Pelosi: Criminalizing Private Transfers Will Be Dems Top Priority Following Midterms

A lot’s at stake this November. If the Democrats win the House — political forecaster FiveThrityEight gives Dems an 81 percent chance of taking control following the midterms — Nancy Pelosi (D-CA) promised that criminalizing private transfers will be a top legislative priority.

During a sit-down this week with U.S. Rep. Ted Deutch (D-West Boca) of Florida, survivors of the Parkland massacre, and gun control activists, the House minority leader spoke about both the importance and political feasibility of enacting universal background checks.

“What saves what saves the most lives is the background checks — keeping guns out of the hands of people who should not have them, whatever the weaponry,” said Pelosi who also expressed support for banning modern sporting rifles in a video posted by the Sun-Sentinel.

Pelosi indicated that there was bipartisan support for universal background checks, which would make it unlawful for one private citizen to transfer or sell a firearm to another private citizen.

“The people will want us to consider what this bill will look like. We have a bill right now that is bipartisan,” Pelosi said explained. “This will be a collaboration and will be a consensus to have the bipartisanship we need to build on the legislation.”

Korwin: Here’s Why You Need Oppose Universal Background Checks

The last bipartisan universal background check bill to gain steam in Congress was drafted by Sens. Joe Manchin (D-WV) and Pat Toomey (R-PA). Known as the Manchin-Toomey amendment, it was defeated in the Senate on April 17, 2013, falling six votes shy (54-46) of the 60 needed to overcome a Republican-led filibuster.

Nationwide 20 states have background check laws tougher than the federal standard, 11 of which criminalize private transfers for the sale of all firearms, according to the Giffords Law Center.

The National Rifle Association has vehemently opposed expanded background checks. In an NRA-ILA post dated August 8, 2016, the gun lobby laid out all the reasons to oppose amending the law:

  • NRA opposes expanding firearm background check systems, because background checks don’t stop criminals from getting firearms, because some proposals to do so would deprive individuals of due process of law, and because NRA opposes firearm registration.
  • Background checks don’t necessarily stop criminals from getting firearms. Federal studies have repeatedly found that persons imprisoned for firearm crimes get their firearms mostly through theft, the black market, or family members or friends. Less than one percent get guns at gun shows. (Bureau of Justice Statistics)
  • Most mass shooters, including those inspired by Islamic terrorist groups, pass background checks to acquire firearms.
  • ATF has said that nearly half of illegally trafficked firearms originate with “straw purchasers”—people who pass background checks to buy firearms for criminals. The terrorists who attacked in San Bernardino in 2015 allegedly got firearms from a straw purchaser who passed a background check.
  • Federal law requires firearm dealers, regardless of location, to initiate a background check before selling or otherwise transferring a firearm to a person who is not a dealer.
  • There is no “gun show loophole.” Federal law is the same, regardless of where a firearm sale takes place.
  • There is no “online sales” loophole. Federal law is the same, regardless of how people communicate about selling/buying a firearm. Federal law prohibits anyone— licensed firearm dealer or not—from shipping a firearm to a person who lives in another state, unless that person is also a dealer. Dealers must document all firearms they receive.
  • There is no “Charleston loophole.” The National Instant Criminal Background Check System (NICS) has three days to determine whether a person is prohibited from acquiring a firearm, to prevent arbitrary delays. If the FBI thereafter determines the person is prohibited, ATF recovers any gun inappropriately transferred.

    How many firearms have been used in crime that were legal individual to individual transfers? If a criminal wants a gun, I am sure the seller is going to run an instant background check before they sell it to them. OK, so the government has buttoned up the background check, purchase trace on all firearms. After the mass murder and the shooter is dead, they can now arrest the last person on the firearm register. That really saved a lot of lives.

    Nancy, please step out of your fantasy land. Spend a weekend or so in Chicago, NYC, Detroit etc. without your trusted, armed body guards.

    Better yet, take a walk to a convenience store after dark for a coffee or bagel. Get back to us on if you feel safe alone, (w/o security that only you can afford or have the govt. provide)

    Oh, wait, ban and collect all guns, that will work. Honest citizens, criminal, drug dealers, or gang banners. I’m sure we’ll all be much safer with your ideas. Hell , it worked for Stalin and what is that guy’s name, from Germany, with a mustache ?

      I’m from Chicago.. anytime they come to the city it is always to the wealthiest sides of town, with armed details. How about they spend the night in the bad parts of Chicago. In all the gun free zones (target rich environments) that they have created. Democrats like this ignorant cunt are the reason for violent crime. Maybe not directly, but they drive the poverty, the racial tension, and the division of the classes. They are the keystone of animosity in our country. They are the reason that prison is no longer a deterrent, but an option.
      Bring back capital punishment, cut entitlement benefits (from the bottom, not social security and Medicare), give more incentive for employees to work and be retained, cut the fucking salaries of elected officials and athletes while you’re at it, and cut taxes. You will see a change.

    I have been thinking about this article since my last comment. Something clicked. This is a backdoor disarmament scheme. If they criminalize private transfers, they lay the foundation for disarmament with an outright ban. There will be no more give away or destroy clause. It will be destroy or surrender. No more buy back programs, no more leaving them with family out of the jurisdiction. They can literally break you to their will.

    Maybe I’m late to that party of foresight, my apologies. But that would be the logical next step for an illogical communist dictator.

    I think the Democrats have given up on passing bills on criminals. It’s easier, more vocal and rallying to pass laws on our 2A rights.

    Apparently , as we live by the laws of the land regarding the 2A, we are softer targets. Criminals will , by definition, are crime generators. No bill or law will mean two shits to them. It’s the law abiding citizens who must decide on whether to join them , or not?

She and her democommies want semi auto guns bans, magazine restrictions, registration, waiting periods, police fingering printing for gun purchases, and banning SHALL ISSUE on carry conceal licenses and permits.     How many guns, collected by the police after a crime, have been traced back to a private sale? Shouldn’t this be known before considering such a draconian law? Gun shows are a minor source of crime guns, about 2%, private sale numbers can’t be much different than that.

    “Being the son of a WW2 Navy Officer and Police Captain I was raised to respect and fear guns, especially the ones my father kept locked up at home. Consequently, I never owned a gun until the 1980’s when unarmed sailing friends of mine were massacred by local thugs in the Bahamas out islands. Since my brother and I sailed often, I bought a rifle and a shotgun to carry on the sailboat just in case. My have things changed and I never dreamed that I would ever considered carrying a gun on or near me on a day to day basis. Working mothers, fatherless families, abrupt racial integration, lack of religious training and left wing teachers have all contributed to a reduction in moral values and a major increase in violence in America. Also, while we were sleeping, Hollywood, Television and most American newspapers have been taken over by rich left wing agitators who now use the “news” to slant and misinform public opinion. This must be stopped since lies and slander are not protected by the right of free speech. Please note that the people most vocal pressing for gun control and gun bans are the same people who pay for armed security guards and can well afford to have own large estates with high walls, guard dogs and electronic surveillance.     Many moons ago, I was a Democrat voter. I voted Republican too at times but overall, I sided with Democrats. That was before I really understood the left and right side of political spectrum. I was young and voted on the issues, thinking that mattered. Over time, I realized I was more Libertarian, minus the taxation is theft nonsense. Then Obama came and was successful at exposing the Democratic party for what it was: anti-american. I grew up during the Cold War. I joined the USMC and “Ivan” was the enemy and spent time in Infantry School memorizing silhouette ID charts of Soviet tanks and AFVs, aircraft and now Democrats are openly advocating for socialism (communism’s predecessor)?!?!? They openly advocate for repealing the Second Amendment, eliminating our international borders???? W. T. F. !!!!!!!!!!

    Now, the idea of voting Democrat makes my stomach turn. They are so anti-American (the America I believe in) that I am slowly seeing them as traitors. I have a gay sister, I am pro-choice, I am anti-drug war, I should be a Democrat, but Democrats no longer believe in the American dream, they believe in a Communist system where they are in control of every facet of your life, how you think, what you believe in.     Pelosi shows she is senile. The Parkland shooter passed a background check. He LAWFULLY purchased his weapon. A universal background check would not have prevented that tragedy. The same with the Las Vegas shooter. The shooter in Sandy Hook took the guns from a locked gun safe. Guns he mother LAWFULLY purchased. Pelosi is either stupid or senile…or both.

      Exactly… A background check, no matter how thorough, can not prevent a criminal act from taking place. As soon as a criminal act is perpetrated by an individual, no matter how clean their record is, they become a criminal. Therefore they can no longer be counted amongst the law abiding, period.

    The key wording here is Private! Meaning it’s none of your damn business! I don’t know anyone that sells a firearm privately who doesn’t ask for ID and that means picture ID and make note of it just in case to protect themselves. Most people I know don’t sell to total strangers in the first place and usually are friends, or friends of a friends they sell to!

    Yes serial no. model + make goes into dealers private records.
    IF then reported stolen then those records can go to LE in a report so future ID can be made.
    However all stolen guns by the 10\’s of thousands are out there in someones hands likely felons- who won\’t giv\’em up nor report them.
    Not to forget guns brought in from other nations via the black market.
