New California Law Imposes Court Process for Confiscating Guns

Long a pioneer in gun confiscation, California lawmakers have developed a brand-new way of ensuring “dangerous” felons relinquish their firearms.

As part of Proposition 63, those convicted of crimes that prohibit firearm ownership will be required to provide proof that they have surrendered those firearms to local law enforcement or a licensed firearm dealer.

The move, according to the Los Angeles Times, is designed to reduce the backlog in California’s Armed and Prohibited Persons System (APPS). Which currently includes the names of over 10,000 residents of the Golden State.

Whereas most states are content to wait until a prohibited person is caught with a firearm, California’s approach is much more proactive. The California Department of Justice cross-references known firearm owners with individuals who have been convicted of felonies, deemed mentally unstable, or given domestic violence restraining orders.

All such individuals are placed on the APPS list.  That allows a special gun confiscation unit to visit those people and ensure that they relinquish their firearms.

Confiscating firearms is never safe or cheap. California lawmakers infused the APPS program with $24 million in 2013. And agents cut the number of people on the list from 20,721 people in mid-2013 to 10,634 in 2016.

Now that grant money has run out. While agents have managed to keep the number around 10,000, lawmakers worry about maintaining such a large backlog. Proposition 63 will help in the future. But it cannot reduce the number of people who own guns but have already been convicted and sentenced.

The system is also ripe for abuse, as numerous gun-rights proponents have noted.

Craig DeLuz, a spokesman for the Firearms Policy Coalition, told the LA Times lifted restraining orders are not always reflected in the database.

“When the information is inaccurate, you potentially put people at risk because you have the attorney general’s office sending armed SWAT teams to people’s homes to confiscate firearms,” DeLuz said.

As the NRA’s lawyers point out in this memorandum, individuals are often not aware that they cannot own firearms until the police come knocking. And many of them are first-time offenders convicted of non-violent charges.

The broken nature of the system, however, hasn’t stopped California politicians from promoting it for their own personal gain. Lt. Gov. Gavin Newsom, who is running for governor, recently released a campaign ad threatening the “dangerous criminals” on the APPS list:

“If you are a dangerous criminal, we really are coming for your guns,” he said.

The new law took effect on January 1.

    I am a Conservative living in Kalifornia for over 70 years (except for several years of Army service spent in Korea). Kali politicians are without a doubt the biggest joke on the planet! Get this…one of our geniuses just wrote a bill (hasn’t passed…YET) that would put a waiter/waitress in prison for 6 months IF he/she served a drink with a “single use” STRAW without being asked for it by the customer! go back and read that again!
    When it comes to gun control…you’d think that kindergarten children were writing the laws. They banned magazines with a capacity over 10 rounds and one of our brightest commented that “what’s the issue here?…once they fire all the bullets (in the magazine) they are useless! She didn’t know that magazines could be reloaded.
    But the Democrat who wins the prize for being the biggest jackass of all time is Hank Johnson, representative from Guam who while questioning a Navy Admiral wondered out loud if the island might “tip over” if the Navy build another base one one side of the island. Obviously ol’ Hank is unaware that islands are attached to the ocean floor! The Admiral deserves a special award for restraint.

    Years ago in a desert town in Calif. I was visiting and having a radiator repaired on one of my old cars at a small shop, the owner said go have lunch and it will be finished when you are done. As I was driving back in heavy traffic a kid stepped in front of my car and began firing a small chrome 22 at another guy across the street, the other guy reached for his gun in his waist band and his 45 went off hitting one of his toes, during all this I couldn’t move because of the heavy traffic, I just sat there as the kids ejected brass bounced off the hood of my car, I reached for my gun, but it wasn’t there, I cant carry there as a non-resident. The kid ran down the street and threw his gun on the roof of a building, the other guy threw his gun under the seat of a car parked nearby, I reported this to the Police when they showed up and they said they couldn’t do anything without a warrant, blah, blah,legalese, etc. keep in mind this happened at the busiest time of day for all these businesses, women pushing baby carriages, how they didn’t hit anyone else with approximately 25 rounds fired still amazes me. Thats why they call it criminal justice.

      Indeed, and a further simple question here follows from the statement in the article “they cross-reference with a list of KNOWN FIREARMS OWNERS” How is it again that there is a list of “known firearms owners.” I thought that this was vehemently denied, and now they are admitting that they have a list of all who own firearms? Yeah, I thought conspiracy theories were for kooks. NOT ANY MORE!

        You are misinformed. The federal government is prohibited from maintaining a list, but state governments are not. In California, there has been handgun registration for decades, long gun registration since 1/1/14. The list is kept by the California DOJ, which receives a copy of the Dealer’s Record of Sale (DROS) every time a gun is purchased. So obviously the list is not complete. Further, the list is not completely accurate, since it does not cross-reference sales of used guns 9which also go through DROS) to eliminate guns you’ve bought but sold, and just as obviously, it keeps you as a registered owner of all guns sold out of state. There is a way to get yourself off the ownership record for sold guns, but few actually do so. Because of this, the DOJ record of ownership alone is not sufficient evidence for the issuance of a warrant. Typically, the DOJ confiscation squad asks reputed owners to turn in their guns/allow searches. Last but not least, statistics appear to indicate that the task force goes after people involuntarily committed to a mental instituiton first, since they are usually less prone to violence.

Gavin Newsom who is running for governor of California at one time cheated on his (now ex) wife with his (now ex) best friend’s wife which is not exactly exemplary behavior even in the twenty first century of our current era.
    I personally feel Lt. Gov. Gavin Newsom is a personal disgrace who should never be elected governor of California.

    God, where to start, California just keeps getting further off the reservation. How many more people are going to have to actually die, before this insane behavior stops?

    First off, I agree that if you, “Do the Crime and Serve your Time”, you should automatically have all your Civil Rights Restored. Does that mean you can become a Cop or Work at a Children’s Day Care, I’d say “NO”, as these are areas of employment it would be reasonable to exclude you from, based on the prior acts you have committed.

    However, does that mean that the State can deny you the Right to Vote, The Right of Free Speech/Assembly/Travel and/or the Right to Bear Arms and all the other Rights Guaranteed by the Constitution, I say, “NO”. Clearly the law passed by Congress, Known as the 1968 Gun Control Act, got it wrong and has trampled upon people’s rights, sending many back to prison. If you are still a danger to society, you should stay locked-up, however if we release you, you should get a clean slate and a chance to start over and become a productive member of society.

    So now the State is going to send Armed Teams of Paramilitary Troops to people’s homes, to what, “Kick in the doors”, have conversations, arrest them, kill them if they “move wrong” or “appear to be doing something” that could/maybe/might, endanger “officer safety”. Does a Judge even need to issue a warrant or is being on “The List” probable cause in itself??? What third world “Shit Hole” are we talking about here??? Clearly a Federal Injunction is needed here? Where is the Justice Department, The NRA or The ACLU for that matter???

    What sort of process is there here? Do they get the 3 government letters telling them they are “On the List”, with the third letter telling them a bench warrant has been issued for their arrest? Do they have their drivers’ license and all their professional licenses suspended, tax refunds and food stamps withheld, notices issued to their parole officers, like in a child support case? Or are we just going straight to the armed teams kicking in doors and putting people’s lives at risk for political gain?

    I live in Arizona and my neighbor was arrested in a child custody case many years ago. He was never prosecuted and has sole custody of his daughter. He attempted to purchase a gun and was denied, as the charge, although never prosecuted, is still in the system, even a decade later. He has to file papers with the court and send it to the FBI, so he can have his ability to buy a firearm restored. Luckily, he doesn’t live in California, otherwise his life may be at risk, maybe not, who knows.

    Civil Rights need to be Guaranteed for all Americans. The Federal Government has a responsibility under the Constitution to guarantee that each state has a republican (small “r”) form of government. California is changing into something else, with the new One Party State Election Rules, Registering Aliens to Vote and now persecuting free citizens because of their names being on an administrative list.

    I realize that sympathy and standing up for the rights of convicted felons and wife beaters, etc. isn’t a politically popular thing to do, but it is the right thing to do. People who have made mistakes, been punished and set free, deserve to be free and not live with a literal target on their backs for the rest of their lives. Civil Rights are for all Americans, otherwise they are truly meaningless.

        I’m with you, depending on the crime. I have family member who, many years ago, got felony conviction for pot possession. Back when a fairly small amount was a felony. No jail time served, but still lost 2nd Amendment rights. I think maybe violent offenders get some extra monitoring time, but non-violent should have all rights restored, or never taken in the first place.

        It will be interesting to see how it plays out when swat goes to the wrong address, and a bunch of cops get shot. Or even when they go to the right address, and the gun owner decides not to comply. By the way, how do they know who has firearms?
        Anyone who can leave Ca, should.

      Should a convicted felon who has served his sentence without incident (no disciplinary action for fighting, possessing contraband, assaulting COs, etc) have his right to vote restored? Absolutely. Should his right to possess firearms be reinstated? Absolutely not. Do we really want someone convicted of armed robbery, aggravated battery, distribution of a controlled substance, etcetera to be able to walk into a gun store and buy a firearm? In any State I’m aware of for a person to be convicted and actually serve prison time either the crime was particularly egregious or that offender has multiple priors.
      Mauser 6863’s absolutist position is that all rights should be restored to someone who has “done their time”. Absolutist positions are seldom correct. For instance, one right even more basic than the right to bear arms is the right to freely associate with anyone one chooses. Would he defend the right of a serial rapist to associate with his daughter, sister, or wife?

      As a native, 4th generation conservative Californian, I resent that remark. Yes we have a problem with the progressive commies in all three branches of government, however, the state has a large number of conservatives who would turn the state around if we had the numbers. Most of the liberal faction has only been here for one or two generations. They came here for the freebies (we had free college through the state college system).

      I live in a rural county. Most such counties are conservative leaning. My sheriff freely issues CCWs. The county rejected even considering a vote to be a sanctuary county. Even some of our liberal neighbors like their firearms. This is typical of rural California, which accounts for 96% of the land mass. The other 4% is locked up in the major metropolitan zones (LA, San Diego, SF Bay Area, Sacramento) and they are predominantly liberal progressive Democrats.

      Many of us, particularly through the NRA/ILA and organizations like the CRPA (CA Rifle and Pistol Assoc.), as well as Guns of America (GOA) and others. There are presently a number of law suits in progress, and they have gained support from quite a few other states Atty Gens filing briefs against the state laws. Additionally, a number of law enforcement agencies have publicly rejected the draconian actions of the state. Unfortunately, we have people like Gov Brown who do what they want and essentially say that if th people don’t like it, they can leave.

      All of the public servants in the state take essentially the same oath of office, “to protect and defend the Constitution of the United States and the State of California against all enemies foreign and domestic”. By their tyrannical actions, they have broken their oaths of office and are, therefore, criminals themselves. We are hoping that the USDOJ will investigate and bring charges against our governor and his gang.

      CA’s latest is that drivers licenses must be issued to illegals. Under the law, anyone who has a drivers license will be registered to vote. Which means all the illegals will soon vote for progressives.

      He, and the rest are intentionally passing legislation designed to violate the 2nd Amendment rights of US Citizens while sucking up to illegals for future votes. Denying people their rights by regulating gun shops out of cities (as SF has already done), and similar acts, is a criminal act in and of itself.

      CA now prohibits buying ammo across the state line without going through an FFL holder. If you own certain firearms, when you die, you can not pass them on to your descendants. They must a) turn them in, b) move them out of the state, or c) render them permanently inoperable. The same kinds of actions are being instituted in other states.

      They have messed CA up so badly that it is illegal to misidentify (verbal or written) an individual as to their sex.

    Seems to me that this “war on guns” being waged by law enforcement is a lot like the “war on drugs”; a complete waste of time and money. As a once upon a time law enforcement guy who worked in narcotic investigation, I left the department believing that people who really want something, legal or not, will find a way to get it. To me, the sad reality is the pathetic , deranged liberal politicians who think that laws stop those with criminal intent. Criminals don’t obey the law, so don’t be surprised when your efforts to curtail or stop some dangerous activity don’t work.

          The issue is in CA is that at the time of the purchase they were legal to own the weapon. But, CA has put several more infractions on the list that now make you prohibited. So now when you go to the gun store and try to buy a weapon and they do the DOJ background check, they now find you are prohibited from owning a firearm. So, that sends a trigger that a prohibited person is attempting to purchase a firearm. A check is ran on that person to see if any forearms are registered to them, if so, they will send a couple of agents from various departments knocking on your door to see the firearms that you previously legally owned. They will ask you to open your safe, and then since you obviously have access to all those arms and ammo, they will take them. All the time, they have a search warrant in their back pocket just in case you try to resist letting them in….
          We, as responsible gun owners, need to do our part in making sure that people do not do bad things with firearms and hurt themselves or others. We need to educated others who have just purchased firearms in the proper use, and safe handling of firearms. The issue in Las Vegas has set us back several years. We were doing so well up until that time.

The sheriff’s dept came and emptied my safe over some BS she made up. 3 weeks later, the judge saw right thru her BS and I had an order in my hand to release everything back to me.
