Exclusive: ATF Kills Controversial Program that Fast-Tracked Applications for NFA Items

The Bureau of Alcohol, Tobacco, and Firearms (ATF) has scrapped a controversial pilot program that expedited applications to purchase items restricted under the National Firearms Act (NFA), including suppressors and short-barreled rifles.

Knox Williams, the President and Executive Director of the American Suppressor Association, told GunsAmerica that the ATF had instituted the program to speed up wait times that in some cases have taken over a year. The program targeted individual applications (as opposed to trusts) that did not contain any errors and moved them through the system noticeably more quickly. In some cases, individuals had their items within 60 days of submitting their Form 4’s.

In order to find error-free applications and move them up the chain, however, agents often put others on the back-burner, especially applications that were submitted as part of a trust.

The ATF cut the program, according to Williams, because “they were getting a lot of negative feedback from folks who had been in the queue for a year or more.”

Williams expressed sympathy both for the program’s supporters and detractors.

“I understand. It’s not fair if people are cutting in line,” he said. “But the flip side of that coin is, if nothing is holding an application back, why should it be held up just to wait on other applications?”

The ATF did not respond to multiple requests for comment. Customer service representatives directed GunsAmerica to the agency’s Media Inquiries line, which was not answered.

Williams and his organization believe the ATF should move to an electronic approval system rather than rely on the team of 25-35 “examiners” who must wade through the 180,000 to 200,000 NFA applications that come in each year.

Increasing the number of examiners will only go so far, he said.

“Anytime they hire more people, yeah it helps, but you hit diminishing returns. As demand increases, there’s only so much manpower you can throw at this problem. A technological solution would fix it long-term. Throwing more people at it is a short-term stopgap.”

In the National Firearms Act of 1934, the federal government highly regulated certain firearms and accessories, including short-barreled rifles and shotguns, machineguns, and suppressors. In order to own any of these NFA items, an individual or a trust must submit to the ATF a form commonly known as “Form 4” along with fingerprints and $200.

Demand for NFA items has increased over the last decade, according to Williams, and the ATF has struggled to keep wait times under a year for application approval.

A Little Myth-busting

The opaque nature of the Form 4 approval process has fostered a cottage industry of internet speculation, including a website called NFA Tracker aimed at crowdsourcing NFA approval information. As with speculation related to any federal agency, there’s plenty of keyboard warriors posting on Reddit forums with more time than well-sourced information.

Or, as Williams described one comment GunsAmerica emailed him, “There are grains of truth mixed in with a lot of bullshit.”

One popular narrative making the rounds contends that the ATF is concerned that the NFA will be challenged in court if wait times exceed reasonable limits. If a right delayed is a right denied, and the NFA isn’t supposed to ban the items under its purview, a sympathetic judge might rule that one-year wait times endanger the constitutionality of the entire NFA.

While the theory sounds promising, the ATF isn’t worried.

“I can tell you with certainty that the ATF doesn’t care about that. That has not even crossed their mind,” Williams said. “When I brought that up, they were like, ‘Oh, no we never thought about that.’ Because they are still approving forms.”

The Supreme Court ruled in the 1930s that the NFA is constitutional because it’s a revenue-generating tax, Williams explained. As long as they’re generating revenue – no matter how much or how little – the act is justified.

Another common line of thinking among applicants for NFA items imagines that wait times can be reduced if applications are made at the right time. Using tools like NFA Tracker, prospective suppressor or SBR owners attempt to game the system and get their items back as quickly as possible.

Williams acknowledged that wait times for approval do tend to be cyclical.

“As wait times decrease, demand will increase. As demand increases, more forms go into the pipeline, and the examiners get tapped,” he said. “They can only process so many forms by hand. It does create further delays. It’s cyclical. There’s a constant back and forth between wait times and demand.”

At the same time, submitting a Form 4 now will always get you your suppressor more quickly than waiting.

“The best time to buy was yesterday,” he said. “Like it or not, the NFA isn’t going anywhere in the immediate future. The wait is here to stay. Maybe your actual processing time will be down, but is it worth it to wait a year to save three months?”

Want a Suppressor NOW? Play Nice with the FBI

There’s only one way to increase your chances of getting your NFA items in a timely manner: don’t let the FBI sit on your background check.

Williams explained that the FBI background check causes the worst bottlenecks in the NFA approval process. The ATF sends all NFA applications to the FBI to conduct a NICS check, the same system used in standard gun purchases. And while ATF agents can earn unlimited overtime and holiday pay for working through NFA applications, FBI agents enjoy no such incentives.

If the application doesn’t contain any errors—nothing is misspelled, all the numbers are correct, etc.—the check goes through instantaneously and the FBI clears the application for the ATF. But if the application contains an error or the applicant has a common name or the check gets delayed for any other inane reason, it goes to the bottom of the pile to wait for an agent to figure out the discrepancy. And, since the FBI isn’t required to complete the check within any time period, there’s no telling how long it will take for the check to clear.

“The FBI will routinely just sit on anything that gets delayed,” Williams said. “If it gets delayed for any reason, they put it in a pile, and say, ‘We’ll get to it whenever we feel like it.’ And that can be months. That’s a large part of what’s holding it up.”

Williams advises applicants to cross their T’s and dot their I’s:

“Make sure you don’t have errors on your application. That’s the single biggest thing that can speed up your application. If for any reason there’s something that will delay your application, it will delay it for a while. Make your list and check it twice.”

If your NICS checks often get delayed during normal gun purchases, Williams also suggested getting a Unique Personal Identification Number from the FBI. This number allows the feds to more easily differentiate you from other people who might be prohibited persons, and the Form 4 was recently updated with a box to input the unique ID number.

The American Suppressor Association was founded in 2011 to fight for pro-suppressor reform nationwide. They lobby at the state and national level to ease suppressor restrictions and allow the use of suppressors while hunting.

Recently, the organization worked with the National Hearing Conservation Association to publish a position paper stating that suppressors are a tool that can mitigate hearing damage. Prior to this paper, no medical association had acknowledged the health benefits of suppressor use.

    Having been an FFL for 46 years, and Class 3 dealer since the early Nineties, the volume of NFA purchases has multiplied tremendously, due to the allure of being able to own machine guns, suppressors, SBS, and SBRs, coupled with the profit margin, as they ONLY grow in value due to the limited number of transferables available in the market.

    The solution to this problem is to develop an electronic processing system that takes the human being, with all its flaws. out of the equation. E-filing is a start, but Form 4s are excluded for reasons cloaked in ATF secrecy. Perhaps we can get our Congress Critters to put some pressure on the right agency to embrace, and even assist in the development of such a system, within our lifetimes, to allow us to enjoy our right to partake in these pleasures!

It can even be a graduated tax, the further in ‘early voting’ that you cast your vote the more tax you pay.

    This confirms what I’ve always believed, that the whole complex procedure around NFA items is simply the same background check done for regular firearms. But instead of thousands of dealers making the calls, the task has been delegated to a deliberately small number of examiners.

    The delay serves the purpose of discouraging the average gun enthusiast from even beginning the process. This is intentional.

    $200 is not a lot to pay for a tax on a machinegun, I’m sure the state sales tax would be that much or more. Problem is, the supply was frozen in 1986 by a voice vote (shouting match) in the congress. A fixed or declining supply has priced the tommy gun out of the reach of the average citizen.

    The Constitution prohibits a tax on the right to vote. How can a tax on the right to bear arms be legal?

    Does $200 even come close to the cost of shuffling a stack of papers through two or three different agencies?

    The NFA is a joke that raises money. It is pure taxation, and when it was created, that tax stamp was very expensive. It was prohibitive for the average man to get one.
    Nothing seems to be keeping this law alive anymore. if you have money, you can buy whatever you want.
    In our traffic court, if we are fined for speeding, it hurts a poor guy more than a wealthy one who can peel off hundred dollar bills while the poor guy goes without food.
    I don’t agree with a ban on machineguns. Few people can afford to feed them, and they are an albatross if you ever wanted to use one in crime. They are mostly for sheetz and giggles.
    Silencers should be fully legal, and mandated, except they make the gun too big for concealment. We should be encouraged to use them for safety reasons and to stop the snowflakes from getting too upset at the sound of a gunshot.
    Where were these idiots raised? Didn’t any of them have a normal childhood?

    Trump is only about Trump. The only good thing about him is that he is not liked by any of the parties. He really has not demonstrated that he has any core values to what America was once about. What I mean is doing what is right, justice or morales. Voting is only about what candidate will potentially do the least damage not about having a belief that the person will actually be benefit to our country and people.

    In terms of the gun community I have not seen that he has done anything to be of assistance to supporting us or our rights, he has actually done the opposite. Typical spineless politician who points his finger at everyone else. This is called projecting.

          And yet he essentially committed an unconstitutional act when he ordered the Justice Department to have the BATFE to not only re-interpret the NFA but change the language so that bump stocks and any other rate increasing devices were automatically classified as a machine gun. That should have been your first indication that Trump wasn’t a friend to the 2nd Amendment!

          Additionally those Supreme Court Justices he has nominated have voiced anti-2A sentiments and William Barr, the current Attorney General is staunchly anti-2A when it comes to citizens owning firearms.

          So please, get out of your confirmation biased bubble and recognize that Trump is not working for you nor does he really care about 2A rights (he only pretends to because dumbies like you and OP vote for him).

          On a side note, I’d postulate that if Hilary was President, most of the gun community and conservatives/Republicans would come together to prevent any more rights being taken instead of us all being fractured complaining about the state of things.

    Well let’s go through some Typical Government B.S. and discuss facts, etc. The BATFE is composed of around 5,101 employees, including 2,630 special agents and 842 industry operations investigators. The agency’s 2018 enacted budget was $1.274 billion. In 2016, the latest year I have data for, a total of 133,911 Form 4’s were processed. In the same period, the total number of Forms processed was over 2.5 million, but these included Form 3 (FFL to FFL) transfers and Form 2 which is manufacture of a firearm by a licensee. So taking into consideration only the $200 Taxed Transfers on Form 4, we get a total revenue of $26.7 Million dollars per year, divided by 35 examiners, equals $762,857 in revenue per employee. So if BATFE was actually a business, they would be either out of business or they would expand or reassign their employee pool to handle this increasing demand. I would be happy to get the contract to process these applications for the $200 fee.

    There has always been a lot of questions about what the examiners actually do to process an application; confirming the transferred firearm is in the registry and the the owner is the registered owner or a licensed FFL, should take mere minutes. As we all know, the FBI NCIS is an “Instant Check” system and for the most part, applications are approved immediately. So blaming the FBI for their backlog is a bold face lie. The real reason for any problems with the NCIS is that the agents who are manually typing paper forms into a computer are making errors, around an average of around 8 to 10 errors per form. The FBI conducts over 20 million checks a year for FFl dealers, so the BATFE 133,000 is just a drop in the bucket.
    It is very interesting to note that the BATFE does allow electronic E-forms to be filed for the bulk of the 2.5 million forms, but not for Form 4 submitted for individual transfer, HMMMMM. The reason is really BATFE’s own doing, as if you submitted a Form 4 on behalf of a Trust, no fingerprint card was required and you could submit electronically, now that BATFE has changed the rules and required all Trusts to submit finger prints, basically no one can use electronic forms and therefore they have pulled them. I guess the BATFE has never heard of Live Scan (electronic) fingerprints used by the rest of the planet. Does anyone doubt that if the BATFE treated industry like they treat lowly civilians, a shake up would be immediate with companies like FNH, SIG and Beretta unable to conduct business with a one year form approval wait time. Some of their customers like the Defense Department, would likely get pretty upset.

    The article brings up an important point…NFA is about tax revenue, that is true, what is also true, the FED takes payment immediately…you should take possession as soon as proof of payment is received, which can and should be immediate at point of sale when the background check is done…just like when buying any other firearm. Think about this….it takes longer to get an accessory than the actual firearm. The extra NFA tax should be made part of the initial point of sale, collected on the spot and paid forward by the retailer.

      The true reason for the Tax was to eliminate civilian commerce in Machine Guns. The $200 Tax was created as it was the price of the uber expensive Thompson Submachine gun at the time, so doubling the price was the goal. $200 was also 3 to 4 months of take home pay for the average worker at the time and buying a Thompson would be like buying an optic equipped Barrett Light 50 today. Originally the NFA was to include all firearms, but that was stripped from the final bill. The creation of “Short Barreled” shotguns and rifles, was to prevent folks from converting their existing firearms into NFA regulated (concealable) pistols. Even though pistols were stripped from the NFA, someone “forgot” to strip the new, now unnecessary category of “Short Barreled” firearms from the final bill. Make no mistake, the intent of the Bill was to Ban and Eliminate Commerce in the regulated arms and it succeeded at the time. The “Tax” was a (quasi) legal tool to get it done, as they had done the same with Marijuana, only in that case they refused to print tax stamps or collect the tax. The courts upheld this as well, ruling the government didn’t have to collect tax money and print and issue Tax Stamps if they decided not to do so.

      Agreed…and while this is true, and the tax was tied to the now outdated form 4 paper trail system, we now have a faster 4473 system with instantaneous background checks. That means—if the government wanted to—it could make the tax on suppressors, short-barreled rifles and other NFA items an end-user purchase tax. After all, the background check that allows one to buy any other firearm is precisely the same. The only reason NFA purchases are held up now is simply because the government can. Fact is the whole 1934 Firearms Act is unconstitutional. It was and is the camel’s nose under the tent and it seems the camel is about to walk in virtually unopposed.

    I JUST RECENTLY SENT IN CHANGE OF ADDRESS FORMS FOR MY CLASS III ITEMS, I HAD LISTED SOME OF MY ITENS AS SUPPRESSORS AS WELL AS OTHER CLASS III ITEMS, I GET THE FORMS BACK AND SUPPRESSORS HAD BEEN CROSSED OFF AND HIGHLITED AND THE NFA EXAMINER HAD HAND WRITTEN IN (SILENCER) AS ALL OF US KNOW THERE IS NO SUCH THING AS A SILENCER IN THE GUN WORLD, THIS IS THE KIND OF THING THAT WE LAW ABIDING CITIZENS HAVE TO DEAL WITH THE NFA BRANCH OF THR ATF

      I am friends with the person who takes care of the suppressors applications. He received a phone call from the feds telling him that suppressors were to be called silencers on the application forms. Amazing!

      Actually, “silencer” is the proper name. Has nothing to do with Hollywood. When the device was first conceived, it was called a silencer.
      The classical meaning is synonymous with suppressor, but that’s about it.

      The inventor Hiram Percy Maxim, son of Maxim gun inventor Hiram Stevens Maxim and co-founder of the ARRL, is usually credited with inventing and selling the first commercially successful silencer around 1902, receiving a patent for it on March 30, 1909. Maxim gave his device the popularly trademarked name “Maxim Silencer”.

      He did not name it the “Maxim suppressor” like those not in the know like to claim he did, he named it the MAXIM SILENCER. And still to this day many of the companies that actually make silencers, use the two names interchangeably. So now you know too! Stop this nonsense already.

    If the FBI conducts a NICS check for NFA items, and local gun stores can also conduct a NICS check, why the hell does the mess have to go thru TWO federal agencies? All they do with the prints is stick them in a file. According to the NFA, all that is required is a fee and registration. That could easily be done on a 5×8 card in duplicate at the gun counter.

    The nfa actually was going to be applied to handguns as well as the things it was regulating so they regulated long gun demensions ro prevent you from making a handgun from a rifle or shotgun.since they didn’t ban handguns they should remove demensions from the nfa! Suppressors are self explanatory but should be removed because they help more than harm. Let them keep full auto and work on that later when we evolve a little more

    The ATF was appropriated funds by Congress to institute the eForm system, INCLUDING Form 4s. They turned that part of the eForm system off after discovering they had very poor control over their registry. This is what is know as fraud, waste and abuse in governmental financial terms. Why has no one investigated this in Congress and forced them to open the Form 4 section of the citizen bought and payed for eForms system??

    So, with what Williams states above, regarding UPINs leads me to believe he has no idea what he is talking about.

    The FBI will not issue a UPIN to people who have not been denied. Even at a denial, it will take moving heaven and earth to get them to work through your appeal and then your UPIN process.

    While the system ALLOWS for a UPIN to be applied for from anyone, the FBI frankly wont do squat about it.

    What ever happened to the Hearing Protection Act we were promised? That was the only positive thing I expected to actually come from a reality television clown getting elected to our nation’s highest office… Instead of making it easier for law abiding citizen’s to prevent permanent hearing loss, that giant orange douche actually stated that he was considering a ban on suppressors just earlier this year!

    How did the giant orange douche get elected in the first place? Way back in 2013 Donnie the Douche tweeted the following and I QUOTE: “Do you think Putin will be going to The Miss Universe Pageant in November in Moscow – if so, will he become my new best friend?”
