California Mayor Proposes End to Private Sales of Guns and Ammo

San Jose Mayor Sam Liccardo wants to stop assaults and robberies committed with firearms at the local level.  To achieve his goal, Liccardo has proposed what he calls a “modernized gun safety ordinance.”

In a press release, the Mayor announced that the proposed ordinance would:

  • Require vendors to include video and audio recordings of all gun transactions, training for gun sales staff, and other unspecified measures to combat “straw purchases” (where a person purchases a firearm for someone who cannot legally purchase or own one).
  • Prohibit the private sale of any firearms or ammunition within or from a residence in the City.
  • Require a license for the sale, transfer, or advertisement of all concealable firearms and ammunition within the City.
  • Require the display of information at all points of sale about local gun laws, suicide warnings, and Santa Clara County-approved resources for suicide prevention and domestic violence.

In the event that the State Legislature fails to address the issue, Liccardo also called for the ordinance to apply to anyone who provides or downloads data required for the production of a 3D-printed firearm or its components.

“While our current occupant of the White House tweets about emergency declarations, a real crisis persists in the 39,377 Americans who died from gun violence in 2017.  The federal government — cowering in the presence of NRA lobbyists — has abdicated its role to safeguard Americans by implementing reasonable firearm regulations.  In the absence of federal leadership, cities and states will continue to step up to do more to keep our residents safe,” said Mayor Liccardo.

“By confronting ‘straw purchases’ of guns for felons and other people who should not possess guns, these reforms can prevent guns from getting in the wrong hands, and offer a model for other U.S. cities and states to follow,” he added.

Liccardo expects opposition to his proposal.

“We believe we have been very careful crafting this proposal to ensure that this complies fully with the Second Amendment,” Liccardo stated at a press conference.  “Where there are guns there are lawyers.  I am sure there will be lawsuits.”

Gun-rights advocates, like the Sacramento-based Firearms Policy Coalition, criticized the proposal calling it “unconstitutional, burdensome and irrational.”  The organization wrote in a statement that it would gladly fulfill the mayor’s expectations of legal action.

“If the city ignores the Constitution and proceeds to pass this awful proposal, we will be delighted to force the city to pay our attorneys hundreds of thousands of dollars in legal fees and costs after we beat them in court,” the organization wrote.

The Mayor’s proposal must first go through the Rules Committee of the City Council and then to the entire City Council for approval.  The entire process is expected to take six months.

    Common sense is not common sense in California.It has shown time and again it is a power grab from the citizens.Now just for giggles if you are serious then put forward a ban on the possession of all firearms by all the citizens including police and military within the city then were all equal ,make tasers the only defensive weapon allowed.Bet it wont happen.

    Remember California Senator Leland Yee, wrote lots of gun control laws then started selling guns after he got the prices up. FBI caught him, then he was allowed to be free until his trial, good message to the public that a crooked politician has different rights. Then he asked for a reduced sentence due to health?

    Guess he forgot criminals don’t follow the law. He should be forcing prosecutors to enforce gun crime laws currently on the books.

    BTW Approximately 30,000 of those gun deaths are suicides.

    The purpose of this law, as was the tax passed in Seattle, is to force out all the gun shops in town, first by banning all table top FFLs, and second by making it hideously expensive for regular gun stores to stay in business by imposing the videotaping (and storage) requirements. It is as simple as that. The rest of the crap being proposed is window dressing as it covers stuff that is already covered by state law.

    Gun store employees have the right to Deny a purchase if they suspect an illegal purchase.These stinking Progressive-Socialists are hiding behind the smokescreen of \”reducing gun violence\”

    California all ready prohibits person to person private party sales of firearms, we must use an FFL. We are also limited on private ammo sales being limited to only selling 50 rds to any person at a time, this includes giving ammo away, only 50 rds or less.

    I left CA in 1972 for good and have not been back. If I never return it will be too soon. CA used to be a bastion of conservatism, but that is naught but a distant memory. Any right thinking individual needs to get out ASAP.

      You are so wrong in your thinking, true conservatives do not run away and hide, they stay and fight the good fight. Encouraging people to leave California is the same as waving the white flag of surrender. Whatever California and New York get away with in gun bans, will eventually follow you, don’t run away, stand and fight and educate those around you. A few years ago I and my friend were at a retreat where between 30 and 50 college students were attending a different retreat. Their is a shotgun range there, my friend and I turned our range time into a shotgun clinic for the college students who went through better than 1000 round of 12 gage ammo with many learning how and wanting to become gun owners. So either become part of the solution or shut the hell up because you are supporting the problem by giving in.

    Bunch of idiots. The city’s residents will just go to some other town to buy ammo or firearms. The issues that they want to ‘prevent’, straw purchases, felons in possession, etc are already against the law.

    As for a ‘concealable ammo’, really? That covers anything that’s ‘man portable’ small arms. I think that stops at about the 40mm Bofors as far as size goes.

    They can ‘prohibit’ all they want, criminals will still be criminals and disregard their proposed laws. It is already required that all firearms sales in CA throughout the state go through a 01FFL.

    Naming private sales of firearms? Huh? What’s the point? They’re ALREADY practically banned in that ALL private transfers must be mediated by an FFL01 and a DROS (Dealer Record of Sale) filed with a background check and 10-day waiting period.
    There is no “gun show loophole” in California.
