Texas State Senator Joins Uvalde Families in Proposing 'Gun Safety Solutions,' Including Taxing Gun Sales

With Uvalde survivors gathered in the background, State Sen. Roland Gutierrez, D-San Antonio, TX, addressed gun violence and proposed four new gun control measures at a press conference on Tuesday

“We’re gonna talk about gun safety solutions,” Gutierrez said after introducing the survivors of the Robb Elementary School attack. “Real commonsense stuff.” 

If these bills pass:

  • School shooting victims and their families will have the ability to sue Texas state agencies and law enforcement officials.
  • The state will also be required to create a permanent compensation fund for victims of school shootings.
  • The fund will be paid by imposing a tax on gun sales.
  • Last, legislators will repeal the Protection of Lawful Commerce in Arms Act, which is a federal law that protects gun sellers and manufacturers from civil action. 

Gutierrez pointed to Uvalde and Santa Fe as reasons for Texas democrats to work together and craft this legislation.

“So much [of] what happened on May 24th was a tragedy that we have never seen before in the state of Texas,” Gutierrez said.

The state senator spoke at the press conference about how Texas Democrats will work to carve out “a series of pieces of legislation,” to address justice, appropriations, emergency management, and gun safety solutions. 

According to an interview with ABC News, Gutierrez says the bills have not received any Republican co-sponsors but remains confident that they will all have companion bills eventually. 

“We can sue big tobacco when they market towards kids, but we can’t sue big guns. It’s ludicrous,” Gutierrez said. “How that ever got passed is beyond me and I think my Republican colleagues can get behind me on that one.”

State Sen. Sarah Eckhardt, D-Austin, spoke briefly at the press conference as well. According to her speech, 70-90% of the illegal guns in Mexico are sourced in the United States with Texas accounting for 40% overall.

The mother of a Uvalde shooting victim, Felicia Martinez, had a chance to speak about her family’s grief and thinks a 21-year-old age limit could have prevented the massacre.

“An 18-year-old should not be allowed to purchase this kind of weapon,” Felicia Martinez, mother of victim Xavier Lopez, said on Tuesday. “These laws need to be changed and they need to be changed today, not tomorrow.”

Texas House Speaker Dade Phelan told reporters last week that he is willing to let a debate on the issue play out on the House floor, but he doesn’t think it has the votes to pass.

    If that were the solution, then outlaw alcohol since there are so many killed by drunk drivers. Or baseball bats since that is the mafias most used weapon of death, at least it once was. Not sure about now.
    Be sure that no one can enter the military until you emotional folks feel like a person is old enough to purchase a rifle. You pansies surely don’t want a young man to be able to die for you when you don’t feel like he is old enough to purchase a rifle on his own, do you?

    So, who is holding those responsible for not acting, and waiting the hallway while children were murdered? What is the Senator saying about that? Nothing. This is just another attempt at persecuting the inanimate rather than those that pulled the trigger and those that responded and did nothing.

      I’m NOT so sure about that. The “replacement theory” is based on fact but that is a deeper issue than I want to make on the issue.

      The more basic counter argument is to remember that TX was a Dem state until Reagan flipped it. Politicians like LBJ owned the state up until that point. The Dem party has changed into a scary mob, the US continues to change for the worst and I am afraid that TX will at some point fall victim to the twisted agents of change.

    Multiple failures in Uvalde resulted in needless deaths, slow response by witnesses, unsecured entrances, cowardly cops, unarmed teachers and staff to name the top 4. Taxing gun sales is just revenue enhancement for Dumbcrats to spend more hard earned taxpayer money on illegals, will most likely make everyone in Texas less safe. Truth is no gun laws prevent a nut case from killing people, and all gun laws are unconstitutional.

    Ludicrous and stupid! If I sell someone a car, and that individual plunges that vehicle into a crowd at 75 mph, killing many, am I to be held responsible for that action??!! This is ANOTHER way that government officials drum up publicity and avoid accountability, as well as placating their political cronies. A more sensible response would be to reexamine the Texas State Police policies; many officials that were “in charge” at the scene in Uvalde failed to act, but have not been held accountable. Lives were lost because of a lack of purpose and action on the part of the responding officers; it seems that the Democrats would like to ignore that crucial fact and instead gain more power by playing on the emotions (with greed being one of them) of the gullible American public. The ONLY good part about this bill is the ability of the taxpayer to sue the incompetent badge-wearing individuals that played a part in this tragedy. However, taxing (and thereby recording in more detail) gun purchases is pointless, from a safety point of view; all it does is give Texas more money! If a fund were created to “compensate” family victims (which, strictly speaking, is unnecessary) you can bet that Texas is going to keep back the bulk of that tax money for its own purposes.

    “2. The state will also be required to create a permanent compensation fund for victims of school shootings.” The LOCAL governments that have FAILED to do their duty should be footing the medical bills and burial bills for the INNOCENTS killed under their “protection”!
    “3. The fund will be paid by imposing a tax on gun sales.” There IS already a 10% excise tax on guns and ammunition! The FUND should be paid by that local government for showing DERELICTION OF DUTY!
