Looks like the Florida GOP-controlled House has followed suit, voting 67-50 to enact the “Marjory Stoneman Douglas High School Public Safety Act.”
As mentioned below, the 105-page bill contains measures to both improve school security and tighten restrictions on gun ownership.
One of our readers was specifically concerned about the portion of the bill that bans bump stocks and similar devices. From the legislation:
790.222 Bump-fire stocks prohibited.—A person may not import into this state or transfer, distribute, sell, keep for sale, offer for sale, possess, or give to another person a bump fire stock. A person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s.741 775.083, or s. 775.084.
As used in this section, the term “bum fire stock” means a conversion kit, a tool, an accessory, or a device used to alter the rate of fire of a firearm to mimic automatic weapon fire or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device.
The question is whether there is a grandfather clause for current owners of reciprocating stocks. Doesn’t appear to be the case based on the text.
Gov. Rick Scott, meanwhile, will now review the bill and decide whether it’s worthy of his John Hancock.
“I’m going to take the time and I’m going to read the bill and I’m going to talk to families,” said the Republican governor.

Things are moving fast in the Sunshine State. The Florida Senate this week approved a comprehensive gun control package in response to the mass killing at the Marjory Stoneman Douglas High School in Parkland.
Narrowly, by a vote of 20-18, the Senate approved bills to ban gun sales to anyone under the age of 21, prohibit the purchase and possession of bump stocks and establish a three-day wait period for all gun buyers.

Along with those anti-gun provisions, the package sets aside $400 million for hardening schools and improving mental health services. Funds may be used for mobile crisis teams, the purchase of metal detectors, bulletproof glass and the hiring of student resource officers, reports NPR.
Teachers are barred from carrying guns under a last-minute amendment proposed by Sen. Rene Garcia (R-Miami). But other school personnel including support staff, those who are current or retired military and JROTC instructors would be exempt.
“The goal is to make sure that those instructional personnel that are in the classroom cannot participate in the program,” Garcia told The Miami Herald. “This is an opt-in program … It’s dependent on the school district and the sheriff to determine if it participates in the program.”
Legislation to ban black rifles and magazines with a capacity of 10 or more rounds was voted down.
The Florida House will now take a look at the legislation. Given its tendency to lean pro-gun, it’s likely that more changes will be made to the package before it lands on the desk of Gov. Rick Scott. Stay tuned. The legislative session ends this Friday. We’ll know how this all shakes out in the very near future.
So, this October, it will be illegal to POSSESS a bump stock. So, the person who paid between 300 and 500 dollars for his or her stock, will have to either turn it in to the law, or give it away to someone out of state (a state that has yet to ban them). I do not see any of this happening. I do see several thousand Florida residents guilty of a third degree felony after October. It will be interesting to see how FDLE deals with all that.
If you live in Florida and own a bump stock, rapid fire trigger such as binary, or an adjustable gas block, etc, you are now a felon in possession of an illegal device. Go look at the list of things they banned and it will boggle your mind.
The Libs have almost got it right, we need more laws. Well at least one more. I don’t know why they haven’t thought of this before now. I’m disappointed with Governor Scott, in my view he caved in to the pressure to do something. The most harmful legislation is the age limit from 18 to 21. Outrageous! You are putting law abiding citizens @ risk, especially women Gov. Scott. Bumpstocks will do nothing because you can bumpfire a firearm without one. Now, adding more security in your schools is in the right direction. Have portable panic rooms in each classroom is something to consider. Having trained armed teachers, if they want to as a last resort is another reasonable option. More guns in the hands of law abiding citizens is the best remedy to against criminal behavior. Gov. Scott, your anti-gun laws will unfortunately do nothing in the end.

Governor Scott, that bill is flawed. Bump stocks? What used one time in a shooting, it’s an inaccurate novelty item. You will find it’s unconstitutional to retroactively make something illegal at the very least. You could ban future sales but cannot force people to discard previous purchases. Note the 1986 NFA act banned further machine gun purchase but could not take previously purchased ones. The sneaky part of the bill is the add on to ban teachers from carrying firearms. The future will show that this is an effective deterrent. There’s zero evidence that armed teachers poses a problem.

You’re right, this is unconstitutional for them to make all these gun parts illegal. The new FL law bans adjustable gas blocks, binary, tac-con, Larue, geiselle, etc trigger systems. Bump stocks, trigger cranks, buffer springs, lightweight blt carrier groups etc. Guess who gave the Florida Governor the list of things to be banned? None other than the NRA. The NRA petitioned Obama’s ATF to ban these devices through regulation, but were told they can’t be banned. WHy does the NRA want these devices banned? It’s because they compet with the sales of the full autos owned by the NRA elite and big donors. When people can get rapid fire fun for a few hundred dollars, they stopped buying their 20 thousand dollar full autos, even if they could afford them. The sales on full autos tanked when these simulated full auto devices came on the market. NRA sold us out again. This list of items the NRA gave the FL governor to ban, is the same list they gave Trump to ban with an executive order.
I do not walk Lock Step with any party, and yes I have Voted since I was old enough to have a Draft Card. The NRA brought me into Firearms around the age of 12, or 53 years ago. I own most everything, SKSs AKs, MAC, and so on. I own more then a few Pistol Arm Braces, and of course I never should them. Bump Stock, nope, and I knew it was only a matter of time and they would be off the market. Per the guy that owns some and he will use them on anyone trying to take them away, grow up. i have lived in maine all my life. i have held firearms in my hands since old enough to understand the responsibility of so doing. about 12. firearms have always been a part of my life and that of my three children. so as i direct my concerns to those who cassify all northerners as blue liberals, understand you put your trust and faith in elected officials who only now show their true colors. i now find it necessary to purchase an”assault type” weapon solely because i don’t like the idea of someone who has never held a firearm telling me it is against the law to own. if our lawmakes ever gave it any thought as to why the sales of ar-15 firearms have spiked in recent years their clearly transparent ways and means processes are to blame. i suspect you good old southern boys don’t like the notion of being TOLD what to do understanding you are perhaps MORE law abiding than those governing. when they come for my guns the last one will need to be pried from my dead body. now i going to buy a bump stock. good luck in your fight
I agree with you from Maine too. I bought two bump stocks not because I need them but because they want to ban them. What if I want one someday? Well now I have it. CRITICAL: I don’t know for sure but what if these shootings are allowed to go forward (Liberal Sheriffs men sat outside while people were murdered) FBI ignored the threat. Far more lives could be saved if children under the age of 25 were not allowed to buy cars. While this sounds ridiculous, just wait in 10 or 15 years when self driving cars become the norm and for safety considerations, to save lives, it will become illegal to drive if you are under 25.

The federal government routinely raids cannabis dispensaries in CA. They wait until they have a certain level of income/assets. As far as the firearms regulations, any rights not reserved by the federal government are the purview of the states. I.E., the states can pass more restrictive.
Each day that passes a few more republicans expose themselves to be Marxist rats. If he signs the bill Rick Scott the Governor of Florida will cement his name into the Marxist hall of fame. The bump stock bill as written by the Florida legislature gives government a broad swath to ban trigger packs and even gunsmithing operations that would reduce trigger pull weight therefore making it easier for the user pull the trigger faster than they would in a stock weapon. The proposed law does not establish what constitutes a minimum rate of fire for a firearm. Each user will differ in how fast they can pull a trigger. What about gas systems and muzzle breaks and compensators. They have the potential to alter firing rate. And buffers.
The age change to 21 will be challenged as unconstitutional because it is. But so are hundreds of other laws that are enforced every day.
Rick Scott is in his last term as governor and is vying to grab a US senate seat. Will he pander to the gun grabbers and hoping to draw votes from centrist democrats or will he veto the bill in the hope republicans put him into the US senate. I think he will lose votes no matter which way he turns.

So to appease the gun grabbers the Florida Government implements a 3 day waiting period, bans bump stocks or other accessories that might increase rate of fire over fast finger action and prohibits educators from carrying a firearm. How does any of that even begin to address the issue of a sociopath entering a gun free zone and murdering a bunch of innocent people? Why didn’t they include banning box knives form schools and pressure cookers also? Now hardening the schools, that makes sense. This other is BS and all this did was nibble away at freedom. It boggles the mind to hear school teachers rant on possibly having a firearm in a classroom. First I would like to change the conversation from pro-gun to pro-rights and anti-gun to anti-rights. School teachers should have the option to opt in or opt out of participation in having a firearm discretely placed in their classroom. Security especially first line security is the deterrent to stopping a criminal or a coward from even thinking of bringing a gun to a school to murder innocent people ! Metal detectors and a guard should be present at all times school is in session to secure a one point of entry and exit being the only point of entry/exit allowed , security is the only sensible answer. Hmmm. Better read the law carefully. It defines bump stock asANY device that increases rate of fire. Don’t fool yourself that this was not intentional. You can bet that someone (liberal judges) will interpret this very broadly. There will be no binary triggers allowed either.

When I was much younger, mass shootings occasionally occurred. The weapon of choice back then was usually an M1 carbine or sometimes a shotgun. Outlawing a particular type of weapon isn’t going to change anything. In countries where guns are not easy to obtain, you still have mass killings. The perpetrators just use a machete, a butcher knife, a bucket of gasoline, or whatever other type of weapon is available. Gun control laws change nothing, other than making it harder for law abiding citizens to defend themselves.

Lets see The Promise Program, the county sheriff department bad leadership and organization, the Trump FBI all failed in this event. You are correct. Chain link fences around ALL school buildings with at least 2 or more gates with armed security, and security cameras. The ownership of a lawfully purchased item, such as the bump stock, prior to this bill, should be legal, or, the state should have to pay the individuals for turning them in. They should not be able to just expect people to throw their money in the garbage can.

Step 1, lawful person legally buys bump-stock.
Step 2, government outlaws possession of bump-stock, so person sells bump-stock to recoup their money before the law takes effect.
Step 3, person sells bump-stock to person who may be less likely to follow the law since bump-stock will soon-to-be illegal to possess.
Step 4, now outlaw has bump-stock.

As with all knee-jerk, reactionary legislation, this bill was poorly written. Specifically, the extremely vague language used to ban “bump-fire” stocks, passed by ignorant, lazy, politicians, this vague language will no doubt be used by the left to go after far more than just bump-fire stocks. The below wording opens the flood gates to ban almost every aftermarket accessory, and certainly every aftermarket rifle & pistol trigger (including those used in hunting & 3-gun competition). This is the wording the left will use to go after everything:
“a device used to alter the rate of fire of a firearm……or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted….”
It can easily be argued that lightweight bolt carriers, improved triggers, vertical grips, muzzle brakes, etc all “increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted….” because all those accessories make it easier to shoot & control firearms. Was afraid they would do something like that with the definition of a bump stock. Basically, it is now a felony to lighten the trigger pull or possess any parts to modify the trigger pull/mechanism in any way that makes it easier to pull the trigger; i.e. makes it fire faster. That standard also catches anybody that is disabled (such as me) and has a trigger assistance device installed.

I personally dislike the wasteful spending of ammunition, but if one practices enough, they’d manage to bumpfire with a regular stock.. this is all ridiculously stupid. I’ll say what I’ve said before. Any elected official that initiates a bill like this should have to pay the retail price of every item they are banning to each individual. It should come either out of their campaign warchest or personal savings and until they have finished paying it off they can’t run for any election or be selected for any unelected governmental positions. Some would say they think the government should pay for it, but since a special interest is involved, they should be the ones paying rather than the general public.

But what also isn’t revealed are the penalties for a particular type of violation under this new law. They could make a mere possession (no intent to sell) non-criminal, effectively allowing current owners to keep them without fear of arrest, but a bump stock could still be confiscated if found by police during a lawful search.
The real punishment for conviction would be the loss of gun rights permanently.
