NRA Director Files Motion for Board’s Dissolution as Only Way to Save Organization

National Rifle Association Director Rocky Marshall filed a motion Friday with the New York Supreme Court seeking to intervene in the state’s lawsuit against the NRA. He’s asking the court to make him a party to the case so he can seek the dissolution of the organization’s board, the ousting of Wayne LaPierre, and the election of new and independent leadership.

“It is clear that the NRA’s Board has not and will not fulfill its fiduciary duties to the NRA and its members,” his lawyers write on his behalf. “As Mr. Marshall says, these issues have been raised many times in the last several years by intelligent and serious people but the Board has steadfastly refused to objectively investigate and analyze them, or to take any action against the Individual Defendants.

“Therefore it will do no good to merely remove the Defendants LaPierre and Frazer, because this would leave the same passive Board in place that has allowed the misconduct that brought the NRA to where it is today. Only a new and independent NRA Board elected by the membership and free from Defendant LaPierre’s influence and control can effectively hire new executive leadership to oversee the NRA’s rehabilitation.”

Marshall argues in his motion that neither New York State Attorney General Letitia James nor the NRA are making true arguments in this case. James’ campaign against the gun-rights group is a thinly veiled attempt to “destroy the NRA and liquidate and give away its assets,” he claims. Dissolving the organization would not protect the NRA or its members, and Marshall believes the NRA can continue its mission and programs if its current leadership is removed.

On the other hand, Marshall says, the NRA is incorrect to claim that the AG’s case is nothing more than a political attack on the NRA and its leadership.

“To rule for the Defendants [i.e., the NRA] merely requires that the Court hold its nose and swallow their claims that the NRA Board has investigated the Attorney General’s allegations and found nothing wrong, disregarding abundant evidence of the Individual Defendants’ serious breaches of duty and conflicts of interest, some of which is already before the Court,” he writes.

Marshall argues that as the Director of the NRA, he has standing to intervene in this case and ask the court to dissolve the organization’s current leadership and install a temporary Receiver under N-PCL § 1111.

The Receiver would be able to hire independent accountants, attorneys, and other professionals to investigate and correct the alleged corrupt dealings on which the AG’s action is based. This Receiver would handle the NRA’s day-to-day operations until he or she organizes the election of a new Board, officers, and executives.

Marshall believes he is “well qualified” to act in this role.

“To the extent possible Mr. Marshall will work with the Attorney General to reform the NRA’s leadership for the benefit of all rank-and-file NRA members. Mr. Marshall will pursue recovery of all NRA funds wrongfully paid to the third parties implicated but not sued by the AG, while vigorously opposing the AG’s dissolution claim,” his lawyers write.

    Like many other members of the NRA, I will maintain my membership in the organization but will not make any donations to it as long as the stench of corruption and fiscal mismanagement permeates its current leadership. If Wayne LaPierre truly cared about the NRA instead of taking advantage of the membership, he would step down to be replaced by someone who would bring fiscal responsibility to the fore for the benefit of the organization and its membership.

    First thing that needs to happen is cutting all the executive salaries by 75%. That will make donations go to where they were intended. If Wayne and co. don’t like that, they are free to leave.

    The NRA needs our support more now than ever. Any AH on here suggesting the NRA be desolved is clearly a left wing anti. If Lapierre needs to be removed there are policies in place to make that happen. On the other hand, he has been connected and very powerful for decades. I don’t trust any claims made by a NY AG. Face it, they’ve been after the NRA for ever and tried every angle. This is most likely another attempt. Not the first, won’t be the last unless we, the membership, cave.

      As a life member, I agree! If there is a problem with current leadership, it should be handled by the membership and not NY liberals. Tying in with them would be a big mistake.

    A very sweet lady by the name of Mary called me a couple of times to try to get money out of me for the NRA and I asked her why they canceled the convention this year and she said it was because of an abundance of caution over covid. I laughed and said no, I think LaPierre was too afraid to face the membership over his and the board’s corruption, and I will not be giving them any more money until they are replaced. I have been a member since 1972, and I asked her to please pass my displeasure along to Wayne. She very sweetly said she would. I felt sorry for her, because I could only imagine what a thankless job that must have been to hear the members anger over and over… I am not sure if the NRA will survive this.

    The NRA needs to disappear! It’s nothing like it was 30 years ago, now its simply a political PAC for anti-gun control nuts, political hacks and self-serving idiots. Management is a den of thieves with their siphoning off $$ for their personal gain. It now serves no useful purpose.
    The nra should go back to the basics it was established to promote – get the hell out of fascist autocratic politics it now so loudly and openly supports, and reread its charter promoting sensible gun ownership, safety and education. It has zero relationship to its responsible roots…and get rid of all the crooks, self-promoters, and loud-mouthed hacks that feed at the $ trough of member’s dues.

I am a Benefactor Life member and realize that the enemies of the NRA haven’t been able to pierce its armor, so they’ve put a traitor inside the organization i.e. Rocky Marshall et al. HE is the one that needs to be ousted!! Wayne and company have kept the faith and traditions of the NRA.

    As a Patriot Life member, I will no longer consider upgrading my membership level or contributing in any way until the NRA does some serious house cleaning. Start with LaPierre.

    I suggest the NRA listen to the membership – this is costing them some SERIOUS funds.

    I’ve been a member of the NRA since 1971, I’m currently a Benefactor Member. I was around, and supported, the Cincinnati Reforms of the 70’s and I support Marshall’s efforts to reform the organization. Wayne LaPierre started out very, very well, but after decades of running the NRA has turned into the poster child of corrupt insiders, as has the Board of directors, as a result I have cut off ALL funding on my part of the organization and my 2A money goes to other groups now, that will continue as long as the current power structure, Board, and Leadership are in place. I think that the organization is worth saving and strengthening, but only if it has a massive re-structuring and new leadership. I would love to fully support the NRA and the ILA, but the way things stand right now, not another penny will they receive from me.

    Wayne LaPierre and the current board of directors went off the deep end many years ago and the organization became a get-my-friends-rich scheme.. A one-time strong leader for the organization, he became corrupted with greed and the board did NOTHING to stop his spending sprees. A STRONG board with direct oversight to the operation is needed, as well as a strong leader who MUST BE voted into his/her position at LEAST EVERY 2 YEARS by the board of directors–WITH THE APPROVAL of voting members.

    The BOD is a joke: FAR TOO LARGE with too many members that don’t take their roles seriously. We need to have a smaller board with term limits and actual discussion of the issues with candidates BEFORE the meeting begins. Most members have no idea who these candidates are, their qualifications, or their positions.
