Under the auspices of the Harris-Biden Administration, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) has cooked up a scheme to directly change federal gun laws in order to foist gun control on the American people.  

The target is pistol braces and firearms that readily accept them.  ATF wants to give them the NFA treatment, subjecting current owners to a $200 tax and registration, or criminal liability for noncompliance.  

Specifically, the agency, via an arbitrary and vague point-based system, wants to “clarify when these attached accessories [braces] convert pistols into weapons covered by these heightened regulations [the NFA].”

This week, 140 lawmakers wrote a letter to the Dept. Of Justice (DOJ) voicing “deep concern” about the implications of the notice for proposed guidance on “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’”

“The proposed guidance is alarming and jeopardizes the rights of law-abiding gun owners and disabled combat veterans across the country,” wrote the members of Congress in the letter dated June 14, 2021.  

“Should this guidance go into effect, a disabled combat veteran who has chosen the best stabilizing brace for their disability is now a felon unless they turn in or destroy the firearm, destroy the brace, or pay a $200 tax,” they continued.  “Furthermore it could make millions of law-abiding citizens felons overnight.”

While this letter helps the cause, we still have to do our part as well.  To that end, the gun community has already begun to comment on the proposed rule to the tune of about 60,000 responses.  If you haven’t already, take the time to write a comment opposing this backdoor gun ban.  

Comments matter.  As GunsAmerica previously reported, good comments can help litigators fight the rule even after it’s been adopted. According to Harvard Law School, comments are crucial for future litigation: “Your comments help create the administrative record that a federal agency or decision-maker has to consider when finalizing a rule or regulation,” the law school points out.

In addition, if government agencies like the ATF fail to adequately consider public comments, a judge may invalidate the rule at a later date. In other words, if they move forward with the rule, they have to show that they’ve adequately addressed the concerns of the public. With each thoughtful, well-articulated comment advancing a new argument against the rule, that becomes more difficult.

    Trump opened the door to this type of NFA changes when he shoved the bump stock rule through. The bump stock is not a firearm yet it was declared to be covered by the NFA. If they can add bump stocks they can add any other firearm accessory and declared that it is now a part of the NFA and all NFA rules apply.

    I foresaw the ever growing interests of the legislature and government coming a mile away as I’m sure most of you have. That’s why I purchased a 10’ 300 blackout with brace 6mo back. If they choose to make this a taxable item I will expect the use of a suppressor as part of that tax credit. I wholeheartedly believe if u have no prior illegal status we as Americans should be able to posses any weapon of class we want, with the proper training and considerations of course this is what being free is all about!!!! Lol free my ass, just another attempt to criminalize the hard working class of Americans who have taken care not to break the law in anyway!!!! Jmtc. Semper fi.

    The right of the people to bare Arms is not only to protect themselves , but it is also to protect the Government from foreign and domestic incorrection by members of their own Government officials,
    who wish to over throw their own Government and Constitution of the United States. (Treason)
    The only gun law need to be enforced is Unlawful use of a firearm. I E Does the individual in question have a leangle right to bare arms (ANY firearm ) If an individual has not broken law how can they be denied any firearm as they are not a criminal.

    I applaud the congressional signatories of this letter sent to the ATF and recognizing the unconstitutionality of that “letter bureau’s” actions. But they seem to have missed two factors that obliterate any of that bureaucracy’s actions – The ATF’s action(s) of enacting binding regulation on the American people is unconstitutional. 1) per Article I, Sec. 1, only Congress is vested with “legislative Powers” (proposing law). Therefore, any/all laws drafted by and then imposed upon the American people by a governmental bureaucracy, are contrary to Article I, Sec. 1. 2) This specific ATF action is clearly an example of enacting fiat regulation that is also contrary to Article I, Sec. 9’s prohibition of the govt., or agency thereof, enacting and enforcing, ‘ex post facto Law’. In essence, criminalizing an item that “was” lawful to possess and freely utilized by millions of Americans and then punishing them for owning a previously lawful item. Furthermore,
    being that ALL gun-control IS a treasonous act of ‘warring upon a secured provision (the Second Amendment) of the U.S. Constitution’ (re: Cooper v Aaron, 358 US 1) by enacting colorable regulation that unlawfully regulates and in some instances abolishes a secured constitutional liberty through unconstitutional means (both Article I, Secs. 1 & 9), this letter nails the ATF to the wall for their unconstitutional acts, past and present, of treason.

    You should have seen this coming. How many arm braces do you see for a 9mm Glock or .357 S&W Model 19? When you “cut down” a rifle caliber firearm, (AR-15, AK-47, etc.) and call it a “pistol”, then attach a “brace ” to control accuracy and recoil, you turned that “pistol” into an SBR. That’s the issue.

      Exactly. Except for a very small number of people with genuine disabilities, NOBODY has ever bought a pistol brace to strap the stupid thing to their arm. They’ve never been anything but a shady NFA workaround and I’m amazed it has taken this long for the issue to come to a head.

    Why are you all in such an uproar over this? I due believe and correct me if I’m wrong that the ATF doesn’t have the right or power to make law…only to enforce law as it has been legislated and legally falls under their jurisdiction!!! Another words any law passed that infringes upon the legal rights and freedoms of WE the CITIZENS as guaranteed by our Constitution can’t be legal and the 2nd Amendment is very clear about that as it states… the right to bear arms SHALL NOT BE INFRINGED UPON!!!! It doesn’t say this weapon or that bullet or even a shooting stick to steady one’s aim…by regulating the sizes, shapes, caliber, color, accessories and most importantly the availability of munitions for weapons is a complete violation of the law according to the 2nd Amendment…common sense was applied then and should be applied now! Ownership of a firearm is not to be taken lightly it comes with a great responsibility and money spent on training in the handling and safe use would be better spent then disarming responsible citizens or making them criminals by enforcing useless laws and regulations!!!

    C’mon folks, this is just another attempt by this current administration to “Tighten the Screws” on us!!
    I’ll admit that the nauseating volume of videos (and magazine articles) showing pistols with braces being fired from the shoulder was certainly unnecessary!
    We ALL know that they can be fired from the shoulder: but why did we have to poke the bear with a stick by showing it time after time?
    Also, has there been some kind of spike in gun violence using pistols with braces? I can’t find anything on the internet that would support this!!
    Like all the others before me have said: “How does putting a $200.00 tax on it make it okay?”
    Didn’t the Revolutionary War start because of tyranny and unfair taxation??? Lately, we seem headed down that same path.

    Here is the relivant law concerning a illegal firearm. 5-10 years. 5 years minimum.

    POSSESSION OF A FIREARM OR AMMUNITION BY A PROHIBITED
    PERSON:
    18 USC § 922(g) & (n). Punishable by up to 10 years imprisonment. May receive
    minimum sentence of 15 years without parole if offender has three or more prior
    convictions for a felony crime of violence (e.g. burglary, robbery, assault, possession
    of offensive weapons) and/or drug trafficking felony.

    VI. KNOWINGLY POSSESS OR MANUFACTURE:
    18 USC § 922(k), (o) & (v); 26 USC § 5861. Punishable by up to 5 or 10 years
    imprisonment, depending upon specific violation.
    A. Any machine gun, fully automatic firearm or any part designed or intended exclusively for
    use in such weapon;
    B. Any firearm silencer, including any device, or part thereof, designed to silence, muffle or
    diminish the report of a firearm;
    C. Sawed-off shotgun with a barrel length of less than 18″ or overall length less than 26″;
    D. Sawed-off rifle with a barrel length of less than 16″ or overall length less than 26″;
    E. Destructive device;
    F. Semi-automatic assault weapon manufactured after October 1, 1993; OR
    G. Any firearm which lacks a serial number or contains an altered or obliterated serial
    number.

    People, you better take this seriously because ATF see’s it as a perfect way ti ustify their existence for years to come.

    Re: The ATF’s claim that a forearm brace turns a pistol into a SBR (Short barreled rifle). While this seems contradictory, and having used a (borrowed) brace that a fellow shooter was trying to sell me…
    There have been a whole RAFT of supposed “Firearm Experts” who, in both video and print have used these devices as shoulder stocks in demonstration. Some of these “Experts” haven’t even bothered using them as they are intended to be used, fastened around one’s forearm to support a “pistol” consisting of an AR-15 with the shoulder stock removed and a slightly shorter barrel installed. While I can see such “Pistols” being used with both hands for support, OR the forearm brace as a means of support, I have rarely seen this done. Instead, these “Experts” use these as shoulder stocks and laugh about it. Privately, one wonders if some of these “Experts” are taking “gifts” from ATF to help the agency in its drive to have these devices outlawed or at the least, regulated as SBR’s.
    In many ways, we’ve brought this one on ourselves…

    Why are the commenters attacking each other instead of discussing the issues the ATF brought to the public today. OK now read on, I’m a Democrat and don’t own a braced pistol but let me remind you that stock braces have been in common use since the Civil War with Colt and many others, then in the early 1900s luger’s all came with a lug built for a brace for the semi auto then the auto versions in WW 1. A lot of others from that era but this is long already. A brace or stock simply makes a pistol more accurate but NOT.. as accurate as a rifle by far, (see what I did there, far and range), anyway, the ATF is creating it’s own agenda/importance by ignoring facts, imposing the SBR taxes, pandering to the haters and ignoring public safety. Lets argue the facts folks. My citizen brothers should not be labeled felons for possession of a brace. Stats show criminal use of pistols/hand guns to kill and maim far more. Law officers have not requested braces for better handgun performance. There is no menace IMO to braces on pistols but the ATF is turning us against each other to divide and prevail. Anger won’t help but if you’re motivated to let the Congress know your reasoned logic we may make this crap go away. Pistols and rifles are as safe as automobiles. I see mental illness, racial intolerance, ignorance of facts far more deadly. ATF, you need to focus on illegal select fire (read automatic) firearms and back off of the gun sports gear. The Calif assault gun ban is useless because it focuses on black rifles not facts. Lets all paint our rifles green or maybe hire firearm educated law makers from CMP to increase public safety.

    This is all political. The length of a gun should not matter a bit to lawmakers. The idea that you can pay a tax to allow this is outrageous as well.
    If you are going to allow something because you taxed it, it should not have been made illegal. We all understand it isn’t a gun that kills, but the bullet, and the person who put that bullet in motion. The overall length of the gun does not really matter.
    We have handguns and we have long guns, and they often shoot the same bullet. How does gun size matter? We have to assume only the handgun is concealable, and that is a concern, but making it easier to use should not be a bad thing.
    What in the world does a brace have to do with anything? If you need it, you need it, and I would assume that it is only there to steady the gun so it can be used by physically challenged people, with no effect on anything else.

Originally it was a simple bribe, offered to the right people, that gained one permission to bend the law in one’s favor.
      Nowadays, since Bribes are Illegal, the word Tax or Tax Stamp is used. It’s the same thing really, just updated and modernized.

    Where in the constitution does it give the ATF any powers at all to change laws? Fact is the only way to change the second amendment is with a Constitutional convention! Even the supreme court does not have that power! Neither does the president! Just say no! And if they push push back! As this is just another brainwashed Democratic liberal trick to fool the people into disarming! As the Constitution is the supreme law not the Brainwashed Democrat! Lets just get rid of them instead!       I am sorry your high school civics class was so deficient. Truly, I am. Please allow me to help you understand.

      Under the US Constitution, Congress can delegate certain tasks to agencies. The Supreme Court has recognized the legitimacy of federal administrative agencies to make rules that have the same binding effect as statutes by Congress. [Wayman v. Southard, 23 U.S. (10 Wheat.) 1, 41 (1825)] Modern doctrine was established in the 1920s in the case, J. W. HAMPTON, Jr., & CO. v. UNITED STATES, 276 U.S. 394. Collectively, this is referred to as the Delegation Doctrine.

      The Delegation Doctrine applies to all three branches of Government. THere are three different operations that are delegated to agencies: rule-making, enforcement, and adjudication. The Administrative Procedure Act was passed right after WWII and provides rules and regulations that must be followed by the agencies when they are carrying out these three duties. It is very specific about how these duties can be carried out and the scope of Congressional delegation. Essentially, though, delegation by Congress is for the purpose of filling in the details, which, by court decree, must stay within the bounds of the provisioning Congressional legislation.

      So, to sum it up, agency regulation is constitutional as long as it is within the rules.

      I don’t like it. I feel that it is the single most egregious mechanism for expanding government, and expanding government always leads to oppression. Next time we write a constitution, we need to insist that Congress write all the laws and each law should be limited to 500 words or less, including article adjectives. Not even counting agency regulations, we have far, far too many laws. It is estimated that the average adult commits around 4 federal felonies a day because of the number of laws and regulations we have. That is insane.

    Only Congress makes laws. ATF is tasked with enforcing the laws that have gone through Congress, Senate, and then POTUS. ATF and other agencies don’t get to make law, they only get to enforce properly enacted laws.

Is there a big problem with braced pistols being the weapon of choice with mass shooters? No. This is the ATF getting creative and redefining terms, and by that, changing the law. This shouldn’t be allowed. If it was ok, it’s still ok. Period.

      It is intellectually dishonest to deny the morass that is the web of laws and regulations that surround the ownership and use of firearms. The regulations themselves are so arbitrary and capricious that this kind of “work around’ should be expected.

      The pistol brace is something that shouldn’t have been needed for folks to embrace the progression of firearms technology. Unfortunately, as laws become outdated by advances in technology as well as by advancing training methodologies these laws just pile up on each other.

      For example: What kind of moron shoots a pistol one handed? I can’t think of one trainer that would teach or encourage shooters to do this if they have two functional hands. Yet this is a major portion of what divides pistols and rifles from a legal standpoint.

      The red tape surrounding SBR’s is something that anyone should realize is repetitive and stupid. Paying a tax stamp and waiting a year to complete a background check that is functionally identical to every other NICS check that a firearms owner goes through…what practical and honorable purpose does that serve?

      Hunting – I live in an area where it is uncommon to take a shot at a deer that is over 100 yards. The ground cover is some of the most dense in North America.
      Why in the world would I need a boat anchor of a rifle with a long barrel?

      Self Defense – If I have cause to be forced to shoot someone why in the world would I desire to do so with a long barreled rifle? It’s not like I’m going to snipe a trespasser from across a field? No, it’ll be when they are close to accessing my home and endangering my family. An SBR is PERFECT for that use.

      Now don’t get wrong. I HATE 5.56 rifles that are 7.5″ flame and noise thrower range toys! They are annoying as hell. But 300blk/.450/6.8/6.5… or even 5.56 with a shorter barrel is simply one of the best tools for a lot of practical applications. Add in a small suppressor and you have an even more optimized tool for some situations.

      Also, I’m an older, semi-retired guy going to school to be a state qualified elementary school teacher. I may only ever teach my (and maybe some neighborhood) kids as I’m politically and morally inconvenient for the public school system.

    Ultimately we will be crushed by the weight of federal agencies, empowered by an administration that fears its citizens, to create laws and supersede the Bill of Rights via regulations, with such regulations having the full force of administrative law behind them. Administrative law, of course, being used to grind down anyone who dare oppose a government agency.

    So why does an AR pattern rifle have to government consent to be that short..?

    AR pattern rifles need a buffer tube buffer spring and a buffer to function, so if the rifle muzzle to end of buffer tube is 26” or more it shouldn’t matter. But yet it does matter.

    I think our founding farthest we’re quite clear that the 2nd amendment “SHALL NOT BE INFRINGED” , but who am I…?

    Does the OPINION of the ATF make law abiding citizens felons overnight? Really? And what law (statute or code) would someone be charged with? If owning or using one of these things is breaking the LAW, what law was broken? Please provide the code. Asking for a friend.

    Take the time to make well considered, rational comments on the Federal Register website in opposition to this proposal. Profane or rude comments are automatically excluded. If they (ATF) proceed in spite of overwhelming public opposition, that lays the groundwork for a judicial overturn. Also… Ammo-Up!

    I truly wonder if people who claim to be pro-2nd know anything at all about the subject. I recognize that the general world population subscribes to the notion that governments have control over the individual. It is as if monarchy’s never went away.
    The U.S. is a constitutional federal Republic, not a democracy; Article IV, Section 4. All power was supposed to rest in the hands of the people.
    Why do you suppose the Founders ratified the Constitution with Article I, Section 8, Clause 15?
    Why do you suppose that the Virginia delegation insisted on a Bill of Rights that highlights the functions of law in the original Constitution?
    Every time I read one of these articles I have to ask if any of these people have taken one minute to read and understand what the Founders institutionalized.

    Upon the repeal of Prohibition in 1933, the Department of Alcohol & Tobacco became unnecessary. So the shltbags i n Washington decided to stick their noses into the gun business, announcing the new name of “Alcohol, Tobacco ( non-applicable by then) and Firearms,” staffing it with the same thugs who weren’t above shooting moonshiners in their unquestioned ( by them ) line of duty previously. Different times, but still thugs. Years ago, it was considered to combine the ATF with the FBI… FBI agents threatened to quit en masse if this were to happen, knowing the low caliber of ATF agents and not wanting to be associated with them, according to a neighbor of mine, an FBI regional director.

    This is my comment to the proposed new rules: I strongly OPPOSE all these new rules, as well as the old ones. The 2nd Amendment plainly states our rights to keep and bear arms shall not be infringed, so I do not have to be Alan Dershowitz to determine that every single rule and law that regulates citizen gun rights is abhorrent to the Constitution and a violation of the public trust. I do not even own these braces, because I knew you people would pull this out of your rectums sooner or later and foist it upon the millions of trusting fools who believed the letter originally sent to that brace manufacturer. I have been around guns for 60 years now, and I have no illusions that more gun laws mean more safety. They do not. Such regulation only reduces the tenuous remaining freedom and self-determination of US citizens, and increases the power of despicable, cheesy little self-important despots like David Chipman, Pelosi, and Schumer. For all the good it’ll do, I vote NO, or NYET. Charles Schisler.

    Don’t own a ” BRACE “, never wanted one, don’t see the need or use for it… BUT As a Chief Range Safety Officer, I know they are ” HARMLESS ” !!! Not to damned FUNCTIONAL, but none the less, HARMLESS !

    It doesn’t change the PISTOL, SBR or anything else you’d like to call this firearm, doesn’t MAKE it FISH nor FOWL . It fires the same, functions the same, and doesn’t make it automatic, or more concealable… What’s the Big Forkin’ Deal ???

    Just another confused useless ” LAW “, not passed by Congress ( so it’s NOT a law ), that affects the 2nd Amendment !!!

    not to long ago the same useless BUREACRACY determined even shouldering the brace didnt make it an SBR . . So clearly any judge who hasn’t been corrupted and read the constitution and the ATF’s own conclusion from a couple of years ago would have to question the ATF’s hard 180 on this . . . .damn

    We have become too comfortable in our day to day lives in fact so comfortable that we are willing to relinquish some of our freedoms and God given rights to remain comfortable. If we don’t find a way to organize and unite our children and grandchildren won’t have any freedom because their parents and grandparents were mostly concerned about their own comfort.

    Million(s) of braces are sold PER YEAR and every major weapon manufacturer sells AR Pistols with braces installed at the factory. A simple internet search would have shown you this. Instead,, you are willfully ignorant, deceitful, and clearly unqualified to speak on behalf of “the shooting public” or “the people”. Perhaps a few moments of your time to perform your due diligence to be better informed regarding pistol braces prior to commenting would have kept you from being perceived as a stubborn, gun hating, un-American, leftist? However, I highly doubt that given your chosen name includes “(he/him)”. Speak for yourself next time and at least try to obtain some semblance of familiarity with the subject matter beforehand, please.

      Blue Dog would like to make everyone think he/him/it was a former FFL Dealer however that is not what he states. He specifically says he is a former gun seller. Hell I am a former gun seller and I am sure at some point I will be a future gun seller. Blue Dog probably acquired a gun sometime in the past then got scared that it might jump up by itself and shoot someone so he sold it. Thus making him a gun seller. Just like everything else he/him/it says it is pure BS.

    I agree with Blue Dog. I just have to add that the vagueness of the proposition is frightening. I think they’re strictly referring to pistols outfitted with these, but the excerpt from the prop nowhere mentions this. How do I know this isn’t some shady grey area of a law that bans ALL braces and the like? Last and final statement; Why? Lol are pistols being braced on a shoulder so often that it’s more of an issue than anything else, or is this the ATF chipping away at our civil rights?

    The manufacturers have sold 3,000,000 or so of these braces. ATF has twice flip-flopped on this very issue, and many of us who didn’t buy them initially, did so after the last flip-flop. They keep moving the goal posts. What exactly is the problem with them being shouldered, anyway? it’s already illegal to commit murders, robberies, carjackings, rapes etc with ANY firearm, regardless of barrel length, regardless of brace/stock. Are they really foolish enough to believe that anyone is going to register or pay any taxes on their pistols? Do they not realize that at least some people are going to actively resist arrest for a non-crime like this. Do they not realize that cop killers are heroes in prison?

      I sir am one of those who will actively resist any attempt at violating our rights. 24 years in the military and one big oath later I am compelled to resist. They are more Than welcome to come get them. But I can assure you they will meet a very well trained and equipt vet when they do.

    The headline of this article claims that a change in the legal status would affect millions of firearm owners across the country. Millions. Is it likely that there really are a million Americans that own handguns with pistol braces – AR, AK or otherwise? As a former gun seller myself, I find this claim unlikely.

    It is not the government that is deciding these are effectively SBRs. It is the shooting public, individuals who think they are cute, getting away with something by shouldering the pistols outfitted with these braces. Truly, this is a small-d democratic determination and the Justice Department is only changing the rules to reflect the common belief of the people.

      To the Blue Dog comment – public really should not stick their nose into what is in my gun cabinet and why it is with brace or not. Public should care on their kids mental health, spend time with them and talk. Craze people could kill with anything, braced or not. Our guns should be something nobody could touch, especially ATF whIch is not rule making type of organization. ATF should not be under control of liberal politicians. And no, braced pistols is something that is very popular last couple of years and there is many of them on hands. Starting with brace they will go to your M1 or lever next, nothing should be touched!

      The common belief of the people is the us constitution. Rights given to us by our creator not government. If you don’t have a problem with unelected people just changing an already unconstitutional law then move back to England where a monarchy can decide what they feel is right. Yes it is the government deciding these are sbr’s by changing what a brace is. Just because you use a product for something other than what it is designed for doesn’t change it to something else. It’s funny how they don’t do this same thinking with knives or rocks. The gun control acc needs be repealed and these people run out of town. The federal government is a monarchy. Do as we say not as we do. We are doing a full circle back to the King and queens who once ruled over us. They just have different titles.

      Don’t be dumb, in 2012, the ATF approved these pistol braces, then, in 2014, they wrote a letter saying that they can be shouldered and by doing so, it doesn’t make the pistol a rifle. Yet here you are claiming that they are changing the law by saying it’s now an SBR, because people are shouldering them. If you actually sold guns, you’d know this. And no, it’s estimated that between 3 million (likely too low) and 40 million (likely too high) have pistols with these braces. First you say it’s not the government doing this, then, you say it’s the Justice Department that’s changing the rules, is the Justice Department not part of the government?
