New Yorkers: Re-Certify Your Assault Weapon Registration (or Spend A Year In Jail)!

Every five years New Yorkers must re-certify the registration of their “assault weapon,” under the New York Secure Ammunition and Firearms Enforcement (SAFE) Act. State police announced last week that the deadline for recertification is quickly approaching for many black rifle owners.

The SAFE Act was rammed through the Legislature in 2013 by emperor Cuomo on the heels of the mass killing at Sandy Hook Elementary School in Newtown, CT. Never let a crisis go to waste! Five years from the approximate enactment date is now, 2018.

“State law requires that assault weapon registrations must be recertified every five years from the date the registration was filed.  Under NYS Penal Law Section 400, failure to recertify will result in a revocation of the registration,” reads the press release.

If one’s registration expires then one is in violation of the law. Because possession of an unregistered “assault weapon” is a Class A misdemeanor. Meaning, New Yorkers could spend up to a year in prison and get slapped with a $1,000 fine if they don’t comply.

The good news, if you want to call it that, is that recertification is free. And relatively straightforward. There is an online portal that allows one to do it as well as a downloadable form (I’ve embedded it at the bottom) that can be sent to State Police.

“As part of the recertification process, licensees must affirm that they are not prohibited from possessing firearms under state and federal law, and must also confirm certain personal information,” states the announcement.

Of course, the whole idea of having to register guns with the government is asinine. Government is the reason we need (notice I didn’t say, “want”) ARs and AKs. “Black rifles are kryptonite to tyranny,” as Clay likes to say. Telling Big Brother who owns what is tantamount to giving them a kill-first list.

Boneheaded it is for another reason. No violent killer or street thug is sitting in his basement right now preparing a recertification form.  Criminals don’t give a rip about the law.  Especially not enough to self-report their status as an armed prohibited person to police.

Anyone with any common sense knows this.  Then again, the overlords in Albany didn’t conceive the SAFE Act to stop bad guys from getting scary-looking guns.  They designed it to chill the 2A rights of law-abiding citizens.  To make it increasingly burdensome for good guys to exercise a fundamental right.  That’s why it contains all that nonsense about only putting seven rounds in a 10-round magazine, recertifying assault weapons, and registering handguns.

We are the ones (I live in NY now) with the target on our backs.  Not the criminals.  If there is a silver lining to all this it’s that about 1 million New Yorkers have silently refused to comply with the SAFE Act’s black rifle registration scheme.  These patriots are betting that one day sanity will be restored to the Empire State, that the SAFE Act will be fully repealed.

But until that moment, memo to Gov. Cuomo: Molon Labe!

    Move out of NY huh?? To where?? Who is going to buy my $325,000 house? The people that can afford it left with the jobs when they moved out.

    This is why most of the people i know never registered there “assault” riffles. Its much easier to just to modify your rifle to not have any of the points that the bill points out.

    Now the ones who registered their so called assault rifles with the state of New York and decide not to re-register will see what their initial compliance with the law do for themselves. The state now has their names and addresses and know where to come kick their door in to confiscate their “evil rifles”.

      Hopefully no one has registered an “assault rifle” in New York. An assault rifle would be a military selective-fire weapon that can operate as a machine gun, which has been strictly prohibited since the 1930’s (without a special license).

      The New York (and CA and a few other nutty states)’s laws require registration of assault “weapons”, which is a completely arbitrary and made-up term. Some “assault weapons” aren’t even rifles, they’re pistols. It’s a total cluster-mess. And yes, the people who came up with that term, and crafted those laws, *deliberately* confused “assault weapons” (probably the most popular & common rifles in the U.S.) with “assault rifles”.

    Although I have lived in NYS for 62 years I wonder why? the highest taxes of all states. the most red tape and restrictions on any incoming and existing businesses. One of the biggest Nanny states taking care of people who refuse to work at a job, but work the system. I have watched people going thru the grocery check out in front of me with an overflowing shopping cart. Get thru the register and hand the clerk an EBT card to cover their $400 purchase. I am next in line and pay cash for my $60 purchase. Did I mention the EBT card owners had tattoos on every piece of exposed flesh and a smart phone in their ear? I don’t have either but pay cash for my own groceries. And for part of the EBT cardholders groceries. something is wrong about that. Could the EBT cardholder have paid for their own groceries if they did not piss away their money and then depend on somebody else to take care of them?

    Well, I’ve been warning everybody for years on this blog and others. I was laughed at right after Obama was elected and got a sneak peek at their gun control agenda for relating that there’s a clear and present danger of illegal fiat type gun Confiscations mandates coming down the now accelerated jet powered slippery slope, right after universal background checks are passed, thus creating the ‘supposedly’ illegal practice of keeping Registery Data Bases on all gun owners. They told me ‘Nobody’ll stand for that’, They’ll never get away with that, LOL! You’re just paranoid…it’s just your PTSD showing or TBS from too many combat explosions?

    Notice the official Certificate above has no qualms or reservations now for using the word Registration three times in their little certification letters.

    All my life I’ve been proactively anti-gun control and telling the NRA for years to quit capitulating like a suck-ass Commie sycophant under the subtle aegis of this nascent but speed shifting tyrannist agenda and start getting a ‘grass roots’ gun law–ALL unconstitutional gun laws–repeal PAC moving.

    Instead of relying on the useless NRA anymore for anything, why don’t start supporting action groups like the Oath Keepers and the Rutherford Institute? Who actually create some physical movement toward preserving our rights and combating the criminal gun grabbers? Oathkeepers are serious patriots comprised of what’s left of the Vets and Cops who do not bend their knees before their slavemasters. And the Rutherford Institute files SCOTUS lawsuits to protect against the police statist anti-Constiutional tyrannies.

    Why? Because after all is said and done, there will always ne more SAID, than ever done.

    And this is like surrendering before you even have a chance of losing.

    Fast initial Action always beats re-action, but no action at all does not always hold true to the old martial art aphorism that ‘you can”t lose the fight you don’t get into.’

    Because as history has proven, the most important things in life must be fought for and the fight must be WON to preserve your life, liberty, and the pursuit of…stuffing your macro-mouth full of Cheetos and chocolate cookies from your armchair borne Ranger couch commando headquarters. while getting your ‘briefings’ from Hunger Games sports programming or Saturday morning cartoons with your kids…

    This is old and inaccurate info. The 7 round magazine limit is gone, increased to 10. Pistol Licenses are up for renewal. Assault rifle registry is not. Not that any of this crap makes sense, also the ammo background check has died a quiet death

    The main problem with NY is that everything seems to revolve around the city (NYC). The rest of the state, outside of Albany and Buffalo, are heavy conservative and they just get screwed at every turn.

    Well, New Yorkers have an additional “weapon” at their disposal – their feet! Vote with your feet and move out of New York (city and/or state). There is a whole nother world out there folks – one where “govern”ment isn’t afraid of (or stupid about) those nasty little black rifles. Head em up and move em out.     How far we have come from the intent of our founders? The people of this country have lost their way mostly due to the urbanization of the populace. City folks just don’t get it. Notice that even in red states there is an ugly blue stain around population centers. It’s hard to vote out the liberals when they have so many supporting voters but you have to try.

      That is why our forefathers deemed it necessary to stick that old anoying little thing called the “Electoral College” in the Constitution – so our Country wouldn’t be a pure democracy. It was a nice touch also to have every state allocated two Senators to even things up a bit! The key is vote, vote, and vote in every election.     My thinking is that all police officers must have a valid oath of office filed and are they not obligated to uphold the constitution so would they not be in violation of that oath in upholding this statute. 42 USC 1985 certainly should be our protection against persons that violated our rights and yet I see no one using that law to protect oneself. 1985 is designed so that an individual can use it without the aid of an attorney. Is 1985 just another law being ignored by the judges in this country. I think for the most part people look to our politicians to protect their rights and that just does not seem to be working in many cases.

      You are correct, to a point, Dwight. But as we know, Agenda based anti-American tyrannists (even though your grammar programs flag this, it IS a real word with an oriented definition) also include police and military and certainly most government agency police.

      Throw in a justice system with far too many corrupted judges who prefer to legislate their agenda from the bench rather than protect the Constitution with the oath they took.

      The scam here is that it takes so long to challenge an illegal lower court pseudo-law (euphemistically known as a decision) that still functions as a law from the bench until it is overturned/repealed. The Tyrannists know this and play it like 3 Aces in the hole.

      While the rest of us sleep.

      And there are more laws specifically preventing anti-constitutional circumvention of this Supreme Law of The Land, as well as the Bill of Rights. But ‘THEY’ just ignore them. And Police are still the most prolific and egregious of offenders. I just read something not long ago I first thought was fake news or a joke/prank about a police department routinely entering homes without a warrant just on an officer’s subjective ‘suspicion’ and when confronted with their complete denial of due process to the victims and committing what was essentially a criminal home invasion, the police department ‘officially’ ‘believed’ that this was ‘okay police work’? Hard to believe, in this day and age, with all the bad PR rogue ops are getting, but it’s really worse than that. In North or South Dakatoa, I seem to recall, when local departments first started using drones, a couple years ago, one Sheriff’s department wanted to go one step further and got their legislators to sponsor a state bill to weaponized them, oh, nothing serious, just tazers, which unnecessarily kill dozens of civilians a year, and tear gas, and maybe full auto paintball pepper shots or hard glass balls, which doubtless will eventually escalate to flash bangs and even real Glocks or ?

      But one of the news reporters asked the sheriff about the probable cause necessity required for Constitutional Due Process in a search if they intended to fly these drones over private property and the Sheriff said arrogantly and condescendingly that flying the drones close enough to private property to spy on people was, in fact, how they would GET the probable clause for a warrant!

      If you go to the Oathkeepers website and read their membership creed, which is a reiteration of the Oath of office to protect and uphold the Constitution, you’ll see the difference between good cops and bad ones. Right now, there’s too many bad one’s and not enough good ones.

      But yes, I agree that some new political base modeled somewhat after the virtuall now defunct libertarian party that otherone the Tea Party which nobody cares about anymore for all pragmatic applications should be created with the main specific purpose of repealing all gun laws and proactively prosecuting all violations of the Constitution and our Bill of Rights according to the laws already on the books like 1985, and to include proactive education and promotion of Jury Nullifications.

      That got off to a start a few years ago, but the corrupt Justice system quickly retaliated and judges would arrest anybody caught outside of the courthouse handing out jury nullification instructions. The charge was Obstruction of Justice and/or Jury tampering.

      It’s going to be a rough uphill battle for us at this point against a fast moving avalanche of tyranny down a well greased with corruption slippery slope.

      But if we don’t quit procrastinating…

    It is paramount that the NY Police maintain this Constitutional registration of weapons that are in the hands of the peasants. I bet their were many Jews who also lived in the same state of denial when they were being stripped of their rights, property and being tagged.     What’s next? How about, NY residents are directed to return the Assault Weapon Registration Recertification form with a certified check in the amount of $1000 for each weapon by the due date. Late submission will result in a 10% penalty per weapon. Thank you!
