Texas Attorney General Ken Paxton is making moves to halt the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)’s Pistol Brace Final Rule from going into effect.
On March 6th, Paxton filed a motion for a preliminary injunction against this arbitrary rule from the Biden Administration. The injunction would block the ATF from imposing new and serious rules on pistol owners who utilize stabilizing braces.
Under the new rules, to avoid federal prosecution, owners would be forced to register their brace-equipped pistols under the NFA. Or, they’d be forced to surrender their pistol braces to law enforcement or render them permanently inoperable.
Americans have been using stabilizing braces since the first was created over a decade ago. Although, their use has been chilled by vague, and at times, conflicting opinion letters from the ATF concerning their legality.

Owners have until May 31, 2023, to comply with the mandates. Failure to do so could, as mentioned, result in felony prosecution.
ATF estimates that the new rule will affect at least 1.4 million Americans. Though, the agency acknowledges that over 3-7 million have been sold from 2013-2020.
In other words, millions of Americans could become felons overnight if they don’t capitulate to the new rules.
The rule was immediately met with strong legal opposition around the country, including lawsuits from 26 states filed in the U.S. District Court in North Dakota, as well as Paxton’s lawsuit in Texas.

Paxton’s latest maneuver seeks to halt the implementation of the rule before the May 31st deadline.
“I filed this lawsuit to ensure that pistol brace owners are protected from the anti-gun Left and the radical activists staffing Biden’s ATF,” said Paxton in a statement on the Texas Attorney General’s website.
“As the case moves through our legal system, I am hopeful that the court will protect the Constitutional rights of Americans by issuing a preliminary injunction against this rule. The law is on our side. We will prevail in this battle against the Biden Administration’s war on the Second Amendment,” he added.
