Dems Urge Obama to Close ‘Loophole’ via Executive Action

Democrats in Washington D.C. are asking President Obama to use executive action to close the so-called “gun-show loophole.”

Ninety-six representatives and 24 senators signed separate letters with the same message addressed to the president urging him to “investigate and pursue all available options under your executive authority to reduce gun violence,” reads the senate letter.

The purported loophole allows the private sale of firearms without a background check by those not “engaged in the business” with only licensed gun dealers required by law to perform the checks.

Specifically, the Democrats want the administration to provide clearer and broader language about who must administer background checks when selling a firearm.

“Updating the definition of ‘engaged in the business’ to provide more explicit guidance as to which gun sellers are required to obtain a federal firearms license would not impact a father giving a gun to his son, or an individual selling his gun on the internet,” the Senate letter reads. “But it will help ensure that individuals are not able to continue to exploit ambiguity in the current regulation and sell guns at a high volume without any oversight by ATF and without conducting background checks.”

The effort, led by Sen. Chris Murphy of Connecticut and Rep. Mike Thompson of California, echoes Democratic frontrunner Hillary Clinton’s pledge to use executive authority to close the loophole.

The language of the letters may be especially worrisome to gun rights advocates, with the House document urging the administration to act regardless of the elected officials who oppose tighter restrictions on the sale of firearms.

“In the face of Congressional inaction, your administration could take an immediate step that would have an important impact on limiting gun violence,” states the letter.

The senate letter goes even further, boldly stating the true intent of the action:

“This change would be a positive step forward in achieving universal background checks, a policy change that roughly 90 percent of Americans support.”

The Huffington Post notes that Obama has used his executive authority before, having signed 23 executive actions on gun control after the massacre at Sandy Hook. However, the administration argues, there is only so much Obama can do on his own.

White House press secretary Josh Earnest said earlier this month that he’s not sure if Clinton’s proposal is actually feasible.

“I’m not sure that the administration has conducted a legal analysis of their specific proposals,” Earnest said during a Nov. 3 briefing. “But what the administration is doing, at the direction of the president, is actually carefully considering what authorities are available to the president and looking to see if there are some additional steps that can be taken to prevent criminals … from getting their hands on a gun so easily.”

    Isn’t it interesting that the ruling class never has to explain just how their schemes will achieve ANY effective results? It must be great to be in a career where problem creation is the measure of success– not problem solving.

    Time to stop thinking of gun control as a dumbacratic issue only. Retardicans are also guilty of infringing upon our constitutional rights. Even the NRA has failed by characterizing open carry as not normal when in fact the SCOTUS has already ruled that the 2nd/A protects open carry.

    The SCOTUS has also already ruled that the “regulation” of firearms sales by states is not a violation of the 2nd/A. As another commented government ratchets down on freedom and rarely releases. In other words it is easy to pass a bad law and near impossible to remove a bad law. As citizens we are obligated to follow the law of the land. This is not to suggest we should not question and challenge. My hope is that SCOTUS begins to challenge the state laws as unconstitutional. This idea is not gaining any mmomentum since SCOTUS to date has not ruled and has chosen not to hear those arguments until such time that the laws are overly enforced / abused. This is based on a recent decision by SCOTUS not to hear arguments regarding the city of San Francisco’s law requiring people to lockup firearms in their own house.

    The part that kills us law abiding citizens is access to the courts and making sure we get equally capable legal representation. Unfortunately the law is as much politics as it is supposed to be doing what is right for the citizens. Our suposidly best advocate the NRA is so imbedded in the retardican party that I personally do not trust them. We all known that the majority of representatives do not represent anything but themselves. The idea that ACLU might start to really pay attention to 2nd/A infringement is encouraging.

    While I like many others here think that at least one mass shooting is pure propaganda and that all others are used as propaganda for infringement upon the 2nd/A, that type of politicizing will go over the average citizens head. Not a good outcome and self awareness has to be learned. Very few of us, if any, possess the skill to teach others how to be more aware.

    Best thing any citizen can do now to protect our rights is to actually own a gun. Be smart and talk to one person a day as an intelligent advocate.

    If some politician would come up with a way to stop criminals from gaining access to firearms, I would be willing to have a conversation but every argument they have is only meant to restrict access to law abidding citizens. Stop making stupid suggestions to impress ignorant voters. Left wingers want gun control-end of story.

    How about the government focus on MENTAL HEALTH CARE for crazed individuals instead of attempting to take guns from law abiding citizens? Obviously, mass killers are mentally deranged, yet the government has NO PLAN NOR PLACE for these people to be institutionalized?

    Making new laws will not diminish the amount of guns in criminal hands . Criminals do not care about any laws ! The only people they are harassing are the people who actually try to abide by the law , not any criminals ! If these so called intelligent
    people haven’t figured this out by now . they should all be voted out and sent home to learn about real life . Let them try to get a real job for a change !

    While there is no doubt that many in the govt, especially some of the Dems, plan to eventually get the guns but they know they can’t do it all at once, so they will take one step at a time, while they continue to use the media to persuade the masses that they will be safer when only the govt has guns. Anyone with half a brain knows this and also knows what eventually happens once only the govt has guns. History repeats itself and that is very unfortunate. Now for the part that will generate hate mail. While I can hardly believe that the govt is actually proposing something (although their motives are not good “already stated above”), that kind of makes sense, as I have watched individuals buy and sell large volumes of firearms who don’t have an FFL. And they are using the “private collection” language to work around it. And while I don’t have a dog in that part of the fight, however, why should individuals go through the process to get an FFL and do all the paperwork, etc. and there are folks buying and selling without doing it? I like being able to buy and sell some of my private collection, but these folks absolutely aren’t selling their private collect. They are buying and selling as a side business and that is not what suppose to be happening. And as it always happens, those who abuse the system, screw it up for us all. And while this step will help cut that down some doing this, and maybe reduce the chances of someone buying who shouldn’t, we all know that they will just get one some other way. Black market, steal it, etc. The fact is, criminals don’t follow laws “duh”!

    These ones that sent the letter did so because they know that they cannot get it passed the legal way ie. through Congress itself. That pretty much shows that it is not needed nor wanted. Also they have lied so long about the number of Americans ” wanting ” more gun control I believe that they now actually believe their own lies. I read an article where they had gone to different prisons and ask the criminals that were in for different felonies where they had gotten their illegal guns and each and everyone said either by breaking and entering and stealing the firearm or buying it on the street from another criminal that had stolen it. Two simple steps would stop the majority of crimes committed with firearms. One is to enforce the laws that we already have and the second is to STOP any and all PLEA BARGAINING period. Just by doing these two simple things would cause a big drop in crimes committed with guns. Make the sentences long enough that would make any criminal simply choose NOT to buy nor use a gun in their commission of their crimes. When a criminal knows his lawyer can PLEA BARGAIN his charge as well as his sentence down to basically nothing ie. a fine and or community service he will continue to pursue his life of crime. The two items I mentioned are extremely simple but therein lies the problem as anything simple will be made very complex by the politicians as well as a lot of people losing large amounts of money because crime pays by employing more LEO’s, lawyers, judges, prisons, and anything else that money can be made from the crimes and criminals. Sad but true

    There is no such thing as “The Gun Show Loophole”. Read the Oct American Rifleman, “Standing Guard, Existing Laws” and you will understand that under Federal Statutes already on the books any Seller who knowingly sells to a prohibited possessor or a firearm Buyer who is a prohibited possessor has committed numerous Felonies. If in doubt, check US Code Title 18, Firearms Sec. 922 A
    The Federal government has failed to prosecute and deferred to local jurisdictions except in the highest profile cases. One can only assume that it is not so much as a States Rights issue as much as it is “not on my budget” issue. So, don’t let anyone tell you that there is a gun show loophole.

    I find it fascinating that members of Congress are urging the President to go around them as the legislative body in this country and enact laws not passed by that entity. Somehow, that smacks of complete and actual stupidity. They may think it’s neato/keeno to urge that for their pet project, but what’s to happen when the shoe is on the other foot and we have a Republican President and he does what Obama is doing, i.e. violating his oath of office to protect and defend the constitution. That’s the problem with liberals. They go for the expedient over the calmly rationed approach. If it fits their agenda, then it has to be enacted RIGHT NOW!. That’s not the basis of our representative republic’s founding. But they don’t care as long as they can whine loud enought to get their way.

    Another day another way the Democrats find a way to screw the small businessman/woman. Gun dealers and owners attend these gun shows to sell there wares. They for the most part are honest, hardworking, every day Americans just trying to make a buck. While the Democrats portray them as the Evil gun show purveyors of death and destruction. I’ll bet these idiot Democrats have never gone to a gun show or for that matter even seen a real gun. But all they want to do is mess with peoples lively hood. Making it ever more expensive and difficult for these people to stay in business. While setting up another level of unnecessary bureaucratic restrictions…

    What gun show “loop hole”? All ATF licensed dealers are required to do background checks whether they sell from their shop, a gun show or out of the car trunk. What rankles the liberals are the private parties and collector “not engaged in the business of selling firearms” selling their personal guns at a gun show. This is just a fancy way of getting the camels nose under the tent in regulating all transfer of firearms between private parties and private parties + licensed ATF dealers, which is in direct contravention to “shall make no law…” directive in the 2nd amendment regarding the right to keep and bear arms. The “spontaneous and unsolicited” letter by a paltry handful of liberal senators and congressmen to an unsuspecting president is designed to create a hoax of the existence of a”loop hole” that doesn’t exist and the problem they see is to prevent the creation of new gun owners who come into being by buying a gun from a private citizen without their permission.

      It’s the first amendment that says Congress shall pass no law etc. The second amendment is much more absolute in that nobody is allowed to infringe on our right to keep and bear arms. It means exactly what it says.
      “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
      Requiring a permit is an infringement. Forbidding certain types of weapons is an infringement. Barring weapons from certain areas is an infringement. The Second Amendment IS my concealed carry permit.

    I believe that most anybody can go to a gun show and buy a fire arm from an individual and take it with them, if they buy from a dealer at the show the dealer will have to do a background check, I believe that is the loop hole they are talking about.

    I am a FFL Dealer and Duty Disabled/Retired Policeman. I have sold at Gun Shows and TOTALLY AGREE that there should be some kind of background check for ANYONE buying a firearm for the protection of the Seller as well as the public. I HAVE REFUSED TO SELL TO MANY INDIVIDUALS THAT BEHAVED THE SAME WAY AS THE OVER 2000 SHOOTHEADS I LOCKED UP IN MY CAREER! The first CLUE is when a person is told they have to fill out the form to transfer they claim “they dont want the government knowing their business!”….which is TOTAL BS, especially if their born in the U.S. and already have a Social Security card or Drivers license!!! THE REAL REASON IS THEY HAVE PREVIOUSLY BEEN ARRESTED AND/OR ALREADY KNOW “THEY WOULD NOT PASS ANY BACKGROUND CHECK!”

      Hey Mark, What does being ‘born in the U.S. and already having a SS # and Driver’s license’ have to do with NOT Wanting the Government to know your business, ESPECIALLY WHEN IT COMES TO PRIVATE PURCHASES? Just because we have those, do we automatically give up our 2nd and 4th amendment guarantees?

      You must have been on the job too long? Which was long enough to make you develope ‘police state’ tendencies putting you in the with ‘Them’ in the ‘Them against Us’ battle. I’m a LEO and haven’t bought a gun on a 4473 in Ten years. I prefer private transactions. Because I refuse to be a contributor to the slippery slope of eroding our Constitutional right to private property purchases. Because It’s stupid because people who want to use guns criminally will get them from the infinite store of guns already in private hands, one way or another. I don’t like to be ‘stupid’. And It’s not just guns. There’s a parallel effort to ‘register’ if you like, ALL property eventually with records of ALL purchases big or small. Do you know about that? Like the slow creep total gun registration agenda for eventual confiscation and public disarmament, They’re on a parallel underground railroad track coming soon to everyone’s personal ‘station house’. Think about it. It’s right under your nose. You’re likely already contributing to it. When you get the epiphany you’ll have the profound revelation of why it is so desperately important to stop all gun control first.

      What many are missing here is that the idea of background check registration and purchase records were originally ONLY supposed to be for commercial business firearm transactions NEVER private party transactions. But before that your local Sears &Robuck stores sold over the counter guns with absolutely no paperwork and no background checks other than your cash and carry store receipt in case you wanted to return it.

      So FFL licensing was ALSO part of the great American Gun Confiscation agenda when it was first implemented, and Now, in true slippery slope application, they want it ‘Universally’ in application fpr ALL private exchanges as well! Are we all really that stupid?

      The other concept that seems impossible to be ‘grasped’ by so many is that there’s a reality check with being the most Libertarian Free Country in the world. The simple factual truth that in such a country you simply CANNOT control evverybody–especially non-law abiding criminals–as well as countries who do not have such ‘liberties’, to a point where all behavior, thus all crime, can be eliminated.

      So you have to take some ‘bad’, with the Good.

      Too many people believe that it’s okay to give up some of your precious freedoms for a little more ‘potential’ security. To me, this is the height of weakness and absurdity. America was never built on weakness. We recognized that life was neither safe nor easy. We evaluated our own self respect and value by how well we could handle, survive, and prosper through social and personal adversity because we had the Freedom to make life changing decisions for ourselves. It makes for a higher evolution of the species. We made our own decisions and didn’t rely so much as we do today on a ‘nanny police state’ government.

      This type of government has never really been proven to work well in other countries. Especially in a government predisposed to capitalizing on restricting the people for its own avaricious agenda. They all eventually become despotic entities with not many civil ‘rights’ left for the people.

        You are right on! I can remember my Grandfather and even my Father ordering firearms through a catalog and those very same firearms being delivered by US mail! So those of you that think our rights haven’t been eroded over the years just haven’t been around long enough to know the truth! Some of those firearms were even made before serial numbers on each one existed, that actually cost extra and many didn’t want to pay for a traceable number on their firearm, even way back then!

    BTW, not even a quarter of Congress signed letters. That tells us one thing. Three quarters of Americans do not want gun control and the only way Obama & Clinton can get it is DICTATE it!

    So under this action, Grandpa will be required to do a background check (submit many forms, money, wait for government OK, etc) before he may gift his classic .22, he had as a young boy, to his grandson for Christmas morning. And that will reduce crime how again? This Marxist Democrat Party has turned into just that. The leaders are pure evil and the followers are lemmings.

    Maybe they would do well to begin to go-after criminals instead of honest and legal citizens; well, if the Marxist Party (Democrats) have their way, there will be no more honest and legal citizens. But what better way to destroy a once great country like the USA? King Obama has achieved a pretty good start; and the Democrat lemmings are sure to follow him off the cliff.

      Take it easy Junglebook Larry! If you knew anything about the actual background checks and who gets them, you would be embarrassed. Checks are required for handguns and assault weapons. Your Grandpa’s purchase of a .22 will be free of a check, just like it has always been. Get a grip! It’s obvious you hate this Prez, but you are wrong in context and have never read anything about Marxism. Best to just stay quiet.

        You are blind to what they are doing if you think that they will stop with this action. They will keep infringing on our rights more and more and more as quickly as they can get away with it. Anyone who thinks otherwise is seriously mistaken. It’s what they’ve been doing since the first time they used federal money for a local flood about 1857 or so. There’s nothing in the constitution that allows them to do that. There’s nothing in the constitution that allows them to take our money and give it to others either. Their sole job is to prevent invaders and make sure that all the states treat each other equitably.

        Now I know for sure you’re a left wing troll. “assault weapons” really? Background checks are required for .22’s, shotguns, and everything else that’s considered a modern firearm. Only muzzleloaders are exempt.

    We only have the illusion of our Constitutional Rights. Since 911 both Bush and Obama have taken away our freedoms. Under the 2012 NDAA’s Sec. 1021, Pres. Obama agreed to give the military the power to arrest and hold Americans without the writ of habeas corpus, although he promised with that year’s signing statement that his administration would not abuse that privilege. Since when do believe a President when he quote “Promises” to do anything. For the most part, they are all a bunch of LIARS. They have a plan to disarm every law abiding American. It is being done ever so slowly. Piece by piece they are chipping away at our ability to own firearms period. Don’t forget Homeland Security bought 1.6 billion rounds of ammo back in 2013. At the height of the Iraq War the Army was expending less than 6 million rounds a month. Therefore 1.6 billion rounds would be enough to sustain a hot war for 20+ years.

It’s a tacit admission that the actually intend to round up American Citizens who openly resist tyranny and put them in internment camps for as long as ‘They’ feel like it. It was planned to fit in with the latest one -escapes me momentarily- that authorizes the Secretary of State Office to ‘administratively’ sanction anyone they subjectively ascertain to be ‘aiding and abetting’ terrorism. Starting with putting them on a no fly list, freezing assets, etc. No Due process at all. Just a State Department Decree!

      And yup, don’t forget that the DHS also is in the process of procuring 7000 new very light and compact PDW AR platform 5.56 automatic weapons. LCWR, I believe, has one they’re interested in. Perfect for ‘Urban’ warfare.

    It doesn’t matter what he tries to do – who is going to comply? State by state, gun owners are just refusing to go with the program. They are declining to register, declining to surrender, and continue to openly sell guns on a person to person basis without any paperwork. CT, NY, MD, WA, and last week – the City of Los Angeles. That one was a magazine surrender program mandated by the city government. Last I read there were exactly ZERO magazines surrendered prior to the deadline. Zero!

    And 96 Dems who requested that the POTUS circumvent the Constitution and do by fiat what they (Congress) are supposed to do (legislate) but afraid to lose their jobs over? That’s a pretty long ‘target list’, but not unrealistic. Vote them out! Vote in their primaries for any other Dem challenger, because in Congress power comes with seniority – committee chairman seats, e.g., and the new guys will be ‘weaker’ if elected. Then vote Republican in the regular election. You may have to change your registration along the way depending on your state’s voter registration laws, but who cares? It’s a tactical change… not your life.

I have been a Democrat for over 40 years and I’am embarrassed by their stupidty . Most Repubicans are pro gun and we need to get more of them in office. This is easy to do and will shock the Democrat party.

      I’m sure you’ve heard the addage that “when guns are outlawed, only outlaws will have them”. That tells us that those bent on committing a crime using a gun, couldn’t care less about the laws against such action. We don’t need more laws for people who obey them; we need better enforcement and stiffer penalties for those who don’t. And we certainly don’t need laws that assure the aggressor that his potential victim isn’t carrying a loaded gun. KEEP ‘EM GUESSING! That, in itself, should help some to reduce the number of daily/nightly assults being committed on this little planet we live on.

    Each of the House members and Senators who are urging the President to take executive action on gun laws should be cited for failure to uphold the Constitution as they have sworn or affirmed they would do. Article I, Section 1. clearly places all legislative power in the hands of Congress. This also means that the President has no power to issue executive orders outside of his own little world.

Why should it be different buying a gun from a show vs. any legal gun shop? If federal laws abide regarding background checks on purchases everywhere else (even online), then why is there a fight enforcing the laws on gun shop shopping? WHY? If you are a patriot, then you MUST be law biding! There is and shouldn’t be ANY double-standard when it comes to gun sales. Not one! I have guns, but follow local, state, and federal laws regarding purchasing. The laws have always been there and gun shows have been breaking those laws in my book. When someone wants to purchase a weapon from someone (not a business vendor) all they will have to do is to exit the gun show and make a very legal Face to Face transaction, then re-enter the gun show and continue on per usual. F2F transactions are legal and have been so since before the Bill of Rights was passed.
          All this executive action (by the most non-transparent administration in history whom also swore not to use executive action) would accomplish is to make the 2 individuals walk out of the show, make their transaction and then press on.

          Why are people always blaming gun shows, guns, or the buy and sale of guns for the reasons why criminals use guns, knives, bats, or any weapon for their purpose. Instead of enacting more gun laws, why not punish severely those that use them in a crime. Think of it like this. you are homeless, jobless, no family, no ties to the community, need food or drugs, what is the worst that can happen you get caught committing a crime. go to jail, get three squares a day, cable TV, a warm place to sleep, education, health care, dental care, and learn more about committing crimes without getting caught. This is the deterrence for committing a crime. Now, commit a crime using a weapon, killing someone, they should die. This is deterrence. End of discussion.
          Cheap way for government to take care of the wrongful buyer geeting a gun at the gun show or from individual sales, it is very simple. All states require a drivers license, or state ID. On this ID if a felon or domestic violence charge, place a letter on the ID, U or A, unable or able to purchase a firearm. Make everyone look at ID. Perfect gun control with no control.

However, strengthening sentencing of those that use guns in crime would definitely attack the criminals where they live. The only gun I ever sold was a Walther P-88 to my uncle who is a rabid collector. I never really understood what “Libturds” call the “gun show loophole.” One day, at a local gun show I fell in love with an old custom sporter Mauser. I paid the guy and then asked when I could pick it up. In Florida we have seven days, unless you have a CCL. To my surprise the fellow said, no, take it know. I then realized that he was just a private citizen with more guns than his wife wanted in the house. The best metaphor is a swap meet. So you see, there is no loophole. That is only a buzz word. It is simply a private sale. It would be the same if I put an ad in the paper, saying “Remington 1100, 12 ga. 30” brl, full, for sale. No legal difference whatsoever. As such, I hope that you see that closing “the gun show loophole” is only a farce and another step towards curtailing our rights under the Const. Remember, the government is a uni directional ratchet. It only tightens and never loosens regardless of the party in charge.

          As the law currently exists, there is no restricting any individual from making a personal sale of a firearm, or firearms. There is not any proof that any gun sold at a gun show has played a part in any of the many shootings we have witnessed in the past or present. The problem is one of rabid anti 2nd amendment propagandists lies being repeated over and over and the uneducated buying into them. The criminals do not buy their weaponry at gun shows, nor do they get them from licensed dealers. The black market is how criminals obtain firearms and by burglaries and other thefts. They are criminals and do not have any problem with violating the law in order to get their weapons. It is about time someone was able to communicate this concept and that people started becoming adults in their realization of the facts. We have had enough of the lies and propaganda, and not enough of law enforcement.

      All gun sales require a background check? Sounds like a foot in the door to make private gun sales illegal. Just how
      will this be enforced if I sell a buddy a shotgun or pistol?

      To reduce gun violence it is simple effective immediately bring back the death penalty for all who illegally murder any US citizen whether it be man, women, child or babies no matter of skin color, race or religion.

      Stop and deport all Illegals including muslims from inside the US boarders.

      Shut down by force all Muslim Terrorist Training Camps inside the US – arrest and tried for conspiracy and murder of the US citizens.

      Disarm and try all drug gangs for murdering of babies, stop all illegal drugs from coming into the US. Place our Military at the boards to help close it. Shot anyone whom crosses it coming in from Mexico and Canada.

      Try all politicians on ground of treason for total and complete FAILURE to their Oath of office and payment from FOREIGN COUNTRIES including Murdering of Americans by Hillary Clinton and Obama and the rest.
