Disarm Hate Act Introduced: Would Permanently Revoke 2A Rights for Misdemeanor Hate Crimes

2nd Amendment – R2KBA Authors S.H. Blannelberry This Week

Two Democratic legislators introduced the “Disarm Hate Act” this week, which calls for the permanent revocation of 2A rights for any misdemeanor offense deemed to be a hate crime.

The bill was brought to both chambers, via Rep. David Cicilline (D-RI) in the House and Sen. Bob Casey (D-PA) in the Senate.  

Sponsors believe the bill closes the “Hate Crimes Loophole” by banning the sale and possession of firearms for anyone convicted of committing a crime on the basis of race, religion, gender, sexual orientation, gender identity, or disability.  

“Over and over again we have seen what happens when a convicted white supremacist, white nationalist, or neo-Nazi is able to purchase a gun,” said Cicilline, who serves as Vice Chair of the House Gun Violence Prevention Task Force, in a statement obtained by GunsAmerica.   

“This bill closes the Hate Crimes Loophole and makes it much harder for someone to give voice to their hatred in a volley of gunfire. It’s just common sense. If you’ve been convicted of a hate crime, you don’t get to buy a gun. Full stop,” he added.  

John Feinblatt, the president of Bloomberg-funded Everytown for Gun Safety, cheered the measure.  

“When hate comes armed, it can be deadly,” said Feinblatt. “But right now, there is no federal law that prevents people convicted of misdemeanor hate crimes from owning or buying guns — a situation that defies both common sense and common decency.”

“We applaud Rep. Cicilline and Sen. Casey for honoring the victims of shootings at the Chabad of Poway, Tree of Life Synagogue and thousands of other preventable tragedies for introducing legislation to disarm hate,” he added. 

While the Left would have you believe that hate crimes are skyrocketing in the age of Trump, the data paints a different picture.  An analysis by the Bureau of Justice Statistics suggests that while reported hate crimes have increased in recent years, the number of unreported hate crimes have dropped over the same period. 

Meanwhile, the overall total of both unreported and reported hate crime victimizations has remained somewhat steady over the past three years but down significantly since 2014 and the previous years when Obama was in office.

Alan Gottlieb, the founder of the Citizens Committee for the Right to Keep and Bear Arms, raised an interesting point about the difficulty of defining a misdemeanor hate crime and the potential for anti-gunners to use this legislation to target law-abiding gun owners.

“The devil is in the details,” Gottlieb told GunsAmerica in an email. “Who defines what a misdemeanor hate crime is? Is protesting and calling an anti-gun politician an ugly name a hate crime?”

“I have no doubt that this will get out of hand and only disenfranchise legitimate firearms ownership,” he continued, adding “Congressman David N. Cicilline (RI-01) who is the sponsor of this legislation has a track record of demonizing guns and gun owners.”

    The 2nd Amendment reads “Shall not be infringed.” The wisdom of the founders, to word it like that. No sneaky small incremental bites to eventually nullify it that the Liberals are so fond of. Unless the Law has some reason to revoke all Constitutional rights (such as a convicted felon), it is obliged not to even tamper with any of them.

    Any time you see the words “Common Sense” in any bills introduced you know they fit into one category.
    Lets just say that these politicians talk more BULLSHIT than a manure salesman at a fertilizer convention.
    Here’s a little info about me. I grew up in a Pittsburgh neighborhood not far from the Tree Of Life Synagogue.
    I spent many days in the area known as Squirrel Hill where that building stands. The high school there is
    Taylor Allderdice. For many years during my high school days they had riots almost on a daily basis as well as the school that I attended in Hazelwood named Gladstone. I was often a victim of the violence imposed on the white students for no other reason than the color or their skin. I get fed up of reading, seeing and hearing how racist whites are. As if no other race shows racism!. And FYI I happen to be a Latino. Maybe these politicians propose all this “Feel Good” legislation because of the sins of their Forefathers.

    What crime isn’t a hate crime? Crappy people do crappy things. Giving people of another color more rights than another is racist. The whole idea of hate crimes is a hypocrisy. If a white person attacks a person of a different color and it is consider a hate crime they get more jail time. That itself is racist as it is vice versa.

    I’m curious how this is news, because the two bills allegedly introduced do not have their House and Senate numbers published in the article, and any reference to “Disarm Hate” only comes up with two hits. Both are from the 115th session of Congress.

    The currently sitting Congress is the 116th session.

    Those two bills were introduced in 2017 and died in committee.

If you could actually stop hate by outlawing it we shouldn’t still have this problem. If someone hates somebody and has evil intent, denying them a gun is not going to stop them, just ask the Mayor of London.

    if I physically attack someone, that’s one thing; but if I offend them because of something I said that’s not really in the same league.

    As someone whose opinion on the second amendment most closely aligns with the late great Antonin Scalia I am appaled by the opposition to this.

    Those convicted of hate crimes should not have access to weapons. In those hands they become tools of oppression and not a means of securing freedom.

    It is very easy to make a gun. I made a .50″ caliber pistol when I was 15, and then produced another pistol in 12-gauge caliber. My mother found my guns under my bed, and completely freaked out. That was the worst scolding I ever got, and she called up dad, who said “These are murdering guns.”

    Since he used to beat mom up, I explained who they were intended for.

    You could have heard a pin drop after that. He got up and left right away. Mom let me keep them.

      Atheists don’t typically attack Christians. Historically, it’s been the other way round. Atheists generally don’t care about Christians at all until Christians try to impose aspects of their belief system into state and federal governments. That that whole separation of church and state thing.

      Muslims now, that’s a different matter entirely. Anyone who has studied Islam in any depth and understands the Quran, and Haddiths; as well as the Tafsirs (exegeses of Islamic scholars) will attest that it is a horribly oppressive religion, and absolutely intolerant of non-Muslims.

          Religion in any form was only created as a way for leaders of civilizations to explain why things happened and ease the minds of confused people, in a time where science and an understanding of how the world and the universe worked.           Better refresh yours. you’re conflating lack of religious beliefs with political ideology. Communist leaders typically suppressed ANY religion, as it was a threat to their authority. That had nothing to do with being an Atheist. HISTORICALLY, Christians have tortured/killed/ostracized unbelievers/heretics, not the other way round. Especially considering until recently the numbers were overwhelmingly on the side of the Christians.

          And as far as not keeping God out of government, they were absolutely NOT clear on that. Many of the founding fathers were, if not true Atheists, certainly Christian skeptics, with little tolerance for the supernatural nonsense in the bible (John Adams, George Washington, Benjamin Franklin, and James Monroe come to mind to name a few). So for you to say they didn’t recognize the harm that allowing religious beliefs (anyone’s) into our Government could cause, is a little naive. The Supreme Court agrees, as they have decided in multiple cases that there is absolutely a wall between the two. I don’t want your religious beliefs forced on me, anymore than you want a Muslim’s forced on you.

    What I said before is starting to come true. They will not come for your guns head on, but just increase the crimes that cause you to lose your gun rights. That is a scary sentence I just wrote, as when the government allows itself to take away one of your rights, others will soon follow. Our corporate elected representatives in Congress see no problem with that, as their controlling corporations see no problem with it. They have their millions and private armed security guards, but you do not.
