Police Confiscate 88-Year-Old Woman’s Gun After She Shoots To Defend Liquor Store

May Boyce, 88, owns Murfreesboro Road Liquor and Wines in Nashville, TN. 

Last week Boyce shot a man she believed was trying to rob her store.  Local police are now charging the octogenarian with aggravated assault. 

In talking with media, Boyce believes she acted within the law to defend herself and her property. 

“I did what I had to do, and I hope word gets out on the street that I’m fed up and I’m not taking it anymore,” she told The New York Post on Saturday, when she returned to work after being released from jail on a $10,000 bond.  

“You’ve got to stick up for yourself sometimes,” she added.  

Authorities, on the other hand, tell a different story, according to an affidavit obtained by the McClatchy News Service.  The man Boyce shot, identified as Ramon Fisher, initially told police that he was high on cocaine and alcohol when he entered the store with the intent to steal some bottles.  Fisher was accompanied by a buddy.

However, the next day, Fisher recanted, telling investigators that he and his friend planned to pay for the booze after all. No charges have been filed against those two “customers.”

But, it looks as though prosecutors believe they have enough evidence to hold Boyce criminally liable.  Hence the charge she’s facing for aggravated assault.

Boyce maintains she was being physically threatened by the two men and that she didn’t intend to actually harm either one when she produced her late mother Mary’s .38 caliber Smith & Wesson snub-nose revolver.

“I never shot a gun before,” Boyce admitted, “but I guess it’s something that comes natural. I aimed at the floor to scare him.”

Boyce, a widow who stands 5’3″ and weighs 115 pounds, told WSFA12 that this is not the first time she’s had to fend off would-be thieves over her 26 years in business. 

In fact, the latest incident happened just days before the confrontation with Mr. Fisher.  Two individuals tried to steal an entire case of liquor.  Boyce pursed the thieves with a club.  

“I was going to break it before, you know. I’d let them have it, I thought, but instead they just knocked me down outside,” Boyce explained.

All in all, it appears this little lady is tired of being a target.  

“After you’ve been played for a fool by people stealin’ from you for years, you get fed up. And don’t put me in the category of a little old lady. I know how to take care of myself.”

Though she’s no longer scared to engage criminals, moving forward she’s going to do so without her gun.  Police confiscated it and told her it may take up to two years before it’s returned. 

“I told ’em, s–t, I might be dead by then,” Boyce told the New York Post. “But the law’s the law.”

    You know, after dealing with a legal issue for several years, finally getting it resolved, attorneys sit on their asses a lot, they hang around the courthouse waiting for the judge to do something at my 300 bucks an hour, they have a staff that does all the leg work. So, in a town like Nashville, why is there not one pro-gun attorney who would just step up and defend this woman gratis, to both save her from the gears of the machine, and defend 2A rights?

    If one thing is clear, know that if you defend yourself with a gun you better be able to prove your life was in danger. Your behaviour will often be scrutinized more than the person that tried to harm you. Just telling police “I thought this” or “I thought that” won’t cut it.

    So the perp admits they intended to go in and steal…..then later recants probably after speaking with an attorney. So her “legal” recourse was to allow this to unfold and hope they did not cause her any bodily harm or kill her. Why is it the innocent civilian has to wait and see what the criminal decides to do and then be allowed to react. The out come is always the same the innocent suffer the greatest loss. You know why this doesn’t happen in other countries with firearms or why it didn’t go over in the past, because criminals knew they were likely to be shot. I’m not advocating shooting everyone for any reason but I am frustrated that the law protects criminals and punishes innocent victims for reacting to poor choices made by people.

    This 88 yr old lady should NEVER been arrested! These two druggies entered her store with the intention of stealing or robbing her and would have had she not pulled out her gun. Instead of arresting the two thieves they arrest her AND she has a $10,000 bond placed on her! She IS NOT a flight risk and should have been released on her own recog!

    Aggravated assault is a felony. This 88 year old granny may lose her state liquor sales license, her city business license, and her freedom. If she has an otherwise clean record, they will probably plea this down to a misdemeanor and probation, but she will very likely lose her licenses and livelihood. If she had articulated a reasonable fear for her life or great bodily harm as the reason for using deadly force, it’s not likely she would have been charged. In most cases, you cannot legally use deadly force to protect property.

    Ms. Boyce did the right thing, the LEOs are wrong. She was outnumbered and had to face a clear and obvious disparity of force and was right to use deadly force. If it was a cop in that position you can be certain the perps would be dead with back-up on the way. When, if ever, will people wake up to the fact that we all are on our own?

      The way the law is written now is in favor of thieves and criminals. We need to change the laws to be in favor of the property owners and victims of crimes in all situations.

      A single law could change all this and also do away with civil cases against those who act in self defense. This law with 3 simple sentences would end the issues of law over justice.

      1) Any person who is harmed while in the act or commission of a crime, is the responsibly of the criminal.
      2) Any and all damage to property that occurs during the commission of a crime, shall fall entirely upon those committing a crime.
      3) Property owners (or their chosen representatives) shall be within their rights to act to protect their property from any and all criminal activity on their property, with any force required to stop the criminal activity being authorized.

      We need to have justice enforced not merely law. While this lady’s case may be a violation of the current law, it is a miscarriage of justice arresting this woman for defending her livelihood, property, and possibly health from these criminals.

After the court costs and probably a followup civil suit, she’ll wish she had just sold her store and retired before all of this. She now stands to lose her livelihood and spend some time in jail. Nashville like Asheville and Austin are all liberal bastions and an old lady with a gun is a threat to them.

As if somehow their in the wrong for returning fire to a criminal who was in the wrong to start with, wrestles the police in a lawful arrest, steal their tazer and shoots at police. Now because he was running away as he turns back and fires at police they should not have returned fire??
      Thank God those police returned fire.
      Ask ourselves, what would have been the outcome if the police had let him go, the criminal then encounters a woman and her small children (maybe our loved ones) a block away and car jacks her?? Then he decides a mile away, he doesn’t want any witnesses or while making a high speed retreat wrecks the car, killing the woman and the children?

      At that point the officers are then charged with cowardice and fired (at minimum).

      The cops can’t win, especially with the liberal media constantly convicting them in the court of public opinion. But heck, these riots make for plenty of news to fill their 24 hour news machine. Isn’t that what really matters?

        Nice try but those are two totally different things. This lady was trying to protect her property which I think she should have been able to do vs what those cops did which was escalate a situation.

        No one should ever die over a drunk driving charge. If the guy was so drunk that those cops felt like he couldn’t drive then obviously he also didn’t have the mental state to make good choices either. They should have let his dumb butt run. They had his car and knew where he lived. Who is he going to harm if they don’t detain him right then? I’m sure he would have realized what he did when he sobered up and turned himself in or they could have met him at his door with a warrant if he didn’t. You don’t pull a gun on someone and shot them in the back if they are running from you. A citizen I would give more leeway on this but as a cop you are supposed to be a trained professional able to use some common sense about the situation.

        As a long time resident of Atlanta I know that there are cops on the job that have this Rambo attitude and it goes back to the days of the now disbanded Red Dog squad.

        Those two cops are hopefully going to get what they deserve and spend sometime in a cell to think about the life they took for no good reason.

          He didn’t die for drinking drunk. He died because he violently resisted arrest, concussed one of the officers, stole a weapon, and used the weapon. If he incapacitated the officer with the stolen weapon, he could have easily stolen the officers pistol and executed him. He became a threat to the lives of everyone in the vicinity when he resisted arrest. Being drunk and making bad decisions doesn’t make someone harmless.

          Your argument is foolish and half baked, disregards important facts, and lacks critical thinking, and common sense. You sound like an Everytown shill.

          I have to disagree about the cops. They did t escalate anything. The drunk decides to resist and fight with the officers and swipe a taser and try to taze the officers. The guy is drunk and fighting the cops… who knows what his intentions are if he tazes them. That’s all speculation. Fact is, he fought and took a service weapon from the officer and fired it at the officer. That’s fact.

          First if you watch the video of the two officers, everything seems calm until the handcuffs are started to be placed on the drunk. HE is the one that resisted. HE is the one that started the fight. HE is the one that took the taser from the officer. HE is the one that turned slightly while running away and HE is the one that fired the taser at the officer. And the ass hat DA said just a week prior that a taser IS a deadly weapon. It is less lethal but still lethal non the less. During our taser quals we are never to shoot it at anyone in the chest area because they have caused cardiac arrest.
          You are correct in that no one should die for being drunk unless you bring a taser to a gunfight.

Those Officers in Atlanta were COMPLETELY JUSTIFIED in shooting that guy as he was arme and fired at the Officer. The Officer that shot him had just suffered a concussion from having his head slammed against the paved parking lot and while chasing him had his taser out but when he say the flash and heard the noise he thought to be a gunshot he transitioned to his firearm and returned fire. All of which is perfectly justified according to law.

        The issue in the Atlanta case is that 1) he took a tazer, not a firearm. A tazer is not legally considered a deadly weapon. That has been the law since the 1960s. Thus the force used by the police officers, given the facts presented, was excessive.

          That is absolutely incorrect. A taser is considered LESS LETHAL. If shot in the face a taser can easily lead to death and oddly enough when that joker turned around, he was aiming towards the officers face. I’m pretty sure the taser didn’t exist in 1960. But nice try.

          Alan – you are ignorant of both the law and the tactical dynamics of deadly force encounters.

          Under circumstances when the taser is used AGAINST a police officer, having been stolen off the duty belt of a police officer by a violent felon who violently attacked two police officers and resisted arrest, the taser as employed poses an imminent threat of death or serious physical injury. Why? Because if employed against the officer it is likely to incapacitate the officer, making his weapon available to a violent felon who has already shown a propensity to violently steal weapons from the duty belt of police officers. As such the individual poses an imminent threat of death or serious physical injury. Whether the taser is considered a lethal weapon or not is legally irrelevant. The target wasn’t the taser, it was the individual wielding it in a manner that was, under the circumstances, likely to cause death or serious physical injury. Had the cop been successfully engaged with the taser it is reasonable to believe that he was facing an imminent threat of death or serious injury. The law is actually very clear on this when you consider both the law and the tactical dynamics.

          Again this is whats called assessing the situation and making a correct decision regarding the situation.

          This guy was drunk which means he wasn’t in his right mind to begin with. If he starts resisting why even wrestle with him to begin with? He does not have a weapon at the point that they begin fighting, he isn’t showing any signs of posing a threat to anyone if they dont arrest him right then. If they decided to let him run after he resisted, again what is he going to do? Probably run home, sleep it off, then realize that he made a huge mistake.

          As for the facts of the case, he did take a taser. As Mr, Walker above pointed out, which is a non lethal weapon. The second fact is that he fired the taser and MISSED. At that point the taser is no longer a threat to anyone. The third fact is that he turned to run AFTER he missed the officer with the taser and was shot IN THE BACK AFTER RUNNING. There was no imminent danger to anyone after he missed since he did not have another weapon.

          By the way, thanks for the insults from some of you. That is always a sure fire way of know you are winning an argument.

            You are false. After a tazer is fire it is still usable. It can be used as a stun gun with the 2 probes @ the end of the tazer. So running off & car jacking is a very high posablity.           A taser is a less lethal deadly weapon. The ones in the sixties are far less then the more modern ones. And Ga law says they are considered a deadly weapon.
          Have you been shot with a taser? it incapacitates the the person so if he would have hit the officer he could have conceivably gotten his gun.

        OK, hear’s what everyone seems to be missing. The drunk hadn’t broken any laws and should not have been arrested. He told police that he had left the rental car at the Wendy’s and been driven to a party and then was driven back to the Wendy’s and dropped off. So, he had only driven on private property as far as the officers knew. The officers, therefore, had no legal cause to arrest him.

        So, what should have happened, cops should have offered to call Uber or Lyft for him and told him he could pick up the keys to his car at the police station in the morning. Basically, “No harm, No foul” should have been the only “law” invoked in this instance. Instead, a man is dead for no good reason. I don’t usually side with criminals but there really was no need for this at all.

          DWI and DUI laws are enforceable ANY TIME that you are behind the wheel ! It does not matter if you are on private property or on a public street. He has the same ability to harm himself OR SOMEONE ELSE if he is DUI or DWI in a Wendys parking lot , or on a public street. ALSO, YOU FAIL TO REALIZE THAT THEY WERE CALLED TO THE SCENE BY THE WENDYS RESTAURANT AND HE WAS BEHIND THE WHEEL OF A RUNNING VEHICLE !

    She’ll be fine. All she has to do is claim qualified immunity, and she was in fear for her safety. She’ll be put on paid leave, other liquor store owners will investigate, and in a couple weeks when things quiet down she can go back to work because they’ll say it was a good shoot.

      Private citizens cannot claim qualified immunity. That only applies to government officials in performance of official duties. She is now open to civil liability in addition to criminal prosecution.

    Just for record: I’m a former LE officer and now own a private security company that operates in and around Nashville. There is one very important fact left out of this encounter – she shot the man (3) times in the back as he exited her store. If that had been me or one of my people, there would be multiple charges and a helluva lot worse than aggravated assault. Think attempted murder and a hate crime.

      That’s probably the most important fact. Why, I wonder, do they leave out facts like that? After reading the story, I was leaning towards a store employee confronted by drugged up idiots and she feared for her life. When I read your comment about shooting him three times in the back as he was leaving, I quickly revised my thinking that it was a crazy old woman with a gun.

      We in the pro-firearm community need to ensure we stay within the law as the liberals continue to pass legislation to criminalize the victim and victimize the criminal. This is the lawlessness we see regularly out here in CA. It is bad and getting worse.

      As a 88 year old woman, she probably did fear for her life. But she unfortunately placed herself in a gray area for avoiding charges. If they had weapons and she had lethally fired upon them while they were facing her, I think her situation may have been different. She gave the left the opportunity to capitalize on their anti-gun mentality, and placed law enforcement in a predicament where they had to charge her.

      We need to be smart, know the law, have a plan on what to do when we defend ourselves, and ensure we make it easier for law enforcement to side with us. As the liberals continue to push lawlessness forward, we will have to be more diligent to avoid going to jail for legally protecting ourselves.

      As far as “facts,” at least in this article it describes her firing a shot at the floor as a warning. Where do you get her shooting the suspect 3x in the back? Nevertheless, I understand that you’re one of those who like to coddle criminals and protect their “rights,” while doing their utmost to stick-it to honest citizens.

        As I stated in my initial comment, I live right outside Nashville and work security in the same area her store is located. The guy she shot had picked up multiple bottles of liquor and was exiting her store – this is known as a SHOPLIFTER for all you law and order types that support what she did. You would also be charged right along with her if you did the same in ANY jurisdiction. My personal opinion of him, his theft, her or her actions have nothing to do with anything. For the record, I’m as pro-2A and as conservative as they come, but this incident isn’t about that – WE ARE NOT ALLOWED TO SHOOT SHOPLIFTERS !!!!!!!

          You are completely correct !! There’s a wildly popular bumper-sticker around Nashville that says :
          Thanks for visiting Nashville, now go GO HOME”. It stems from the fact that Nashville has always been, but slowly changing to “WAS” a tourist town. Now we are being flooded with “transplants” from major liberal hell holes and they’re staying. Property prices have and continue to skyrocket. Nashville and Memphis are liberal strong holds, but the rest of the state is reliably conservative. For now anyway. This damn “WooHoo flu” is changing that fairly quickly – people are leaving large cities in droves and LOTS of them are landing here, as well as other less populated places. Sadly they bring their liberal ideals AND VOTES with them. Therein lies the biggest problem.
