And So It Begins: House Dems Move to Ban AR Parts Kits

Democrats filed H.R. 7115 even before they regained control of the U.S. House of Representatives, and now that they hold a solid majority, they’re ready to make their gun control fantasies come true.

Rep. Frank Pallone, Jr., a Democrat from New Jersey, filed the legislation on November 2, 2018, and it’s being co-sponsored by 13 additional representatives. The bill would “prohibit the sale, acquisition, distribution in commerce, or import into the United States of certain firearm receiver castings or blanks, assault weapon parts kits, and machinegun parts kits and the marketing or advertising of such castings or blanks and kits on any medium of electronic communications, to require homemade firearms to have serial numbers, and for other purposes.”

Legislators dubbed the bill the “3–D Firearms Prohibitions Act,” though the text doesn’t mention 3-D printed firearms anywhere beyond the title.

Under H.R. 7115, gun manufacturers would no longer be permitted to sell partially machined receivers for “assault rifles.” Also called “80 percent lowers,” these items do not qualify as “firearms” under U.S. law and have long been a target of gun-control lobbyists because they allow individuals to create “ghost guns,” or firearms without serial numbers.

For those wanting to manufacture a firearm without using an 80 percent lower, H.R. 7115 also requires all individual firearm makers to request a serial number from the federal government before creating a firearm. The prospective gun maker would contact a federal firearms dealer, who would issue the number using the same process as any other firearms transfer.

But the bill also targets serialized, do-it-yourself AR-15 kits by outlawing “assault weapons parts kits” and “machine gun parts kits.” Strangely, it also prohibits companies from advertising 80 percent lowers, AR parts kits, or machine gun parts kits. According to the law,

(a) In General.—It shall be unlawful to market or advertise, on any medium of electronic communications, including over the Internet, for the sale of any of the following:

(1) A firearm receiver casting or firearm receiver blank or unfinished handgun frame that—

(A) at the point of sale does not meet the definition of a firearm in section 921(a) of title 18, United States Code; and

(B) after purchase by a consumer, can be completed by the consumer to the point at which such casting or blank functions as a firearm frame or receiver for a semiautomatic assault weapon or machinegun or the frame of a handgun.

(2) An assault weapon parts kit.

(3) A machinegun parts kit.

It’s unclear why the bill bans the advertising of already prohibited items, but political grandstanding has always trumped logic on the anti-gun priority list.

For those hoping to get around the law by simply purchasing individual parts rather than a complete kit, the bill has that covered, too. It defines “assault weapon parts kit” as “any part or combination of parts designed and intended to enable a consumer who possesses all such necessary parts to assemble a semiautomatic assault weapon.”

So much for that loophole.

Gun owners can also say goodbye to building Ruger 10/22’s. A “semiautomatic assault weapon” is, according to the bill, “a semiautomatic rifle or semiautomatic shotgun that has the capacity to accept a detachable ammunition feeding device.” Under H.R. 7115, a parts kit for a .22-caliber child’s rifle would be considered just as deadly as a kit for an AR-15.

With the Democrats in control of the House, passage of H.R. 7115 is more than possible in that chamber. The Senate is a different story, as Republicans expanded their majority, and President Trump has remained a solid supporter of Second Amendment rights, despite some concerns early in his presidency.

Still, Washington is the capital of backroom deals, and it wouldn’t be the first time Republicans concede ground on one issue to get what they want in another arena. H.R. 7115 doesn’t ban “assault weapons,” after all, and who really cares about 80 percent lowers?

    Here is what is called a “novel legal theory”:
    If you buy an article today (while it’s legal) and tomorrow legislation makes it “illegal,” that law is an unconstitutional ex post facto law.
    But you say it doesn’t criminalize the possession on the first day, how can it be an ex post facto law?
    Because any law that purports to criminalize the current possession of something that was legal to purchase and own earlier must, in order to divest the owner of the right to possess the article, <reach back and criminalize (i.e. make illegitimate) its acquisition as well.
    If an article of property was legally purchased and possessed, the owner has a right to that property, a right the government cannot break into without the constitutionally-guaranteed due process of law, which includes trial and conviction for a crime. It’s the only way government is authorized to take your property (the illusion of seizures in admiralty – aka “civil forfeiture,” which are seizures for crimes other than the possession of the property being seized – excluded).

    They may as well ban shovels. I’m referring to the story back in the early 2000″s of a gentelman that built an AK from a shovel using the blade to construst a receiver and used the handle as the stock. All he needed was the fire control group, bolt and front and rear trunnions. You can do the same for an AR. There used to be an 80% receiver that was built by just sandwiching sheets of metal together and then welding them up. Sure it was ugly but it worked.

    All this is just the non-common sensed liberals trying to take away guns from law abiding citizens. Criminals will always do criminal things like stealing guns, or buying them illegally then filing off serial numbers if they really cared. A serial number has yet to tack down a criminal. If they think they would be caught with a murder weapon they would just throw it away. what do they care.

    I’ve yet to see a story of any criminal taking the time to find a parts kit, order it, then get the tools and knowledge to build it, then use it in ANY criminal offense. Its easier, and cheaper to buy a gun on the black market or through a straw purchase, which if discovered, doesnt ever get brought to court. The last story i heard of our government chasing a straw purchaser was when Prez Obama had his ATF conduct operation Fast and Furious that lost track of over a dozen ARs into mexico which later turned up at a Border Agents murder scene. How come they dont go after that agency for incompetance.

    It is illegal to lie on the forms for buying a firearm yet anyone caught is never brought to trial, they had those numbers published years ago as well. Havent seen anything like that, ever, in the news.

    Every story is about a criminal that had a gun that they stole or was bought legally but they had a known mental illness. Its right there on the form asking about it, how they dont tell the gun shop they were mentally defective. Because they are breaking the law, want to break the law, and will break the law.

    Laws are only there for people that obey them, thats why they are called criminals and we are law-abiding citizens. They should put their efforts into to stopping the law breakers, not us.

    Normally I’d post a list of credit card providers who have demonstrated Anti-2A behavior but it wouldn’t see the light of day here. It’s been deleted before. GA thinks it supports the 2A but contributes to its demise by accepting anti-2A credit card poviders. GA gets a little rankled when somebody tells others to cancel credit cards that contribute to its sales.     When is enough. At what point do Americans decide that the lawmakers and the courts no longer respect the constitution as their rulebook, and stand tall in defiance?

    Are we past the point of civility, of elections, and of debate. Have we reached the point of tyranny by lawmakers that the people must act in civil disobedience?

    The proposed gun laws that communists are writing will ban the selling of gun parts, ban magazines, ban private sales, and require a serial number and registration of all home made guns. Of course if you cannot buy gun parts then home made guns becomes very difficult.

    Its clear that the proposed laws are a step in the total scheme to register all guns with the government. Of course this is a kill me first list that gives the feds a list of where to go and what guns to take. Its a national confiscation registry.

    The second amendment has been violated and watered down since it was written. The Supreme Court is the biggest violator of the Constitution but lower courts are catching up. How much longer are Americans going to allow their government to violate their rights ? When is enough ?

    It’s certain that the slide toward communism in America will insure the confiscation of privately owned arms will happen. When will enough be enough?

      If the Senate trades something and pass this Un-Constitutional Bill, we can only hope that Trump veto’s it. The Dem’s are signaling if they ever regain control they will look to repeal 2nd Amendment.
