New York Passes Sweeping Anti-Gun Bills Disarming Teachers, Requiring 30-Day Waiting Period

Proving once again that the gun ban lobby will never, ever be satisfied, the New York state legislature just passed six additional restrictions to lawful gun ownership in the Empire State.

Among other anti-gun measures, the new laws ban “rapid-fire” modification devices, prohibit armed teachers in schools, mandate a 30-day waiting period for delayed NICS checks, and allow gun confiscation without due process.

“The anti-gun rights leftwing lunatic politicians in New York will not be happy until every firearm is banned and confiscated,” Second Amendment Foundation Founder Alan Gottlieb told GunsAmerica. “Believe me this is just the beginning. That is why it is so important that United States Supreme Court hears the gun rights cases that are currently filed with the high court.”

Even though New York already has some of the strictest gun control laws in the state, the legislature has signaled that they have more planned for the coming months.

“It will not be six years, believe me, between sensible gun laws,” said Senate Majority Leader Andrea Stewart-Cousins, referring to the time gap between these laws and New York’s infamous SAFE Act.

New York Gov. Andrew Cuomo reiterated the senator’s commitment.

“Sometimes history irrefutably bears out your actions,” he said at a news conference on Tuesday. “Today is the next evolution in this ongoing crusade.”

While New York gun owners brace for the next wave in Cuomo’s crusade, they’ll have to acclimate to a half-dozen new restrictions on their Second Amendment rights.

Among the worst is a “red flag” law that allows the confiscation of firearms without due process. While the National Rifle Association has angered gun rights advocates with their support of some red flag laws, they oppose New York’s version “because it does not contain strong due process protections for respondents who could potentially lose the Second Amendment rights.”

“This legislation is perhaps one of the more dangerous in the package as it would become a widely used instrument to take away someone’s constitutional rights with little or no due process,” the NRA said on its website.

Another piece of legislation prohibits local school districts from allowing teachers to be armed. Only law enforcement officers, school resource officers or other security personnel can carry a firearm on school property.

Yet another bill will mandate a 30-day waiting period to process delayed NICS background checks. Under federal law, an FFL can transfer the firearm to the buyer after three days, even if the background check has not been completed. This ensures that Second Amendment rights are not restricted due to processing errors, as often happens to people with common names like John Smith.

Now a delayed background check may suspend a New Yorker’s rights indefinitely. According to the FBI, a NICS check is only valid for 30 days, which means that if a background check gets lost in the bureaucracy, the FFL will have to renew the background check once those thirty days are up.

If the check gets delayed again, the buyer may never receive his or her firearm, especially since the FBI has instituted no appeals process for a delayed check.

Other bills will ban bump stocks (along with any other “rapid-fire” modification device), mandate safe storage of firearms, and ban 3D printed firearms.

    I was born in Western NY State.

    I knew by the time I was in high school many decades ago, the area was dying mess. I left as soon as I could and have never considered moving back.

    Outside of NYC, most of the state is composed of small towns and cities that have been dying since the WWII and union labor boom ended in the late 50s. The only real change that amounts to anything is the increase in the welfare state and the associated businesses.

    Much of the state is like the walking dead and it will continue in that direction as state legislators address every issue with more taxes, more regulation, more welfare and less freedom. It’s a shame, it was a beautiful and productive land once, but no more.

    Steel mills and many other industries are now shuttered with nothing left but rotting old buildings. People leave for southern states with a better and less expensive quality of living, but then try to turn their new home into the one they just ran away from.

    I’m fortunate I was never afflicted with that genetic disposition for self mutilation and don’t like suffering needlessly.

    I live in one of a handful of states allowing civilian firearm purchase with only federal regulation and minimal, reasonable state regulation. What’s troubling to me, is that people like my friend Alex here, are relocating to my state and bringing their politics with them. Once residents, they are voters. I left NY many years ago to escape a state government whose objective was to tax its citizens into poverty (unless you’re already poor), revoke any rights you have and promote political correctness, inclusiveness and social justice to the point of obsurdity.

    I now am SERIOUSLY concerned at the mass exodus I see of people like this moving here resulting from the oppression from their home states. I can only pray, that they are people seeking relief as I did and not looking to re-establish another NY or the like!

    Two of my favorite lawmen from the history of The “Wild” west are Wyatt Earp and James Butler Hickok. Talk about gun control. You couldn’t carry your pistol or your rifle or your shotgun in Tombstone, or in Dodge city or Hayes city or in a hundred other little towns in the “Wild” west. And there was no such thing as a license to carry one either. No exceptions. Some NRA types at the O.K. corral thought they had second amendment rights. They wound up mighty dead for their politics. But today’s wannabe’s and gun nuts like to forget that, even though its shown on every TV show and movie about those guys.

    I was a cowboy as a young man – and a Deputy Sheriff. Carried a pistol on my hip for 42 years. It was an important tool when it was needed. Fortunately, 99% of the time off the ranch it wasn’t needed. I don’t carry in New York State any more – its not safe. Cop sees it, he’ll probably just kill you, and in court he’ll say “I was in fear for my life.” Yeah, these young cops today are a fearful, skittish bunch. I never shot anybody because we weren’t allowed to be “In fear for our lives” back then, 50 years ago. We had no bullet-proof vests, not even walkie talkies. In a valley, often even the patrol car radio couldn’t send or receive sometimes. One man patrol cars. You were on your own. Backup was 20 miles away. But still, before you pulled the trigger on some bad guy you had better see the knife or the gun, and they’d better be facing you. Fear was a thing you may have felt for a minute, but you would never admit it. And admitting to it would not be a defense for shooting an unarmed man. That kind of defense would just make you a disgrace and a pariah in your hometown and pretty much guarantee a lifetime of unemployment if you escaped jail back then.

    No, not safe to carry a pistol in New York anymore – not with these cops running around who are always in fear for their lives – like that Cleveland cop who shot that 12 year-old kid who had an airsoft replica that scared that cop so bad that 2.5 seconds after he rolled up he drew and fired and killed the kid. Bad mistake, but understandable – that replica gun looked 100% real – and that cop was fearful. Fearful. Terrible thing, fear. It makes mistakes happen – it makes tragedies happen, this fear thing. If you’re a licensed carrier in New York – or anywhere – be afraid – be very afraid – because the cops are too. They are not the men that Earp and Hickok were, and they are not the men we knew as kids who inspired some of us to become lawmen. No, these men are in perpetual fear for their lives – and that could kill you quicker than Wild Bill Hickok ever would’ve.

      Couple of points here (regarding cops walking around in fear):

      Back in the “good old days”, there was RESPECT for LEO. You didn’t sass them, and you definitely didn’t pull a gun or knife on them (never bring a knife to a gunfight). Nowadays they’re spit on, assaulted, and the “bad guys” don’t think twice about shooting them. So yeah – if I was a copper today, and a perp even moved to point a weapon my way, they’d get 3 center mass with zero hesitation.

      Ohio incident: Was the cop quick to shoot? I dunno – regardless of the age of the kid (many gangs specialize in “baby-killers”, because they are disposable and typically don’t get charged as adults), when a cop rolls up on a report of a person brandishing a firearm in a public park, he tells the guy don’t move and the guy reaches for the gun – yeah, I’d be in fear for my life. If you saw the picture of the “replica gun” (which had no orange tip) I (as a GUNSMITH) would almost need to have it in my hand to determine it wasn’t the genuine article.

      With cops being gunned down on the street, simply for being a cop – is it SOCIETIES FAULT for somehow making this acceptable – or – the cops fault for simply WANTING TO MAKE IT OFF SHIFT ALIVE that day?

      Since I don’t live anywhere my rights are curtailed (dodged the BIG ONE here in FLA by keeping Gillum out, otherwise, I had plans to move to Texas) – as daily carrier for 30+ years, EVERY INTERACTION WITH LEO I have, is done in such a manner as to make them feel as secure as humanly possible. And my OBVIOUS CONCERN FOR THEIR SAFETY (usually) makes that interaction very pleasant (and appreciated by the LEO), regardless of the initial reason for the interaction.

      The Wild Wild West was a different place and time. People “came to town” to shop, drink, gamble and whore. Most of the “townfolk residents” were employed or associated with the businesses setup to support the surrounding area (mining, farming, ranching) and folks coming to town for the “nightlife” were asked to surrender their weps to minimize the all-too-frequent drunken firearms incidents. Depending on whose view you subscribe to – the OK Corral folks were looking for a fight, and got one.

      Let me see if I have this correct. A civilian carrying a pistol made by, say Glock, is a murderer because he carries it. But a police officer who carries the same Glock, perhaps only 1 serial number away from the one owned by the civilian, is not a murderer.

      Do you comprehend that given the murder rate in the US, it would take about 10,000 years to equal the death toll of 3 countries from the 20th century where only police and military were armed? And those 100 million+ murders of disarmed civilians happened in a space of only about 50 years.

      Historically, government is a greater threat to your life and liberty than even natural disasters. The only things that have killed more people than government are the plague, small pox, and malaria. And I’m not sure about the last two.

      superior, but does nothing to bolster their argument. Alex my own experience of being an armed citizen

    I am glad that I do not live in the state of New York, and if I did live there it would be time to throw in the towel and move to another state that is not run by a bunch of tyrants.

      Just moving IS NOT THE ANSWER, THE PROBLEM WILL EVENTUALLY FIND YOU IN THE NEW STATE !
