Pro 2A Group Threatens Lawsuit to Stop San Jose’s Gun Owner Tax & Liability Scheme

Leaders in San Jose have yet to unveil the details of their 2A tax and liability scheme on responsible gun owners, but that hasn’t stopped one pro-gun group from stepping in with a stern warning.  

The National Foundation for Gun Rights (NFGR) this week sent a cease-and-desist letter to the San Jose City Council, Mayor, and City Attorney threatening legal action if they proceed as planned.  

“Please be advised that should you pass the proposed ordinance and blatantly violate the constitutional rights of the residents of San Jose, my clients have authorized our firm to file a lawsuit against the City to protect the constitutional rights of their members,” San Francisco-based attorneys David A. Warrington and Harmeet K. Dhillon, who are representing NFGR, wrote.

But SJ Mayor Sam Liccardo didn’t seem too concerned with the letter, indicating that he expects his agenda to prevail in the courts.   

“In the realm of sensible gun regulation, the gun industry and their lawyers ensure that no good deed goes unlitigated,” Liccardo said in a statement Wednesday. “I suppose that I should not be surprised that they have threatened to sue the City before they’ve even seen a single word in the ordinance.”

As GunsAmerica previously reported, the San Jose City Council approved all of the mayor’s proposals back in June, including:

  • Liability Insurance Mandate
  • Tax on Gun Owners 
  • Red Flag Confiscation
  • Ban on Ghost Guns
  • Video and Audio-Recorded Gun Sales
  • Background Checks for Ammo
  • Encouraging Public to Report “Explicit” or “Implied” Threats
  • Gun Buy-Back Programs 

“This a full-frontal assault on lawful gun owners by the gun control zealots running the city of San Jose,” said Dudley Brown, Executive Director of the National Foundation for Gun Rights, in a press release. “The city brazenly admits in their own press release that the burden of extra insurance and fees will ONLY be on the law-abiding.”

“Punishing law-abiding gun owners for the actions of criminals is the kind of insane behavior (the foundation) has come to expect from bureaucrat gun control idiots like the ones that run San Jose,” Brown continued.

While mayor Liccardo’s plan is meeting fierce resistance from the pro-2A community, the Biden Administration greeted it with open arms.  In fact, Liccardo was invited to the White House earlier this week to meet with the president.  

Liccardo had this to say about the trip, “This is a hopeful moment for me, an opportunity to be able to hear from colleagues from throughout the country and most importantly to be there while the President is hearing them.”

“The president demonstrated he was passionate about this issue; he’s very concerned about what’s happening on the streets of big cities throughout the country,” Liccardo continued. “He is really committed toward every prong of the strategy that we articulate around prevention, around intervention, and getting police out there in the street, as well as community-based public safety solutions.”

In other words, Biden would love to take the San Jose plan national, forcing all states to adopt gun owner liability insurance, taxes, and all the rest.

    What is it about antigun elected politicians that attempt to infringe upon the constitutional rights of law-abiding gun owners? Is it due to the fact that they have never been able to adequately control the criminals, but choose instead to punish lawful gun owners for the crimes committed by those criminals?

    These types of minor elected officials are afraid to admit they are completely powerless to stop criminals and instead choose to punish the law-abiding people with unconstitutional rules and regulations, which are themselves unlawful in their application over the innocent population. There is no greater crime than punishing the innocent for the criminal acts of others, especially by insane lawmakers who do more harm than good and should be voted out of office for trying to infringe on our inherent ability of self-defense.
    To this the people just need to say NO!

    Good idea to do what san Jose wants to do , except now there is no reason an individual can be denied a concealed carry permit because they will insurance , tax will be paid so as long as a training session then all those that want to carry a handgun can ….good move

    This should be a no-brainer. The US Supreme Court long ago ruled that no state has the authority to tax or license a constitutionally protected right. The 2A clearly says the “right to keep and bear arms” shall not be infringed. Taxing gun rights is a blatant infringement of those rights. The affected people of San Jose should simply ignore any such infringement and thereby nullify any such unlawful tax. The people of San Jose should consider the actions of their elected officials and take measures to dismiss those who would infringe upon their protected rights.
