Buffalo Police to Confiscate Firearms from Deceased

In an effort to “take guns off the streets” police in Buffalo, New York, are confiscating firearms from recently deceased pistol permit holders.

Law enforcement officials publicized the initiative last week during a press conference.

“We recently started a program where we’re cross referencing all the pistol permit holders with the death records, and we’re sending people out to collect the guns whenever possible so that they don’t end up in the wrong hands,” Police Commissioner Daniel Derrenda told WGRZ.com.

“Because at times they lay out there and the family is not aware of them and they end up just out on the street,” Derrenda added.

The program is legal under state law that gives families of the deceased 15 days to sell or transfer handguns to a licensed dealer or registered permit holder.

“They’re quick to say they’re going to take the guns,” Tom King, president of the New York State Rifle & Pistol Association, told Fox News. “But they don’t tell you the law doesn’t apply to long guns, or that these families can sell [their loved one’s] pistol or apply to keep it.”

King also complained that the program is the yet another example of targeting law-abiding gun owners instead of going after criminals.

Obviously, police snatching up property that belonged to someone’s loved one has the potential to create legal repercussions, as Buffalo defense attorney Dominic Saraceno noted.

“These gun collections can value into the hundreds of thousands,”Saraceno told Fox News. “If a police officer came to my door without a warrant signed by a judge, I’m not giving them anything. Most people don’t know that and get intimidated.”

    My immediate question is how do the police ‘know’ what guns the ‘deceased’ owned? How did they get a ‘data base’ list of all gun owners to compare with the deceased data base from the coroner? If they get anybody but a leftist Totalitarian judge, the verdict should be the immediate return of all confiscated guns, and 100 million in punitive damages against the state.

    I never liked governor combo. He says one thing,and does another.typical politician. It’s a shame, our elected officials; cannot see the forest fore the trees. It is not that difficult to understand, that our forefathers gave us these rights; to protect us through time. T he constitution, bill of rights, declaration of independence; were thought out very carefully. They were not written in haste. They actually mean something; not just documents to be interpreted by old decreped dinosaurs, lounging in their ivory towers. If our founders, wanted their work; they fought so hard for, to be picked apart as a matter of convience; they would not have taken the time and patience, to do it right, as far as this crap law in new York; it should be overturned. It is nothing more than armed robbery!

    Well when you let the likes of the president we have cheat his way in office this is what you get. Hope all the so called legal gun owners who voted him in or helped buy him in are happy . They would have impeached and jailed Bush if the stuff this pig has done . And is still doing impeach him now were in trouble till we do . Then we have to work on the congress vote for term limits and no life benefits , congress was not intended to be life jobs to turn into multimillionaires . We as the people need to turn things around the powers above are getting prepared with the homeland security thugs being trained to shoot us as we are the new terrorist in there sights open your eyes people . This is just the beginning , we never learn by the past so it repeats ……..!!!

    When my Dad died, I moved all his registered pistols to a state where they were legal w/o registration. When the Trooper came by to get them he was very disappointed to be told they were no longer within his grasp. I was happy the guns, which has gone from my grandfather were safe with my son.

    I see all the rhetoric in your replies and all I have to say is Colorado had your solution it is called a RECALL ELECTION. If this totalitarian law appeared in my home state (Wisconsin), there would be a stampede to the voting booth to get rid of the Socialist Bastards! Come on New York Grow a set of Balls or backbone (as it applies) and pass a Constitutional Amendment or at least a voter initiative that guarantees citizens the 2nd amendment right to Bear Firearms. This law puts an undue burden and cost on it’s citizenry. Someone needs to sue or challenge this in Federal Court.

    This confiscation of guns is also alive in well in Texas with the cowards that now run the police and sheriff departments and judicial thrones like gods. One day they will be on the wrong end of their perverted opinions. Of course they are all armed to the teeth so the average American must also be for parity. I bet our Founding Fathers are sore from all of the rolling around in their graves. Van Zandt county Texas and Sheriff Lindsey Ray are some of the biggest gun grabbers in this state. Vote them out of office at all costs.

    I have informed several friends who are law officers, including one police chief, that if anyone comes to my house to confiscate any guns they think I might have they will die on my front lawn. Is that radical? Yes! Is what the government doing radical? Even more so. Just a few of these unlawful “fake” cops giving their lives to serve their communist masters would put an end to this. If we don’t resist this in the most radical way they will completely destroy our freedoms completely and own you much as a slave on the old plantations. Who would have thought it would happen under the oversight of a so called “black” president? Black heart yes. Love for America, no!!

    Food for thought for sure, even if you’re not in the Big Apple. Maybe it would be better to specify in your will who your guns go to…or maybe not. Perhaps it’s better not to let them know you have them, and let heirs know that when you die, to make sure to pick up your firearms first, and keep them in a safe place – safe from greedy law enforcement and governors.

Does Gestapo sound familiar because these hand picked cops seem to fit the criteria for those especially honest and upstanding representatives of Hitler’s best! If my history servers me correctly this is how they worked it except you didn’t have to be dead unless you resisted! When are people going to wake up to the fact that the honest people are getting screwed, and the state and federal governments are taking advantage of their positions to shove their values down our throats through closed door secretive legislative voting. They know the majority of us would vote them down if given the chance. Liberal or conservative, one should see that the democratic procedures put in place to protect us from this type of government are being cutout of their schemes! They won’t or can’t catch those that are stealing guns, committing crimes, so they stick it to us law abiding citizens under their concern of our safety! Given enough time they’ll have all of us in jail and join forces with the criminals they cannot now catch; that or just let all of them out of jail and say sic’em boys!

    It’s even worse than S. H. Blannelberry reports. When Governor Adrew Cuomo rammed his new S.A.F.E. gun law through the legislature in January of 2013, he borrowed Senator Dianne Feinstein’s list of dangerous guns to list the firearms to be restricted. All AR15 type and several high capacity pump shot gun models were included on that list of approximately 140 different firearm brands and models. Since the passage of the law, many more rifle and shotguns brands and models have been added to the restricted guns list.

    Cuomo’s law requires that these guns be registered just like handguns already were. Here’s the fun part, once registered these rifles and shotguns may never be sold or given to another person, not even a relative. When the gun owner dies his estate must surrender the firearm to the New York State police. The state authorities then destroy these surrendered guns. I should note that all of the “dangerous” rifles and shotguns on Dianne Feinstein’s infamous list appear to be firearms that could be used by normal citizens to resist criminal attack or abuse by a tyrannical government.

    It’s been nearly two years since Andy Cuomo’s S.A.F.E. gun act was passed. The RINO leader of the New York Senate only agreed to bring the S.A.F.E. bill, that the state assembly already passed, if the governor declared and emergency session. That avoided any news of the bill from reaching the public before the vote. The bill was presented for a vote at 11:30 pm and passed within 20 minutes with an overwhelming majority that included the senate majority of the Republicans. My own Republican State Senator said that this Albany outrage made his stomach turn. Only 13 other Republican senators voted against the S.A.F.E. gun Act.

    A pro gun group recently filed a freedom of information request to discover the status of how many, and what types of rifle and shotguns were registered in the almost two years since passage of the S.A.F.E. gun law. Andrew Cuomo is stonewalling that request. Everybody including the Democrats understands the reason for Cuomo’s reluctance in this matter. Only the clueless registered their rifles and shotguns because they don’t know what is coming next. Yup, dollars to doughnuts Cuomo will call for the confiscation of all “dangerous” firearms after the next crazy commits mass murder on the North Slope of Alaska.

    Oh by the way, if you want to purchase a box of 50 count .22 caliber rimfire cartridges in New York State, you have to pass a NICKs phone call inquiry first.

    To tell the truth, I wouldn’t remain in Syracuse, New York if it weren’t for our record snow falls in the lower 48 states and the number one position that we enjoy as the state with the highest total amount of state taxes. You know the old saying about the guy who was asked why he was hitting his thumb with a hammer. “It feels so good when I stop!”

      Hey Ted, not all of the law enforcement people in New York State are enthusiastically supporting Governor Andrew Cuomo’s new S.A.F.E. gun law. Almost every Sheriff in New York has flatly refused to do so. There official statements are the lack of state funds to enforce the new law. Unofficially, they detest the governor and most of the legislators in Albany, New York.

      I have personally talked with Police Officers, Sheriff’s Deputies and New York State Troopers on one-to-one conversations, and to a man and woman they all said that they would not shed a tear if Governor Cuomo contracted Ebola while attending a dinner event that included dignitaries from West Africa. Actually, these fine people voiced much stronger opinions of the S.A.F.E. gun law but I was trying to tone it down a bit.

      The basic rule of thumb seems be to exercise prudent ownership of “dangerous” firearms. In other words, don’t wave a “phantom” AR15 around at the local gun club range where liberal visitors might show up.

      It does not work like that now, they would arrest you and enter you house and take them. Then you would have to get a lawyer and fight it, after spending many,many bucks you might win. People are not smart enough to see that there rights are slowly erroding away. So keep voting for all these liberal nuts and see in the future what rights we have left

        This is no longer really true. All gun dealers who eventually close send in all of their 4473s and they are being scanned in. And even stores that never close are often using electronic filing, which is shared with BATFE. Very very few stores are specifically keeping your records private. When you file a 4473 you should assume that it will eventually be logged by the Federal Government.
