House Democrat Proposes National ‘Buyback’ Bill

I know I don’t have to tell you this, but gun buyback programs are worthless. For starters, it’s not technically a “buyback” because the government never owned the firearm to begin with. A manufacturer made it, shipped it to a dealer, who then sold it to the purchaser. Nowhere in that chain of custody did the government take possession of the firearm. So, “buyback” is a B.S. term. It never belonged to the government!

Beyond that, the purpose of a buyback is to, as we so often hear, “take guns off the streets.” The logic behind the buyback is that if we offer criminals money for their firearms they’ll voluntarily disarm and turn their hardware over to law enforcement.

It’s such a transparently stupid idea that one wonders how it ever got taken seriously. Proponents of buybacks actually believe that hardened drug dealers and thugs will give up the tools that not only protect their criminal enterprises from rival competitors (gangs, cartels, etc.), but also ensure the safety of themselves, their family and their property — all for a $100 gift certificate or money card. In a way, it’s like asking the lion to give up his claws and teeth for a cheeseburger. On what planet would the lion ever take that deal?

So, buybacks do not “take guns off the street.” No criminal shows up to trade in his piece for the Applebee’s gift card. It just doesn’t happen. What ends up happening, though, is that folks from the community turn up and swap out their worthless, junk guns (broken guns, non-operational guns, etc.) for the handout. You can’t blame them either. It’s getting something in exchange for garbage.

With that in mind, I want you to consider a recent bill introduced by Democratic congressman Donald M. Payne from New Jersey, called the “The Safer Neighborhoods Gun Buyback Act of 2015.

The premise of the bill is to use $360 million in taxpayer money to allow the U.S. Department of Justice’s Director of Bureau of Justice Assistance (Who knew that agency even existed!) to hand out smart debit cards to state and local governments and gun dealers so that they can be used to purchase unwanted firearms.

“We owe it to the communities we have sworn to protect to pursue every opportunity to reduce gun violence in our neighborhoods,” said congressman Payne, Jr. “Although no one piece of legislation will eliminate all gun violence, this bill will get guns off the streets and keep them out of the hands of people who wish to cause harm. If we can get one gun off the street, if we can save one life, then we have to take action.”

In short, The Safer Neighborhoods Gun Buyback Act of 2015 is a great idea if one wants to piss away $360 million of taxpayer money. What’s funny, though, is that I know a lot of people who would take advantage of that deal. Some of my friends are sitting on some real junk guns and would love to to trade them in for a debit card.

Based on language in the bill, the “debit cards will provide gun owners with funds 25 percent above the market value of the guns traded in, based on an assessment conducted by the Director of Bureau of Justice Assistance, and will be valid for two years. Sales on individual firearms are expected to range in price anywhere between $40 and $400 depending on alterations, condition, age, and model of the firearm.”

The one downside for those who would exploit the program would be that one couldn’t use the debit card to buy another firearm or ammunition, nor could one attempt to redeem it for cash.

Yes, this is an epically stupid idea. Will this bill gain any traction in Congress? Probably not. What it is is another example of just how idiotic our elected leaders are when it comes to addressing violence. Instead of putting that money toward, say, a targeted law enforcement effort to crackdown on drug dealers and gangs in high-crime neighborhoods, Congressman Payne, Jr. would rather appropriate it for an initiative that doesn’t have a snowball’s chance in hell of “taking guns off the street.” I mean, where is his head at? What the heck is he thinking?

    I’ve been through a couple of those Buyback programs and people bring in junk, parts, old stressed and worn Frames, leftovers from swap outs, and repairs, and turn them in for money. Few actual functioning guns except someone whose spouse passed and they have no use for the gun, or the family doesn’t want them gets turned in, but no gang banger, thief, or dishonest person is going to turn in a several hundred, or several thousand dollar firearm for $100. But bring it on, I’ve got a bunch of leftovers from repairs that I can make realistic enough for Grocery Money. It’s hard to believe that they let these people serve the public, and handle the public’s Tax Money. It’s even sadder to realize that we’re not shocked by it anymore.

Payne comes up with a concocked idea it just validates the bafoons are running the country. The government has been very sly on pitting the people against each other. That’s what they want so we can kill each other off and hate some more. The law abiding citizens need to band together not against one another . we have to do so to prevent tyranny and to keep from being treated like cattle. Use the money for the people not to violate the laws of the Constitution.     I went to a gun buyback in Hempstead, Long Island. The gun i traded in was a rusty Chinese sks. I’m white and so was the rest of the people there. No gang bangers showed up. What a surprise !!! LOL. And anybody that knows that area knows that it’s a mostly
    minority town with non-white gangs.

    Ok, let me get this straight. These people that turn in these guns get taxpayer’s money for it. So, the money they get, is from most of the seller’s pocket anyway.     Took less than 60% of guns off street, most of what was bought back was semi auto 22 rifles and gun parts, cost the taxpayers in excess of $60 million, most gun owners who sold their guns have since purchased new guns, made no known or detectable reduction in guns on the black market, did not reduce the number of suicides, did not reduce the number of murders, did not reduce the number of violent crimes, it is speculated those in fact increased.

    What I lament is the loss of scarce and expensive gun parts needed to repair antique collector pieces. True, many of the old guns are worthless and were cheap in the first place, but if one in a hundred was an old broken Colt or Parker, it is a tragic loss of great craftsmanship and high quality American manufacturing to history.

    Furthermore, the entire premise of “taking guns off the streets” angers me. These arrogant politicians make the presupposition that the unwashed masses, who elected them in the first place, are not good or trustworthy enough to own firearms in a nation which has carried and cherished the right to own firearms for 400 over years (1607 – 2015).

    P.S. You know the good guns end up in the collections of government officials and police. Heck, the rifle used to assassinate Medgar Evers disappeared into the presiding judge’s private gun collection. V/r, T.J.

Gun buy backs are a joke. Just leading the lambs to slaughter. Great for people wanting to get rid of a POS gun. You think they would do something positive; BUT OF COURSE WE ARE ASKING COMMON SENSE TO BE USED HERE, with 360 million bucks as to lets say intact a special pilot law enforcement program in one of the high crime cities and put foot on the throat of crime in some of the major cities that the police force is overwhelmed with gun and drug related violence and put our hard earned tax dollars to work and put a lot of thugs in prison. In rural cities, towns, and areas we are by majority pro gun and have been raised with firearms; I myself since I was old enough to carry a 22 rifle and BB gun, we know how to handle firearms and there is very few households that does own a firearm and by percentage of population we have a very crime rate. Dr. Ridgeway also debunked one of the mantras/arguments that his fellow gun-grabbers have been bleating for decades- that guns used in inner-city drug-dealing gang shootings were brought in from areas with less restrictive laws regarding gun ownership. These idiot political hacks either don’t read the research done by their fellow gun-grabbers or they totally ignore it and proceed as if the equally moronic laws they are proposing will have some effect on the demographic responsible for 80% of the gun homicides in the USA- inner-city drug-dealing gangs (according to the Centers for Disease Control & Prevention).       While I may not agree with that poster’s comment, the TRUTH is that 80% of the US Gun Homicides ARE committed by Inner-City Drug-Dealing Gangs of 14-20 year olds according to the Centers for Disease Control and Prevention. When you factor out the homicides those folks are committing, and use 325,000,000 population for the USA (which includes 11,000,000 undocumented aliens and US citizens who just refused to answer the U.S. Census), the USA’s gun homicide rate is 0.08 per 100,000 higher than Japan’s, Iceland’s and Norway’s. The USA is No. 1 in the world in rate of gun ownership and No. 83 in the world in terms of gun homicide rate. Cuba, North Korea, and Venezuela, which ALL forbid guns in the hands of their citizens, ALL have greater gun homicide rates than the USA. Cuba 5.0 per 100,000; North Korea 15.1 per 100,000; Venezuela 45.0 per 100,000. Before you jump in with any data about suicides: Japan has only 1/3 of our population. They not only have a GREATER RATE of suicide, but have GREATER NUMBERS of people committing suicide. The USA’s suicide rates compares very favorably with that of MOST European countries.

    Buying guns from the public will do nothing to change the violence. Human violent behavior is the problem, not the possession of guns. In China no one is allowed to have a gun legally, none are sold to the general public, yet violence against innocent people is still rampant. The weapon of choice, knives. Australia the same. United Kingdom the same. Take away all weapons known and do nothing to change human behavior and they will beat each other to death with their bare hands.

    Gun buy back programs do nothing but support the firearms industry. It is simply supply and demand. When you take used guns out of the supply side, manufactures will make more new guns to fill the demand. I hope congressman Payne is getting a big check from the gun manufactures, because he deserves it.

    The more guns manufactures make, the more money they have to develop new and better models of guns. Oh, Thank You congressman Payne.

      You really don’t understand how/why firearms are bought and sold on an individual level.

      A semi-auto rifle, like an AR15 costs between $600 and the sky’s the limit in the retail market. So, if I haul my AR to a firearm buy back and sell it to the feds, I don’t get enough to go out and even replace it, much less buy something better. Most of the people who take firearms to gun buybacks were never criminals in the first place and left their firearms to collect in their sock drawer at the back of the closet. They don’t go out and buy another firearm. Check, there aren’t ‘spikes’ in the sales of new firearms in places where the government has totally just ripped a bunch of buyers.

      If it worked like you think it did, firearms manufacturers would be pushing firearms buyback programs like hot dogs at a Yankee’s game.

      The only ‘good’ thing that can come from buybacks is, if while waiting in line, you spot a person who’s going to sell back a firearm that is worth hundreds or thousands of dollars more than the cops are going to pay for it; you approach the seller and negotiate with the seller to affect a private treaty sale. This makes the seller better off and you get a good deal on a good firearm. And the firearm comes out of the alleged ‘criminal’ hands into the hands of a responsible firearms owner who won’t use it to commit a crime.

    This bill need only be re-titled: “How I plan on re-election.” Grandstanding but for one purpose only. Hey pal. Show us you are really aware of the actual problems in this society. Spend about a year or so in prison, and get to know those who actually have the intent to harm others. It also might help to loose some weight in there. Then when you come out, you will have a better focus on who you should be attacking. Just compare the real, ordinary citizens out of prison with those you met in jail. Now you can see the difference and begin designing real laws to attack those people, not us.

    If the card is not registered to anyone in particular, then trade the card to someone for cash and buy another gun. Technically the card was not used to buy a gun, The gun was purchased with cash. The one who sets the price for the trade in probably has no concept of it’s worth. The value given to the gun should be the highest price obtainable from either the Blue Book value or Black Market value.

      I don’t know where the Congressman’s head is at, but I have a pretty good idea. Participating in any gun ‘buyback’ program because you think criminals have too many guns is like castrating yourself because you think your neighbor has too many kids. How does the Congressman propose to enforce the plan he is pulling out of his butt? I have seen many people, back to the birth of food stamps buying food with the stamps, and selling it to mom and pop diners to get money to drink on. The diner profits from lower food costs, and the seller profits because they get their Mad Dog. I have not heard that the government has come up with a way to stop that traffic, but you think that criminals will turn in their guns, That takes a very special kind of stupid. The only people this will affect is the law-abiding gun owner who does everything right, but will become a criminal if they don’t go like a sheep to the shearing. There are enough gun laws on the books in the US (approx. 20,000) that if law enforcement takes a week and rounds up every gangbanger with a gun, every drug dealer with a gun, every convicted felon with a gun, they could fill every jail cell and patrol car and LEGALLY take these criminals off the streets for a minimum of five years, plus remove their arsenals from the streets. Too, destroying the captured guns really does no good, the guns should be sold by the police agencies to fund these raids. As a civil deputy in Arizona, I almost cried when we had to take a torch to a gorgeous 1928 Thompson sub in a wood presentation case. It was not fully automatic, and could have brought an easy two to three grand to aid in fighting crime. These anti-gun nuts with their ‘common sense’ and ‘reasonable’ gun grabs don’t appear able to grasp the concept that these stupid ideas don’t work, can’t work, for one simple reason: criminals do NOT obey laws, so they will never obey the new laws designed to disarm the citizen any more than they have obeyed laws alreqady on the books against murder, assault, robbery, rape, arson and even more. Quit trying to take our firearms away and make resiprocity legal in all fifty states, districts, and territories.

    Following the good congressman’s thought process: “If we can get one gun off the street, if we can save one life, then we have to take action.”, then the good congressman will surely resign his seat due to the simple FACT that legal people turning in junk weapons or self protection devices doesn’t reduce gun violence.

    Pretty simple congressman. So listen to your own advice and resign before it becomes too late and you end up killing more people. It is also sad that he doesn’t sponsor a car buyback program as cars kill more people than guns i the U.S. every year.

    Again, nobody ever said politicians were all that smart. (except themselves, of course)

        Their oath is to protect and defend the constitution, not to protect the citizens from each other. They are supposed to be protecting us from invaders and traitors. Instead they are the traitors we need protection from. Most of them break that oath the very first time they vote on a bill. Most of the laws the feds pass are unconstitutional. How hard is it to understand that “shall not be infringed” means they can’t legally tell us what kind of guns we can have, how many we can have nor where we can carry them. How is requiring a permit or a waiting period or a background check not an infringement on that right? Since when do you have to ask permission to exercise your rights?

    Try $500-$1000 for a pistol. More for semi-automatic rifle. Get serious not on a grandstand. That will get illegal guns off the streets, a bit. Kids will be prime customers turning in weapons that should be turned in. Also, no prosecution or they will never cooperate. Then you can say you really tried something beside blowing smoke up our butts.Problem is, Dems really aren’t interested in the safety of the American citizen. All they care about is getting elected and further ruining our country.

      $500 per handgun
      $200 per singleshot shot gun
      $500 per repeater long gun (bolt, lever, pump)
      $1000 per semo automatic.

      So, a Marlin .22 semi would get a cool thousand. That’s fine by me. A old .30-30 gets $500. A ratty old mosin nagant gets $500.

      If they want “guns off the street” then pay at least a fair price.

        First, Big Joe nailed it. Second, Super G needs to check the law. In the majority of states it is a “Capitol Felony” to kill a police officer, teacher or politician and the law is effective 24/7 no only when they are on duty. Note, I have no problem with this law . . . at least as far as it protects check the law enforcement and teachers. Most states also include all emergency or first responders but that is not universal and I am unaware of any state that does not make it a capital felony to kill a politician (no surprise there, they make laws to protect themselves firs, laws to benefit themselves second, laws to ensure re-election third, and when they find time to stop screwing the staffers, they actually take up laws to benefit the people that pay them.)

        The point is, there is already a law that makes it a death penalty crime (in states that have the death penalty) or a mandatory life sentence for killing a cop. Super G’s proposal would result in unfair and illogical detriment to otherwise law abiding citizens because it WRONGLY ASSUMES cops never make mistakes. If further assumes there is no such thing as a cop who abuses his/her authority.

        Do police officers, firefighters, OUR MILITARY who is painfully and very importantly missing from the protected persons list and are infinitely more valuable than politicians, and teachers deserve special protection? Absolutely. Texas goes so far as to add children under the age of 5 to the list – though military service members on duty remain missing while politicians and “public officials” are deemed deserving of extra protection.

        Lest anyone think otherwise, the capital felony is assumed, it becomes the defendant’s affirmative duty to show a justified shooting. In other words, if you kill a politician, public official, police officer or first responder, or a child under the age of 5 in Texas, you will be put to death unless you can show it was “justified” under the law. That more than meets SuperG’s draconian sense of justice.

        What we need is not de-arming, we need to have mandatory gun training in high school. Not just a “hunter safety” course that is optional, a real training how to use a gun properly, how to safety a weapon, and for goodness sake – how to hold a firearm so at least the bangers can stop doing that stupid sideways thing, but more importantly, so that law abiding individuals who are raised by bleeding heart liberals will have the training and education necessary to make an informed decision when they become adults and eventually, we can shoot all the bad guys and the problem is solved.

          Back a bunch of years, when I lived and raised my kids in San Bernardino, California, there was a popular initiative to put an optional firearms safety class in the public schools. At that time I was privately teaching gun safety to Boy Scouts in the area, and I fully supported the effort to use the schools to educate more kids in this critical area. As soon as the proposal was made public, the anti gun nuts came “out of the walls” and saturated the local media with the most hysterical propaganda you can imagine. Net result was that the school boards ignored the gun safety proposal – it was never even officially considered.

          Meanwhile, California has become one of the most anti-gun states in the country, along with New York and Chicago in its strident opposition to allowing law abiding citizens to be legally armed. The recent terrorist attack (that’s exactly what it was) in San Bernardino is an example of what happens when 2nd Amendment rights are denied. The only reason it got the coverage it did was that details hit the TV news before politicians could suppress the fact that it WAS a terrorist attack by Muslim extremists against a Christian group in a peaceful assembly. Of course, our pretend president jumped in right away and dubbed it “workplace violence” – not that it matters, anyone with half a brain could figure out what it really was as the details of the investigation were made public.

          Bottom line: it’s clear that government sponsored gun “buybacks” do NOT address any issue of violence in our society, but they do misdirect mega-bucks of taxpayer money. The money would be better spent providing gun safety and skills training to the public – starting with our kids in school. We all pay taxes to support public education, so let’s include mandatory basic gun safety and optional advanced shooting skills training in those schools?? It makes more sense than using millions of tax dollars to buy (mostly) junk guns from law abiding folks.

        My proposal is for everyone that is registered Democrat to let their party know that they do not support their stand on anti-gun! If the politicians really want to get tough on illegal use of firearms then make a law if a crime (person is found guilty in a court of law) is committed by the use of a firearm then a minimum of 10 years (this number can be any you like just as long as it has the word “minimum” is in front of it) without parole must be served plus any additional time for the crime committed! Use a firearm to commit a crime = 10 years of your life locked up!

      Why do people persist in this bizarre belief that cops’ lives are more valuable than the lives of citizens who go to work and actually have to produce something? You know, contribute to society? Create wealth? Support the economy?

      I am not saying cops lives are worth less than anyone’s else’s. Just because they found a job where they could be professional bullies, beat up or shoot people for a living while being completely unaccountable–while grazing at the public trough and taking money out of the economy–does not give their lives greater value and demand higher punishments.

        Are you seriously so stupid that you believe that’s why dedicated men and women become police officers? I was a cop for twenty one years. Not once was I accused of excessive force or of any other crime. Not one time EVER. I have known cops all my life. Are there some who shouldn’t be in law enforcement? Of course. And it is up to the department by whom they are employed to weed them out. The VAST majority of law enforcement professionals are decent, compassionate and honest, and have a sincere desire to make things safer for all citizens. A cop’s life is worth more than yours, Fake, because they risk theirs daily, but the officers I have known would lay down theirs to protect yours even if you are an idiot.
