Tenn. Bill Would Give Concealed Carriers a Pass for Violating ‘No Firearms’ Policies

A state lawmaker in Tennessee wants to give concealed carriers a pass when they accidentally enter a business with a “no firearms” policy.

State Rep. Clark Boyd told News Channel 5 that under current law anyone who violates a “no firearms” policy is subject to a Class B misdemeanor, which is punishable by a $500 fine.

While no one in the past five years has been charged with such an offense, Boyd believes in clarifying the law before someone is unfairly prosecuted.

A parent chasing a child into a store that prohibits guns is one such example Boyd cited.

“If you were in the business, because that circumstance happened, and someone mentioned it to you, or you saw a sign somewhere else in the building, you have broken that law,” said Rep. Boyd. “The moment you step through that door, you’ve committed a crime, and all you want to do it make it right.”

Critics of the bill told Channel 5 it would give concealed carriers a means to circumvent the law.

    What did I saw to offend the moderator? First of all how did that law ever get passed in Tenn.? What if the store has a sign for “no drinking or eating” etc.? $500 fine for carrying your stupid bottle of water into their store.

    I feel like The Soviet Socialist Republic of California won’t be happy until the police are only armed with a pen and note pad, but only the police, pens are too dangerous a weapon of mass destruction to arm the populace with, they did write the Bill of Right after all, and it took over 200 year to slay that dragon.

    Anyone that is accosted, attacked, injured, or killed, or has a family member suffer the same fate in or around a store that prohibits concealed carry, where your legally carried firearm would have protected you or their safety, they or their survivors should get a lawyer and sue them out of business for violating you 2A and state given right to defend your self. You are being asked to remove your defense, while they provide no alternative other than calling 911, while the criminal lays in wait.

    In my state the law is pretty severe. You can be politely asked to leave. LOL. Truth is 99% of businesses don’t even bother to post a no guns sign.

    A red circle with a photo of a 6ün in the middle means nothing to me. Unless there is a metal detector there, I carry (which is usually only Federal buildings).

    Additionally, my firearm IS concealed and nobody but me is going to know I am carrying a firearm but me. If they do find out I am carrying it is because there is an immediate life or death moment going on and I have to display and/or use my firearm to save my life of the life of another. If they don’t like that, they have a bigger problem than me. As a retired LEO I know when to display a firearm and/or use it and I do not take that chore lightly.

    I try not to do business with any establishment that bans the possession of firearms but there are times that I have violated their policy if I am carrying concealed and find myself having to walk through the store to exit or to get to another store. I am not about to leave the area and go to my vehicle, remove my concealed firearm, store it in a hiding place in my vehicle, and then walk back to the store for whatever reason.

    When you attain a CC, at first you feel that now you will be allowed to carry. The reality is that every state complicates the issue by having different laws of their own. Beyond that, the general rule is that there are many places where you are simply not allowed to carry, for example, schools, government buildings, Federal property, bars, airplanes, and the list goes on. It soon becomes an endless game, where you may carry, but suddenly, you’re breaking the law if you carry in the wrong location. Say, you suddenly saw a Post Office and remembered that you need stamps. So, do you leave your gun in the car? By driving into the parking lot, you’ve just entered Federal property and if caught, you’ve already broken the law.
    The way I see it, I’m a responsible adult with a CC and I should therefore be allowed to carry anywhere that is public. At the moment, the CC is bull and nearly worthless, except to let the government keep tabs on me. Finally, we need Federal laws that make all states reciprocal, which would help remove the state by state confusion, currently in existence.

    Any business that posts a No Guns Allowed Sigh “Must” (By Law) provide Sufficient Certified Armed Security.

    See how they like that cost. (Which is “all” they “really” care about)

    Otherwise they “Must” allow Permitted Concealed Carry.
