Everytown Law, the legal arm of Everytown for Gun Safety, announced this week a $3 million litigation fund to “support impact litigation that can help advance gun violence prevention.”

The funds will be made available to a host of applicants, from smaller and mid-sized law firms to solo practitioners, and non-profit legal projects, including law school clinics and legal services organizations.

“A lack of resources shouldn’t prevent gun violence survivors and their allies from holding reckless actors in the gun industry accountable,” said Eric Tirschwell, managing director for Everytown Law in a press release obtained by GunsAmerica.  

“Where constitutional or other legal violations are contributing to gun violence, legal action may be the only remedy available. Even as we make major strides through our own impact litigation, we see tremendous untapped potential to advance gun safety through the courts,” he continued.

“By making it easier for smaller and less resourced law firms to represent clients with cases that can have a broad impact, we expect this fund will start a new and important chapter in gun violence prevention,” Tirschwell concluded. 

Categories of litigation that Everytown Law is willing to back include:  

  • Claims seeking accountability for survivors of gun violence from potentially liable firearm manufacturers, distributors and retailers;
  • Claims that product defects caused unintentional shootings;
  • Claims based on unfair or deceptive marketing and/or sales practices;
  • Challenges to laws that increase the risk of armed confrontation and gun violence;
  • Lawsuits arising out of unjustified shootings or armed intimidation;
  • Lawsuits seeking to compel state and local officials to enforce gun safety laws;
  • Claims to compel disclosure of gun violence-related public records and data; and
  • Appeals arising in any of the above categories of litigation.

One of the key goals of the anti-gun lobby is to bankrupt the gun industry by making it pay for the criminal acts of third parties.   

Federal law, under the Protection of Lawful Commerce in Arms Act (PLCAA), is designed to shield gun makers and sellers from such frivolous lawsuits.  

However, anti-gun litigators have been persistent when it comes to challenging the PLCAA.  

In fact, just this week, they scored a victory as Remington Arms’ insurers have offered to pay $33 million to nine Sandy Hook families to settle a lawsuit that claimed the gun company’s marketing practices were, in part, responsible for the 2012 killing that left 26 dead.

Making matters worse is a New York bill that Gov. Andrew Cuomo signed into law this month that allows anyone to take legal action against gun makers if the products they make are deemed to be a “public nuisance.” 

“The products can be considered a public nuisance even if the gun manufacturer did not purposely cause harm to the public,” states Cuomo’s press release.  

With its $3 million war chest, Everytown Law is going to put the gun industry on the defensive.  Even if all the lawsuits fail in the end, gun dealers and makers are going to have to put valuable time, money and resources into defending their right to sell and make legal products for law-abiding citizens.  

It also has a diversionary effect as well in that it takes attention away from the true sources of gun-related crime: violent offenders. 

“Claims against firearm manufacturers were consistently thrown out of courts prior to PLCAA’s enactment,” Mark Oliva, public affairs director for the National Shooting Sports Foundation, told GunsAmerica via email. 

“This is Everytown’s pandering to victims of crimes to hoodwink them into lending their tragic stories to pursue Everytown’s agenda of clogging up the courts with baseless claims instead of holding criminals accountable for their actions,” Oliva continued.  

In the end, nothing good will come from this litigation fund. Nothing.

      You made a fundamental assumption with your last statement that I refute. If you are a democrat and could vote for Biden with good conscience, then you are either inherently evil or so brainwashed out of the ability to think for yourself that you are a lost cause. There is no waking up for them, because they’ve lost the ability to think for themselves. Even Tim Pool voted Trump, mostly because he thought Trump had good points, but also because he realized what a Biden presidency would mean.

    So, why don’t we create our own fund to fight their challenges. GA or the NRA or some other trustworthy corporation could manage the funds and hand out to any gun manufacturer or dealer who is being taken to court by these anti-gun people. I would donate regularly to it.

    Gun Safety is a very good idea. In our society all children are going eventually come into contact with guns. Therefore we should put into schools, mandatory gun safety classes, where all children are taught the fundamentals of how to handle guns safely. How to always know how to check all action models for live rounds by opening all types of actions and ensure that the gun is unloaded and never to be pointed at anything, where if it were to discharge no damage could ever be done.

    Shooting clubs should be encouraged with rifle teams, handgun teams, and sporting clays teams so that everyone grows up being very familiar with guns.

    Seat belts for vehicles, life jackets for all boating and water sports, learning how to swim, how to safely handle guns, and grow a culture of good manners and mutual respect for all should be the main responsibilities for adults to hand down to all children.

    Bloomberg should invest in building more shooting ranges, and opportunities to practice, and improve standards of good gun safety.

    Above all, remember the original 10 ten, specific rights were labeled, “The Bill of Right”, guaranteed by the founding fathers. These were individual rights, forever to be guarded as actual perpetual rights that all Americans get as citizens. Commies, nazis, dictators of any type can’t infringe upon. That 2nd Amendment is the bird in the mine shaft warning flag, that we are a free people not subject to some weird brand of anti-American propaganda. If those guys don.t like guns, move to a great place Mexico, China, North Korea where only the bad guys have guns. Go after the bad guys not the average good guy Americans. With 450 million guns in the hands of Americans it is a pretty good indicator that most Americans rate being armed. Good insurance that invaders or bad guys can be made to think twice about being stupid and picking the wrong house hold to bust into.

    Notice how they deceptively invent new terms to woo the ignorant masses–
    gun control becomes thwarting gun violence; gun violence becomes promoting gun safety.
    What sane person isn’t for stopping gun violence, or for promoting gun safety? See how that works?

    People who know nothing about firearms, criminal use of guns, & the Left’s true agenda, will go along with more gun control laws, swallowing the BS propaganda that they will magically eliminate the criminal misuse of firearms. The agitprop is designed to demonize those who are legit gun owners and the “evil” companies that make those “weapons of war” that are “super-lethal,” and “on our streets.”

    Unfortunately, there is/has been woefully inadequate push-back from our side. The Left has a goal, and it is being relentlessly pursued with the backing of globalist billionaires, foreign actors, and placing their own in positions of political power.     I rarely make comments about controversial subjects but making laws to punish gun manufacturers for crimes committed by irresponsible people is about as foolish as making auto makers responsible for drunken drivers. Wake up people, objects do not kill people; people kill people. People should be held accountable for crimes instead of skirting the real issues. Enough said.

    While the dumbasses are at go after cars and alcohol brewers. It would wouldn’t be any different. There is probly more people killed by these than guns. They’ll never do that. While they’re at it get baseball bats,screw drivers, hammers, find ways to disable peoples ways to make a fist and mutilate their feet. do away with lumber. these other ways kill more people with guns. My guns sit most of the time in a gun locker. I couldn’t kill any one for almost any reason except for self defense. If these idiots get there way idiots will find other ways so most of the crap anti-gunner get will only effect law-abiding people and me.
