Judge OKs Healey ‘Consumer Safety’ Investigation of Glock

A Massachusetts judge green-lit Attorney General Maura Healey’s investigation of gun manufacturer Glock over “consumer safety” reasons. A Democrat, Healey is spearheading gun control policy in Massachusetts in the name of reducing violence.

Massachusetts law bars the sale of Glock pistols with a few exceptions including law enforcement sales. Healey maintains that because some Glock pistol are available in the state that the investigation should move forward.

Healey’s investigation is targeting a range of gun manufacturers. Glock and Remington filed motions to deny Healey access to their records saying the investigation was overly broad.

Healey is looking for any information tied to injuries and deaths as a result of people handling — or mishandling — firearms. While Remington has been the target of several suits due to safety concerns Glock’s record is near spotless.

One argument against Glock is that their extremely popular and widely adopted design requires the pull of a trigger for regular maintenance. If a user does not unload and make safe prior to disassembling a Glock pistol they can fire a live round.

Glock is not the only gun manufacture that makes pistols that must be unloaded before cleaning. It’s common to many handguns that share similar features, even much newer designs competing for the same markets.

It’s commonly held among gun owners that when a live round is discharged unintentionally in this way that it is the result of gun owner negligence. Healey investigation is looking for evidence that gun manufacturers are at fault for user error in some way.

Healey is demanding all documents about gun and ammunition testing, product recalls, safety designs and testing, product warranties, and advertising and marketing. Glock argued that this information was not pertinent because it included information about out-of-state sales. A judge disagreed.

Massachusetts Judge Edward Leibensperger found that Healey has “good and sufficient grounds” to obtain these documents “based on safety and other concerns about Glock pistols owned throughout the commonwealth,” writes MassLive.

“We are pleased with the court’s decision, which allows our office to go forward with our inquiry into safety concerns about firearms manufactured by Glock,” Healey said in a statement. “The gun industry is effectively exempt from federal consumer product safety oversight, resulting in an unparalleled lack of transparency and accountability around this potentially dangerous consumer product. Our office is seeking information that will allow us to determine if these guns are safe and we will evaluate it on the same standard that we would apply to other manufacturers under state law.”

Glock products are common in particular because of how safe and easy they are to use. They have seen worldwide adoption among military, police and private shooters, making the polymer-framed striker-fired pistol the de-facto standard modern handgun.

Healey’s investigation revolves around three negligent discharges. One involving a retired Los Angeles police officer, another a San Fransisco police officer and a third Massachusetts man. In Los Angeles the retired officer and ex-Marine was shot and partially paralyzed by his 3-year-old son while driving with him in the back seat. The man, Enrique Herrera Chavez, blamed Glock’s design for lacking a grip safety.

In San Francisco deputy Rhonda Gaines brought a personally-bought “Baby Glock” to work. Gaines, unfamiliar with the gun, asked a fellow deputy, Sotero Santos, for help with it. Santos took the gun, pointed it past Gaines, and shot it at a cabinet inside the local hall of justice. Santos was unaware that the gun was loaded. No one was hurt and the round went through the cabinet and got stuck in a wall.

And in Massachusetts, Kiel Helenese shot himself in the leg at a Fourth of July party earlier this year. He apparently had the gun in his pocket and alcohol is believed to be involved. He was dancing when the gun discharged.

Gun owners will see this as a circular route towards even more gun control policies in Massachusetts. Earlier this year Healey expanded the state’s “assault weapons” ban to include a wide spread of semi-automatic firearms. Now she is taking the fight to include guns that are not even available to the public.

    With a Republican House and Senate and President, perhaps they can pass a law that denies these states the right to infringe upon Citizens 2nd amendment rights. MA, CA ,NY, NJ and others need to be put in their place. Would not be too different than the law that prevented Southern states from enacting voting laws because of their history of abuseing such laws.

    They deputy should have been fired. Did not follow the gun safety rules that every gun owner has drilled into their head. Have the person show it is unloaded before yo take possession and the check that is Clear yourself.

    Alcohol and guns don’t mix. As far as your kid getting your gun in the backseat that was negligence

    And why does she have to have a big investigation on three situations none remotely similar and only one in the commonwealth. Do other states check our laws to see if they conform with theirs?

      Yes three stupid people: one retired cop who was careless, the other active duty one who should be fired for stupidity (pulling a trigger on a gun without first proving it was empty) and a civilian accidentally discharging a gun where at alcohol was involved. You canot fix stupid folks. Help is coming… Trump just got elected.

    I do believe that Attorney General Healey is only doing this right now in an act of desperation, now as Trump will be the new president and the republicans have the majority in the senate. I mean, Trump promised in front of the NRA, that he will unsign many executive orders about guns that president Obama has created. Trump promised that he will do so in the first hour that he is in office! I hope that he is really going to do it that way. He needs to keep his promises to show the people that he is good and in this way, he will hopefully stop these anti-democratic anti-Trump demonstrations that are going on right now everywhere (even my hometown Berlin, Germany has two scheduled today!).     Glock should move to have the case involving the discovery over reach question to federal court since the only Massachusetts’ connection appears to be a negligent discharge, by a person who probably didn’t have a carry permit, and where alcohol could be a factor. In my state, possession of a concealed weapon without a permit while intoxicated are criminal acts. I’m sure these acts violate Massachusetts’ law as well. I would then argue by analogy that federal law preempts the investigation because of the person’s criminal acts. Moreover, I would argue that the AG lacks jurisdiction over the other negligent discharges because they happened in another state. This investigation is pure abuse of power by the AG overreaching her authority granted by the Massachusetts’ Constitution. If an AG in a Red state launched an investigation of BLM, the New Black Panthers, etc. and requested such a broad discovery request involving other states, the Ditzycrats and its propaganda arm, also known as the liberal media, would be raising hell, and the ACLU would be filing suit for a permanent injunction.

    For whatever reason, some states are screwed up when it comes to common sense. It has been this way for a long time and will probably last much longer. The old saying, “There is no fool like an old fool.” definitely applies to the way of thinking in states such as Massachusetts, Connecticut, Delaware, Rhode Island, New York, New Jersey, California, Oregon, Washington, and a few others that have rediculous gun control laws and feel that deranged Hillary would be a better president than Trump. Maura Healey must be one of these “old fools”. She probably feels that maybe some day the “rest of us” will eventually correct our thinking and “feel good” about her and damn fool Hillary.

    While there are Laws to restrict firearms from people with severe mental health issues, there is no preventative measure for self imposed ignorance, stupidity or negligence. There is only one relevant question regarding this anti gun which hunt: Did the firearm work as advertised in the users/owners manual?

    Just as The Government can’t require a “Smart Car” to have the same level of crash protection as a M1 Tank, finding operator incompetence is not a legitimate determining factor of design flaw. We know the term “gun safety” has been hijacked by those that only want to restrict then ban all firearms.

    This effort is no different then civil suits that try to hold firearms manufacturers responsible for criminal use/act with a product they manufactured. Firearms are designed to fire a projectile that will disrupt the the impacted material.

    I know a person that used to be my friend that lives in Massachusetts. He complained about firearm policies there but continues to vote democrat. So, he is not worth having as a friend anymore.

      I feel the same way about California. I think that gun manufacturers should halt ALL sales in those States. Including law enforcement. And if all the manufacturers did this, it would put a hurt on the State government.
