Former Cop, Veteran Has Firearms Confiscated for Alleged 'Threat' Against School

Stephen Nichols wasn’t convicted of a crime. No judge signed a “red flag” order. There wasn’t even a hearing. Nichols’ constitutional rights were stripped and his firearms confiscated after an out-of-context comment was overheard by a waitress at a local diner.

Tisbury, Ma., Police Chief Mark Saloio seized the 84-year-old’s firearms—and fired him from his job as a crossing guard—after receiving a tip from a diner employee. The waitress had heard Nichols complain that the Tisbury School resource officer had been “leaving his post” and visiting a nearby convenience store while the children were filing into class.

In that conversation, Nichols told a friend that someone could “shoot up the school” in that officer’s absence.

That’s all it took.

Chief Saloio fired Nichols from his job as a crossing guard while Nichols was helping kids cross the street and told him that what he said was a “felony.”

“He came up and told me what I said was a felony but he wasn’t going to charge me,” Nichols told the MV Times

Saloio later drove to Nichols’ house and demanded that he hand over his license to own firearms. The police chief confiscated the man’s firearms, which were subsequently turned over to Nichols’ son-in-law. Nichols says he never received any paperwork or receipts for his confiscated license or firearms.

He clarified the comments he made in an interview with the MV Times.

“When I was in the United States Army, and it wasn’t just me, it’s anybody who’s in the United States service, if you are on guard duty for eight hours, you didn’t leave that position,” Nichols said. “And I’m just so accustomed to that, that when I see someone who’s suppose to be protecting kids…leave the school unguarded — if you’re on guard duty, you stay there.”

Those who heard Nichols’ comments and who know him say the idea that he would threaten to harm children is patently false.

The diner’s owner, Marc Hanover, called the situation “absolutely outrageous.” He said he believes one of his servers “overreacted.”

The man who was speaking with Nichols, Andy Marcus, also described the situation as “absurd.” Marcus told the MV Times that Nichols did not threaten the school but was worrying that the resource officer was leaving the children potentially exposed.

The police department and local government have refused to comment on the situation, and requests for the police report have been stonewalled.

“There’s nothing that I can legally discuss about the matter. Period,” Chief Saloio told the MV Times.

Town administrator Jay Grande confirmed that Nichols had been removed as a crossing guard but wouldn’t comment further.

“In response to your inquiry, I want to acknowledge that a crossing guard was removed from active status pending a review of personnel related concerns,” he wrote. “I will not have any further comment on this matter.”

Nichols has retained a lawyer but appears unconvinced that he’ll be successful in restoring his Second Amendment rights.

“My grandson is manager of a gun shop in Worcester, Mass and he’s going to be allowed to come down and take the weapons and sell them for me,” he told the MV Times. 

Nichols served as a Tisbury police officer for six decades and in the United States Army during the Korean War. He’s also been licensed to own firearms since 1958 and has never committed any firearms violations.

More importantly, he wants his community to know that he would never threaten kids.

“I would never, ever, ever, harm a child,” he said.

Update (10/17/19): Nichols has been reinstated as a crossing guard, according to the MV Times. The newspaper reported that the story garnered “never before seen” activity on the paper’s webpages, and Chief Saloio noted the “outpouring of support” in his statement to the paper:

“The town, collectively, has expressed an outpouring of concern about Mr. Nichols, and his employment as a school crossing guard. We as well share those concerns. We wish to make you aware that today, Mr. Nichols was informed that he may return to his crossing guard duties tomorrow morning,” Saloio wrote in an email to The Times. “This return to work was always pending upon a final review that was in process. Throughout this period, Mr. Nichols has retained his position as a crossing guard for the town. However, these reviews are thorough and complete, and neither immediate nor instantaneous.”

There is no word on whether Nichols will have his firearms and license returned.

    A man would have done his duty and not only made sure his job was re-instated but would have made sure to apologize for the violation of his rights and spent less time and words covering his cowardly backside with explanations that come across as excuses.

    Tisbury, Mass. population 4,000 people, the man who’s firearms were seized was a former police officer for 6 decades in Tisbury this story seems to be that “someone has an ax to grind in Tisbury, Mass. and the whole story is not coming out, I believe the current Cheif of Police in Tisbury has some explaining to do.

      Andrew: We have a bicameral mind which divides everything up into opposites, Left/Right, up/down, good/bad, etc. It’s conceptions are therefore finite and not absolute. And by definition each Party has only a part-ial perspective. And, the part is not the whole. Never forget that!
      With this in mind I want to say two things:
      1) it is a mistake to think that one side is totally right and the other completely wrong. Parties are composed of people who are bigoted, shallow, and given to identification politics and from that the age old self righteousness that is utterly unsupportable!

      2) for convenience sake it is perhaps a good idea to refer to those on the Left as tending toward Socialism/Communism, and those on the Right tending towards Fascism. One or the other may agree with your favorite positions, but at the top both parties are utterly corrupt and operating from motives that are never mentioned publicly! This means that in a crisis some Republicans will side with the Gun Grabbers! Trump, for example, is already leaning in that direction with his verbal support for “Red Flag Laws, eh? And never forget that both parties habitually sign on for three things: A) any war that comes along, B) taxing the people into poverty, and C) raises and sweet retirement packages for themselves!

    Red flag laws are such BS! I can’t believe we’ve let this great country get to this point. If the waitress was worried about his conversation she could have asked what he said. Act interested even if she wasn’t. When you only half listen story’s change drastically! Not taking up for the resource officer; because I don’t know his job. I work at a school with a resource officer. He has to leave to go to other schools in our district. He also went to pick up a student who missed the bus. He goes with teachers that have to do at home visits. Hopefully he wasn’t just skipping out. We don’t need anymore Parkland resource officers!

    The really weird part wasn’t mentioned in this article. Remember where it says the police informed him he was fired while he was actually performing his job? “Chief Saloio fired Nichols from his job as a crossing guard while Nichols was helping kids cross the street and told him that what he said was a “felony.” According to another article they were not just relaying a message. In that town the POLICE hire, train, and schedule the crossing guards. I realize that crossing guard is not a real sensitive position but I would hope that ANYONE hired by the police is vetted.

    Chief should be fired and criminally charged for failure to make an arrest if what the crossing guard did was a felony and he says he’s not going to charge him. I was a LEO 30+ years and that’s what would have happened to me in that situation. Arresting a felon is not optional.

    This so called chief is nothing more than a leftists political hack that has no business with a badge, gun and arrest powers.

    But in a commie state like MA I’m not surprised.

    After reading how shooters in some instances have records an arms length long with wrongful actions, not just words, this is a real travesty of justice. The waitress should have been questioned as well as the crossing guard before any action was taken. The police Chief should be stripped of his rank for such a poor decision. How can the people of that city trust his future decisions. Common sense alone would tell a person that he did not come even close to fitting the profile of a shooter. I haven’t heard of any dangerous criminals with a background matching his. I don’t think much of lawsuits but I think some form of additional public service for the Chief would be ideal for correcting an attitude that is hurting law enforcement officers already.

    There I was, having a long-distance girlfriend who was a Federal Agent in another state. So, I was flying out to see her with checked firearms in my luggage. When the airline “tagged” my bag for having a firearm, I began to have doubts. When I finally arrived in Tucson, my luggage and guns were lost.
    We hung out at lost baggage until they told me to go to a hotel, and when my bag arrived, it would be sent to my hotel. I was angry that they made me declare there was a gun or two in my bags, but I understood. I also realized that the “tag” they put on my bag said, “steal me.’ I reacted with a bad comment.
    I said to the clerk, “If you were to know that there was a bomb in my bags, you would find it fast.” OMG! I never said there was a bomb. I never made that remark as a threat, yet I was told I could go to prison just for mentioning the word “bomb.”
    So, yes, I can see why a nosey woman needs to learn the difference between a threat an easy observation. In this case, the waitress should be sued for libel. Anybody can say somebody made a threat, but proper follow-up should include verification that an actual threat was made “in her OPINION.”

      Depends on the jurisdiction. Here in Illinois you have to have a FOID card [Fireams Owners ID] to even purchase ammo much less a gun. Then is takes yet another license to be allowed to carry the gun. Also here there is no state pre-emption so counties, cities, villages can impose their very own unconstitutional laws. I have a friend who is an NRA certified instructor [which the state recognizes] and a CCW holder but there are some towns he can not enter.

      The best thing is that Mr Nichols did was that he retained his attorney! The best way to correct what happened is to hold the Police and School accountable for what they did. Certainly the Police violated their own policy or they had no policy. They failed to verify the comments, they failed to give Nichols any warrant or receipt for his firearms and it was the police dept’s actions that directly led tho Nichols dismissal from his job. His stress and suffering cannot be measured. I hope his attorney makes them pay dearly !

    I hope the restaurant owner fires that waitress, all Mr. Nichols did was give a tactical analysis of the situation of a very real threat trying to protect this dumb wench’s kids. He didn’t do anything wrong, plus as a School resource officer its kind of his job! No seriously go to NYC on New years eve and the police have a whole division that is dedicated to setting up security for time square!
    At least we know that someone was trying to make their job better and actually ” Think of the Children” than this waitress. Id say i hope she dosen’t have kids, but ten bucks says she probably has 5 of them who all go to the same school that this guy protects. So for Mr. Nichols thank you very much.     I would hope that the writer Mr. Michaels follows up on this story. 1. I Would like to know who the waitress was reported this and since the other party in the conversation said there was no threat did that waitress have consequences? 2. Would like to know if the resource officer was investigated for leaving the campus/post and 3. If and When Mr. Nichols gets his guns back.

    I know that when an officer in our department confiscated guns and the court said the person was not a danger the subject would have to get a lawyer and spend a bunch of bucks to get them back. The department never got sued just made it so difficult that most gave up and the department destroyed them or more likely some bigwig in the department got them. But that was in The Peoples Republic of Kalifornia

    In a situation like this, DO NOT give up your firearm. Make them get a search warrant. With probably cause like that, a search warrant won’t be issued. I’d be embarrassed to present that affidavit to a judge.

      The problem is that they come in under color of law , and if you “resist” , you are the bad guy when push comes to shove. legally, you would think that they need a warrant, but in cases of firearm permits in “may issue ” states, they have the “right ” to rescind or revoke for any reason as a “condition” of your license.
      Remember, you are dealing with the Peoples Republic or Massachusetts .

    Sorry, but this is Mr. Nichols’ fault. Granted, the douche cop took advantage of Mr. Nichols’ age, but your freedoms are only yours if you are willing to defend them. If some cop came up to me and said that some speech of mine rose to the level of a felony, he wasn’t going to charge me but was taking away my “license’ to own a firearm and confiscating my guns, I’d just say no. Force the jackass to arrest you and fight it in court. I’m sure there’s a process for revoking a firearms license….force them to follow it or do not comply. Do not turn over your property unless there is a court order. Insist on receipts and take pictures. Read the story: no ‘Red Flag’ law was invoked.

    Look, I’m as ‘Law and Order’ as they come, but complying with an illegal order from a police officer is not ‘law and order’, it’s tyranny.

    I’m retired military also. Mr Nichols “what if” type of discussion with his friend are common among military personnel.
    It was common to have discussions like “if I were going to attack these defenses, what would I do?” Then on to theory’s of how would I defend against those attacks.
    Military personnel never train for best case scenarios so these types of debates are more academic than actual threats.
    Gross over reaction by the police and ,based on the limited information from the article, definitely overstepping their authority but given the history of psychopaths shooting up everything in sight lately I suppose it’s somewhat understandable to err on the side of caution however this shows a basic flaw in red flag laws by stomping all over a law abiding citizens rights without due process or a clear path to restore said rights.

    He has no idea how to investigate a complaint, and he should of been looking at what his SRO was doing.

      I’m a retired LEO; it’s been my practice to question both the person who heard the alleged threat and the person alleged to have made the threat. From my readings of this story appearing here and other sources, none of that was done. It’s a gross violation of the crossing guard’s civil rights and the chief’s lack of basic common sense. I agree with the other retired LEO on this thread, the Tisbury folks should look for another leader of their police department. Is this what’s in store for Americans if we continue with our snitch society and so called ‘red flag’ laws? We are on the slippery slope if we continue down this path. I hope Mr. Nichols gets his firearms back and finds a good attorney who’ll sue the chief and the department for violating his civil rights.

    A couple of questions…..Does this state have red flag laws in place? If so, why didn’t they have a judge’s order to remove his weapons per the red flag law? Is their CCL tied to the Chief of Police in that state? If, not, who gave the chief the authority to revoke said license? This sounds to me like the “Barney Fife” chief took matters into his own hands with NO authority to do so! Be prepared to Rise and Defend our rights soon because you can see where this country is headed.

    If this story is completely true, it is a prime example of the dangers with the Red Flag laws. When you have a not so funny Barney Fife law enforcement officer that fails to actually investigate but chooses to be judge and jury and make a rush to judgment without actually knowing the facts or apparently not caring for what ever reason you end up with the accused person being convicted in Barneys eyes. When in reality all he was doing was saying that when the resource officer left the school he opened the school up to danger. If someone wanted to cause a problem at the school all they had to do was watch for the right opportunity and when the resource officer walked away there the opportunity arose. Very poor excuse for a police officer.

      It’s the diner the cops eat at…. the waitress was giving the chief a heads-up that the school cop was screwing-off, and the chief took this action to cover his dept. Portray an old fart as a nut-case and squelch the rumors fast…… He didn’t count on the parents and grandparents to know different and to speak out.

    I have a feeling that this story is skewed. I don’t rightly know which way, but it seems to be skewed.
    If the Red Flag law was the basis for this poor man’s plight, I am against it. That’s for sure.
    The job of the police is to enforce the law and that requires going by the books. If they overstep the
    laws, they are no longer in bounds and will be treated just like the rest of us.
    Mr. Nichols, as old as he is, has the right stuff when it comes to responsibilities. I am not so sure about
    the police chief. Maybe the chief feels he is THE LAW. No one is above the law. Not even the chief.

    It’s really unbelievable that a police chief would ignore legal process and proceed with an action , (on hearsay evidence no less) which clearly violates a citizens constitutional rights. I believe that the police chief needs to be adjudicated, and perhaps held liable for the real damages he caused this man who appears to have done nothing wrong. This country is losing its backbone due to a pervasiveness of “leftist progressive ideology” which has no business being given any credence, since it’s aim is to subvert our form of government.

    If he is reinstated as a crossing guard then he should get his guns back correct? If he didn’t do anything to get fired you can’t remove his firearms.

    This makes me sick , that someone can just “say something” with no proof, no crime committed and your job, constitutional rights and legally owned property can be taken from you in a blink of an eye. That waitress should be fired and so should that Chief of Police. This is absurd that all it takes is someone’s incorrect, second hand statement and all he was doing was talking about the safety of the children. These people should be ashamed and he should have his right and property restored as we as be reimbursed for his time, energy and lawyer fees. The waitress and the chief of police should pay for it, but sadly they won’t.
