gun rights groups vowed to fight Biden’s measures.
“Gun Owners of America is wholeheartedly opposed to the unconstitutional gun control threatened today by President Biden – restrictions such as the attacks on homemade and brace equipped firearms and so-called ‘Red Flag’ Gun Confiscation Orders,” GOA Senior Vice President Erich Pratt said in a statement. “Joe Biden knows he cannot beat gun owners in Congress. Instead, he’s circumventing the legislative process to impose his own tyrannical vision by executive fiat.”

The Second Amendment Foundation, which focuses primarily on pro-gun litigation, vowed to sue if Biden’s Department of Justice crosses the line.
“The devil will be in the details,” acknowledged SAF founder and Executive Vice President Alan M. Gottlieb. “Our legal team will review them and we are prepared to file suit if Biden and his administration steps over their legal authority.”
The NRA chimed in as well, saying they’re “ready to fight.”

These actions could require law-abiding citizens to surrender lawful property, and push states to expand gun confiscation orders.

“This is a huge victory for the gun safety movement and we applaud President Biden for his strong leadership,” said Shannon Watts, founder of Moms Demand Action. “For years, our grassroots volunteers have fought NRA-backed leaders in Washington as they ignored the fact that more than 100 people were killed and hundreds more were wounded every day –– but now, President Biden is making it clear that those days are over.

Here’s a summary of each of Biden’s orders:
- The Justice Department, within 30 days, will issue a proposed rule to help stop the proliferation of “ghost guns.” Unserialized firearms have become a popular target of the gun control crowd in recent years. Several lawsuits have been filed calling on the ATF to redefine a firearm receiver to include products known as “80-percent receivers.” For a great breakdown of why such a redefinition would be unjustified, check out this brief by the Second Amendment Foundation.
- The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act. With Chipman in charge of the ATF, you can bet the rule will “make clear” that stabilizing braces always make a pistol subject to NFA requirements.
- The Justice Department, within 60 days, will publish model “red flag” legislation for states. Many states have already passed red flag laws, but Biden’s order also calls on Congress to impose a nationwide law allowing a court to seize a person’s firearms without a hearing.
- The Administration is investing in evidence-based community violence interventions. It’s unclear why this was included in Biden’s gun control agenda. These programs target the individuals who commit violent crime—not law-abiding gun owners. The efficacy of these programs is up for debate, but they don’t threaten the right to keep and bear arms.
- The Justice Department will issue an annual report on firearms trafficking. It’s been 21 years since the Justice Department issued a report on firearms trafficking, the White House claims. Biden is calling on his Justice Department to issue a new, comprehensive report on firearms trafficking and annual updates necessary to give policymakers the information they need to help address firearms trafficking today.
- The President will nominate David Chipman to serve as Director of the Bureau of Alcohol, Tobacco, and Firearms. They tried to sneak this in at the bottom, but it could be the most consequential of Biden’s executive actions. Chipman was an ATF agent for 25 years, and he now serves as a Senior Advisor to the anti-gun group Giffords. This nomination will give the gun control lobby even more direct access to the administration than they already had.
Biden’s gun control measures in Congress have run into opposition from the evenly divided Senate, but majority leader Chuck Schumer has vowed to bring them up for a vote. The success of an “assault weapon” ban, universal background checks, and red flag laws hinge on whether the Democrats decide to remove the filibuster and pass the legislation in simple majority votes.

Perhaps one of the things they will try to use against you with these illegal EO’s is that you are a red flag person and a risk to yourself and others because you use drugs. Now how can they prove you use drugs? Simple the federal government has not made it legal for any drug use, and though the states have made it legal for many drugs they have records. When you go to the legal weed places they in many states ask for your drivers license, and make a copy of it. Your mistaken……Cheeto-Mans Ban on Bump Stocks….was overturned in two Federal Courts. Using the ATF’s very own definition of a machine gun…..the bump stock was clearly NOT a firearm. OVERTURNED…..Bump Stocks are no longer banned.

If the government had the power to do this, they would have done it a long time ago. First they regulate full auto and suppressors. Someone please explain to me why the pistol brace should be an NFA item? First explain why an SBR is an NFA item in the first place. An SBR is too big to conceal. It’s not long enough to get rifle velocities…..and rifle velocities create much more deadly terminal effects. An SBR is generally less accurate than its rifle brother. So why is it an NFA item…….because some politician defined it as sinister many years ago…..and no one with any common sense has challenged this flawed rational. It’s the same with suppressors. No one has ever been hurt by a suppressor…..yet they are still so sinister they require NFA approval……..we really have stupid people running theses agencies……they don’t have the sense to HONESTLY re-evaluate the silliness of regulating SBR’s , Suppressors, or braces.

I heard on the news Biden/Harris want to SAVE LIVES by banning AR-15s. I did some learning today. According to the 2019 FBI crime statistics their were 13,927 homicides in the US. 10,258 were by firearms. Of the 10,258 only 364 were by rifles which include AR-15s. That means 2.6% of the homicides were by rifles. Handguns accounted for 6,368 homicides which is 17 times more i believe. It also said that 1,476 were by knife, 397 by club/hammers and 600 by hands and feet. I also saw that the DOJ reported that the 1994 to 2004 Assault rifle band did not work.

Here we go again. As well-intentioned and positive as these executive actions are, executive orders are not the right way to get these community violence intervention solutions. These kinds of solutions require an act of Congress, otherwise the judicial branch will (rightly) overturn them, like just happened with bump stocks, and we will be freshly at square one, having to start over again. It is just better to do it right the first time. Everybody tends to forget that the President isn’t a despot when their guy is sitting in the big boy chair and this overuse of executive actions have been especially bad for the last four.
Particularly the ghost guns and arm braces are problems that should be addressed but there’s a reason they don’t address more common sense gun violence solutions via executive action, like placing limits on hi-cap magazines or closing the gun show and Charleston loopholes.

Exactly, and I was thinking the same thing. EOs only apply to State and federal agencies, and if they are unconstitutional, they are null and void, and will be thrown out of court. Blue Dog, I will agree each President can abuse misuse the executive orders, and they rarely stick because the next admin changes them with a pen and the 3 equal branches (which Congress seems to forget and despise it unless it’s the same party). I resoundingly reject your opinion that the last four years were horrible as far as executive actions go, while I disagree with some of the former President’s exec actions the majority were because Congress would not act accordingly and a temporary fix was applied.
As far as homemade guns and arm braces you can stuff your opinion (and head) further up where the sun doesn’t shine. I have one arm and using a rifle with a long barrel requires me to lay down or sit where those types of calibers are used frequently giving me less access to enjoyment for any use I deem desirable. Last I checked the English language and the Constitution were clear “shall not be infringed” is an impediment to all those who seek to subjugate the American people.
Oaths are taken bu everyone serving the public or “We the People” to protect ALL citizens from threats both foreign and domestic and really soon it is going to come that “We the People” are going to take that back. We don’t need or want a government that gets to tell us everything we “have” to do because someone needs to look after us.
