Ohio Homeowner, 74, Shoots 16-Year-Old Burglary Suspect

Akron resident and homeowner James Lowgher, 74, shot a teenager in self-defense after the teen broke into his house this week. The boy, 16, was taken to a local hospital where officials say he is in stable condition.

Officers responded to a call about a morning home invasion and administered first aid to the boy before taking him to Akron Children’s Hospital. Police have not charged Lowgher with any crimes.

According to Lowgher, the boy broke in through the front door. Lowgher confronted him before the boy tried to force his way into his basement, which is when he shot him.

“He headed to the basement and I pumped two into him there,” Lowgher said. “He went down the steps that way and I got him a third time I hope.”

“He didn’t belong here and I knew damn well after he came through the door like that, I can shoot him,” said Lowgher.

Michael Benza, Senior Instructor of Law at Case Western University, told News 5 Cleveland that the shooting looks like a perfect example of self-defense under Ohio’s Castle Doctrine.

“Somebody’s breaking into the house, they are in the house, the person is defending their house and they have the right to use deadly force in that case,” Benza said.

Charges against the minor are still pending while the police investigation is ongoing. Lowgher was not hurt during the break-in.

    Never talk to the media before you speak with counsel. Let him/ her deal with those news whores. The guys words are going to be used against him even if he isnt charged with a crime for shooting the future brain surgeon. He just may be dragged into civil court and sued. This is why its a good idea to belong to one of the organizations that offer inurance for this kind of thing. Unfortunately this is the world we live in.

      Most states include within their Castle Doctrine laws a preemption against civil suits.

        While 23 states ( including Ohio ) offer some protection against civil liability it doesn’t prevent a civil suit from being filed against you. In the case of Ohio it puts the burden on the plaintiff to prove that the defendant did not act in self defense. Rather than putting the onus on the defendant to prove they did. Never talk to the police or anybody else without your lawyer being present.

    Mr. Citizen obviously is not prior military because the intruder is still alive. Size or caliber is not the problem here it’s accuracy. Just having a weapon in your position will not guarantee a positive outcome.

Note the following. Name and picture of the perpetrator/criminal/felon are omitted from this article while name and picture of the victim are present. Age is mentioned for both although the emphasis of the perpetrators youth is sprinkled throughout using the words teenager, teen, minor, and boy (using the word “boy” four times). Senior citizenship of the victim is omitted. The health of the criminal is emphasized. The health of the victim is omitted. Read this again, then read the source articles, then think about it for awhile. This is brainwashing, not reporting.     A generally good story, but the homeowner screwed up. The perp survived, so now he will probably be subjected to politically motivated legal persecution, complete with the kindergarten graduation picture, etc.
    And woe to him if the criminal claims some sort of disability from the shooting.
    Lesson: intruders that get shot should not survive the experience. That is the best and only way to insure that the truth is told about the event, and that it is not obscured but imaginative lies.

      WRONG! You know the difference between right and wrong way before you are 16 years old. It’s not the little thugs parents fault, even though he probably doesn’t even know his ‘baby daddy’s’ name. Sadly, he probably won’t learn a lesson from this and will pick up right where his thug life left off and he’ll probably end up on a slab in the morgue – or put an innocent person on the same slab. Maybe the next time he’s double-tapped it’ll be with a larger caliber weapon with properly placed hollow point rounds.
