Georgia Lawmakers Introduce Bill to Ban, Seize ‘Assault Weapons’

Georgia Bill to Ban and Confiscate Guns

Georgia Democrats have introduced legislation that would make the possession and sale of “assault weapons” and “large-capacity magazines” a felony offense that would necessitate seizure by the Georgia Bureau of Investigation.

Georgia HB-731, sponsored by Democrats Mary Margaret Oliver, Carolyn Hugley, Pat Gardiner, Stacey Abrams, Dar’shun Kendrick and Dee Dawkins-Haiglerwas, was unveiled Jan. 11. On Oliver’s website the bill is touted as a “debate [that] Georgia needs…about these weapons which are only used for rapidly killing people. Assault weapons are not necessary for deer hunting.”

In addition to banning magazines that hold more than ten rounds and a laundry list of rifles, handguns, and shotguns, the bill conspires to prohibit “armor-piercing bullets, and incendiary .50 caliber bullets,” and to “provide for enhanced penalties for the possession and use of machine guns.”

While legislator seeking to ban scary-looking firearms and magazines that hold more than ten rounds in the name of public safety is nothing new, calling for outright seizure of such weapons is a bold move. Their aim is not to cut down on crime—no one uses .50 caliber incendiary rounds for petty theft—it is to criminalize gun ownership.

Since this doesn’t have a snowball’s chance in Hell of passing—this is the state that approved of the “guns everywhere” bill two years ago—the least we can do is thank these Democrats for being partially honest: they don’t want you to have these firearms and they are willing to use the full force of government to take them from you. And, according to the bill, the punishment is severe.

“No person shall possess, distribute, transport, transfer, or sell any assault weapon,” the bill reads. “Any person who distributes, transports, or imports an assault weapon into this state shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than two nor more than ten years.”

“Any person who possesses a large capacity magazine on or after January 1, 2017, that was obtained by such person prior to July 1, 2016, shall be fined not more than $100 for a first offense and shall be guilty of a felony for any subsequent offense,” the bill reads. “Any person who possesses a large capacity magazine on or after January 1, 2017, that was obtained by such person on or after July 1, 2016, shall be guilty of a felony.”

The bill even has a provision to cover if your “assault weapon” is somehow legally owned: any person who fails to report a stolen legal assault weapon to the GBI within 72 hours “shall be fined not more than $90 for the first offense and shall be guilty of a felony for any subsequent offense.”

This is the first step toward the left openly stating that they would approve of gun seizure. Luckily, for now, Georgia has a governor and citizens that have demonstrated they will stand for gun rights.

    Gentlemen and Representatives of our government.

    I am 67 years old, Veteran, Boyscout, Engineer and retired.

    I have more time to review what goes on a daily bases looking at the government business, politics, and citizens of our country conducting the nation’s business.

    One item I am most concerned about at the moment is the process of reviewing gun control. Seriously for the safety of our country the 2nd Amendment needs to be preserved for the life of our nation. A citizens militia has been required in almost every war in history. Key to it is that the weapons of the militia be substantial enough to counter any invading nation, or alliance that would choose to challenge us on our soil. A ten shot pistol will not hold up against an AK-47 with a 30 shot clip. I believe the right alliances against the U.S.A. could overcome our shores from multiple fronts at any given time. Seriously, our Arm Forces could not push back such attacks. A 200 million man army of China represents a substantial force all by themselves.

    Army’s have often come up short in protecting their nations without the help of their citizens. Through out history unarmed citizens have meant defeat for their nations. The results being, genocide, and labor camps.

    I feel strongly for those that have lost their loved ones through reckless mental or gang related shootings. But we cannot weaken the “Militia” in the second amendment. Self defense of one’s home and property is a by-product of amendment, but let there be no doubt the serious purpose of the amendment is in the meaning of “Militia” in defense of our nation.

    I read somewhere recently that there is estimated 80 million gun owners in this country. Note, that a large number are battlefield hardened veterans, and other veterans that went through training. This is an army by itself, and a substantial one. I almost believe it would be treason for any group, or individual to weaken this force in defense of our nation.

    In reaction to the shootings, the young and many others are practicing their right to stand up and protest against guns. Guns are an icon to the shootings, but we can not forget, guns, are a monument to the wars fought inside our nation, and, foreign countries to preserve the freedoms we have.

    Note, that I was 19 when I was drafted into the Army in the Vietnam era. I had a lot of shooting experience before being drafted. I had no trouble qualifying with excellence on most weapons. It was easy for me. But let me tell you, there were many kids that had no experience firing a weapon. On the ranges they did poorly. Handling the firearms they did poorly. A few times on the firing range is hardly time to train an individual to fight a war and defend themselves. I felt like a lot of them were just being sent to slaughter.

    In my mind, “Sacrificing a nation to protect a few” would go against the second amendment. My first priority is to protect the hundreds of millions of people, citizens, in this country in a challenge. Second is to find better ways to protect individuals. They both are important.

    It is such a contradiction, to be reducing the effective defense of our nation’s gun owners, in face of Russia’s current aggressive actions, China’s expansion and military buildup, North Korea, Syria, Pakitstan, and Iran. We have had our foot on their necks for quite some time, but they are succeeding at reducing the effective pressure of the United States of America. Their respect for our military is weakening every year.

    Gun reduction laws affect the future citizen opportunity to defend our country. I read a few years back that in a WWIII type of scenario, technology weapons would be used up in the first 3 – 6 months of the war. Defense factories would be destroyed, and missiles, ammo and etc. would be used up. Logistics and supplies would be almost non-existent.
    Ultimately the final determination would come down to face to face individual combat.

    I respect the outpouring of the young and parents on the mass shootings. But I know the answer to their problems are not in the “Gun”. Nice object to blame everything on. But it will not stop knife attacks, bomb, poison and vehicle attacks. These people are intent on payback, or just causing mayhem in what they believe.

    In the end it is the adults that need to figure out a balance between protection, and safety for all. There needs to be the ongoing continuous debates. But please don’t sacrifice and weaken our ability to stand up to a national threat. These types of threats are created over generations. No country survives up on the pedestal for ever.

    I’ve read the comments below. Relax folks. This is simply democrats agitating on Barack’s trip out the door. And unfortunately, while Georgia is a conservative RED state, there are a few urban counties where democrats are clustered. ( like turds in a septic tank) Fulton, DeKalb, Gwinnett, etc. Don’t worry, not only are these democrats harmless, they’re also grossly outnumbered in this state, and they know it.
    Further, post-Sandy Hook shooting when many liberal states used the opportunity to try to ban so called, “Assault rifles,” The Georgia Sheriffs Association stepped forward for the citizens. They made a resolution that they would tolerate NO INTERFERENCE from ANY govt entity that tried to infringe on the 2A rights of Georgia citizens, be that from local, state OR federal entities! And said resolution was signed by EVERY ACTIVE SEATED SHERIFF IN GEORGIA! And, the resolution is re-introduced and reaffirmed EVERY YEAR at their annual meeting. My thanks to Sheriff Howard Sills of Putnam county, the then-seated president of the Georgia Sheriffs Association, for having the foresight to initiate this annual resolution. Nothing like elected representatives with a bit of foresight….. lol
    So inessence, the few lefties we’re forced to tolerate here in Georgia? Can kiss my @ss. They ain’t collecting SHEE-IT in this state, and they never WILL….

The 2nd Amendment is not so we can hunt deer more effectively: it\’s to ensure the citizenry have adequate defense against their *own government.* (Every self-respecting Son of the South should already know this.) This DemocRAT bill is a perfect example of why the 2nd Amendment is in place. The 2nd A also protects the FIRST A, which is freedom of speech and religion. Once the 2nd A falls, the 1st goes next, and after that, the Constitution will be able to defend itself no longer (against domestic or foreign invasion, such as Islam) or even speak for itself, and Islam\’s \”Great Satan,\” the United States, will fall.If you do NOT believe that every current democrat is an acting dhimmi under the thumb of Islamic terrorism, then you haven\’t fully comprehended the *extent* to which Hillary prostituted her position to Islamic (terrorist) interests.     Georgia being pretty much a gun friendly state who do these people think they work for?
    We need to remind our representatives (both state and fed) that they are not placed in office to express and push their personal agenda’s but to express and promote the desires of their constituents. They shouldn’t be allowed to have an opinion.

Georgia is setting themselves up for multiple lawsuits, monetary damage and could cost the state hundreds of millions of dollars, if the state has that much money to lose, then let them try it. I am afraid that if the state tries to confiscate these weapons, ammo and large capacity magizines, that there may be blood shed and i know i dont want that to happen, neither does the state of Georgia, the democrats and the republicans do not want to see that. you know the republicans will not stand up to the Government and the democrats make up stupid laws that make no sense what soever.

    These laws won’t hold up under Supreme Court review. The Constitution doesn’t say “the right to keep and bear arms that aren’t capable of killing many people very quickly.” The purpose of keeping Americans armed is to keep Americans safe, from other Americans, or our government, or even foreign invaders. If the state of Georgia wants to start going after people with firearms and attempt to confiscate them, they had better bring some of those banned weapons with them just in case. I doubt anyone owning firearms like these would have any qualms with protecting their right to do so.

    I used to worry about the government trying to disarm the American people but I don’t worry anymore. In this country 100 million people own 350 million firearms and 200 billion rounds of ammunition. The scale of this is hard to imagine. It’s so big that if word ever leaks of forcible civilian disarmament and even a small fraction of these gun owners decide to resist with force, that’s called ‘civil war’. It will be the most uncivil of wars, because each year states issue something like 15 million hunting permits presumably to people who own items of military utility such as camo gear and night-vision scopes and who are adept at moving stealthily through wilderness for the purpose of making one-shot kills at distances measured in hundreds of meters. We sometimes call such people “snipers”, and we have 15 million of them. “15 million” is larger than the seven largest armies in the world — combined. In the face of such a force (augmented by most of the police and most of the military) the government would fall overnight and senators would flee to Canada.

    There may be the occasional nut-case in this state legislature or that one, but the bulk of them want to keep their jobs and their lives. The chance of something like this actually coming to a vote is lower than your chance of being trampled by a unicorn. Relax; stop worrying.

    When asked “why” I own an AR15 and many higher capacity magazines and stock-in a couple thousand rounds of ammo, I’m honest enough to to tell that person that I own such a weapon because my civilian government has authorized all of it’s bureaucratic agencies to arm themselves with “assault weapons”, hi-capacity semi-automatic pistols, purchased hundreds of millions of hollow-point ammunition for their pistols, and hundred of millions of 5.56 ammunition for their AR-15 rifles. When civilian government agencies who in the past hundred to two-hundred years never felt the need to arm themselves and mimic a military force of the Defense Department in their weaponery and military equipment and practice combat tactics, then I feel justified in arming myself against a possible armed threat by bureaucrats and government employees who are armed and would threaten the use of deadly force to stop or subdue me, a law-abiding retired military, retired LEO, grandfather and patriot.
    These agencies operate outside the constitution of the US in that they make their own rules, regulations and laws and beleive they’re justified in using force, confiscation, and even deadly force as a compliance avenue without the protections afforded to all as guaranteed by the Constitution, Congressional law making and the Bill of Rights.
    I also enjoy target shooting and high-power rifle matches and the great people I meet at these events. I never hunt with an AR, I have other appropriate caliber long guns to accomplish that activity.

    Hey guys, I am also from Georgia, but currently live in Virginia. I think the Georgia legislators who put forth this bill need to be confronted. So what that not many people use AR15’s for deer hunting; that is not what the 2nd amendment is for. The 2nd amendment is to make sure that the militia is equipped to overthrow the government if it ever came to that, and every able bodied citizen IS a member of the militia. Case closed. You cannot have my assault rifle. We need to reframe the debate, because if we let this “for deer hunting” idea pass, we’ll have nothing but single shots left, and we can’t put up much of a fight (if need be) with single shots when the government has fully automatics.

    I am fortunate to live in the great state of Georgia, where anti-Constitutional bills such as this one are laughed out of the General Assembly. But we must never fall into complacency – these enemies of the American people will never rest until they have completely subjugated us under their iron heel. Stay vigilant, fellow patriots! Support politicians who believe in the 2nd Amendment and all the other Amendments, not only with your vote but with your wallet.       In another state, 2 of the 3 perpetrators (sponsors of arbitrary firearms restriction bills that passed) were later recalled and removed from office, others may follow soon. No one should take lightly their sworn oath of defending the U.S. constitution and when they do so (as in legislators trying to circumvent the very document they swore to protect) they need to be removed from their office and the sooner this is done the better for the country.

      I LOVE women, I truly do. I love probably 90% of everything about them. But..when it comes to their political views, its as if they have short circuits in their brains!

      I think we should have a “show of hands vote” for that kind of thing, just so we know which whipped ones we can not trust.       It would have to be a public list of course. (Like the one here in NY putting everyone that owns a pistol permit on a LIST! They must have been afraid someone would get they did put in an opt out option later on. So you would not be on the long as you were aware of it!!)
      But NO opt out for the liberal list..WE must protect them!! ALL of them!! And send it out like a phone book! So any poor crook can check to be sure HE will be SAFE if he decides to rape, rob, or harm a home owner in any way!
      That would cut down on ALL kinds of “gun violence” in no time! No more poor crooks being shot by those bad home owners! After all..THEY ALL agree, there is nothing to worry about, as long as you have 911 on speed dial. RIGHT?
      I am just suggesting we TRY it with the Liberals, before we go crazy and do it with everyone.
      Just make the liberal list, and give it a couple years and just SEE what happens. Who knows, they may ALL be right..?? Only one real way to know for sure..right?
      Come on LIBERALS put THAT to a VOTE! Show us ALL we have nothing to fear but OURSELVES!!
      I know I for one would sleep like a baby at night knowing that list was out there. And, that I was NOT on it!!

    I encourage you all to take down this information and any time you get a chance to pass it around please do. Lois Beckett, a liberal journalist for the NY Times, wrote a piece in that newspaper called “The Assault Weapon Myth”. In it she admits that contrary to what she thought and wrote about the so called “assault weapon” she discovered it is not this firearm that posed a big problem. Just Google her name and the article title, and read it and pass it around. Oddly (not), liberal legislators never seem to look at contrary evidence to the gun bills they propose. This is doubly true of semi automatic rifles and magazines.
    It’s hard to debate issues with liberal retards who refuse to look at facts, but this is an editorial 2nd amendment supporters should be familiar with, and pass around.

      “Assault Weapon” is a political definition. You can use it in any fashion you prefer if it is helpful in pushing your political agenda. It was originally coined by Slick Willy Clinton when he defined AR in AR15/16 as “Assault Rifle” back in the 90’s. Of course AR is the product name “Armalite Rifle” named after the manufacturer. Since then, Progressive Liberal Bafoons have taken literary license to embellish AR to frighten the ignorant masses into supporting their power grab and undermine our Bill of Rights. Now the ignorant masses have expanded the definition to capture about anything, including machetes, baseball bats, etc. Personally I think one of the most effective offensive battle weapons (for physical attack) is a semi-auto 12 ga. with a cylinder bore and 00 buckshot. :0)

        LOL I already “neverminded” ………. BTW that “journalist” you referred to in the other Kalifornia article was Gregg Jarrett of Fox News. I watched that segment, painfully, yelled at the TV, and darned near shot the TV set. Fox was pretty quick to correct what Jarrett said (within minutes, after obviously getting a whole snootful of tweets decrying Jarrett’s lies), but not nearly emphatically enough, in my opinion. FNC should have fired that idiot Jarrett after he was arrested stoned out of his mind in Minneapolis.

We don’t have a Gun problem, we have a Criminal problem, and when you disarm the People the Criminals will start taking control of everything around themselves because they will be armed, just take a look at Shitcago, and L.A., and these other big Cities that want to control your life, most People in these areas are afraid to leave their Home for fear of being Robbed, or shot by Criminals, we have enough Gun Laws on the books now that aren’t being enforced, and these Idiots want to pile on more, and if these Demo Craps really care about our Constitution then why are they trying so hard to change it ? Because they want to Control us, not us Control them, there was a reason why our forefathers gave us the Right to Bear Arms, so we could protect ourselves from all Evils, Criminal, Political, Foreign, and Domestic, no Government is going to give back things that they take away, you will have to fight to get them back, and our forefathers knew this all to well. It’s time to put an end to all these Career Criminals, I mean Politicians once and for all, they have given themselves high wages, top benefits, outrageous Retirement packages, and all they have to do to get them is just serve one term in office, we have to work for 20 to 40 years to get a Retirement package that don’t even come close to theirs, if these Career Criminals really worked for the People they would work to make America better, and make our lives better, and not their own, and once they take away our means to defend ourselves they will strip every Freedom we have. We will at that point be no better than Russia, or China..

    I’ll agree with them on one point. Anybody that fails to report the theft of any gun, should be charged with a felony. Responsible owners don’t allow their weapons to be stolen and would certainly report a theft should it occur.

They perpetuate the fantasy that if all guns magically disappeared from the Earth, crime would disappear as well. There was plenty of crime prior to the invention of the gun. And of course the 1000 pound gorilla in the room is the fact that the 2nd amendment had nothing to do with hunting. It was written AND PASSED in the Bill of Rights so we, as American citizens could defend ourselves against the very tyranny these gun grabbers are promoting.

    I love this line, “Assault weapons are not necessary for deer hunting.” As if the 2nd amendment is all about hunting. A continuing theme from all of these lefty gun grabbers. Why do these people waste their time submitting this bill to a state legislature who approved a “guns everywhere” statute.

    The author is correct the far left/progressive/Hillary Clinton wing of the Democrat party have finally admitted they are all for firearm seizure and incarceration of lawful gun ownership. These are the true “wingnuts” of the political system.

    I have yet to see a true definition of “Assault Weapon”. I had someone argue that it is a semi-automatic rifle capable of holding more than 10 rounds in a magazine. My response was so my .22 rifle I have shot and owned since I was a youngster is a “Assault Weapon”. His response was “Well no”. I responded I fail to see your logic or lack there of. His next statement was more par for the course. “I can see that I am not going to change your mind so let’s stop talking about it” lol well I guess when you cannot defend your position you should retreat and duck for cover.
    I guess the Libratards and Dummycrats have not figured out a true legal definition for “Assault Weapon” but I am sure it is coming to a debate near you soon.
    The statement from the GA lawmakers “about these weapons which are only used for rapidly killing people” is a total fabrication of the truth. I guess my knife has to be regulated as well because it has the potential of “Rapidly Killing People”.
    I pray we take our country back and restore common sense which is not so common anymore. Get our and vote people especially in local elections it does make a difference.

      Here is the definition of an assault weapon that I found:
      In a strict definition, a firearm must have at least the following characteristics to be considered an assault rifle:[2][3][4]

      It must be an individual weapon
      It must be capable of selective fire
      It must have an intermediate-power cartridge: more power than a pistol but less than a standard rifle or battle rifle
      Its ammunition must be supplied from a detachable box magazine[5]
      And it should have an effective range of at least 300 metres (330 yards)

      Rifles that meet most of these criteria, but not all, are technically not assault rifles, despite frequently being called such.

      For example:

      Select-fire M2 Carbines are not assault rifles; their effective range is only 200 yards.[18]
      Select-fire rifles such as the FN FAL battle rifle are not assault rifles; they fire full-powered rifle cartridges.
      Semi-automatic-only rifles like variants of the Colt AR-15 are not assault rifles; they do not have select-fire capabilities.
      Semi-auto rifles with fixed magazines like the SKS are not assault rifles; they do not have detachable box magazines and are not capable of automatic fire.

      The U.S. Army defines assault rifles as “short, compact, selective-fire weapons that fire a cartridge intermediate in power between submachine gun and rifle cartridges.”[19]

        The M16 is our “battle rifle” and it being a 5.56mm only leaves for the most part a 22lr or 22 magnum or the 17HMR as the “less than battle rifle” cartridge , but they are less than pistol cartridges so there is NO cartridge to fill the “less than – more than” gap.

      The 2 amendment is our right we have lived with for 330 years, so who are those who think they can change that. This is the only reason another country hasn’t invaded us, because they know everyone has a gun. They may take mine, but not with out a fight and only when they PRY IT FROM MY COLD DEAD FINGERS!!!!

    I sent emails to all six Democrat Georgia Representatives that sponsored the GA HB 731 and told them I oppose the bill. The bill is a complete waste of GA tax payers money with unnecessary Georgia Bureau of Investigation seizures, it impacts law abiding citizens that train with AR-15s to protect and defend this country (law enforcement, military, etc.), and a clear violation of our Second Amendment rights.
