Democrats Propose Nationwide 10+ Round Magazine Ban

Democrats in the U.S. Congress have re-introduced legislation that would ban Americans from importing, selling, manufacturing, transferring, or possessing all magazines capable of holding more than 10 rounds of ammunition.

The “Keep Americans Safe Act” would allow those who already own standard capacity magazines to keep them, and it would not apply to tubular, .22-caliber magazines.

But it would ban the transfer of outlawed magazines and, over time, eliminate most standard-capacity mags for mid-and-full-sized semi-automatic handguns as well as the most popular mags for semi-automatic rifles.

The bill’s lead sponsors, Rep. Ted Deutch of Florida and Sen. Bob Menendez of New Jersey, held a press conference on Tuesday announcing the legislation. The anti-gun lobby and their supporters in the media were, as usual, firing strange and misleading comments vis a vis fully semi-automatic.

“Guns become doubly and triply deadly in these massacres because of these high-capacity magazines,” said Sen. Richard Blumenthal, another of the bill’s sponsors. “And so if we take one simple step in approving this prohibition, we can literally save lives. There is no more simple, straightforward way to save lives from gun violence than to ban these high-capacity magazines.”

“The fact is that these high-capacity magazines allow someone to fire off more than 10 rounds in a row,” Rep. Ted Deutch added, helpfully. “You don’t need that if you’re a hunter, you don’t need that for any purpose. You don’t need that for sporting purposes.”

Manny Oliver, who tragically lost his son in the Parkland massacre, couldn’t provide much clarification.

“Have you realized how simple this is to approve? We’re just reducing the amount of ammunition on a gun that you can still carry with less ammunition inside. Is that so hard to understand?” he said.

“We’re not asking, we’re not begging,” Oliver said. “We demand.”

The legislation has yet to receive support from a single Republican lawmaker in the House or Senate. The National Rifle Association also voiced their opposition to the bill.

“This legislation would effectively ban the most commonly owned firearms for self-defense,” said NRA spokeswoman Jennifer Baker. “It is an arbitrary limit pulled out of thin air with no evidence that the limits would improve public safety. In fact the after report from the deadliest school shooting in American history states that magazine limits would have had no impact. This is just more nonsense from anti-gun zealots who are looking to score political points by proposing legislation that would make criminals out of law-abiding citizens exercising their constitutional right to self-defense while doing nothing to deter criminals from committing crimes.”

While the legislation is unlikely to be considered in the Senate, it has secured endorsements from at least five Democratic presidential candidates, including Amy Klobuchar of Minnesota, Cory Booker of New Jersey, Elizabeth Warren of Massachusetts, Kamala Harris of California and Kirsten Gillibrand of New York.

    The Dems must explain how their proposal does not “INFRINGE” (defined in dictionary as restrict or limit) on our rights to keep and bear arms. Obviously they can’t justify as their action clearly restricts and limits; therefore, their proposal is NOT Constitutional. WE, the People, must remember, WE are in charge via the Constitution; not lawmakers.

    There is no practical,logical purpose for 30 rd mags except for range fun while standing or kneeling.. a little awkward when shooting from bench..there’s not much practical purpose for silencers either ..most us us have been using ear protection for decades…works just fine…anyway what you gonna do ..make everyone that comes to the range have a silencer.?because it’s only gonna matter if EVERYONE has one…just like bump stocks..no real practical or logical reason to have one except what ? To get goofy at the range? Or just because you can?Beacuse in all honesty those provisions technically there not provisions granted under our constitution that you knuckleheads say you trust and love..the 2nd amendment provides the right to bear arms….no details after that chumps..so if gun nuts are in the minority..well boys..suck it up that’s the way a democracy works…Bump stockers,high capacity maggers and silencers are outnumbered and in the minority in the USA..that’s the reality of the situation…most mass shooters legally purchased these so yes this law would have made a difference 40 years ago,just like assaualt weapon ban of 94…..we didn’t have as many mass shootings until bush rescinded the law in 04..the majority of huge mass shootings have happened since then by usually mid aged white males that were technically legal..but only because of a flawed system and laws..or should I also say non laws.. that could have made a difference overall..but no one wants to admit the truth…so instead it’s been an arms race..now we all get to look over our shoulder for the next nut job to smoke someone..thanks everyone for your logic and expertise..lol

      What part of “shall not be infringed.” is so hard to understand? Those are the last 4 words of the second amendment.

      Why 30 rounds? If police hit rates are as low as 17%, how accurate will the average person defending their home, family and/or property be? I want all of the capacity I can get to insure I will be able to do that.

      Silencer? You’ve been watching too many Don Corleon movies and, I’d guess, never been out really shooting. A suppressor goes a long way in preventing hearing issues for many shooters. What is your beef with them?

      Selection bias is one of the most difficult things for researchers to fight. People tend to see information they agree with and ignore information they disagree with.

        WE, the People, do NOT have to justify why we “need” something. But, the Government MUST prove that whatever law they pass does not violate the Constitution; which btw, retains all rights to the people unless we specifically abrogate those to the Government. It is NOT the other way around.

      Hoplophobia runs rampant in your post. No evidence that the gun ban of 1994 had any positive effects on mass shootings or any other type of shootings for that matter. President Bush did not rescind the law in 2004 (you might wish to do some studying – the President is not allowed to write or rescind laws, that is up to Congress). The law, when signed, had a ten year limit on it and simply ran out. In truth most of the mass shootings have been by teenagers or young adults – most of them either taking or just coming off of prescribed psychotropic medications.

      With tens of millions of magazines out there in private hands (possibly over a hundred million) that hold eleven and more rounds of ammunition I do not see how they can possibly ban standard capacity magazines especially now with three dimensional printers that can just print and make more. (They also have 80% AR-15 lower receivers that people can make private guns out of.) They might make them illegal federally but there will be no way to enforce it short of a full scale war on the American people.

      If anyone thinks they will stop at banning just the semi automatic rifles over ten rounds they are fooling themselves. California is in the process of trying to ban all privately owned semi automatic rifles.

No add on to that the wolves that all you fuckers in New York and California just had to have brought back into an ecosystem that they were eliminated from for a reason I might add. And they are running around in packs of 30 plus and then you want to tell me I should be happy to have 10 shells or less to defend my family against this. I guess it’s easy for somebody who lives behind closed and locked doors in a city to bitch about this kind of stuff that doesn’t affect them at all. Well done. I really appreciate the tax dollars I donate to the government so they can turn around and use it against me.       yes there were mass shootings before the “Assault Weapon” ban expired and why dont you look and see how few times a rifle has been used compared to a handgun in these shootings. What has changed about these shootings is the 24hour news cycle where the killer becomes infamous and the next one sees it as a new high score to try for. seems like the media has blood on its hands. Another factor is almost every shooter has been pumped with SSRI drugs that have serious side effects. the last factor is the shootings always occur in a gun free zone AKA defenseless target zone. last point is most of the mass shootings with rifles were not done by white men its almost a 50/50 split and parkland shooter only used 10round mags. so basically you have nothing but antigun talking points in your post that dont stand up to facts.

    This is a great idea!!!! All the criminals that use guns to kill people will only be limited to 10 round mags, so that when they go to reload, so brave soul can tackle them and save the day. Wait a minute……….. criminals probably don’t care about a law that would ban +10 round mags. I’m not the fastest at a tactical reload, then again, I’m not the slowest either. If I was engaging a bad guy at 10 paces, and had to do a tactical reload, I doubt very seriously, unless that person is the Flash or Superman, that they could cover those 10 paces before I finished my tactical reload. This law only hurts law abiding citizens. Criminals will still keep their 30 round mags and laugh at everybody with their sucky 10 round mags. Hopefully these criminals will be ones that don’t do range shooting on a regular. Practice with a 10 round mag trumps spray and pray with a 30 round mag every time. I wonder if the armed security for these politicians will be limited to 10 round mags. What about the armed security at their kid’s school, even though many yell, “No guns in schools” ? I’m out.

    If a person is willing to shoot a bunch of unarmed kids in a school what makes these legislators think that shooter will pay any attention to their 10 round magazine law? The only effect will be on innocent, law-abiding citizens. Once again they will be expected to pay the price to allow the do-gooders to feel like they did something.

    Would this also apply to their personal bodyguards, or is that still “different” because it would actually effect them? San Francisco actually had a Councilman suggest DISARMING the Police for “public safety”. It didn’t go over well, especially with the Police Union, I’m sure. They probably told him good luck finding anyone to be a Police Officer in SF if that happened. Not to sound racist, but why is it when a White career criminal is shot and killed, the White community says “Good Riddance” and when the Black career criminal gets shot, it’s a protest against the Police and Black Lives Matter (Do you notice Black Lives Matter ONLY when a White cop shoots a Black criminal? They kill each other thousands of times a year across the U.S., but that’s OK?) block freeways? In Sonora, CA, a White woman apologized after her son was killed in a running shootout, after he had “caused all this trouble” and wounded an innocent woman bystander. A little different response than we see on the news, right?

    S-1945 (115th Congress) at least doesn’t violate Ex Post Facto constitutional prohibitions, i.e.
    “(2) Paragraph (1) shall not apply to the possession of any large capacity ammunition feeding device otherwise lawfully possessed on or before the date of enactment of the Keep Americans Safe Act.
    The text of S-447 “A bill to regulate large capacity ammunition feeding devices.” (116th Congress) has not been submitted to date.
    Insanity is repeatedly doing the same thing and expecting a different result.

    Do they not realize it takes 3 seconds to eject a ten round mag and load another 10 round mag? How is this going to make a real impact on school shootings?

    Nobody on the right wants school shootings to happen. But school violence won’t change because of another law.

    California tried to limit magazine capacity to 10 rounds and a Federal Judge declared it was found to be Unconstitutional. And another Federal Judge found NY”s Safe Act seven round capacity law to be Unconstitutional. And implied by law that they allow ten rounds in a ten round magazine. So what would make it nationally Constitutional now ?

      Colorado already passed the magazine limit law years ago and it is still in effect there. That’s why magpul moves their factories to Wyoming. So don’t take anything for granted that it won’t pass. They are legalizing marijuana so what does that have to say for the people in charge of some of the powers around this country

    So if I have mags over 10 for a Ruger Precision Rimfire (bolt) they want to outlaw those. If I have mags over 10 rounds for my large caliber bolt guns they want to outlaw them. I am a law-abiding citizen – so they want to INFRINGE on my constitutional rights.

      Totally agreed. To be fair, most LEOs don’t support magazine limits but there are some.
      Even if LEOs were not exempt, one problem becomes, who watches the watchmen? If Joe Citizen sees an officer with a post-ban magazine, does he then need to enact a citizen’s arrest of the officer? How is that going to work out?

    A pro rights folks need to stop using the term “high capacity” when referring to magazines greater than 10 rounds. A standard capacity magazine is a magazine that holds the number of rounds that the firearm was designed to hold. A pistol that is designed to accept a magazine that holds 15 rounds, even though 10 round magazines may be available for it, has a standard 15-round capacity magazine, not a high capacity magazine. A 10-round magazine in such a firearm is a “reduced capacity” or “low capacity” magazine.

    Just read in the paper(The Dallas Morning News 02-14-2019) that 40,000 people have been killed in auto accidents. On the same page of the newspaper it reported 40,000 people were killed by guns. I would like to suggest that the government pass a law that make auto makers produce cars that can only go 25 miles per hour in order to reduce deaths by autos.

However, they would also be appalled at the standing army and civil police forces the Republicans have amassed. Look at Venezuela, that fool would be in a spider hole but for his cops and soldiers.
    The founders wanted weapons parity with whatever forces were likely to threaten freedom of the sovereign, the US citizen.     Really? Fully Semi-Automatic? And this from a General Officer in the US Army! The AR-15 is NOT the same as the M-4 or M-16 or any other actual military rifle. The AR-15 is NOT capable of fully automatic fire. The limit on the number of rounds in a magazine is also stupid. All a bad guy has to do is carry extra magazines and they will if they even obey this law which they won’t. I and most other trained shooters can swap out a magazine very quickly without hardly skipping a beat BUT, that swapping of mags with follow Murphy’s Law and be at that exact moment when you need that 11th or 12th round to save yourself or someone else. Understand that criminals DO NOT OBEY THE LAWS, that is why they call them criminals. You are harming only the good guys with this stupid law and if passed you will end up having more criminals as some good people will end up with a felony record after being caught with a high capacity magazine.

    Mass shootings are extremely rare but drive bys, shooting during a robbery are still pretty common. Very few crimes are committed with legally owned firearms and the people using illegally owned firearms while committing a crime are seldom punished for having and illegal firearm. That needs to change.

      I think your example of wild boar infestation is an excellent one. Another situation might be if/when coyotes become overpopulated as they do in some areas (and may be rabid — as the wild boar can also be).

      I think the anti-“full semi auto” gun lobby is very much against the 20 or 30 round magazines and larger, mostly because, in the USA, we have not had large-scale enemy invasions and most of us have not had to deal with firefights against armed enemy. However, we now have large-scale invasions of people who really have no great love for our country, or seek to overthrow it, and these people are being released “into the wild.”

      Some of these people will certainly acquire weapons and some of them may use these weapons. The weapons they acquire may be from the “black market’ and certainly some of the weapons will be 20 round, 30 round, and higher capacity. So, even though we may not have had the need for these weapons very often in the past, we are heading into a time period when these weapons will be more necessary rather than less, and possibly for more difficult adversaries than wild boar, coyotes, etc., and breeding almost as fast.

    Below is a comment I sent to my Congressman the last time they proposed Gun Legislation. I feel the same about magazines. Any attempts to pass legislation concerning gun control, or limitations on how many rounds magazines for my weapons can hold fall into the same category far as I’m concerned:

    To all my elected Officials. I oppose any sort of gun legislation, and so does everyone that I know here in Ohio. We are all law abiding citizens, hard workers, property owners and are not on any sort of Government assistance. All of us own guns, hunt, fish and take off our hats when the flag is raised. We will NEVER shoot anyone, anywhere, under any circumstances who does NOT need to be shot.

    You can also rest assured that if our Country is ever invaded, that we will fight to the death to defend it. If you take away our guns, we’ll have to throw rocks and spears instead, so it will be much harder for us, but we will still fight to defend our Country our last breath.

    Taking guns away from hard working property owning American citizen’s just leaves us open to attack from all the “bottom feeders” in our society.

    On a personal note. When the day comes where the Government sends folks to take away my guns, you can have them, BUT, they will have to pry them from my cold-dead fingertips!

    Article 1

    Being that this is a REPUBLIC and not a Democracy, ANY Democrat who count themselves against ANY constitutional amendment, or any right that is guaranteed by the Constitution of the United States of America, shall forfeit the right to vote.

    Article 2

    Self proclaimed socialists must pay half of their wages to the federal government in order to pay off the debt aquired by the Democratic party when they ran the country.

    Article 3

    Any legislation toward firearms, or the accessories of firearms (Including articles within the NFA)I shall be voted on by gun owners alone. If one does not exercise their right to bear arms, they shall be excluded from the vote.

    Article 4

    Any reserve, or state armed force that is called into federal service by the POTUS, shall remain in federal service until they are released by the commander-in-cheif of the armed forces.
    Individual personnel are still bound by the terms of their individual contract.

    Article 4

    Any individual, local, state, or federal government official or party, found to be using any position awarded to them to move against the nation, or the people of the United States of America without due process shall be charged with treason.

    Article 5
