Everytown Cheers Reintroduction of Universal Background Check Bill: A 'Critical First Step'

Joe Biden’s gun control agenda is moving forward, and anti-gun groups are hopeful the new universal background check bill is only the beginning.

House Democrats were joined by three Republicans this week in introducing legislation that will ban the private transfers of firearms between anyone who is not immediately related.

Rep. James E. Clyburn also introduced a bill that would close the so-called “Charleston Loophole” by eliminating the policy that a firearm can be transferred to an individual if the FBI has not completed a background check within three days.

In a conference call with reporters, representatives from Everytown, Moms Demand Action, and other anti-gun groups emphasized that this legislation is only a “first step” to achieving their no-gun utopia.

“While the fixes in these bills can’t solve the entire epidemic of gun violence, they are a critical first step,” said Kris Brown, President of the Brady Campaign to Prevent Gun Violence.

Gregory Jackson Jr., the National Advocacy Director at Community Justice Action Fund, reiterated Brown’s “first step” language.

“While we’re excited about this step forward… we see this as a first step. A first step towards a comprehensive solution that will address the gun violence in our communities,” he said. “We remain committed to holding [Congress] accountable and to advocate for additional steps to address this crisis.”

The full text of the background check bill has yet to be released, but if it copies the bill that passed the House last year, it bans private sales entirely and only allows “bona fide gifts” between spouses, domestic partners, parents and their children (including step-parents and their step-children), siblings, aunts or uncles and their nieces or nephews, or grandparents and their grandchildren.

However, even those bona fide gifts are allowed only if “the transferor has no reason to believe that the transferee will use or intends to use the firearm in a crime or is prohibited from possessing firearms under State or Federal law.”

Rep. Clyburn’s background check bill gives the FBI a full 10 business days to complete a background check that has been delayed. Once those 10 days are up, a prospective buyer can petition for “escalated review to spur the FBI to complete its investigation,” according to a press release.

The sale may proceed if the escalated review has not been completed within an additional 10 business days, allowing the FBI to delay without reason a person’s Second Amendment rights for a full four weeks.

Gun rights groups have blasted Clyburn’s bill as an infringement on the constitutional rights of law-abiding Americans.

“This bill increases the burden on small business firearm retailer owners and flips the burden of proof on its head,” said Lawrence G. Keane, Senior Vice President and General Counsel for the National Shooting Sports Foundation.

“This would make it incumbent upon the law-abiding citizen to prove his or her innocence to the government to exercise their Second Amendment right to purchase a firearm instead of the government being responsible for proving an individual is prohibited. This could potentially deny a law-abiding citizen their rights for up to a month, while they are saddled with the burden of proving their innocence. That’s un-American.”

While both bills are likely to pass the Democrat-controlled House, the Senate will be a larger hurdle. Representatives for anti-gun groups insisted to reporters that their historic failures in the Senate can be blamed on Sen. Mitch McConnell refusing to bring gun controls bills up for a vote. Since majority leader Sen. Chuck Schumer is sure to vote on these bills, Everytown and others believe they may be able to pass.

But to overcome the filibuster, Democrats will need at least 10 Republicans to join them in support of these bills, a difficult obstacle in the hyper-partisan climate of Capitol Hill.

    The intent behind such legislative efforts is NOT about stopping a bad person, criminal, mass school, mall or church shooting. The intent driving this legislation is to “DISARM AMERICA.” Do Not Confuse These Points. The total and complete disarming of America can’t take place in one step. It takes many baby steps to eliminate more than 300 million guns from more than 130 million gun owners. To turn this democratic republic into a socialist, communist dictatorship, the nation must be disarmed. Pure and simple. Under Kamala Harris, it is well underway in two months of office. By the way, make no mistake, Joe Biden is NOT President other than in name only. This nation is being run by Kamala Harris & other Socialist leaders who are communicating through Biden. Joe is a complete figurehead.

    OK… So you get a universal check passed. Do you think for one second that some criminal who wants a gun is going to go to the local gun shop and wait for a background check? No… He is going to go to an illegal supplier to get his saturday night special and the crime will still happen. The only ones that you will have any kind of effect on is the law abiding citizen that follows the rules! All these laws and edicts don’t hurt the bad guy at all! THEY ARE OUT THERE LAUGHING AT YOU! The only ones you are jamming up are the guys that like to go to the shooting club on the weekends, hunting in the different seasons for whatever game, and maybe shooting in competitions. Also, when you slap criminals on the wrist, pat them on the head, and say be a nice boy doesn’t cut it either! DO THE CRIME… DO THE TIME! PERIOD END OF FRIGGEN STORY! Until politicians get their heads out of their asses and do the WORK it takes, instead of kissing the asses of whiny liberals, criminals are going to have guns! That is just a fact of life. No matter how much money you throw at it, how many studies are done, or how much shaming is tried, it is only going to get worse.     The following is a “reasonable”congressional bill that needs to be submitted by the Republican leadership:

    HR 556 — Until the Second Amendment to the United States Constitution is repealed, it remains the supreme law of the land and does not require “interpretation” by Congress, the Supreme Court or any other government entity. Federal, state and local politicians who violate their oath of office to author, sponsor and vote for legislation that infringes on the unalienable right of law-abiding American citizens to keep and bear arms are to be immediately removed from office. Presidents who write executive orders that infringe on the right of American citizens to keep and bear arms are to be impeached and removed from office. Federal, state and local government agencies that impose rules and regulations that infringe on the Second Amendment will be abolished. Federal, state and local judges who render court rulings that infringe upon the Second Amendment right of law-abiding American citizens are to be immediately removed from the bench and disrobed. There will be no exceptions to or deviations from this rule of law. Anyone in federal, state and local government who has difficulty understanding what “shall not be infringed” means will be sent to a Constitution re-education camp until they can comprehend plain English and regain their common sense. Like the Second Amendment, this inviolate rule of law applies to all public servants in the United States of America. Violation of this law by anyone in federal, state and local government will result in swift punishment befitting the crime of treason.

    These proposed bills once again become sterling examples of legislative overreach, which we must always expect. But the key here is “…this legislation is only a “first step” to achieving their no-gun utopia.” Thus, it may be only ‘common sense’ to them, but it is only a ‘first step’, as if they haven’t had a string of ‘first steps’ over the past decades.

    I can think of nothing more frightening that a Sheila Jackson Lee nobly empowered by Bloomberg’s unlimited budget. I would like nothing more than to have these communists give us some historical examples of other societies that have achieved their ‘no-gun utopia’. I’m waiting…..

    I am going to quote from a S. Ct. case from the 19th Century when they were still reading the Constitution as was intended. I’d like to hear from anyone who understands what the justices ruled. Particularly the people who write these articles.
    “When we consider the nature and theory of our institutions of government, the principles upon which they are supposed to rest, and review the history of their development, we are constrained to conclude that they do not mean to leave room for the play and action of purely personal and arbitrary power. Sovereignty itself, is not subject to law for it is the author and source of law, but in our system, while sovereign powers are delegated to agencies of government, sovereignty itself remains with the people, by whom and for whom all government exists and acts.” – Yick Wo v Hopkins, 118 US 356 (1886)
    That ruling was not novel. The Founders debated it and that was why they wrote the Constitution with all the power “to execute the Laws of the Union, suppress Insurrections, and repel Invasions” as the province of the people, not government agencies.

And they’ll use it to get reelected touting that they were tough on crime.

    Every proposal for a “universal background checks” law requires the background check for EVERY firearm transfer.

    So let’s understand this in practice:

    1) An adult gives his brother or sister a rifle, and the sibling must legally go through a background check.
    2) A gang member can sell someone a gun out of the trunk of his car, and no background check is needed, and certainly none is performed.

    Someone explain to me the following:
    Why the background check is needed in the first example…
    How the universal background check law will prevent the 2nd example…

    I’ve been writing and speaking about the Constitution for several years. What I’ve learned over the years is that there are very few people who understand our system of government. What is so frustrating is that they will take little time to learn. As a matter of fact I’ve debated with people who call themselves pro-2nd, and they know next to nothing on the amendment and its purpose. I’ve learned that most will show a complete disdain for actually enforcing the amendment as the Framers of the Constitution wrote into the document.
    Nothing in the Bill of Rights is not in the Constitution by literal or implied function of law. So, if they removed the 2nd tomorrow, there are still 3 provisions in the Constitution that require an armed citizenry. Herein lies the issue. The word is require, and you will find very, very, very few people in the pro-2nd community who want to be required to do anything but complain, moan, groan, and lie.
    That’s what I’ve learned over the years. You can’t sell require, but you can sell bad arguments that bring in memberships and contributions.

      The so-called pro-2nd groups want nothing to do with him because there is no money in winning the fight. Or at least that’s what they think. There are so many in these organizations that are opposed to the RKBA as the Constitution commands that it is frightening.
      I was interviewed on a show back in 2019. I outlined a plan, and said that I would do all the leg work. I just needed people to show support. The host of the show guaranteed, based on the size of his show, that he could bring thousands to the table. He wanted me as a regular guest on his show. He liked my ideas, which were nothing more than simply following the law as the Founders intended.
      He is an NRA board member and often has 2nd amendment attorney’s on his show. After my show, I did not hear from him again although I know he did receive requests to have me on again. I had to conclude that the so-called pro-2nd attorney’s and NRA told him to stay away.
      I know for a fact that the NRA has sabotaged people trying to fight for the 2nd. It happened in NJ where I lived.

    Why can’t citizens get a dealer’s license?

    I trained a civilian to use a handgun. He became an Oakland (CA) PO. When four officers were murdered he burst into the house and killed the perp with the skills I had taught him. The killer’s handgun was stolen.

    This new legislation is only going to increase perps killing more PO’s.
