LA Times: Obama Moves to Ban Social Security Recipients from Owning Guns…

The following is an excerpt from an L.A. Times article, “Obama Pushes to Extend Gun Background Checks to Social Security.

Seeking tighter controls over firearm purchases, the Obama administration is pushing to ban Social Security beneficiaries from owning guns if they lack the mental capacity to manage their own affairs, a move that could affect millions whose monthly disability payments are handled by others.

The push is intended to bring the Social Security Administration in line with laws regulating who gets reported to the National Instant Criminal Background Check System, or NICS, which is used to prevent gun sales to felons, drug addicts, immigrants in the country illegally and others.

A potentially large group within Social Security are people who, in the language of federal gun laws, are unable to manage their own affairs due to “marked subnormal intelligence, or mental illness, incompetency, condition, or disease.”

There is no simple way to identify that group, but a strategy used by the Department of Veterans Affairs since the creation of the background check system is reporting anyone who has been declared incompetent to manage pension or disability payments and assigned a fiduciary.

If Social Security, which has never participated in the background check system, uses the same standard as the VA, millions of its beneficiaries would be affected. About 4.2 million adults receive monthly benefits that are managed by “representative payees.”

The move is part of a concerted effort by the Obama administration after the 2012 Sandy Hook Elementary School shooting in Newtown, Conn., to strengthen gun control, including by plugging holes in the background check system.

We, the legal citizens, of this country need to get it together soon or our 2nd amendment and other rights will be taken for ever.     Wouldn’t a Vet who’s SS or VA Disability (i.e. emotional problems) were escrowed wouldn’t that preclude this person via the current system? As usual it’s piling on and passing a law that is already being addressed?

    I’m not sure which is less competent – the author or the article content. People not mentally competent (by a number of definitions including those above) are already prevented from purchasing firearms under existing laws. GA loves to stir the shallow pot of its base though.

    The VA fueled gun ban and confiscation is a dangerous tool. It does not differentiate between those with issues that identify potential for self harm and danger to others from someone that doesn’t sleep well at night. This same broad swath of gun restrictions is what the SSA is going to apply. It is being listed to provide data the instant background check system. The issue not disclosed is theat if you can’t buy a gun YOU CAN’T OWN OR HAVE ACCESS TO A GUN. If your taking car of Grandma in your house and she is SSA listed, you can not have guns in the house (even if you keep them in a safe). There are several States that already have programs to go to homes and confiscate guns where a member of the household is restricted or the permit holder has died. This is another reason to fight all forms of firearm registration be it Federal, State or Local. The BATFE requires FFL keep all records and if they close shop, those records must be sent to the ATF. THESE RECORDS ARE NEVER DESTROYED! If you bought one gun from a FFL in your lifetime, that will be enough of a trail for the Gov to come search for it if you become ineligible to possess firearms and they will confisate ALL firearms on the property.
    The SSA/Gov wants to make our most frail, vulnerable and treasued citizens defenseless in the face of escallating criminal activity that prey upon the elderly and weak.
    When they try to take guns from those old wrinkled skin hands they will find out how sharp their minds are. Don’t be a victim of Government crime!

    The last time I checked (as a matter of fact, just this morning, July 20, 2015), I failed to find any evidence during an extensive search of the internet, where any senior citizen(s) has ever shot up a school or movie theater with an AK-47, let alone a semi-automatic rifle or pistol. My nexus/lexis, alas, turned up not one armed attack on a school, etc., by anyone 65 years or older.

    Being an Old-Fart myself, I can attest to the fact that neither myself, nor any of the myriad of Old Farts I “hang” with, have ever thought about committing armed assaults on anyone or anyplace, although this attempted ban by the SS Administration gives me pause to reconsider my thoughts. But let me be perfectly clear, I would never, ever, shoot up anything besides a few paper targets (and maybe a few soda cans) at the range in spite of the Social Security Administration’s mindless decision.

    Anyway, since I decided long ago it’s unwise, insane and foolish (as well as possibly illegal) to undertake an armed attack on anyone or anything, I am wondering just who in the Social Security Department is going to play Psychiatrist to decide whether a Social Security Retiree has “marked subnormal intelligence, or mental illness, incompetency, condition, or disease,” and therefore, who might actually be a target of the Obama Administration’s “push?”

    Personally, if I had to point a finger at someone who had “marked subnormal intelligence, or mental illness, incompetency, condition, or disease,” it wouldn’t be any of my Old Fart friends. I would have to point to anyone irrational enough to work for the Social Security Administration and just about everyone else who works for the US government, starting particularly at the top where trickle down insanity begins.

Well, then, SSA will automatically provide assisted living with security?     So Obama is within his powers to wield the machinery of state to take the guns of Social Security BENEFICIARIES.

      As for “accept a benefit from big brother” – the two you named are earned in the first instance and paid for by that person in the second! And if Congress hadn’t “borrowed” the money THAT money earned over the decades it would be entirely solvent and THEN SOME. The fact is that like many others, I joined the military during a war (excuse me – a “police action”) and both worked hard AND risked my life – I earned that benefit – it didn’t come for free! As for Social Security, I worked hard for that and PAID FOR IT as well! I am heartily sick of being denigrated for daring to become injured and needing a treatment that was and is expensive and is now a permanent need (and thanks to three decades of delays it’s been far more expensive – AND crippling – than it should have been). Any attempt on my part to take care of myself, or to demand the benefits I qualify for has resulted in near LOSS of those benefits – or carping by healthy people who are ABLE to work. Well, I COULD work some, and I could take some of the strain off the system. I tried early on, and was punished for it. In fact I ended up homeless for a time. I tried school, and blew another disk that cut into a nerve. These “benefits” that require those who need them to remain poverty-stricken, and any attempt to find work work we can do, even a little bit, results MORE loss, and often more damage because suddenly we can’t pay rent, or utilities or some other necessary thing. Yes – in America getting injured or old is a TRAP.

We have to be responsible gun owners no one is comming for you gun if your on social security.If you cannot mange your affairs and make competent decisions on your own a gun is the least of your needs. No one is comming to take your guns of the untold millions in this country do you really think they would ever get them all.

      Yes absolutely you don’t want mentally ill individuals owning guns for sure, even though you see them out in the streets and probably in possession of some type of weapon. If they push hard they will pass more laws and regulations and all kinds of restrictions to make it harder for everyone to possess any type of weapon(s) legally I say again legally, that is were I have a problem. The law enforcement, the military, any government agency have the numbers, the best equipment, the tools, the funds and the protection of laws designed to overcome any and all national and international events that might threaten them or the country. They will throw anything at you or anyone else that stands in their way and they will massacre women and child (and call it acceptable losses). That is the reason why out forefathers sat around the table and came up with the constitution of the USA, I recommend that anyone that has not read it ion the last few years, decades, or centuries to take a look at it and try to understand the reasoning used behind every word written down in it, our constitution is the glue that has taken and kept this country held together. The minute we the people allow it to get eroded by politicians, we allow our constitution to loose it true meaning and the glue to start dissolving, there is only one thing that will come out of this, and that’s WAR and chaos, are you ready for this? if you aren’t shame on you. I ‘m ready to defend our constitution as it is and against those who oppose it with my life for the sake of our country as I and many others who gave their lives, have in the past.         I recently completed a survey from the VA-How is your treatment at the VA hospital?-hidden were questions -do you suffer from anxiety?-is your Dr. addressing these concerns and so on. In other words do you PTSD and hiding it? I’m a korean War vet, over 80 years old, on SSA. I replied-“If I were crazier than hell I would never admit it to the VA-it would be an open door to take my firearms to protect my home, my family and myself”.

    We cannot on the one hand advocate that it is the responsibility of the mental health system, the government, and/or the courts to keep firearms out of the hands of people who are mentally unstable or are incapable of making rational decisions while protecting our Second Amendment rights, then on the other protest when the mental health system, the government, and/or the courts pass laws or issue orders to keep firearms out of the hands of people who are mentally unstable or are incapable of making rational decisions while protecting our Second Amendment rights.

    Prior to this new order, people who were so emotionally unstable or mentally impaired that they must be taken care of – to the point court-appointed guardians must manage their checking accounts and be responsible for their daily living needs – could still legally acquire and own firearms. Some years ago the VA adopted a policy of not allowing unstable and impaired veterans to own firearms and incidents of suicides and violent events involving these men and women decreased dramatically. Many lives were saved. Now this policy has been expanded. NOT, as the headline implies, to all recipients of Social Security, but to people people who are so mentally impaired and emotionally unstable that they cannot take care of themselves in day-to-day living and whose support services are paid for by you and me through Social Security. What concerns me is not that firearms are being kept out of the hands of people with severe mental and emotional problems – the very people we’ve been saying, correctly, should not have guns – but that only people who are dependent on the government for services are affected. Anyone who cannot make decisions about paying their bills or living alone but whose support and medical bills are paid through Medicaid or Obamacare or private insurance can still buy and own firearms.

    This – preventing people who can’t understand what they are doing from having and potentially doing harm with guns – is one of the things we’ve been fighting for in our defense of the Second Amendment.

        I retired from three decades in the mental health industry – half of that time I was a case manager in community supports for people who needed guidance and help getting through everyday life. (For those of you who speak Medicaid, I was a QMHP, aka Q: not authorized to make diagnoses or dispense meds, but responsible for coordinating all other services from transportation to counseling to finding employment.) Most of these people had all of their rights intact. It takes months if not years of documented inability to make rational decisions, follow through on daily responsibilities (take meds, pay bills, bathe), and control self-destructive behaviors for appointing a guardian to even be considered – and nine out of ten times the courts find in favor of autonomy. Self determination is the foundation of the mental health services model. Even when they’re ruled mentally incompetent, their constitutional rights – voting, firearms ownership, etc. – are not curtailed. Faith in the government? Not a lot. But thirty years in the system taught me that anyone who is never completely sure about the difference between a real person and a voice in their head cannot – even if they mean well and really, really want to do the right thing – handle a firearm safely and responsibly.

          You mention due process, evaluation and a court judgment. These items are NOT in the new restriction. In plain language: if a person other then the recipient of the SSA benefits recieves those payments, the “beneficiary” is automatically considered mentally unfit to buy/own a firearm. SSA makes that unfit to own/buy determination outherwise there would be no need to report anything to NICS.
          THIS IS DONE BASED ON A PAY STUB. There is no Board, medical or psychological review. There is no process for appeal. Anybody want to show me the justice is in this? And don’t give me the “I it saves just one life bullshit”. There is no federal law requireing seatbelts on a school bus and kids die or get injured every day on them. Where is the outrage on that? It could be fixed with the stroke of a pen and no politicians would go against it.

      My rights as a citizen should have primacy as a function of how government operates. Knowing that this isn’t the case especially with this administration, one has to assume that the government does not have the best interests of the citizenry at heart when making a proposal against Social Security recipients that they shouldn’t or cannot own firearms regardless if they use them or not. That is a backdoor ban and if instituted in its current language will spread to every facet of money doled out by government, from grants, loans, to anything else. Want a government backed mortgage, well, guess you can’t own a firearm or prove that you don’t. Want a government grant for something? No guns. What about gun friendly states and government money tied to them. Once government institutes something, it never goes away. You only see this on the surface as a good, but what you don’t see is the nefarious worming of this language everywhere else. This is how the gun banners will do it. Not through the legislative, but through the regulatory and bureaucratic.

        Very few. That’s why this order is so limited – and will probably have limited effect. It only applies to people who cannot take care of themselves and already depend on government agencies to take care of them. That’s why things like Medicaid (which serves the vast majority of people with mental and developmental disabilities) and the ACA aren’t affected – Medicaid and Obamacare pay private, for-profit agencies to provide the services. You are right, to extend this rule to the private sector or agencies other than the VA or SSA would require a substantial change to the law – perhaps even a Constitutional Amendment.

      Hmmmm, my parents gave me legal charge of their financial affairs because they really wanted to RETIRE… travel the world, not have to worry about the monthly work of accounting and paying the bills, and in the event something unfortunate happened to them in their deserved whirlwind world tour at the end of their lives I would have the power to deal with it on behalf of them and our surviving family. They were mentally competent, very active , frugal, generous, and responsible right up to the day they died, mom at 84 and dad at 93. They paid into SSA all of their lives and now the Gov’t who has screwed us all on SS wants to add a loophole to further an unwarranted agenda on gun control that removes citizen’s lawful rights. This is ridiculous.

        This doesn’t apply to cases where mentally and emotionally competent people sign over power of attorney. It only applies to people who have mental health diagnoses so severe they have been legally declared so mentally and emotionally incompetent they cannot live independently.

          It doesn’t look like they’re contemplating a method that fully discerns that. They’re only looking for people who have been assigned a fiduciary by a court. That can be voluntary as I’ve stated or for other reasons than failing health and loss of mental capacity.

      I have purely physical damage consisting “massive nerve damage and Chronic Intractable Pain” which, had the original physical damage been correctly diagnosed and correctly treated THIRTY YEARS AGO I would NOT be “dependent on the the government! It took decades of fighting the V.A. and other agencies for benefits I qualified for, and the seven back operations were each delayed until pieces of disk and bone were actually cutting into nerves making me scream unpredictably and crippling me that much more. After the last one I had OTHER problems caused by something I was not informed of (which HAD to include anoxia and/or a reaction to the anesthesia); recovery took a year and a half and now that crippling is even worse thanks to constant and consistent delays. Maximum recovery took a year and a half, and I can’t walk more than 50 feet at once. The meds that control the pain are yet again being taken (from everyone in the country who needs them) thanks to the same lunatic fringe opiophobes in Washington State who pulled the same stunt another way several years ago. I’ve no doubt that there will be even MORE suicides as more CPPs (Chronic Pain Patients) have their pain control yanked from under them yet AGAIN. We go back and forth, back and forth from some functionality and ability to rest to almost NO ability to function and NO real rest, over and over again down the years. So we’re permanently crippled as the insurance companies and government try to save money and require all possible useless or damaging treatments and therapies be tried FIRST before the ones that actually work may be tried. Now THOSE are to be taken away yet again. I can no longer care for this old house and yard, and there is no help, so I have to leave. NONE of my limitations have anything to do with MY competence, though over and over I’m being tested for drug addiction (I have none and have never tested positive for it), attitude, which is often rather negative, and my PAID FOR and EARNED benefits and rights are under threat ! Oh yes: and my ANGER at this constant abuse is often considered to be a possible psychological pathology – as if it was without reason!

      Obama, who is a compulsive liar, and who does NOT understand either the American mentality (which has been under attack for years by chemtrails, toxic Big Pharma “medications” and other things we’re never told of by the perpetrators), or the military or Veteran attitudes) has done anything BUT help! He clearly LOATHES this country, especially veterans. I’ve assumed that the Congress and other D.C. parasites who could act in government on our behalf (after all, that’s what they’re supposedly THERE FOR) are being bribed, are under threat or both, and they are useless to perform their jobs save inadequately and for some sort of profit or other – as though their insanely lucrative pay and benefits are not enough while many of us must often stop eating in the last part of the month or suffer other privations!     If this sort of scheme is to be instituted there MUST be a mechanism in place for an affected individual to learn of their inclusion PRIOR TO the entrance of their information onto the database and a NO COST to that individual board of inquiry be available so that the affected individual is given opportunity of their Constitutional right for DUE PROCESS.
    Also, a court configured to offer hearings in a NO DELAY time frame must be available for ANYONE that has been included to such a database so that a change of circumstance or inclusion due to error is adjudicated in the SAME Instant ( or there-abouts) time frame that is used for their inclusion
    An automatic infringement against the inalienable God-given freedom as outlined in our 2nd amendment shall NOT be so simply stripped from a huge cross section of the citizenry by an edict passed down from Olympus.

    More bullshit emanating from the executive office; This ass, (the president) is now trying to scramble and claw his way around gun control by targeting smaller groups of folks… in hopes that the group itself is too small to block his efforts effectively, and gun-owners themselves may suffer a small defeat while hanging on to the ‘bigger picture’! Hitler used the same strategy. This attack on gun rights follows the edges of the mental health argument; any Veterans that basically seek counseling or are treated for any, at all borderline upon mental difficulty counseling, or servicemen that receive help or counseling would be deemed too unstable to posess a firearm.
    Bullshit! Grasping at straws… I’m sure getting fed up with this frantic, rabid freaking out over-reaction style of attacks on my second amendment rights!

Remember that Fast and Furious was to denigrate gun dealers and harm the industry. Some dealers were coerced to sell to illegal immigrants hoping this would cripple the industry. Obama and cohorts do not believe in the Constitution or Bill of Rights. They also believe only those with similar thoughts can made informed decisions. For them, government rule not by the people or for the people is acceptable.

      Technically, yes you are no longer a citizen. You’re not allowed to vote if you’re in custodial care and deemed mentally incompetent. Ask any spouse of a stroke victim who cannot speak.
