Rhode Island Bans ‘Ghost Guns’ w/ 10 Year Prison Sentence for Violators

Rhode Island banned so-called “ghost guns” this week in an effort to “prevent gun violence.”  

Anyone caught with a “ghost gun,” by which they mean 3D printed guns, gun kits with 80 percent lowers, and unserialized firearms, 30 days from now will face up to 10 years in prison and/or a $10,000 fine.  

“Banning ghost guns and untraceable firearms in Rhode Island is a major victory, but our work doesn’t end here,” said Gov. Gina Raimondo in a post on Facebook. “We will keep fighting to prevent gun violence in our state.”

(At present, there is no way yet to know how often “ghost guns” are used in crime because neither the DOJ nor the ATF tracks crimes committed with “ghost guns.”)

Last week, the Democratically-controlled General Assembly passed the measure with overwhelming support.  

Sen. Cynthia A. Coyne, D-32, who sponsored it claimed that these “guns can easily facilitate criminal activity because they totally bypass the safeguards that protect the public.”

She added, “Our state laws should be very clear that possessing, creating, or selling them is a criminal act, and we should be doing everything we can to keep these dangerous weapons from proliferating here.”

Owners of “ghost guns” will have 30 days to serialize their firearm after that they become contraband, according to local media.  Though, how the state of Rhode Island wants citizens to go about doing this is not exactly clear.  

Per the ATF, licensed manufacturers or licensed importers of firearms must mark each firearm with an individual serial number.  But firearms made by individuals for personal use do not require serial numbers or identifying markings.  

As GunsAmerica reported back in May, gun control advocates launched a nationwide campaign urging lawmakers at all levels of government to “ghost guns.”

Rhode Island has heeded that call.  It may be just a matter of time before more states follow suit.

    1. Pass an anti-gun law, and everybody goes out and gets one before they can’t get one any more. This just means that the “streets” will be even LESS SAFE, because the unwashed liberals who don’t understand guns and gun SAFETY will now be armed!
    2. Make it illegal, and people are going to try it; especially the computer-savvy “kids” who will now want to make a 3-D gun on their computers. (And with the newer materials becoming available, those guns are going to become more prevalent and they are going to hold up under use.)
    3. CRIMINALS DON’T CARE! A new law isn’t going to deter them.
    4. EVEN IF THIS WORKED, it still wouldn’t stop the illegal manufacture of guns. Even at the age when I was in junior high school (early 1960’s) I had already learned how to make gun powder from a book called HENLEY’S FORMULAS which I had borrowed from the local public library, and had actually made some. Add to that, (though I never did) I knew how to make a zip gun in my machine shop at school. — Of course, back then, our public high schools still had rifle clubs, so there was no need to make them. Our rifle clubs had teams and competed in wholesome sports (just like basket ball and foot ball —- with less [no] injuries.) —- POLITICIANS MADE SCHOOL RIFLE TEAMS ILLEGAL, TOO.

    I’ve been making about 20 of these per day, mostly .44 Magnum and selling them to some guy named E. Holder and he says that he’s been selling them in Mexico. He says there’s a big market for them down there.

    Are they aware that some .22 rifles legally manufactured and legally sold and purchased in the 1920s and early 1930s DIDN’T have serial numbers, this could include semi-automatic as well as single shot rifles. I guess ignorance of the facts is OK if you are an ANTI-GUNNER.

    This legislation will do NOTHING to protect the citizens of RI. It’s only purpose is to attempt to put an END to a new cottage industry of “Home Built Pistols”. It will not stop the industry though…as the business will carry on and by simply placing a serial number on the 80% receiver. A very simple process…that also can be done in a few minutes……..Now here is the question….even if the guns are serial numbered….what means does the state have to record and track these numbers. The worst that will happen is that these businesses owners who build these pistols will move their businesses out of RI…..ooooo….now they might have to drive 20 minutes to get to their business…..RI is not that big of a state.
    As for the guns that the police confiscated that were without a serial number…….no need for a new law….
    There is already a Federal law ( Felony) for the dealer/maker…..you may build a firearm without a serial number legally……but if / when you transfer it to someone else…it must have a serial number and all the appropriate federal paperwork and background checks must be done. So…ummm they are not really making anyone safer….it is clear here that the ONLY people that are targeted here are the business owners that have these build-it-yourself kits for people. But again…it’s going to be so easy for the business owners to either serialize these parts…or simply buy 75% completed guns that business WILL continue! Other business owners will simply move out of state. Either way…SHAME on the RI people for letting these politicians pull such a political stunt like this….without any checks and balances…..RI you are sheep…..dumb sheep being herded by those who take advantage of you

    Three cheers for Rhode Island. We know need a Federal ban on Ghost guns as they are a major source of weapons for the Paramilitary Lunatic Fringe, Maniacs and dope gangs. If you are a law abiding citizen there is no need whatsoever for a ghost gun or a non-vetted gun. There should also be a Federal law mandating every gun sold be vetted first. The Chicago Study and others like it proved that guns used in crime were on average 13 years old and had been sold unvetted to many individuals until they ended up being used in a crime. And States with lax gun laws have been prove to send thousands of second hand unvetted guns into states with tough laws which nullify their tough laws.

      ‘Ghost guns’, like registered firearms aren’t the problem. It’s the criminals that get their hands on them. The number of legally registered firearms in the hands of criminals FAR outnumbers the number of ‘ghost guns’ in their possession. They have been stolen, purchased on the black market, etc.

      Take away the ‘ghost guns’ – in fact, take away every known registered firearm in the country – and you be be assured that criminals will still find a way to get them. If they can’t, they can still rape, murder and pillage with hammers, steak knives, U-Haul trucks, etc.

      That is the problem with ridiculous, knee jerk laws like this one. No criminal will register them and no criminal will be deterred by the jail sentence – they never have.

    Never mind from 1492 to 1968 all firearms made in the USA did not require a serial number. My dad bought me a nice Mossberg Target rifle, Model 304B in 1966 for my 11th birthday. No serial number. I feel sorry for the kid living in Rhode Island who’s grandpa leaves one to him.

      The most recent Court decision on incorporation came in the 2010 case of McDonald v Chicago, involving a challenge to Chicago’s tough gun control legislation. Just two years earlier, the Court had ruled in a case challenging a District of Columbia gun control regulation that the 2nd Amendment guaranteed an individual right to bear arms. In McDonald, the Court held that the 2nd Amendment right was thought by ratifiers of the 14th Amendment “among those fundamental rights necessary to our system of ordered liberty” and is enforceable therefore now as a right fully against the states. Justice Thomas, concurring, argued that the better vehicle for incorporation, one truer to the original understanding of the 14th Amendment, was the Privileges and Immunities Clause.

      In summary, the Second Amendment forbids federal gun control and the federal government should attack state and local gun control laws in court because of the 14th Amendment, because the 14th Amendment makes the 2nd Amendment applicable to the states. This is what the Supreme Court ruled, and there is nothing in their rulings to the contrary.

    What if you possess a 80% Lower or a pistol that hasn’t been machined into a firearm, would it still be considered illegal ? In my opinion until a 80% Lower is machined into a firearm it’s a paper weight. It might be a good idea to purchase all the parts needed to build a weapon and keep them in a safe place just in case. Democrats will then have to ban and confiscate drill presses and all other tools of mass destruction .

      An interesting suggestion, but let me ask you a question. The 2nd amendment warns public officials that they must adhere to the original Constitution. The original Constitution commands that there must be Militia in accordance with LAW and HISTORY. It is not voluntary as it requires that all able-bodied men 18 – 45 are organized, armed, and disciplined in order that they may exercise their authority “to execute the Laws of the Union, suppress Insurrections, and repel Invasions”.
      While the individual right has to be part of the equation, the Framers made it clear that sovereignty was in the hands of the people as the constitutional “Militia of the several States”.
      Why not start by prosecuting the proper suit in law that would allow the indictment, and prosecution of public officials who violate the “rule of law”?

      What about obliterating existing serial numbers? What difference does it make. Serial numbers prevent crimes? I suppose the people of RI are so brainwashed they think she accomplished something?
      They tried it in CA years ago and it failed because they couldn’t get the idea to work with so many unknown manufacturers. What exactly is the plan to record all these serial numbers? This is written by a 32 year old kid without any sense or knowledge on how to implement it. Even if they could it wouldn’t change the criminals as they don’t go by laws. As always.

      EXACTLY! The problem is schools rarely if ever teach this anymore, even here in Wyoming. Rather, under what I call “Communist Common Core”, they are taught, ” … the Second Amendment gives people the right to keep and bear arms PROVIDING THE GOVERNMENT APPROVES AND THEY REGISTER THEIR GUNS [EMPHASIS added].” That is an exact quote from “CCC”. I know because I retired from teaching a couple years ago and made it a point to tell my students that definition is total bull. Another “teacher” told the kids the “well regulated militia” was the National Guard. I corrected him in front of his entire class and told him the National Guard was 100 years old. The year was 2016 and the 100th birthday of the National Guard. The “militia” is WE THE PEOPLE. Needless to say the socialist studies indoctrinator was not amused but the students were thrilled! It is up to parents and grand parents to teach today’s school kids the TRUTH about the Bill of Rights. They need to be taught about the Battle of Athens, Tennessee [1946]. Google it and then share it throughout social[-ist] media; ie FASCISTBOOK.

    While the country is pulling down statues of people that had something to do with slavery or other monuments that may have offended someone the democratic party keeps pushing for more…but they are part of what is wrong. The democratic party needs to be banned. They once fought to keep slavery and still to this day run cities that run off of fear and oppressing minorities. Keeping people scared and ignorant is the key to their power.

    Federal law supersedes state and city laws so how and why can they do what ever they want. Federal law is governed by the constitution of the United States. If Federal law says its legal then no state or city can override.

        Interesting you mention cannabis prohibition. The federal government doesn’t do anything because the federal government is in direct violation of the Constitution in both of these subjects. The only difference is that guns are mentioned in the Constitution, but cannabis isn’t. The entire cannabis prohibition is a fraud perpetrated by the government for several reasons: 1) to support the big pharma corporations because cannabis solves a plethora of medical ailments but cannot be legally patented, 2) support the lobbying from the cotton and forestry industries because cannabis is a far superior product for paper and clothing, and 3) because the “war on drugs” is the biggest revenue stream for the government besides the illegal federal reserve/IRS, not to mention the revenue they receive directly and indirectly from big pharma. The whole claim of cannabis being a gateway drug has been proven to be a fraud by release of supporting documents.

        Trump should immediately issue an executive order against these states that are violating the Constitution, which would require congress to act. Congress instead would sue Trump for abuse of power or some other bogus crap. But that reaction from congress should then cause the armed citizenry to do as our forefathers established – to remove the entire congress by armed force and replace it!

    I read the attached law and don’t see where it bans “gun kits with 80 percent lowers”. By using an electropen, a metal scribe, punches or dremel a unique serial number can be added by the “maker” and once it has a serial number, the new sections of the law do not appear to be violated. If one already owns a “ghost gun” it appears adding a serial number will bring it into compliance. I have faith that “makers” will find some really clever serial numbers to inscribe on their “no longer a ghost gun”

      Whoop De Doo. So now homemade firearms must be numbered? OK, so the gun I build this month is a Mark Model 6/20. It gets serial number 1. Next month when I build another it’s Mark Model 7/20 and IT gets serial number 1. The month after: Mark Model 8/20 and . . . . yep, serial number 1. Why is this a problem? (Except that it, like all sorts of other regulations, “infringes” on the right to keep and bear arms under the Second Amendment. But, until we get Judges with enough integrity to enforce the law as written instead of acting like super-legislators, we’ll have to put up with this stuff.

        I’m curious as to why so many gun owners are so defensive about the government wanting to force you to serialize and register you firearms, yet you completely comply with the serializing and registration of your automobiles. WHY? Additionally, you fight tooth and nail to keep from being forced to be licensed for your firearm but you let the government force you to have a Driver’s License. Even the Supreme Court has ruled that you have the right to unregulated travel and that you cannot be required to have a license to drive for personal travel. Yet our right to travel has illegally been turned into a privilege. How does a driver’s license make the roads safer? A drunk with a driver’s license can still kill people; a criminal with or without a license can still drive and kill people…….sound familiar? If you are going to fight government on one matter you should be just as willing to fight for ALL infringements!

    There are thousands upon thousands of guns manufactured without serial numbers. It was done for years.

    Serial numbers weren’t put on guns for the governments benefit. It was a manufacturing tracking and record keeping instrument implemented by the manufacturers.

    It may have become a governmental overreach requirement but didn’t start that way.

    **This is a prime example of the true intent of Gun Laws. Unlikely they can produce even one crime committed with an 80% gun. Just another thing to ban.

    ** Besides, if these BS riots have shown us anything, they should be an example that any law means nothing to those willing to disregard them.     Do people realize that government cannot just pass any law that it wants?

    Do people realize WHY “ghost guns” we beyond the regulatory reach of the BATF in the first place?

    With 100% certainty, I can tell you that legally and Constitutionally there is no difference between someone picking up a stick and whittling a sharp point on it to use as a weapon for self defense, and manufacturing a “ghost gun” to use for the same purpose. I can pick up a piece of wood, a piece of plastic, or a piece of metal and turn it into anything I want to use for my own purposes. The only time an actual crime might occur is if I use that object to violate the right(s) of another individual or group of individuals.
