NJ Gun Stores Must Now Sell Smart Guns

2nd Amendment – R2KBA Authors S.H. Blannelberry This Week

New Jersey Gov. Phil Murphy signed legislation Tuesday that forces firearms retailers in the Garden State to sell smart guns.  

That’s not all though. Murphy, a progressive Democrat, also put his John Hancock on three other bills that work to make New Jersey’s gun laws the “toughest” in the nation. 

“The scourge of gun violence is a pervasive problem that affects our entire nation,” said Gov. Murphy, in a press release obtained by GunsAmerica.   

“I am proud to work with our legislators to implement some of the toughest gun laws in the country to protect our residents and make our communities safer for all,” he added.

Per Gov. Murphy, the bills signed into law include:

  • S101 (Weinberg, Codey/Johnson, Vainieri Huttle, Wimberly) – Establishes commission to approve personalized handguns; requires firearm retailers to sell personalized handguns. 
  • S3897 (Weinberg, Greenstein/Greenwald, Reynolds-Jackson) – Criminalizes purchase, transfer, or possession of certain weapons and ammunition by persons convicted of certain crimes; establishes crime of transferring or possessing firearm without serial number.
  • A4449 (Tully, Swain/Singleton, O’Scanlon) – Establishes crime of soliciting transfer of firearm by disqualified person.  
  • A3896 (Downey, Houghtaling, Schaer/Cryan) – Requires AG and Commissioner of Health to establish suicide prevention training course and informational materials for firearm retail dealers.

In addition to requiring FFLs to sell at least one smart gun, S101 also rescinded an ill-conceived 2002 law that required gun dealers to sell smart guns exclusively in New Jersey three years after they became available for “retail purposes.”

Murphy explained during the press conference how the law, known as the New Jersey Childproof Handgun Law, backfired in the face of gun-control advocates as it put an “enormous amount of pressure on the gun manufacturers to not pursue the (research and development) that was necessary” to bring viable smart gun technology to the marketplace.

As GA previously reported, the gun industry doesn’t oppose smart gun development. What it rails against is when the government tries to force the issue.

“The firearms industry is not opposed to the development or marketing of user-authorized (“smart gun”) technology, but we continue to oppose any form of government mandate, including telling a retailer to stock a product in the attempt to create demand that we frankly do not yet see,” the National Shooting Sports Foundation said in a statement to GA in 2015.

While compelling small business owners to sell products they may not want to put on their shelves is troubling, what may be the most concerning of all the bills signed is S3897, which expands the list of prohibited persons in the state, those who are banned from buying guns, to include those convicted of carjacking or making terroristic threats.  While carjacking is a pretty obvious offense, a “terroristic threat” is less so.  

According to New Jersey law firm Aiello & Harris, the standard for defining the offense, which is a 2nd- or 3rd-degree crime depending on the circumstances, is as follows:

Is caustic or harsh online banter enough to qualify as a “terroristic threat”? If so, New Jersey gun owners are going to have to extra careful about what they say publicly. Saying the wrong thing to the wrong person at the wrong time may end up costing them their 2A rights under this new law.

Looking ahead, Gov. Murphy is going to continue to pursue an anti-2A agenda. NJ.com reports that there are a handful of other gun-control bills being considered, including legislation that would require background checks and tracking for ammo sales, price hikes for carry permits and Firearm ID cards, and mandatory safety training every 4 years, among others.

“Governor Murphy’s Gun Safety Package 2.0, will surely be followed by version 3.0. When 2,0 fails to stop criminals as version 1.0 did he will again push his gun prohibition agenda under the banner of ‘comprehensive gun safety’ laws,” said Alan Gottlieb, founder of the Second Amendment Foundation in an email to GunsAmerica.

“New Jersey may have been the first state to ratify the Bill of Rights but unfortunately the last state to recognize it,” he added.

    They release a virus, thankfully ignorant of epidemiology, (think of that punk Fauci). They start a war, having made sure the combatants have the ability to kill off the masses of the other side. They are trying to make sure the masses do not have the ability to defend themselves from all the little insane tyrants they have created and nurtured. they try to eliminate the means of communication of their enemies, (us!).     So New Jersey wants to raise the cost of a concealed carry permit? I didn’t think they even issued permits except to a handful of the political elite. As I recall, Barrett refused to sell or service its .50 caliber rifles to police departments in California when citizens were forbidden to own them. A good, principled stance that other firearms companies should emulate.

    let’s ask the NJ governor to decide for every police officer in NJ that they will only carry “smart guns” while on duty and also for their off-duty weapons. First it would be easiest to establish this with the state police armed detail around the governor. that should do it-the governor leading from the front.

It appears the voters of New Jersy wish to compete with other states like Commiefornia, and Newd York to see who can be the worst. This is truly a governer and legislation that is out of control and should be taken down anyway possible or imaginable, but don’t look to the voters of New Jersey to do it, as they are either to stupid, pussies, or are dieing to become slaves to the state. At one time most will not recall to young, this was a great state with so much to offer, and the men were men and the women were women and would never have allowed this.

    I like the idea that firearms manufacturers stop selling firearms in New Jersy completely. Not to gun stores, not to law enforcement or any government agency (federal, state or local) that operates in New Jersy. All government officials that serve the state or federal level cannot have armed bodyguards. You can have bodyguards but they cannot have firearms or any other type of weapon be it defensive or offensive. No batons, no stun guns, no mace, no nothin. Then let’s see what happens.

    The biggest killer of children in this country is motor vehicle accidents. The most dangerous thing you can have your child do is get on a bus to go to school. This is fact, look it up. So why do they not legislate that school buses be required to have seatbelts and airbags on every seat and have an interlock system so the bus will not move unless every child is in a seat and bucked in?
    And, if gun laws work so well, why did Chicago have over 700 gun deaths and over 4000 gunshot wounds while they have the most restrictive gun laws in the country. These numbers are from 2018, look them up.
    Again, criminals don’t buy guns from gun stores. They don’t license their guns. They don’t get concealed carry permits. They don’t give a rats ass about the gun laws. Most are felons and can’t have a firearm anyway. This all reminds me of a quote from a German writer before World War II and goes something like this. “First, they came for the guns, and I said nothing because I did not own a gun, (Firearms Act of 1934 Germany under Adolf Hitler), They then came for the Jews and I did nothing because I was not a Jew, then they came for the Catholics and I said nothing because I was not a Catholic, Then they came for those that spoke out against the government and I said nothing because I was not a political person, THEN THEY CAME FOR ME!     How can they force a store owner to have in stock that will probably never sell and does not yet exist? I imagine that when a company does market a “Smart Gun” that the cost will be prohibitive for anyone to buy and equally expensive for a store owner to have one on hand. If it were me, there was a company that had an adapter for Smith & Wesson revolvers where you would have a magnetic ring you would wear on the third finger of each hand. The revolver would not fire unless the magnetic ring was on the grip of the gun which would unlock the firing mechanism of the revolver. Anyway, stupid law made by stupid people that will do nothing to curb gun violence because CRIMINALS DO NOT GO TO GUNS STORES TO BUY GUNS! They either steal them or get them from other criminals. If anything, disarming the law-abiding public will only increase gun violence as the only defense for innocent will be to hide themselves behind locked doors which criminals will break down BECAUSE they now these people are defenseless and they will be in and gone before the police can get there. God please save us from these idiots.

      Actually, the gun already exists. It caused big issue a few years ago when they were going to import the gun into the USA. It would have “triggered” ( pun intended) the OLD LAW that they just repealed. Under that law, IF ANY smart gun got to market, then within 3 years ONLY smart guns would be allowed for sale in SCREW JERSEY.. Problem was that they only had 1 gun on the market, and i believe it was a .22 pistol…

    If Mundanes can’t buy a “larger than 10 round magazine” then that’s all which they’ll send.

    Look at whats going on in London, gangs with guns breaking into stores to rob and kill defenseless owners and patrons who have no way to stop them. Gun control at its best. We were wearing hats in 1966 that said when guns are outlawed only outlaws will have guns. This was prior to federal firearms restrictions, but during the proposal time.

      They do exist, sort of. There was a .22LR pistol developed some years back that would work most of the time. The inmates of NJ are not being forced to buy them. The bill just forces the FFLs to carry them as available irrespective whether anyone ever actually does want to buy one. It’s still bad and wrong, and another step into tyranny. It’s those other bills that chap my ass more, soaking responsible citizens for time, effort, and money to shift a right into a privilege. They’re also expanding the definition of “terrorism” to effectively make the term equivalent to “threat”.

        I say that since the SCREW JERSEY Government is forcing the FFL to stock one, that the NJ Government should pay for it from state funds and supply it to the FFL free of charge. IF they sell it, the FFL can replace it with the purchase money !

That’s even better than a so-called “smart gun” as far keeping kids safe, which is the primary excuse gun haters use for promoting the stupid idea.

    I would NEVER buy a “smart gun”, and if it were the only option, I’d immediately modify it to be a functional weapon again. Any smart gun, regardless of design, is a failure to operate in waiting. Worse yet, they could be disabled from a distance via EMP generator.

    There is absolutely no such thing as “gun violence”. I’ve seen thousands of guns in my life and none of them ever acted in an aggressive or violent manner. Of all the guns I’ve seen and owned, all of them were very well behaved and completely docile. I have seen and heard of violent humans forcing the gun to assist them in violent acts, but those violent humans have done that with knives, baseball bats, tire irons, cars and trucks, you name it. Inanimate objects can’t commit violence by themselves. It takes a human to make them do ANYTHING. Stupid, anti freedom totalitarian politicians can’t stop human violence by outlawing objects or tools. Violent humans don’t care about “laws”. They never have and never will. Any so called “smart gun” technology can and will be circumvented.
