U.S. House Representatives introduced over the weekend their take on the new-and-improved “assault weapons” ban, and while the text of the legislation has yet to be released, preening gun-ban proponents like Colorado congresswoman Diana DeGette have outlined the new restrictions on their official government websites.

The Assault Weapons Ban of 2019 (H.R.1296) echoes similar legislation introduced by Sen. Dianne Feinstein and others in the Senate, but unlike in the upper chamber, the House bill has a good chance of passing.

“With Democrats once again in control of the House, now is the time to enact commonsense gun safety legislation,” DeGette said. “We can’t allow what happened in Aurora, or Columbine, or Parkland, or Newtown, or Las Vegas, to ever happen again. We need to get these assault weapons off of our streets and we need to do it now.”

“I do believe, because in this Congress…there is bipartisan legislation to have common sense background checks to prevent guns going into the wrong hands. It doesn’t cover everything, but it will save many lives,” Pelosi said on CNN’s “Cuomo Prime Time.”

“This will be a priority for us going into the next Congress,” she added.

Tellingly subtitled “to ensure that the right to keep and bear arms is not unlimited,” HR 1296 names 205 specific makes and models of firearms that could no longer be legally sold, transferred, produced, or imported. Along with this list, the legislation also bans

  • Semi-automatic rifles and pistols with a military-style feature that can accept a detachable magazine;
  • Semi-automatic rifles with a fixed magazine that can hold more than 10 rounds;
  • Semi-automatic shotguns with a military-style feature;
  • Any ammunition feeding device that can hold more than 10 rounds.

A revival of the 1994 Clinton “assault weapons” ban has been a holy grail of the gun control lobby since the original ban expired in 2004. Despite the fact that the 1994 ban resulted in no discernable drop in crime or mass murders, proponents believe a more restrictive set of regulations can decrease the frequency of incidents like Parkland and Las Vegas.

DeGette, for example, claims in her press release that in the 10 years after the 1994 ban expired, mass murders increased by 183 percent. Unfortunately for DeGette and others, Politifact rates this claim “Mostly False” and points out that it’s based on “flawed analysis.”

But wait, there’s more!

House Democrats won’t be satisfied with an “assault weapons” ban, however.

Another bill, H.R. 1112, takes a page from the New York gun control playbook by removing the “default to proceed” practice for delayed federal background checks.

Under current law, a gun dealer can transfer a firearm to a buyer if the FBI has not made a background check determination after three business days. H.R. 1112 increases that waiting period to 10 days, but then would require the purchaser to file a “petition” with the FBI. A gun dealer could only transfer the firearm after waiting an additional 10 days after the petition has been filed, which would increase the waiting period from three business days to 20.

As we’ve reported, background checks are often delayed unnecessarily due to bureaucratic errors. In addition, the FBI has instituted no appeals process for delayed checks and all NICS checks expire after 30 days. In short, H.R. 1112 could unjustly suspend the Second Amendment rights of American citizens for an indefinite period of time.

Other bills would place rifle-caliber pistols and semi-automatic rifles with detachable magazines under the National Firearms Act. Both policies would require prospective buyers to undergo an extensive background check and pay a $200 tax stamp before taking ownership.

In all, anti-gun politicians in Congress have proposed 20 pieces of gun control legislation. Stay tuned as we continue to track these bills as they wend their way through the legislative process.

    I’m guessing that there nothing like good ‘ol proposed gun control legislation to spur sales through the roof.
    I’ve had more than a few gun dealers tell me that Trump has been terrible for business, while with Obama they couldn’t keep stuff on the shelves (anyone remember the .22 ammo fiasco?)

    There is no power or authority whatsoever for the government to modify, restrict, or repeal any of the people’s rights in absence of of any commission or conviction of a crime.

    No part of the “Bill of Rights” is subject to repeal.

    There is nothing in the Constitution that authorizes the government or any particular agency to armed or have exclusive use of arms.

    The only provision in the Constitution for anyone to be armed is for “the people”, and the term “Arms” refers specifically to fully functional military grade weaponry. Only the people have the right to own, possess, and use military arms unless they authorize Congress to constitute an army to fight an enemy of the United States or any one of them.

    Each year in America, firearms are used for defensive purposes between 500,000 and 3 million times. Those aren’t numbers concocted by Second Amendment advocates. That’s according to the federal government’s own Centers for Disease Control (CDC), which in 2012 commenced a review on gun violence at the direction of Barack Obama. He probably didn’t like what they found:

    “Studies that directly assessed the effect of actual defensive uses of guns (i.e., incidents in which a gun was ‘used’ by the crime victim in the sense of attacking or threatening an offender) have found consistently lower injury rates among gun-using crime victims compared with victims who used other self-protective strategies… Almost all national survey estimates indicate that defensive gun uses by victims are at least as common as offensive uses by criminals, with estimates of annual uses ranging from about 500,000 to more than 3 million per year.”

      Curious, how so many people cry about government intrusion in their lives when it’s something they disagree with; but are perfectly happy to have that same intrusion into other people’s lives for something they do believe in. You can’t have it both ways. I’d also ask you to actually read your bible regarding what God wants. I don’t believe he ever said anything about abortion being evil, and in fact, there are quite a few old testament passages where he calls for the death of/kills pregnant women, children, fetuses, etc.

    I continuously read about someone somewhere trying to enact some new gun legislation. From what I can see, this onslaught will never stop. As gun owners, that means we can never stop standing up to oppose it. “The only thing necessary for the triumph of evil is for good men to do nothing” – so what can we do? I am always confused as to the most effective method for opposing legislation of this sort. “Writing your representative” never feels effective, as you almost never get any feedback, and my representative is outnumbered in the house anyway. There needs to be a simple, effective way for the silent majority to outweigh the incessant cries of the obnoxious minority. Does anyone have ideas on what to do? We need to organize and get it done as opposed to complaining about it in blogs and comments.

      Then the next best thing is go directly to your legislator but this still does no good. People have went day after day to confront legislators and was told to set up a meeting in writing. You then sign a book right there in the office just to comeback and asked to do the same thing the next day.
      Then after over a week of doing this day after day then wait over a month to still not get a meeting.
      Then you get a group of people together to go confront them just to be told all over again by there secretaries to resign the same book again to try and get a new meeting and still after 3 months and never get a meeting period.
      Just like what happened when over 30 people tried to meet with Nancy Pelosi about how she is all for illegal immigrants and not for American Citizens.
      All these people went there with a picture of a Loved one that had came here to America illegally and had killed the loved one.
      And in 29 of the 30 people that were killed one did actual illegal did jail time 45 days in jail then sent back to there country just to sneak back into the USA and get sent back over 5 different times.
      So in reality it does no good to try to write or go directly to these non law abiding idiots.
      And who can a individual or group of people go to to have these law breaking non believers of there oath breaking and constitution breaking arrested.
      No one has the balls to listen to a law abiding citizen to arrest any of the hypocrites

      Ugh, get your facts right Thomas Jefferson. You and your buddies wrote the procedure for repealing an amendment into the constitution. It can be done if proposed by 2/3 of the house and senate or a constitutional convention where it’s ratified by 3/4 of the states.

      That’s how we got the 18th amendment (prohibition) and also how it was repealed.

      The 2nd amendment will probably never be repealed but your bs is preaching to the choir. We can’t rely on saying it’s inalienable and hoping for the best. We must be ever vigilant and continue to engage in politics. You can’t opt out of politics. You either play or you get played.

      With the advent of “pistol braces”, lots of rifle platforms can be converted to pistols and effectively employed with the pistol brace. A 7.62×39 with a 12 inch barrel makes a crappy pistol. Throw on a pistol brace, though, and it’s now an effective firearm.

      They’re very popular now and gaining in popularity . . . and rightfully so.

    The idea that the Right to Bear Arms is not unlimited may have basis and limits the arms available to civilians to the Small Arms category or Arms that can be carried by one man.

    But to limit legal small arms as the communists have proposed is a complete violation of the Second Amendment limitations placed upon the government. At minimum civilians must have the right to possess small arms of the same type and capacity as federal soldiers carry. That means full auto small arms also.

    Considering that the Second Amendment was put in effect to give the citizens of the US Republic the Arms needed to defeat and change a government no longer for, of, and by the people then all gun control laws and future legislation banning small arms are illegal. Yes illegal.

    The founders insured the people would have the arms necessary to fight a government of Tyranny and prevented said government from banning and taking the small arms of the people.

    Will the Second Amendment right to bear arms be tested in the Supreme Court or on the battlefields, in the cities, and in our neighborhoods ? My guess is it will not be decided in the Supreme Court.

        If you removed the 2nd today, it would have no effect on the Law of the Land since our rights come from a higher source than government; our humanity.
        The issue is not a 2nd. The 2nd is just a very small part of the Duty to Keep and Bear Arms. Article 1, § 8, Cls. 15 & 16 recognize the existing State statutes defining the mandatory Militia, its structure and authority. Note that Militia is the only constitutionally recognized authority “to execute the Laws of the Union”.
        The problem we face is years of misinformation, and lack of education. The supposed pro-2nd community refuses to educate themselves as to the law concerning this subject. No matter how you explain it, or parse it the pro-2nd community will insist that militia is now the National Guard, or the State is ultimately in complete control, or it is some voluntary group, or it is some fictitious unorganized group, or any other excuse so that no one will actually participate or train in accordance with “the discipline prescribed by Congress”.
        Jaque believes it will be decided on the battlefields of our cities. How will that happen if we did nothing for the last ban, or nothing is being done for the States that are falling one by one?
        Who of you are willing to go out into the streets with no training or coordination? How long do you think you will last? Are you going to step out and just start shooting?
        The answer is to start fighting the proper legal battle so that the legislatures across the country know that we really mean business, and if they fail to recognize, and revitalize the Constitutional Militia, we will do so.
