U.S. 9th Circuit Court of Appeals Upholds Prohibition on Right to Bear Arms

In a 215-page ruling by the U.S. Court of Appeals for the 9th Circuit, the court decided that the Second Amendment does not secure the right to bear arms either openly or concealed. This overturned an earlier ruling that held that a ban on the right to bear arms was unconstitutional.

In the case of Young v. Hawaii, the appeals court said that the plaintiff did not fully appeal Hawaii’s handgun carry license law, but also that Hawaii has a “longstanding prohibition” against bearing firearms in public, so therefore open-carry and concealed-carry fall “outside the historical scope of the Second Amendment.”

“After careful review of the history of early English and American regulation of carrying arms openly in the public square, the en banc court concluded that Hawai‘i’s restrictions on the open carrying of firearms reflect longstanding prohibitions, and therefore, the conduct they regulate is outside the historical scope of the Second Amendment,” the court said (.pdf).

“The en banc court held that the Second Amendment does not guarantee an unfettered, general right to openly carry arms in public for individual self-defense,” reads the ruling. “Accordingly, Hawai‘i’s firearms-carry scheme is lawful.”

Several judges dissented, saying “the majority’s decision undermines not only the Constitution’s text but also half a millennium of Anglo-American legal history, the Supreme Court’s decisions in District of Columbia v. Heller, … and McDonald v. City of Chicago … and the foundational principles of American popular sovereignty itself.”

In the dissents, judges also held that the court erred in dismissing Young’s “as-applied challenge” to the carry law scheme, calling it “brazenly unconstitutional.”

Young filed his case in response to being denied any form of carry permit, as he did not prove any immediate or urgent need to carry a firearm outside of the home.

Gun rights groups are responding quickly to this decision.

“We are very disappointed in the outcome of this case. As the dissent pointed out, the Ninth Circuit has effectively eliminated the word ‘bear’ from the Constitution,” said the Firearms Policy Center’s Joseph Greenlee. “Now that tens of millions of Americans have been told, for the first time ever, that they have no right to carry a firearm, it is more important than ever for the Supreme Court to address the issue and define the right to ‘bear arms.'”

The National Rifle Association also weighed in, saying “The US Court of Appeals for the 9th Circuit just ruled that there is no right to carry – either openly or concealed in public.”

“This was not an NRA case but we are exploring all options to rectify this.”

“The blatant defiance of the Supreme Court to undermine Heller and hollow out rights afforded to individuals by their Creator and clearly protected by the Constitution is unconscionable,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel.

“It is with amazing boldness that the Ninth Circuit brazenly sets aside not just the previous findings of the Supreme Court, which legally they are bound to apply, but actively chooses to ignore plain English and refuses to acknowledge the right to bear arms,” Keane continued. “We look forward to filing an amicus brief when this heads to the Supreme Court.”

Meanwhile, Everytown for Gun Safety cheered the court’s ruling.

“Today’s ruling, joined by respected appellate judges across the ideological spectrum, is the latest reminder that arguments against reasonable, life-saving gun laws rarely hold up in the courtroom,” said Eric Tirschwell, managing director for Everytown Law.

“As the court recognized, states and localities have extremely broad power to restrict the carrying of firearms in public spaces,” added Tirschwell.

While the ruling specifically cites prohibitions on the right to bear arms in Hawaii, this 9th Circuit ruling also affects Alaska, California, Arizona, Oregon, Washington and Montana.

    I honestly do NOT understand HOW & WHY they can uphold this ban on firearms and that the 2nd Amendment does not apply to Hawaii! Yes Hawaii was not a State at the time the Amendment was written but neither were 36 other States. The only ones were the original 13 States. So are they saying that only the 13 States fall under the 2nd Amendment? That’s just crazy as every State that was admitted agreed to the Constitution and Bill of Rights! The 9th Circuit is very liberal but should not be allowed to rule on those grounds.

      Before any of the states, from 14 onward, became states, they had to adopt the US Constitution. They agreed to it at the time, since they wanted the protections full statehood offered, but once the leftards invaded the island (and we all know they burned any US history books to makes fires for their luaus), like typical lefties, they only remember the parts that feel good to them at the moment.

    The U.S. 9th Circuit Court has too many unqualified justices. This courts rulings have a reversal rate of over 80% in past years. This court found that the Pledge of Allegiance was unconstitutional in our public schools!
    Now they seek to overturn the U.S. Supreme Courts ruling on the 2nd Amendment in 2008! It is way past time to remove some of these judicial weasels. Of course, that would require getting enough weasels in the Congress to vote for there removal. Indoctrination matters (Deut. 6)!

S. 125 (1998) , in the course of analyzing the meaning of “carries a firearm” in a federal criminal statute, Justice Ginsburg wrote that “[s]urely a most familiar meaning is, as the Constitution’s Second Amendment … indicate[s]: ***‘wear, bear, or carry … upon the person or in the clothing or in a pocket, for the purpose … of being armed and ready for offensive or defensive action in a case of conflict with another person.’ ”*** Id., at 143 (dissenting opinion) (quoting Black’s Law Dictionary 214 (6th ed. 1998)).     To those of you relying on SCOTUS to remedy the issue, consider this: Chief Justice Roberts abandoned the Constitution for obama care. During the deliberations he thought it was wrong to overide the will of the people as expressed by their democratically elected representatives. He then performed the mental gymnastics necessary to make the mandate a tax, and therefore Constitutional. This should have resulted in his impeachment and removal. His job was to determine the Constituionality of the law as it was written, not to justify it because it was passed by a democratically elected legislature.

    Think about that and what it may portend for this situation. It appears the Constitution doesn’t apply if the law was created “democratically”.

    Obviously, “shall not be infringed” is not in the ninth circuit communist court of Hawaii’s vocabulary.
    This alone makes the 9th Communist Circuit Court of Hawaii illegal.

    Here is a word that is illegal as per the Constitution and used to be under the original 13th Amendment before it was stuck in the closet before the present 13th was put into motion, “Esquire” which follows an attorney’s name and or status in law.

    So called judge Bybee is a POS. He has NO business in the judicial system if he doesn’t understand plain English. The 2nd Amendment states: right of the people to keep and bear Arms, shall not be infringed. It’s not rocket science. Judge, if I place a pistol in a holster and wear it, what would you call it? It means I’m bearing an arm (pistol). You can take your opinion and shove it where the sun doesn’t shine. Judge, you should resign and let someone in that can comprehend English. The Supreme court should immediately overrule the misguided 9th circuit court ASAP. Lives may depend on it as this court has overstepped their authority again by ruling from the bench and against the constitution. Their ruling is so flagrant that they should be admonished for their ineptness.

    Except that Scotus has stated in Caetano v Massachusetts the following :

    It simply reflects the reality that the founding-era militia consisted of citizens “who would bring the sorts of lawful weapons that they possessed at home to militia duty,” Heller, 554 U. S., at 627, and that the Second Amendment accordingly guarantees the right to carry weapons “typically possessed by law-abiding citizens for lawful purposes,” id., at 625.

    What part of that 2016 ruling did the 9th circuit not understand ??

    Hawaii, as a kingdom, had a “longstanding prohibition” against the public denunciation of government policy, so therefore, free speech, print or electronic publication of dissenting arguments fall “outside the historical scope of “free speech” as identified in the First Amendment.

    The Bill of Rights are optional.

    The Courts cannot be trusted, any half ass reading of the the Founding Fathers papers et al would reveal their intent, and much interpretation of laws are about intent.
    It is clear that individual ownership and carry were intended, plain and simple.
    The terminology and use of “The People” throughout the Constitution and Bill of Rights was deliberate, and specifically referred to both a ‘body of’ and the individual.
    But Lawyers being Lawyers, they often do their best to muddy the waters.
    I believe this is especially true of Left leaning and Liberal Judges.

    If gay marriage is declared a human right covered by the Bill of Rights, the SCOTUS declared it must be enforced equally in all 50 states and US territories. Thus if gay marriage is legal in CA it must be legal in all 50 states and territories. Since the Second Amendment is part of the Bill of Rights why is it unequally defined in the states and US territories. Example a person who passes a background check in TX can own a AR-15 and high capacity mags yet in NY neither is allowed? Is the US citizen in TX different from the US citizen in NY?

Since all successful revolutions must have some level of a moral base among the people any potential revolution should be thwarted by destroying peoples morality. Of course Orwell was correct in having no mention of an armed citizenry in a totalitarians society. The indulgent politicians removed those well before the last act.

    Time for every American living in Hawaii to carry guns and explain that in the Constitution there is the 2nd Amendment, which the founders of the nation specifically made it an individual right to be armed forever to guard against criminal highwaymen, enemy tribes, even our own government going bad. Then all peaceful decenters can be arrested and the government can decide how to feed and house all the humans made into criminals due to stupidity of the court system. Sorta like what is going on with illegal border crossers when stupid government administrations decide to just let illegals do anything they want. When that happens who pays. Going against the Constitutions gives rational to break an unconstitutional law, and thusly manufacture good citizens into criminals, that cannot be enforced or paid for. Get judges who will abide by the constitution. Get Law makers that will write good laws that can be enforced. This country cannot accept any more manufactured criminals or foreign refugees. We are the greatest debtor nation on earth, and we do not have enough water to support them. Did you notice everything is burning down due to either police not being able to enforce the law, and climate change producing so many killer wildfires? We have got to get back to solving our real problems not just creating new ones.

    Until it is repealed, the Second Amendment is the supreme law of the land. “Shall not be infringed” means just what it says. It does not require “interpretation” by anyone. Every “justice” on the Ninth Circuit court violated his oath to the Constitution of the United States and should be immediately removed from the bench and disrobed. Until we the people demand that these “government officials” honor their oaths of office, tyranny will reign. The same goes for every politician and government bureaucrat who believes their oath of office is just a formality. And every American citizen who complies with laws, court rulings, executive orders, bureaucratic regulations and foreign treaties that infringe on the unalienable right of law-abiding American citizens to keep and bear arms is not a patriot. Short of another bloody revolution, non-compliance to such tyranny is the duty of every American citizen. We allow these tyrants to violate our hard-won rights at our own peril.

    If you can take a phrase stricken from a Jefferson speech by Jefferson himself, “…separation of church and state…”, and give it life in 1946 by the ACLU, such that people think the Constitution actually says that, then you can convince folks that, “…the right to keep and bear arms…” does not mean exactly what it says. The Founders understood the English language, and punctuation more than the vast majority of Americans today. The second half of 2A, was actually the third amendment, but they combined 2 and 3, separating the two with a semicolon, punctuation that makes two statements separate, but combined in one with a common link. You will see that semicolon on the document in the Archives, but most other places it is not there, much like the phrase Neal Armstrong actually said,, “One small step for ‘A’ man…”, which is never acknowledged.
