Gun-Control on the Move, Expanded Background Check Bills Sail Through House

Well, that didn’t take long.

Just a week or so after their introduction, the House of Representatives passed two key pieces of gun-control legislation: H.R. 8 and H.R. 1446.

The Bipartisan Background Checks Act (H.R. 8) is a universal background check bill that would criminalize private transfers. 

Meaning, sales or transfers between anyone who is not immediately related would be outlawed.  

In order to transfer or sell a firearm lawfully to another individual, the transaction would have to be facilitated via a Federal Firearms Licensee (FFL).

The FFL would run a background check on the prospective buyer (or transferee).  Many FFLs charge fees for running background checks. 

Failure to comply could result in criminal prosecution for both buyer and seller.  

“This is the moment to act on gun safety, and that starts with background checks on all guns sales,” said Shannon Watts, founder of Moms Demand Action, in a press release obtained by GunsAmerica. 

“Our grassroots army of nearly six million supporters is proud to stand behind Speaker Pelosi, Rep. Thompson, and gun safety champions in the House as they pass this bill with bipartisan support and overwhelming support from the American people,” she continued. 

The Enhanced Background Checks Act of 2021 (H.R. 1446) would close the so-called “Charleston Loophole” by eliminating the policy that a firearm can be transferred to an individual if the FBI has not completed a background check within three days.

The bill gives the FBI a full 10 business days to complete a background check that has been delayed. Once those 10 days are up, a prospective buyer can petition for “escalated review to spur the FBI to complete its investigation.”  

The sale may proceed if the escalated review has not been completed within an additional 10 business days, allowing the FBI to delay without reason a person’s Second Amendment rights for a full four weeks.

“We could have addressed this deadly loophole years ago, but then-Majority Leader Mitch McConnell stood with the NRA to block this bill from ever getting a vote on the Senate floor,” Watts said in reference to H.R. 1446. “Fortunately, there’s a new majority in the Senate –– and we look forward to working with that majority to pass this bill into law.”

Gun-rights groups were quick to condemn the news.  

“Chuck Schumer and Nancy Pelosi have never met a gun control proposal they didn’t immediately want to take to bed. Given the chance, they will rape our gun rights,” said Alan Gottlieb, the founder of the Second Amendment Foundation in an email to GunsAmerica.  

Mark Oliva, the director of public affairs for the National Shooting Sports Foundation, offered a warning for what universal background checks portend: a national firearms registry.  

“H.R. 8 does nothing to address the criminal misuse of firearms, but would put every law-abiding gun owner on a federal gun registry which is currently forbidden under federal law,” he told GunsAmerica.  

“The firearm industry has grave concerns about our customers being profiled on government watchlists for simply exercising their fundamental Second Amendment right to purchase a firearm,” Oliva said. 

Everytown for Gun Safety has repeatedly stated that background checks on all gun sales are its “top legislative priority.”  While it won’t publicly admit it, the truth is that universal background checks will be unenforceable and ineffective without a nationwide gun registration requirement.

Gun-rights advocates know this and gun-control advocates know this because (a) it’s plainly obvious (b) Democratic lawmakers recently introduced national gun licensing and registration legislation (H.R. 127), and (c) the Obama administration told us so in a government-funded analysis titled, “Summary of Select Firearm Violence Prevention Strategies,” authored by NIJ Deputy Director Greg Ridgeway.

The “Twitter Summary” from the document reads as follows (emphasis added), “Universal Background Checks: Effectiveness depends on the ability to reduce straw purchasing, requiring gun registration and an easy gun transfer process.”

Plainly stated, outlawing private transfers and giving the government more latitude to delay one’s fundamental right to keep and bear arms are only the tip of the iceberg of what the anti-gun Left has in store for the 2A.  As Shannon Watts confessed, this is where it “starts…”

Both bills now head to the Senate where Majority Leader Chuck Schumer (D-NY) has promised to bring them up for a vote.  

“H.R. 8 will be on the (Senate) floor and we’ll see where everybody stands,” Schumer said Thursday during a press conference with Pelosi. “No more hopes and prayers.”

    So far the house has passed nothing but bills that are either blatantly unconstitutional or will bankrupt our country. From taking election law away from state legislatures to these ridiculous gun bills that will do nothing to deter crime and in some cases increase it the house has put forth bills that will not pass constitutional muster by anyone who knows the constitution. As written these gun bills are not enforceable. That will mean they will have to put forward another bill causing gun registration. That in turn will lead to gun confiscation as crime will be rampant by all the things that the democrat party has done. Letting criminals out of jail and invoking no bail policies is all about creating more crime so they have an excuse to eventually take our guns and our other rights. If anyone is so stupid to think that the democrat party is doing things to make things better and safer need to pull thier head out of their rear end.

    The Universal background check is long overdue and was originally part of the Brady Bill until it was at the last minute removed by the NRA.

    States with lax laws funnel guns into States with tough gun laws letting any criminal or nut case buy all the firepower they want with no paperwork. Its complete insanity and all civilized nations have vetted all gun sales for decades and have been far more successful at reducing gun homicides.

    The Chicago study proved that the average gun crime was not committed with stolen guns at all but with second hand guns that had passed through many hands. Also Police tracings proved the exact same thing in many other states.

    Many Republicans also support Universal Background checks as they know the majority of the American people want this law passed so it is basically already a done deal.

These laws ONLY affect honest lawful people and will not stop or even slow down the criminal element from buying firearms on the streets. They are by definition ‘criminals’.

It seems the majority of law enforcement, the investigative agencies (the FBI and state equivalents), local, state and federal officials (attorney generals, secretaries of state, mayors, governors, etcetera), legislators (state and federal), and the judicial system (local, state and federal including SCOTUS (except Clarence Thomas and Samuel Alito)) seem to be blatantly ignoring fraud, corruption and outright criminality regarding the election corruption which was against the constitution and against state and federal laws. So … when they ‘see no evil’ who ya gonna call?

    I was a Commisioner at a voting precinct. I know of many conservative minded folks that failed to vote in the last election. I asked them why they had not voted. The usual reply, “I was so sure that Trump and the Republicans would win that I did not go. I had other things to do.”
    Nearly 30% of Americans did not vote. Now we have this. All you who did not vote, SHUT UP! You have no say!

      I could have just arrived as a “tourist” from China and voted. Now you might get a clue as to what happened in 2020. BTW, I received 6 UNSOLICITED request forms for mail-in ballots. I complained to my elected reps. about that and never got a response. And they’re all Republicans. Get the picture?

        The elites have done their best to make the convention of states sound scary. I have heard so many lies about it I can’t count that far. Folks don’t read the constitution and it’s not taught in schools any more. Even most lawyers only know the interpretations of their professors, not actually what it say.
        In all honest, you are precisely correct. The situation we are in is exactly why the founding fathers wrote the convention of states into the constitution. It could cure the worst problems we have with this government but it would probably take years and the country may not exist that long.

      We can thank the spineless Republicans who ignored and/or refused to investigate all of the ballot and election fraud. I watched days of every swing states’ legislative sessions of people presenting their testimony, most backed with affidavits sworn under penalty of perjury; and it was obvious there were significant problems that only 2 courts would listen to – the rest refused to even LISTEN to the evidence when they threw out all of the cases using BS reasons – including the US Supreme Court. Justice Clarence Thomas was absolutely right that the SCOTUS shirked its responsibility on more than 1 case by refusing to hear the evidence.
      The only good news is that Arizona ad other states are fighting to conduct forensic audits on the ballots and the voting machines. And other lawyers are still working tirelessly to gather as much evidence of fraud in the hope that something may be done.

      I believe President Trump’s lawyers and other lawyers who worked on the ballot and voter fraud issues when they say Trump actually received possibly more than 80m votes. Is Biden really more popular than Obama? Of course not. How many major cities/counties did Biden get more votes than Obama? Atlanta, Clarke County, Detroit, Maricopa County, Milwaukee, and Philadelphia – all major cities in the swing states where the ballot and elect fraud allegations are! Did Biden get more votes than Obama in NYC, Miami, or Chicago? No.

I swore an oath as a veteran to protect the constitution against enemies foreign and domestic. The radical left has talked about eliminating republicans for the past 5 years. So yes, I would eliminate these dems by hanging them or have them face a firing squad.

      That’s exactly right. These people hate the constitution and the liberties it provides. First it is 2A, because it’s a easy target, then the other amendments. They will tell you it will save lives, but it won’t. The criminals are not buying ther guns legally- you would have to a total idiot to think that. The threat is real, people. And it’s not just the guns, it the right being taking away. Who are these people who think they know what is best for the rest of us enough to reverse our constitution that has stood for 250 years? And don’t forget, these people have armed security that travel with them paid for by our tax dollars. But they want to take away our right to protect ourselves! We need to be pissed off! Bombard all your representatives with emails, letters and phone and tell them they will be voted out if they support these bills. This is supposed to be government by and for the People, not a bunch of old out of touch assholes who think they know what’s best for us and want to control us and force us to rely on them. Limiting legal gun ownership will not prevent crime. If fact, if every law abiding citizen carried, crime would disappear. Think about it.

Stupid is regulating law abiding gun owners, making it difficult to own or impossible to own guns and turning criminals out on society early and shutting down police..

      It’s not stupid, it’s by design. Scare the sheep into giving up their rights for a false sense of security. History has shown that the best way to lessen crime is to have stiffer punishment for offenders. The dems fight stiffer punishments at every turn. They want chaos, it helps them gain power from the weak.

    I purchased a Ruger Wrangler yesterday at Dunham’s and I swear it took 45 minutes to complete the process to purchase the firearm from filling out the forms to the sales person escorting me out the door and handing my pistol to me. And on top of that, when I paid for it, the cashier took my driver’s license and entered a whole bunch of information into their system (database?). It is my understanding that gun sellers are not supposed to store purchaser information for longer than a certain time and I challenged the cashier about that, but of course I got the “Its Dunham’s company policy” bs. I noticed that Dunhams had a fairly large number of pistols and long guns available to purchase and I am wondering if their policies governing firearm purchases are’t discouraging law abiding citizens from buying from Dunham’s. I’ll probably think twice before purchasing another firearm from Dunham’s again. Oh! and the US house of Representative just passed H.R. 8 and H.R. 1446, Welkom to what used to be America-Land of the FREE and home of the BRAVE!

      The only thing the FFL (retailer) is required by the federal government to keep is the form 4473 for 20 years.

Write to elected people in Washington to tell them no, and write often. We need to make a concerted effort against them, because that is what they are doing to us.

    Enough is enough. It’s time for a lawsuit to go to the SCOTUS to EXEGETICALLY enforce the 2nd Amendment as the Framers intended. If an individual wants to buy a FULLY AUTOMATIC weapon WITHOUT government permission or to carry concealed WITHOUT a permit, SO BE IT.

    For public safety, modified laws of nations like Indonesia. Carry a weapon to a crime, get 5 years in prison. Shoot a weapon in a crime, get 10 to 20 years. Wound a person during a crime, get 20 to life. No paroles. Murder a person, get the death penalty.

    Make sure perpetrators get fair trials with competent lawyers. Also, if police, detectives, lab techs, prosecuting attorneys, or judges plant, manufacture, falsify, or withhold exculpatory evidence, make them face the penalties their intended victims faced, up to and including death.

    Is this a free country?who voted for those idiots.anyone?I don’t remember asking for any new gun laws as they put it.no I don’t know anyone who wants more rights restricted. So who do they serve?elected people are supposed to represent the people.they are not sole authority to govern however They want on a whim.nopeople wake up before its to late.we need to have a voice and more stick together to not cave to these predators.
